HomeMy WebLinkAboutNo 10 Regulating the Use of Private Property for the Establishment and Maintenance of a Trailer Park and Requiring That Such Use Be Strictly Confined to Property Zoned for Industrial Usef ORDINANCE # AN CHDINANCE REGULATING THE USE OF PRIVATE PROPERTY FOR THE ESTABLISHMENT AVD MAINTENANCE OF A TRAILER PARK AND REQUIRING THAT SUCH USE BE STRICTLY CON- FINED TO PROPERTY ZONED FOR INDUSTRIAL USE, PRO- VIDING PENALTIES FOR THE VIOLATION THEREOF AND REPEALING ALL INCONSISTENT ORDINANCES. THIS IS AN EMERGENCY ORDINANCE RENDERED NECESSARY FOR PRESERVATION OF PUBLIC HEALTH AND SAFETY. THE TOWN BOARD OF THE TOWN OF NEW CANADA DOES ORDAIN: Section 1. For the r r.poses of this ordinance a. trailer park is defined as any place, lot, or area upon which automobile trail- ers designed for and used as dwelling quarters are parked, set up or located. Sec. 2. It shall be unlawful for any person to establish or .1 maintain a trailer nark anywhere in the Town of Mew Canada unless the land upon which said trailer park is located is zoned for in- dustrial use pursuant to the zoning laws now or hereafter existing in said Town. Sec. 3. Any trailer park now in existence or under construe - tion may continue to operate and be maintained although it is not in an industrial zone; but if such trailer park shall be discon- tinued for any period of time whatsoever, a trailer park may not be re-established in the same location without first obtaining an order from the Town Board rezoning such property to ind.ustrial use in accordance with the provisions of the Town zoning ordinances and resolutions. Sec. 4.. This ordinance is hereby declared to be an emergency ordinance deemed by the Town Board to be necessary for the preser- vation of the public peace, health and safety; since the statutes Ordinance} Page 2 of the State of Minnesota provide for licensing of trailer parks by the State Board of Health and forbid the licensing thereof by any local governing body; and also because the concentration of sewage facilities within the relatively limited confines of a trailer park may create an aggravated sewage disposal problem within the Town. Sec. 5. All ordinances, resolutions, and orders inconsistent herewith are hereby repealed and rescinded. Sec. 6. Any person who violates any of the provisions of this ordinance shall be guilty of a misdemeanor, punishable by a fine of not to exceed One -undred Dollars (:100.00) or by imprisonment for a period. not exceeding ninety (90) days; and each day that any violation continues shall constitute a separate violation punish— able in accordance with the provisions of this section. Sec. 7. This ordinance shall take effect and be in fcrce from and after its passage and publication. Passed by the Town Board this day of , , 1954.
