SECTION 1. PURIOSE ;XND JURISDICTION Pursuant to the a;,plicable statuatory authority of the Village of Maplewood to regulate, control and nainta.in village streets as provided in Minnesota Statutes e the following regulations and specifications including the exhibit or exhibits hereto are established, The specifications set forth herein shall apply to all streets hereafter constructed within tsze Village of Maplewood and are considered as additional oaf made necessary througkZ the rapid growth and expansion of the Village„ SECTION 2, DEL,INI,IONS For the purpose of this ordinance certain words and terms are hereby defined as follows: Specification, A detailed statement of particulars. A detailed description setting forth the dimensions, materials, work- manship and general conditions under which any given type of con- struction is to be undertaken 9and carried forward by a contractor for the Village of Maplewood, Village, is ,he Village of Maplewood in Ramsey County, Minnesota, Village Council, The duly elected governing body of the village consisting of the hI yor, Clerk and. three trustees, V1LLage Engineer. Stabilized base is the top three (3) inches of the driving surface as spocified in this ordinance stabilized using an asphaltic material. Village Standard is the typical plan, cross-section or detail of construction which is approved by the Village Council of Maplewood for all construction of similar nature. Plant -mix bituminous material is a sand and gravel aggiregate mixed with a specified bitr.:Anons material in a stationary or travel- ing mixing planta Dram is the rneieva.l of surface and storm welter from any given area, Municipal water supply is the furnishing of water through a water system which is owned and controlled by a municipality in which it is located. 2. Communit-y urate system is a water syste:a which has been designed to serve a li:aited area or co imunity and which is usually privately owned. Subdivisions car plat is a parcel of land divided into siaaller parts sucli as blec':s or lots; also means a tract of land wiAch is redivided anew, after firot division. Uni:sgroved lot is one which has been sold to an individual buyer in an unimproved state, that is, without any building having been constructed thereon. Partial maintenance small include only that maintenance which is necessary to permit access over tIae public street to the 1iomes or buildings which right be constructed in a given area at all seasons of the year. Rough grading is the grading work which has been done to bring the area within tae street right-of-way to approxi:aately the designed finished grade. Bituminous mater -.al as referred to in this -ordinance is a cut-back asp',aalt materl-al. or an asphaltic cement, Prime -coat is a light coat of bituminous material applied to a surface ,.rior to the placing of a inixture of aggregate or an ag,Tre- gate and bituminous material. Street access is the right and ability to pass from a lot to a public street without tlae necessity of crossing private property. Stor:.i sewers. A ;pipe line installed underground for the purpose of carrying surface u.ater from any given area. Catch basin is a structure usually placed at or near Mae gutter line of a street and desil;ned to receive surface or storm water through an opening and provide a p:assn'-eway into an underground storm sewer or culvert. 3, Manhole, A structuro placed over ra sewer with an opening at ground level and designed in such a way as to permit access to the sewer for the purpose of cleaning or inspection, Boulevard. The area of a right-of-way which is located betwoen the gutter life of the street and property line on eac : side, Sometimes referred to as sidewalk bench, Puilding permit, A written permit issued by the Village of Maplewood to callow the recipient to construct or cause to be constructed any type of a building or structure on any property or land within the limits of the village, SEC`rION 3, BUILDING PLAU-1ITS No building permits will be issued for any construction with- in the Village of Maplewood unless the building site is located on an existing street which is being maintained by the Village or unless pro- visions for street grading and constriction have been made in full compliance with this ordinance, SUCTION K PETITION Before any improvement of any kind whatsoever is undertaken within the public right-of-way, whether such right-of-way is located in new subdivisions or in an existing subdivision or plat, the owners shall petition the Village Council for the ioprovement thereof, SECTION 5, PETITION FORMS Petitions for any improvement in the street right-of-way shall be submitted to the Village Council for its approval. Petitioners shall use the approved village form which has been prepared for that pur- pose, these forms can be obtained from the Village Clerk or the Village Engineer free of charge, 4, SECTION f. REPORT Upon t'?e receipt of ` petition frem any property owner or owners, the,Council shall secure from the Village Engineer, a re,:crt advising, it in a preliminary way as to whether the proposed iLiprove.aent is feasible and as to whether it should best be made as proposed or :n connection with soaae other improvement and the es- timated cost of the it-,provemert as recommended, SEICTION 7. DEPOSIT BY PETITIONERS FOR PRELIMINARY EXPENSE A copy of the Engineer's prelLminary report and estimate shall be furnished by the Village to the petitioners,, The peti- tioners shall be rc;;-i.red to deposit an amount equal to ten per cent (1O%) of such nrel i!7,aina sry esti:Late with the Village Cleric of Maplewood. This money i7!ill be used -to defray the expenses incurred by the village in the preparation of plans$ opecifications, legal service and adver- tising or any other prelLm-inary expense involved in preparing; for the public Learing. Any balance in this fund shall be returned to the petitioners in the evert that the work is not ordered after the hear- ing, or it shall be a; plied to the cost of the project when completed. SECPION 8, PLANS SPECIFICATIONS AND BIDS After the petitioners have deposited an amount equal to ten per cent (10%) of the l,ngrineer's preliminary estimate of the cost of any project, the Council shall instruct the Engineer to prepare ;dans and specifications for the project. After tihese Flans and specifications have been submitted to the Council by the I,ngineer and a..proved by said Board, the Clerk shall be instructed by the Council to advertise for bids for the c,nstruction of the project, This advertising, wlaen necessary, shall be for such length of time as the Council uzay deem advisable, This Procedure to be in accordance with the provisions of Chapter 398 Laws of 19530 5, S -C CION 9, i UA71I.IC i,` ARING After bins have been r_ce-ived, but before any contract is let or any work is ordered by day labor for any imps ovcment, the Village shall hold a public hearing on the prognosed improvement following two (2) publications in t'te newspaper of to notice statin; the time and the place of the hoaring, the general nature of the improvement, the estimated cost, the area proposed to be assessed and that the Village Council proposes to ] arocecd under the authority granted by Chapter 398 Laws of 1953,, STICTION 10,, BOND TO 1.�UARLINTAIIE CASH PAYMINT FOIi kMZK BY I'LL► TT I'1' 1 UAtI : R5 After t!:.c public '"fearing as described in the preceding see - tion has been held and before the award of any contract or the order- ing of any improvement =pork by t1te Council, the petitioners shall furnish a surety bond in the amount equal to one and one-half times the cost of such work as submitted by the 1,w bidder or in the case of day labor, work as estimated by the Village Zngineer. This surety bond shall guarantee t??e paynent of such assessment for all of the work contemplated in cash immediately upon its completion. SECTION 11.
