HomeMy WebLinkAboutNo 46 Prohibiting Keeping, Breeding, Raising or Feeding of Pigs on Any Farm Less than Forty Acres Except Under Permit to Maintain a Piggery; Establishing a License Therefor...ORDPITANCE N0. 46 AN ORDINANCE PROHIBITING KEEPING, BREEDING, RAIS- ING OR FEEDIIiG OF PIGS ON ANY FARM LESS THAN FORTY ACRES EXCEPT UNDER PERMIT TO MAINTAIN A PIGGERY: ESTABLISHING A LICENSE THEREFOR, AUTHORIZING THE VILLAGE BOARD OF HEALTH TO ADM r ISTER AND TO ESTAB- LISH RULES AND REGULATIONS AND PROVIDING PENALTIES FOR THE VIOLATION HEREOF. THE COUNCIL OF THE VILLAGE OF MAPLEWOOD DO'S HEREBY ORDAIN AS FOLLOWS: Section 1. From and after the effective date of this ordinance it shall be unlawful for any person to keep, raise, breed, or feed pigs on any farm or within any area zoned farm -residential unless such farm or farm area, owned or leased, is at least forty (40) acres in size, except as hereinafter provided. Sec. 2. In order to keep, raise, breed or feed pigs on any farm of less than forty (40) acres in area, a permit shall first be obtained from the village council. Application for a permit to keep pigs shall be made to the vil- lage clerk and such application shall set forth: a) 'Tame and address of applicant; b) Legal description of property upon which pigs are to be kept; c) Number of pigs applicant proposes to maintain on the premises; d) Complete description of facilities on the premises, including source of water supply, kind of soil, comprehensive data as to drainage, and locaation of all residences within 500 foot radius of proposed piggery. The applicant shall pay to the village the some of Ten and 00/100 ($10.00) Dollars which sum shall be deposited with the Village Clerk at the time of making applica- tion for permit and shall be deemed the first annual license fee. Sec. 3. Any person keeping pigs on a farm smaller than forty (40) acres in size shall pay an annual license of Five and 00/100 ($5.00) Dollars, except the first annual license set forth in paragraph 2 hereof which is Ten and 00/00 ($10.00) Dollars. This fee shall not be pro -rated and the license year shall be concurrent with the calendar year, with renewal license due on or before January 10th of each year. Ordinance No. 46 Sec. 4. The Village Board of Health shall supervise all piggeries licensed under this ordinance and the said Board of Health shall establish and promulgate rules and regulations governing the operations of any licensed piggery which rules and regulations shall include size and design of buildings, runway, feeding platforms, sanitary regulations and any other provisions deemed necessary to accomplish proper protection for the public in the administration of this ordinance. Sec. 5. a) Any person who keeps, raises, breeds, or feeds pigs, or main- tains a piggery in violation of this ordinance shall be guilty of a misdemeanor. b) Any person licensed to maintain pigs or operate a piggery under a license issued pursuant to this ordinance who fails to comply with all rules, regu- lations and orders of the Pillage Board of Health shall be guilty of a misdemeanor. c) Each day that any violation continues shall be considered a separate offense, punishable as a separate misdemeanor, the penalty for which shall be One Hundred ($100.00) Dollars fine or ninety (90) days in jail or both. Sec. 6. Before any vermit to maintain a piggery or to keep pigs on any farm smaller in size than forty (40) acres is granted by the Village Council pur- suant to this ordinance the Council may, in its discretion, hold a public hearing and notify all property owners within 500 feet, of such hearing. Sec. 7• Upon conviction for violation of this ordinance or the rules and regulations promulgated hereunder, the Council may revoke the piggery license of such convicted licensee. Sec. 8. This ordinance is adopted and approved by the Village Council as an emergency measure deemed necessary for the public health and welfare of the citizens and residents of the Village and shall apply to all persons keeping pigs or maintaining a piggery at the time of the effective date of this ordinance.
