AN ORDINANCE RELATING TO STREETS AND PROVIDING
FOR THE REMOVAL THEREFROM OF CERTAIN MATERIALS.
THE TOWN BOARD OF THE TOWN OF NEW CANADA DOES ORDAIN:
Section 1. It shall be the obligation and duty of all owners,
lessees or occupants of property within the Town of New Canada to pre-
vent discharge into the public streets of the Town of any dirt, debris
or other material.
Sec. 2. The term "street" as used in this ordinance shall include
any alley, cartway or other public thoroughfare, or any easement in-
cluding drainage easements.
Sec. 3. Whenever any dirt, sand, rocks, soil, vegetation, debris
or other form of material has been placed upon, discharged into or
washed upon the right-of-way of any street within the Town from pro-
perty abutting upon the said street, it shall he the duty of the owner
of the property from which such material came to remove it from the
public street right-of-way.
Sec. 4. Whenever any materials as described in this ordinance
are permitted by the owner, lessee or occupant of the premises from
which said materials came to remain on the street, such person shall
be notified by the town clerk to remove same within three (3) days
after notification thereof. If the materials are not removed pursuant
to notification, the town board may direct the street superintendent
to clean the street and charge the cost of such work to the owner or
occupant of the property from whence such material came.
Sec. 7. The amount of expense caused by removal of material from
the street may be recovered by the town from the owner or owners of
the lot or parcel of land.
Sec. 6. A statement of the expense of the town for any work inci-
dental to the cleaning of a street under this ordinance shall be filed

by the town clerk in the office of the county auditor. This expense
as shown in the clerk's statement shall become a lien in favor of the
town upon the lot or parcel of land.
Sec. 7. Any lien which has been established against any property
by virtue of the provisions of this ordinance shall be collected as
taxes after the auditor has been notified by the town to assess the
charge against the property designated and shall be paid by the pro-
perty owner in the same manner and at the same time as his taxes are
paid.
