HomeMy WebLinkAboutNo 53 Establishing Standards for the Construction of Streets and Roads within the Village of Maplewood, Providing Specifications for Work and Material and Procedures, and Providing Penalties for Violation Thereof; and Repealing Ordinance No 40 4 ORDINANCE NO. 53 AN ORDINANCE ESTABLISHING STANDARDS FOR THE CONSTRUCTION OF STREETS AND ROADS WITHIN THE VILLAGE OF MAPLEWOCD, PROVIDING SPECIFI- CATIONS FOR WORK AND MATERIAL AND PROCEDURES, AND PROVIDING PENALTIES FOR VIOLATION THEREOF; AND REPEALING ORDINANCE NO. 40. THE VILLAGE COUNCIL OF THE VILLAGE. OF MAPLLWOOD DOES HEREBY ORDAIN AS FOLLOWS : PART ONE Section 1-1 Pursuant to statutory authority of the Village of Maplewood to regulate, control and maintain village streets as provided in Minnesota Statutes, Chapter 412, the provisions of this ordinance are hereby declared to apply to all streets hereafter constructed within the Village and are declared to be necessary and essential because of the growth and expansion of said Village. Sec. 1-2 For purposes of this ordinance, the following words and terms are hereby defined: i- A.A.S.H.O. - The American Association of State Highway Officials. All refer- ences to A.A.S.H.O. specifications or methods of test shall be understood to refer to the latest published edition of the "Standard Specifications for Highway Materials and Methods of Sampling and Testing" of the A.A.S.H.O. unless specifically provided otherwise. BASE - That portion of the street which is the foundation for the bituminous surfacing. BITUMINOUS SURFACING - That portion of the street mixed with bituminous material and including the prime coat, aggregate, curbing and seal coat. GRADE - The established elevation of the finished bituminous surface of the street. GRAVEL - For the purpose of this ordinance, the term "gravel" shall be construed to mean gravel or sand , or any combination thereof. 410/ M.H.D. - Minnesota Highway Department. All references to M.H.D. specifications or methods shall be understood to refer to the latest published edition of the "Speci- fications for Highway Construction" as published by the Minnesota Highway Department. ululnauee No. ').5 rage e PLANS - All drawings and standard details or reproductions thereof pertaining 1110 to details of construction or of the contract work and which are made a part of the contract. PRIMARY STREETS - Streets serving commercial, industrial and/or manufacturing areas and/or connecting pcints of major traffic interest within the Villages RESIDENTIAL ACCESS STREETS - Streets providing access to residents only and not serving business, commercial, industrial or manufacturing areas and not connect- ing points of major traffic interest. SPECIFICATICNS - The directions , provisions and requirements that are prepared for the project under consideration and made a part of the contract, SUB-BASE - The portion of the street lying between the base and the subgrade. SUBGRADE - That portion of the street which is the foundation for sub-base , base and surface. Sec. 1-3 No building permits will be issued for any construction within the • Village unless the building site is located adjacent to an existing street which is dedicated and maintained as a village street, or unless provision for street construc- tion has been made in full compliance with this ordinance and in no case until grad- ing work as provided in Section 2-5, Subdivision a. hereof has been completed and certified to the Clerk by the Village Engineer; except that in isolated instances the Council may enter an agreement with a property owner for special handling of an unusual situation which agreement shall be recorded so as to run with the land af- fected . Sec. 1-4 Before any improvement, construction or alteration of any kind what- soever is undertaken within the limits of a right-of--way, the person proposing such improvement, construction or alteration shall procure a permit therefor from the Village. Sec. 1-5 All requests for street construction, improvement or re-construction 410 shall be initiated by a request to the Council upon a street improvement petition form. The form of petition shall be available to the public at all times at the Ord-finance No. 53 Page 3 office of the Village Clerk or the Village Engineer. Such petition, when properly • executed, shall be filed with the Village Clerk. Sec. 1-6 Upon receipt of a street improvement petition, the Clerk shall pre- sent same to the Council. All such petitions, before being acted upon by the Coun- cil, shall be referred to the Village Engineer for preliminary report as to feasi- bility of the improvement, as to whether it should be made as proposed or in connec- tion with some other improvement, and as to the estimated cost. When the Engineer's repert has been received , the Council shall determine whether such improvement is tc be made and how it shall be financed. If the Council determines that the im- provement shall be financed by assessment against benefited property, all further proceedings shall be in accordance with the provisions of Chapter 998, Laws of 1953, as amended . If the Council determines that the improvement is to be financed by means other than assessment of benefited property, all further proceedings shall be in accordance with Section 1-7 of Part One of this ordinance. Sec. 1-7 Subdivision a. When the street improvement will not be financed by assessment, a copy of the Engineer's preliminary report shall be furnished to each petitioner. The petitioner or petitioners shall deposit with the Village an amount equal to ten percent (10%) of the preliminary estimate. This sum shall be used to defray expenses incurred by the Village for plans, specificaticns, legal services, advertising, or any other expense in connection therewith. In the event the work is not ordered by the Council, any money remaining in such ten percent (10%) deposit after expenses as above specified have been paid , shall be refunded to the petitioners. Subd. b. After the petitioners have paid the deposit required in Subdivision a. of this section, the Council shall instruct the Engineer to prepare final plans and specifications and estimate of cost for the improvement, construction or re-construc- tion including drainage and utility installations as petitioned and as recommended • by the Engineer's preliminary report. When final plans and specifications and esti- mate of cost are completed, the Engineer shall present same to the Council and shall furnish a copy thereof to the Clerk for transmittal to the petitioner. Before the _ Ordinance No. 53 Page 4 Council orders the work done or advertises for bids, .the petitioners shall deliver 410 to the Village a cash deposit, or a surety bond, in the amount of one and one-half (l4) times the engineer's final estimate ; and such cash deposit shall be used for, or such surety bond shall guarantee, the payment in cash for all work as specified in the payment terms of the contract as let by the Council. If the petitioners fail to furnish said cash deposit or bond within thirty (30) days from the date the Clerk forwards a copy of the engineer's final estimate to the petitioner, the project shall be terminated and the Clerk shall forthwith deduct all expenses incurred by the Village from the deposit provided in Subdivision a. of this section. Any balance remaining shall be paid back to the petitioners. Subd. c. Upon receiving from the petitioner the cash deposit or bond required by Subdivision b. , the Council shall proceed in accordance with the provisions of Chapter 398, Laws of 1953, and acts amendatory thereof, for the purpose of advertis- ing for bids and letting contract for the work to be done. This language shall not 411 be construed to require the issuance of bonds by the Village nor to require assess- ments to be spread. Sec. 1-8 In the development of a large subdivision or plat the street construc- tion may be undertaken in parts or sections of the plat providing that the petitioner includes in each separate undertaking streets which will make a complete circuit so that there will be no dead ends when the construction of a particular section has been completed. Sec. 1-9 Any temporary or permanent street having a width of less than sixty (60) feet shall be considered as a permissible variance from this ordinance provid- ing the village engineer shall design such street in the best possible manner for the contemplated use. The petitioner may be required to enter into special agree- ments pertaining to such sub-standard streets. 410 Sec. 1-10 The Council shall at all times have the right to determine and specify the timing of street construction and may in its discretion contract for grading under a separate contract from the finishing or surfacing of the driving area. Ordinance No. 5'3 Page 5 Whenever surfacing is delayed for a substantial period of time after grading, the 0 Council may provide for snow plowing and general blading operations on such streets at the expense of the village . If the council does provide for snow plowing and blading, such action on the part of the council shall not in any way constitute or be deemed to be final acceptance by the village of such streets for maintenance. If conditions require , during the period of such partial maintenance, that aggregate or gravel be applied to the entire driving surface , the application thereof shall be deemed to be part of the street construction to be paid for by the petitioner on a time and material basis to the village. Such partial maintenance as provided for in this paragraph shall not be construed to have any effect upon construction agree- ments existing between the village and the petitioner but shall be construed to be part of such construction agreements and shall be construed to be an exercise by the council of its right under Chapter 398, Laws of 1953 , and acts amendatory thereof, to perform part of the work contemplated by village labor and village equipment on a IIItime and materials basis PART TWC Section 2-1 Primary Street System. The Council shall from time to time desig- nate those streets which shall constitute the primary street system of the Village. Primary streets shall differ from other streets as set forth in the specifications in this ordinance. Designation of primary streets shall be by resolution of the Council. Sec. 2-2 General. All streets constructed within the Village of Maplewood shall be constructed in accordance with plans and specifications prepared by the Vil- lage Engineer and approved by the Council. All streets, including residential access streets, shall be designed as minimum 5 ton (axle loading) all weather streets, capable of handling a minimum of 4C0 vehicles per day. Primary streets shall be designed to handle such additional axle loadings and traffic volumes as the ultimate use of the street may require. Sec. 2-9 Right-of-way. All streets constructed hereafter shall be constructed on right-of-ways of not less than sixty (60) feet in width except as provided under Ordinance No, 59 Page 6 Section 1-9 of this ordinance. Primary streets shall be constructed on right-of- 0 ways of such additional width as may be necessary to accommodate the final completed ultimate street as required by the ultimate use for which that street is designed . Section. 2-1h Test. The Council may authorize the Engineer to conduct such tests, take such borings or make such surveys as may be necessary for the proper design of the street. The cost of such tests, borings and/or surveys shall be con- sidered as part of the overall cost of the street improvements. Sec. 2-5 Minimum Construction Reouirements. Basic requirements for construc- ting streets described in Section 2-2 above shall be as follows: Subdivision a. Grading. All streets shall be graded for the full width of the right-of-way and in such a manner as to provide a minimum finished surfaced width of thirty-two (32) feet from back to back of curb. All streets shall be undercut below the established grade for the width of the finished surface to a depth adequate to accommodate the sub-base , base, and bituminous surfacing. Subd . b. Subgrade. The subgrade of the streets shall be so constructed as to satisfactorily sustain the street in a stable condition. Any unsuitable or undesir- able materials shall be removed . Subd. c. Sub-base and base. All streets shall be constructed having a gravel sub-base of six inch minimum thickness using gravel conforming to M.H.D. spec. #3138, Class 4, and a gravel base of three inch minimum thickness using gravel conforming to M.H.D. spec. #3138, Class 5. The total minimum thickness of the sub-base and base as mentioned above, are applicable to the A-6 subgrade soil group. For other soil groups the following factors shall be employed to determine the total minimum thickness of the sub-base and base. Adjustment of the total thickness shall be ap- plied to the sub-base thickness only and _the..minimum base thickness of three inches shall be retained. Subgrade Soil Group Factor A"2 ?5% A--3 50% A-4 125% A-5 130% A-7-6 130% A-7-5 120% Ordinance No. 53 Page 7 Soil group classifications are in accordance with A.A.S.H.O. designation, M145-49. Subd, d. Bituminous Surfacing. All streets shall be surfaced eith a road- mix bituminous mat having a minimum thickness of three inches using bituminous material of the type and grade as specified by the Engineer and aggregate conform- ing to the requirements of M.H.D. spec. ,#3139, Grade BA-2. The aggregate used for the bituminous mat shall be applied to the street immediately prior to commencing bituminous surfacing operations. Subd . e, Bituminous Curb. Bituminous curbing shall be constructed on all vil- lage streets as a part of the bituminous surfacing operation using stationary hot plant mix consisting of asphalt aggregate an filler of the types and grades as spe- cified by the engineer. Curbing shall be installed bv use of a machine designed and manufactured specifically for that purpose . Subd. f. Seal Coat. A bituminous seal coat shall be applied to the finished bituminous surface after the installation of curbing. The seal coat shall be con- structed in accordance with the requirements of M.H.D. spec. #2356. The types and grades of materials and rate of application of the same shall be as specified by the engineer. Subd. g. Drainage. Provisions shall be made for the proper drainage of all streets through the installation of adequately designed culverts, storm sewer, etc. and the installation thereof shall be considered part of the essential street con- struction requirements provided for by this ordinance. Wherever possible, such drainage shall fit into the overall drainage plan for the village. Subd. h. Boulevards. The boulevards (area between the backs of the curb and the property line) shall be uniformly finished to match the top of the curb and sodded or seeded to present a pleasing finished appearance. Sec. 2-6 Public Utilities. All public utilities which are available and IIIwhich are to be buried within the street right-of-way together with such service lines , leads, stubs, and/or other appurtenances as may be required to connect the adjacent property to these public utilities shall be constructed and/or installed prior to the time any part of the bituminous surfacing is applied to the street. Osrtinance No. 59 Page 8 Seco 2-7 Standard Detail Plates, Attached hereto and made a part hereof are standard detail plates showing typical standard minimum requirements of construc- tion and materials. These detail plates may be revised or added to from time to time by resolution of the Village Council and such revised or additional plates shall be considered part of this ordinance. PART THREE Section 3-1 Variations and Exceptions. The Council may permit variations from these requirements in specific cases which, in its opinion, do not affect the general sense of this ordinance. Sec. 3-2 Validity. If any section, subsection, sentence , clause or phrase of this ordinance is for any reason held to be invalid , such decision shall not affect the validity of the remaining portions of this ordinance. Sec. 3-3 Ordinance No. 40 is hereby repealed. Sec. 3--4 This ordinance shall supercede the provisions of any other ordinances filnot hereby repealed which may be in conflict herewith. Sec. 3-5 This ordinance shall be in full force and effect from and after its passage and publication according to law. Passed by the Village Council this 16th day of January, 1958.
