parts of automobiles which may nave come into the possession of

Sec. 5. Any person, firm or corporation licensed under pro-
visions of thin ordinance, shall, at all times durinn- the term of
said license allow the chairman of the Town 3oard, or any officers
whom: he shall designate, to enter the premises where the licensee
is carrying on the business, for the purpose of inspecting such
premises and inspecting the automobiles or autonobile parts or
automobile license plates therein for the purpose of locating goods
suspected or alleged to have been stolen or otherwise improperly
disposed of.

See. 6. Before such persons firr or corporation shall be li-
censed to conduct such business in said Town of Now Canada, a copy
of the application for license shall be delivered to the police
officer or authority within or without the Town as specified by
the Town Board and such police officer or authority shall investi-

of the'Provisions of this Ordinance.
THE TOWN BOARD OF THE TOWN
OF NEW CANADA DOES ORDAIN:
Section 1. No person, firm or corpora-
tion shall exercise, carry on or be en-
gaged in the trade or business of automo-
bile wrecker or automobile junker within
the limits of the Town of New Canada
without first having obtained a license
to do so in conformity with the provi-
sions of this ordinance.
Sec. 2. The term "automobile wrecker
or automobile junker" as used in this
ordinance shall be construed to mean any
person, firm or corporation engaged in
the business of dismantling. wrecking,
burning or otherwise dis-assembling used
automobiles in order to re -sell, lease or
otherwise deliver parts of such cars either
as second-hand parts or as junk: and the
fact that such persons, firm or corpora-
tion may maintain an agency or sub-
agency for any automobile dealer or other
person shall not exempt such agent or
sub -agent from the terms of this ordi-
nance, if such agent or sub -agent en-
gages in the business of wrecking or
junking automobiles.

purpose of permitting a garage, filling
station, auto parts dealer or other person
to clean up and dispose of junked auto-
mobiles in his possession will be granted
by the Board pursuant to application
subject to the furnishing of a bond as
hereinafter required and the fee for
such temporary special license shall be
the amount determined by the Board in
accordance with the time required for
the cleanup process on a pro rata basis
at the same rate as provided in Subdi-
vision (a) hereof.
Sec. 4. Before any person, firm or
corporation shall be licensed as an auto-
mobile wrecker or junker, such applicant
shall file with the Town Clerk a bond in
the sum of One Thousand Dollars
($1,000.00) with a duly licensed surety
company as surety thereon, such surety
to be approved by the Chairman of the
Town Board and said bond to be approved
as to form and execution by the Town
Attorney: conditioned that such licensee
shall observe the ordinances of the Town
in relation to the business to do which
the applicant has applied for a license,
and that such licensee will observe and
conform with all zoning ordinances. Plan-
ning ordinances and any other pertinent
laws, statutes or ordinances of the Town,
County and State: and that such licensee
will account for and deliver to any person
legally entitled thereto any automobiles or
parts of automobiles which may have
come into the possession of the licensee
or in lieu thereof such licensee shall pay
in money to such person or persons the
reasonable value thereof.
Sec. 6. Any person, firm or corpora-

Sec. S. Every person, firm or corpora-
tion licensed under the terms hereof, shall
make out and deliver to such police offi-
cer as is designated by the Town Board
to receive same, every day, before 10
o'clock noon, a legible correct and com-
plete report of the automobiles, automo-
bile parts or accessories purchased, the
amount of money paid therefor, the time
of the receipt of same, the name, resi-
dence and the reasonably accurate descrip-
tion of the person selling the same, re-
ceived during the preceding day and said
report and description shall be signed by
the licensee herein, and shall be deliverei
in 'person by said licensee to the police
officer designated, except that this sso-
tion shall not apply if the licensee buys
the car or part as junk from a licensed
automobile dealer.
Sec. 9. No automobile or part . pur-
chased:by a licensee hereunder shall be
dismantled or sold or permitted to be
removed from licensee's place of business
for at least 72 hours after the copy and
statement required under Sec. 8 hereof
shall have been delivered to the police
officer. If an automobile is purchased for
dismantling, the licensee shall after 72
hours forward to the Registrar of Motor
Vehicles of the State of Minnesota, the
certificate of ownership, together with
the license plates issued for such vehicle,
with a signed notice of the date and man-
ner that such vehicle was received for
dismantling and the name and post of-
fice address of the person from whom
such vehicle was purchased; unless the
same was purchased from a licensed au-
tomobile dealer who had already notified
the State Registrar of Motor Vehicles.
The retention, sale, transfer, loan or de-
struction of any license plates other than
above specified is hereby prohibited.
Sec. 10. Whenever the licensee here-
under is ordered -by the police authority
to refrain from selling any automobile or
part, the same shall not be sold or de-
livered to anyone until authorized by
such police authority.
Sec. 11. All automobiles, parts or ac-
eessories coming into the possession of a
licensee hereunder shall at all times be
open to inspection and right of examina-
tion by any person claiming ownership
thereof, when such person is accompanied
by a police officer: and no licensee here-
under shall hide, conceal or stow away
any of the property in his possession
from any authorized police officer.
Sec. 12. Any license issued under this
ordinance shall be for one year only and
application for renewal must be made by
the licensee each year, provided. that the
Town Board may, if it so determines,
rely upon the police investigation made
for the previous license year. No license
shall be renewed if the majority of the
owners of property within,600 feet of the
Parcel of property upon which the li-
censee conducts his business, file a writ-
ten notice of objection to such renewal.
Such notice of objection shall be filed
with the Town Clerk not less than 80
days before the date of expiration of the
licensee's license hereunder.
Sec. 13. Any person, firm or corpora-
tion violating any of the provisions of
this ordinance shall, upon conviction
thereof, be punished by a fine of not
less than Twenty-five Dollars ($26.00)
nor more than One Hundred Dollars
($100.00), or by imprisonment for not less
than ten (10) nor more than ninety (90)
days, and the Town Board upon such con-
viction, is hereby authorized and directed
to revoke any license which was granted
by them.

THE TOWN BOARD OF THE TOWN
OF NEW CANADA DOES ORDAIN:
Section 1. No person, firm or corpora-

bile wrecker or automobile junker within

plete report of the automobiles, automo-
bile parts or accessories purchased, the
amount of money paid therefor, the time
of the receipt of same, the name, reel- I
dente and the reasonably accurate descrip l
tion of the person selling the an re-
ceived during the preceding day and said
report and description shall be signed by f
the licensee herein, and shall be delivered
in person by said licensee to the police
officer designated, except that this sec- I
tion shall not apply if the licensee buys f
the car or Part as junk from a licensed i
automobile dealer. 1
Sec, 9. No automobile or part pur-
chased by a licensee hereunder shall be
dismantled or sold or permitted to be
removed from licensee's place of business
for at least 72 hours after the copy and
statement required under Sec. 8 hereof
shall have been delivered to the police
officer. If an automobile is purchased for
dismantling, the licensee shall after 72
hour; forward to the Registrar of Motor
Vehicles of the State of Minnesota, the
certificate of ownership. togeth(-r -with
the license plates issued for such vehicle.

dismantling and the name and post of-
fice address of the person from whom
such vehicle was purchased; unless the
same was purchased from a licensed au-
tomobile dealer who had already notified ;
the State Registrar of Motor Vehicles.1
The retention, sale, transfer, loan or de-
struction of any license plates other than {
above specified is hereby prohibited. I
Sec. 10. Whenever the licensee here
under is ordered by the police authority 1
to refrain from selling any automobile or I
part, the same shall not be sold or de-
livered to anyone until authorized by
such police authority.
Sec. 11. All automobiles, parts or ac-
cessories coming into the possession of a
licensee hereunder shall at all times be
open to inspection and right of examina-
tion by any person claiming ownership
thereof, when such person is accompanied
by a police officer; and no licensee here-
under shall hide, conceal or stow away
any of the property in his possession
from any authorized police officer.
Sec. 12. Any license issued under this
ordinance shall be for one year only and
application for renewal must be made by ,
the licensee each year, provided, that the;
Town Board may, if it so determines,
rely upon the police investigation made
for the previous license year. No license
shall be renewed if the majority of the
owners of property within 500 feet of the
parcel of property upon which the li-
censee conducts his business, file a writ-
ten notice of objection to such renewal.
Such notice of objection shall he filed
with the Town Clerk not less than 30
days before the date of expiration of the
licensee's license hereunder.
Sec. 13. Any person, firm or corpora- 9
tion violating any of the provisions of
this ordinance shall, upon conviction
thereof, be punished by a fine of not
less than Twenty-five Dollars ($25.001
nor more than One Hundred Dollars
($100.00), or by imprisonment for not less
than ten (10) nor more than ninety (90)
days, and the Town Board upon such con-
viction, is hereby authorized and directed
to revoke any license which was granted
