AN ORDINANCE PROVIDING FOR THE LICENSING AND REGULATION OF AUCTIONEERS IN THE VILLAGE OF MAPL91100D. THE COUNCIL OF THE VILLAGE OF MA.PLEWOOD DOES HEREBY ORDAIN AS FOLLO"WS : Section 1. No person shall, within the limits of the Village of 1,1aplewood, act as an auctioneer or engage in the business of auctioneer unless such person shall first obtain a. license to do so as hereinafter provided. Section 2. Every person desiring to obtain a license to act as auctioneer or engage in business of auctioneer in 1,1aplewood shall apply in writing for such license on forms to be furnished by the Village Clerk. In this application the applicant shall designate the place where he proposes to conduct business and the type of business which he proposes to undertake. All such applications shall be referred to the Chief of Police for investigation. Section 3. a) The applicant shall at the time of making application, pay for said license the sum of Twenty-five and 00100 ($25.00) for a period of one year. Upon approval by the Chief of Police, the Village Clerk shall issue license to the applicant to act as auctioneer and engage in business as such. The license so issued shall entitle the licensee to the privileges granted therein for the term of one (l) year. All auctioneers' licenses shall expire on December 31 of each year and application for renewal shall be made on or before December 1st of the year in which the license is expiring. b) Pursuant to Council approval an auctioneer's license may be granted to any person qualified for a period of a specified day or number of days not to exceed three (3) days and the fee for such license shall be Five Dollars ($5.00) for each day for which the license is required. All of the terms, conditions and requirements relating to application for an annual license shall apply to applicants who are applying for a daily license. Section 4. At the time application is made, the applicant shall deliver to Nftwwol the Village Clerk a corporate surety bond in the penal sum of One Thousand and 00100 Dollars ($1,000.00 conditioned for faithful observance of Village ordinances and upon proper accounting to parties lawfully interested therein, for all monies and proceeds from auction sales and further conditioned to pay any damages suffered by any person by reason of false statement or misrepresentation made by auctioneer at the time of the sale of any article sold by him. Section 5. Every license granted under this ordinance shall state the place as specified in the application for which such license is to be used and at which the licensee is to conduct his business and no person licensed as auctioneer shall engage in business or conduct his auctioneering at any other place unless permission to so do so first be obtained in writing from the Mayor of the Village, except that the Council may by resolution authorize the change in the location of the place of business during the year in which the license is in force. Section 6. No licensed auctioneer shall have power or authority to confer the privileges of his license upon anyone else or to authorize any other person to sell or to cry for sale at public auction. Section 7. No license hereunder shall be issued to any applicant unless the said applicant has resided in the State of Minnesota continuously for a period of one (l) year or more prior to the application for license. Section 8. Army person who violates the provisions of this ordinance shall upon conviction, be subject to a fine of not more than $100.00 or imprisonment in the County Jail for not more than 90 days, or both.
