Sec.10-189.Dangerous/potentiallydangerousdogs. TheprovisionsofMinn.Stats.§347.50—347.56,inclusive,areherebyadoptedasthe potentiallydangerousanddangerousdogregulationsfortheCityofMaplewood.Whereaconflict existsbetweentheprovisionsoftheCityCodeandtheprovisionsofMinn.Stats.§347.50— 347.56,inclusive,theprovisionsoftheMinnesotaStatutesshallapply. (1)Definitions:Forthepurposeofthissection,thetermsdefinedhavethemeaning giventothem: a.Dangerousdogmeansanydogthathas: 1.withoutprovocation,inflictedsubstantialbodilyharmonahuman beingonpublicorprivateproperty;or 2.killedadomesticanimalwithoutprovocationwhileofftheowner’s property;or 3.beenfoundtobepotentiallydangerous,aftertheownerhasnotice thatthedogispotentiallydangerous,thedogaggressivelybites, attacks,orendangersthesafetyofhumansordomesticanimals. b.Potentiallydangerousdogmeansanydogthat: 1.whenunprovoked,inflictsbitesonahumanordomesticanimalon publicorprivateproperty;or 2.whenunprovoked,chasesorapproachesaperson,includinga persononabicycle,uponthestreets,sidewalks,oranypublicor privateproperty,otherthanthedogowner’sproperty,inan apparentattitudeofattack;or 3.hasaknownpropensity,tendency,ordispositiontoattack unprovoked,causinginjuryorotherwisethreateningthesafetyof humansordomesticanimals. c.Properenclosuremeanssecurelyconfinedindoorsorinasecurelyenclosed andlockedpenorstructuresuitabletopreventtheanimalfromescapingand providingprotectionfromtheelementsforthedog.Aproperenclosuredoes notincludeaporch,patio,oranypartofahouse,garage,orotherstructure thatwouldallowthedogtoexitofitsownvolition,oranyhouseorstructurein whichthewindowsareopenorinwhichdoororwindowscreensaretheonly obstaclesthatpreventthedogfromexiting. d.Ownermeansanyperson,firm,corporation,organization,ordepartment possessing,harboring,keeping,havinganinterestin,orhavingcare,custody, orcontrolofadog. e.SubstantialbodilyharmhasthemeaninggivenitunderMinn.Stats.§609.02, subdivision7a. f.GreatbodilyharmhasthemeaninggivenitunderMinn.Stats.§609.02, subdivision8. g.Provocationmeansanactthatadultcouldreasonablyexpectmaycausea dogtoattackorbite. (2)Initialdetermination.Thecity'sdesignatedanimalcontrolauthorityshallbe responsibleforinitiallydetermining(initialdetermination)whetheradogisa potentiallydangerousdogoradangerousdog.Theanimalcontrolauthoritymay retaincustodyofadogwhichhasbeeninitiallydeterminedtobeadangerous dogpendingthehearingashereinafterprovided.Theinitialdeterminationshall beconclusiveunlesstheownerappealstheinitialdeterminationashereinafter provided. (3)Noticeofinitialdetermination.Thenoticeofinitialdeterminationshallbe personallyservedontheownerofthedogoronapersonofsuitableageatthe residenceofsuchowner.Thenoticeofinitialdeterminationshalldescribethe dogdeemedtobepotentiallydangerousordangerous,shallidentifytheofficer makingtheinitialdeterminationandshallinformtheowneroftheowner'srightto appealtheinitialdetermination. (4)Requestforhearingandhearing.Anownermayappealtheinitialdetermination byfilingarequestforhearingwiththecitymanagerwithinfivedaysofthe owner'sreceiptofthenoticeofinitialdetermination.Ahearingshallbeheldwithin sevendaysafterthecity'sreceiptoftherequestforhearing.Thecitymanager shallassignahearingofficer,whoshallnotbethepersonwhomadetheinitial determination.Atthehearing,thehearingofficershallconsiderthereportsand commentsoftheanimalcontrolauthority,thetestimonyofanywitnesses, witnessstatementsandthecommentsoftheownerofthedog.Afterconsidering alloftheevidencesubmitted,thehearingofficershallmakewrittenfindingsand shalldeterminewhetherthedogisapotentiallydangerousdogoradangerous dog(finaldetermination).Thefindingsshallbemadewithinfivedaysofthedate ofthehearingandshallbepersonallyservedupontheownerofthedogorupon apersonofsuitableageattheresidenceoftheowner. (5)Seizureofdangerousdogorpotentiallydangerousdog.Theanimalcontrol authorityshallimmediatelyseizeanydangerousorpotentiallydangerousdogif, within14daysaftertheserviceofthenoticeoffinaldeterminationdeclaringa dogtobeadangerousdog: a.Theownerhasnotregisteredthedogincompliancewiththeprovisions ofsubsection10-189(8a)or(10a). b.Theownerdoesnotsecurethepropersuretybondorliabilityinsurance pursuanttosubsection 10-189(8a)(2)or(10a)(4). c.Thedangerousorpotentiallydangerousdogisnotmaintainedina properenclosure. d.Thedangerousdogisoutsideaproperenclosureandnotunderthe physicalrestraintofaresponsibleperson. (6)Reclaimingadangerousdogorpotentiallydangerous.Adangerousorpotentially dangerousdogmaybereclaimedbytheownerofthedoguponpaymentofthe impoundingandboardingfeesanduponpresentationofprooftotheanimal controlauthoritythattherequirementsofsubsection10-189(8a)or(10a)have beensatisfied.Adangerousorpotentiallydangerousdognotreclaimedunder thisprovisionwithinsevendaysmaybedisposedofasprovidedinMinn.Stats. §35.71,subd.3,andtheownershallbeliabletotheanimalcontrolauthorityfor costsincurredinconfininganddisposingofthedangerousdog. (7)Substantial/greatbodilyharm.Uponafinaldeterminationandnotwithstandingthe provisionsofsubsections10-189(2)—(6),adangerousdogthatinflicted substantialbodilyharmorgreatbodilyharmonahumanbeingonpublicor privatepropertywithoutprovocationmaybedestroyedinaproperandhumane mannerbytheanimalcontrolauthority. (8)Dangerousdogrestrictions. a.Registrationrequired.NopersonmaykeepadangerousdogintheCity ofMaplewoodunlessthedogisregisteredwiththecityclerkasprovided inthissection.Thecityclerkshallissueacertificateofregistrationtothe ownerofthedangerousdogiftheownerpresentsthefollowing information: 1.Properenclosure.Aproperenclosureexistsforthedangerous dogandthereisapostingonthepremiseswithaclearlyvisible warnin gsign,includingawarningsymboltoinformchildren, thatthereisadangerousdogontheproperty. 2.Bond/insurance.Asuretybondissuedbyasuretycompany authorizedtoconductbusinessintheStateofMinnesotaina formacceptabletotheanimalcontrolauthorityinthesumofat least$300,000,payabletoanypersoninjuredbythedangerous dog,orapolicyofliabilityinsuranceissuedbyaninsurance companyauthorizedtoconductbusinessintheStateof Minnesotaintheamountofatleast$300,000,insuringtheowner foranypersonalinjuriesinflictedbythedangerousdog. 3.Microchip.Theownerhashadamicrochipidentification implantedinthedangerousdog,andthenameofthemicrochip manufacturerandidentificationnumberofthemicrochipmustbe providedtotheanimalcontrolauthority.Ifthemicrochipisnot implantedbytheowner,itmaybeimplantedbytheanimal controlauthority,withthecostsbornebythedog'sowner. 4.Warningsymbol.Theownerhaspostedawarningsymbolto informchildrenthatthereisadangerousdogontheproperty. Thedesignofthewarningsymbolmusthavebeenapprovedby theMinnesotaCommissionerofPublicSafety. 5.Tag.Thedangerousdogmusthaveastandardized,easily identifiabletagidentifyingthedogasdangerousandcontaining theuniformdangerousdogsymbolaffixedtothedog'scollarat alltimes.Thedesignofthetagmusthavebeenapprovedbythe MinnesotaCommissionerofPublicSafety. 6.Photograph.Theownerofthedangerousdogshallmakethe dogavailabletobephotographedforidentificationbytheanimal controlauthorityatatimeandplacespecifiedbytheanimal controlauthority. 7.ProofofDisclosure.Theownerofadangerousdogwhorents propertyfromanotherwherethedogwillresidemustsubmit proofofdisclosurefromthepropertyownerthattheproperty ownerwasnotified,priortoenteringintotheleaseagreement andatthetimeofanyleaserenewal,thatthepersonownsa dangerousdogthatwillresideattheproperty. (9)Dangerousdogregulations. a.Annualfee.Theownerofadangerousdogshallpayanannualfeeas determinedbycouncilordinance,inadditiontoanyregulardoglicensing fees,toobtainacertificateofregistrationforadangerousdogunderthis section. b.Annualrenewal.Theownerofadangerousdogmustrenewthe registrationofthedogannuallyuntilthedogisdeceasedandpaythe annualrenewalfeeasdeterminedbycitycouncilordinance.Ifthedogis removedfromtheCityofMaplewood,itmustberegisteredasa dangerousdoginitsnewjurisdiction. c.Death/transferfromcity.Theownerofanydangerousdogmustnotify theanimalcontrolauthorityinwritingofthedeathofthedog,ofits transfertoaresidenceoutsideoftheCityofMaplewoodorofitstransfer withintheCityofMaplewoodwithin30ofthedeathortransfer. d.Noticetolandlord.Theownerofadangerousdogwhorentsproperty fromanotherwherethedogwillresidemustdisclosetotheproperty owner,priortoenteringintotheleaseagreement,andatthetimeofany leaserenewal,thatthepersonownsadangerousdogthatwillresideat theproperty. e.Sale.Theownerofadangerousdogmustnotifythepurchaserthatthe animalcontrolauthorityhasidentifiedthedogasadangerousdog.The sellermustalsonotifytheanimalcontrolauthorityinwritingofthesale andprovidetheanimalcontrolauthoritywiththenewowner'sname, address,andtelephonenumber. f.Muzzling.Ifthedangerousdogisoutsideaproperenclosure,thedog mustbemuzzledandrestrainedbysubstantialchainorleashandbe underthephysicalrestraintofareasonableperson.Themuzzlemustbe madeinamannerthatwillpreventthedogfrombitinganypersonor animalbutthatwillnotcauseinjurytothedogorinterferewithitsvision orrespiration. g.Sterilization.Theanimalcontrolauthoritymayrequireadangerousdog tobesterilizedattheowner'sexpense.Iftheownerdoesnothavethe dangerousdogsterilized,theanimalcontrolauthoritymayhavethe animalsterilizedattheowner'sexpense. (10)Potentiallydangerousdogrestrictions. a.Registrationrequired.Nopersonmaykeepapotentiallydangerousdog intheCityofMaplewoodunlessthedogisregisteredwiththecityclerk asprovidedinthissection.Thecityclerkshallissueacertificateof registrationtotheownerofapotentiallydangerousdogiftheowner presentsthefollowinginformation: 1.Microchip.Theownerhashadamicrochipidentification implantedinthedangerousdog,andthenameofthemicrochip manufacturerandidentificationnumberofthemicrochipmustbe providedtotheanimalcontrolauthority.Ifthemicrochipisnot implantedbytheowner,itmaybeimplantedbytheanimal controlauthority,withthecostsbornebythedog'sowner. 2.Warningsymbol.Theownerhaspostedawarningsymbolto informchildrenthatthereisapotentiallydangerousdogonthe property.Thedesignofthewarningsymbolmusthavebeen approvedbytheMinnesotaCommissionerofPublicSafety. 3.Properenclosure.Aproperenclosureexistsforthepotentially dangerousdog,andthereisapostingonthepremiseswitha clearlyvisiblewarni ngsign,includingawarningsymbol,to informchildrenthatthereisapotentiallydangerousdogon theproperty. 4.Bond/insurance.Asuretybondissuedbyasuretycompany authorizedtoconductbusinessintheStateofMinnesotaina formacceptabletotheanimalcontrolauthorityinthesumofat least$300,000,payabletoanypersoninjuredbythepotentially dangerousdog,orapolicyofliabilityinsuranceissuedbyan insurancecompanyauthorizedtoconductbusinessintheState ofMinnesotaintheamountofatleast$300,000,insuringthe ownerforanypersonalinjuriesinflictedbythepotentially dangerousdog. 5.Photograph.Theownerofthepotentiallydangerousdogshall makethedogavailabletobephotographedforidentificationby theanimalcontrolauthorityatatimeandplacespecifiedbythe animalcontrolauthority. 6.ProofofDisclosure.Theownerofapotentiallydangerousdog whorentspropertyfromanotherwherethedogwillresidemust submitproofofdisclosurefromthepropertyownerthatthe propertyownerwasnotified,priortoenteringintothelease agreementandatthetimeofanyleaserenewal,thattheperson ownsapotentiallydangerousdogthatwillresideattheproperty. (11)Potentiallydangerousdogregulations. a.Annualfee.Theownerofapotentiallydangerousdogshallpayan annualfeeasdeterminedbycouncilordinance,inadditiontoanyregular doglicensingfees,toobtainacertificateofregistrationforadangerous dogunderthissection. b.Annualrenewal.Theownerofapotentiallydangerousdogmustrenew theregistrationofthedogannuallyuntilthedogisdeceasedandpaythe annualrenewalfeeasdeterminedbycitycouncilordinance.Ifthedogis removedfromtheCityofMaplewood,itmustberegisteredasa potentiallydangerousdoginitsnewjurisdiction. c.Death/transferfromcity.Theownerofanypotentiallydangerousdog mustnotifytheanimalcontrolauthorityinwritingofthedeathofthedog, ofitstransfertoaresidenceoutsideoftheCityofMaplewoodorofits transferwithintheCityofMaplewoodwithin30daysofthedeathor transfer. d.Noticetolandlord.Theownerofapotentiallydangerousdogwhorents propertyfromanotherwherethedogwillresidemustdisclosetothe propertyowner,priortoenteringintotheleaseagreementandatthe timeofanyleaserenewal,thatthepersonownsapotentiallydangerous dogthatwillresideattheproperty. e.Sale.Theownerofapotentiallydangerousdogmustnotifythe purchaserthattheanimalcontrolauthorityhasidentifiedthedogas potentiallydangerous.Thesellermustalsonotifytheanimalcontrol authorityinwritingofthesaleandprovidetheanimalcontrolauthority withthenewowner'sname,address,andtelephonenumber. (12)Annualreviewrequests.Iftherearenoadditionalreportsofthebehavior describedinsubsections(1a)or(1b)ofthissectionwithinatwelve-month periodfromthedateofthedesignationasadangerousdogorasix-month periodfromthedateofthedesignationasapotentiallydangerousdog,the dog'sownermayrequestareview,inwriting,ofthedeclarationdesignation. Theownermustprovidedocumentedevidenceforreviewthatthedog's behaviorhaschangedduetoenvironment,health,age,training,neuteringor otherrelevantfactor.Thereviewrequestandsupportingdocumentationmust besubmittedtotheMaplewoodanimalcontrolauthority,whichshallruleon thereviewrequestbasedontherecord.Theownerofthedogshallbe notifiedinwritingofthereviewresultswithinten(10)businessdaysof receipt.Anadministrativefeeshallbepaidpriortothereview.Incases wheretheownerhassuccessfullycompletedatrainingprogramapprovedby theanimalcontrolauthority,theadministrativefeemaybereducedor waived.Thefeesforsuchreviewshallbeimposed,set,establishedandfixed bythecitycouncil,byresolution,fromtimetotime.
