AAT 071DINANCE REGULATING TEE SALE OF
CIGA3ETS AND PROVIDING LIMTSE FEE.
THE COUNCIL OF THE VILLAGE OF 14APLE'WOOD DOES ORDAM
Section 1. It shall be unlawful for any person to deal in or sell at
retail any cigarets without having first obtained a license so to do as herein
provided.
Section 2. Any person desiring a license to engage in the business of
dealing in or selling cigarets shall first make application therefor to the
Council of the Village of Maplewood by filing with the Village Clerk for pre-
sentation by him to the Council an application in writing, which application
shall set forth the name and place of residence of the applicant and the exact
location of the place at which the applicant proposes to carry on said business.
If any one place of business maintains on it's premises more than one vending
J machine for the dispensing of cigarets, such single business place shall be
required to have no more than one license. Said application shall be sired
by the applicant in person, and when received by the Village Clerk shall be
placed on file; provided, however, that no such application shall be received
unless it is accompanied by the payment of a, fee as provided for herein.
Section 3. At the time of filing an application for a license to engage
in the business of sellin7 cigarets at retail, the applicant shall deposit with
the Village Clerk the sum of Twelve and 00/100 ($12..00) Dollars and the Clerk
shall thereupon deliver to the applicant a receipt therefor containing a statement
of the purpose for which the deposit was made.
Section 4. Any applicant shall permit the officers of the Village to
inspect and examine the place of business described in the application and any
refusal on the part of the applicant to permit such inspection shall be suf-
ficient ground for the Council to refuse the license applied for.

Section 5. The Council shall, after whatever investigation it deems
necessary, by resolution grant the license applied for by such applicant if
in the opinion of the Council he is entitled thereto.
Section E. The annual cigaret license as provided for herein shall run
for the period of one (1) calendar year commencing January 1st of each year.
If application is nad.e after January 1st, the licensee shall pay a fee on the
basis of One Dollar ($1.00) for each month or portion of month of the calendar
year remaining and such fee shall entitle the applicant to engage in the business
of selling cigarets for the remainder of the year unless for any reason the
license is revoked or suspended. Licenses issued by the Town of 2?ew Canada
and held by licensees at the time of the passage of this ordinance shall remain
in force until January 1, 1958 so that such licensees shall not be required
to procure a license under this ordinance during the period between the date
of adoption of this ordinance and January 1, 1958•
Section 7. Any person violating any of the provisions of this ordinance
shall be deemed guilty of a misdemeanor and upon conviction thereof shall be
punished by a fine of not more than One Hundred and 00/100 ($100.00) Dollars
or by imprisonment for not over ninety days.
Section 8. This ordinance shall. take effect and be in force from and
after its date of passage and publication.
