A. CALL TO ORDER
A special meeting of the City Council of Maplewood, Minnesota, was held in the Council
Chambers, Municipal Building and was called to order at 6:45 P.M. by Mayor Greavu.

C. ASSESSMENT APPEAL HEARING - HOLLOWAY AVENUE IMPROVEMENT -81 -12
1. City Attorney Patrick Kelly explained the appeal procedures.
2. Manager Evans stated the following:
a.Parcel 2 - Carl and Mildred Tellin - Code No. 57 01310 040 76
The assessments for this property are in accordance with policy. However, unusual
circumstances do indicate an adjustment may be in order. In 1969 the property was
assessed for water main and water service. Our records did not show a water service
existing. Since the property could conceivably be split into three lots, three water
services were installed as part of the current project. This obviously duplicates
the service installed in 1969. An adjustment or reducing the current assessment
by $671.00 or one water service is recommended.
The question of driveway access was also raised. No additional drives were installed
because no accurate location could be established. The City has learned from past
experience that when the homes are built after the drives, the drive is invariably
in the wrong location. Therefore no adjustment is recommended.

The storm run off from this property does flow through the storm sewer imprvements
constructed with this project. Whether the water flows west to Sterling Street or
east to the wetlands, the project does provide an outlet. No adjustment is recom-
mended.
b. Mr. Carl Tellin spoke on behalf of his request for an assessment adjustment.
C. Councilmember Bastian moved to reduce the assessment of Mr. Carl Tellin by one
water service ($671.00) and that the assessment or Mr. John Wildes remain as billed.
Seconded by Councilmember Anderson. Ayes - Mayor Greavu, Councilmembers Anderson
and Bastian.
Nays - Councilmember Wasiluk.

d. Councilmember Anderson moved to reconsider the previous motion.
Seconded by Councilmember Bastian. Ayes - all.
e. Councilmember Bastian moved to suspend the Rules of Procedures and take immedia
action.
Seconded by Councilmember Wasiluk.
Ayes - all.
f. Councilmember Anderson moved to reduce the assessment Mr. Carl Tellin
oway Street, Code No. 57 01 y two water service connec ions
total assessment reduced o ,
Seconded by Councilmember Wasiluk. Ayes - all.

g. Councilmember Bastian moved that the assessment of Mr. John Wildes, 1864 Sterling
Avenue, remain as stated. Code No. 57 01310 260 76.
Seconded by Councilmember Wasiluk.
