A special meeting of the City Council of Maplewood, Minnesota, was held in the
Council Chambers, Municipal Building, and was called to order at 7:02 P.M. by
Mayor Bastian.

a. Mayor Bastian convened the meeting for a public hearing regarding the
construction of City -Wide Water Main Extensions and Miscellaneous
Improvements, City Project 90 -07 in Areas 9; Donna Senty Drive, north of
Frost: Area 10, Adele, South of Frost; Walter, Fenton to Gordon; Phalen,
Frost to Sophia; East Shore Drive, Adele to south of Sophia; Sophia, East
Shore Drive to Edward; Frisbie, Frank to English; Frank, Ripley to
Frisbie: Area 11, Kingston, Gurney to Jackson; Abel, Larpenteur to
Kingston; Beaumont, South of Kingston.
b. Manager McGuire presented the staff report.

a. Councilmember Juker commented that a relative tried to call her and
was told by an operator that was not a Maplewood listed.
b. Councilmember Zappa moved to direct staff to notify A. T. & T. and U. S.
West to advise employees of where Maplewood is located.
Seconded by Councilmember Juker. Ayes - all.
2. R.C.L.G.
a. Mayor Bastian commented on several charter amendments that were
proposed. R.C.L.G. has requested the cities be polled as to their
opinions.
b. Councilmember Zappa moved that the City_ support the Charter Amendments
with the exception of the referendum requirements bei.n lowered.
Motion filed for lack of a second.
c. Mayor Bastian moved to direct Councilmembers Rossbach inform the
R.C.L.G. that at this time the Maplewood Council is undecided regarding
the charter amendments.
Seconded by Councilmember Juker.Ayes - Mayor Bastian, Councilmembers
Carlson, Juker and Rossbach.
Nay - Councilmember Zappa.

ACCEPTANCE OF PROJECT
WHEREAS, the city engineer, for the City of Maplewood has
determined that Hillcrest Trunk Sanitary Sewer, City Project 86-
22, is complete and recommends acceptance of the project;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF.
MAPLEWOOD, MINNESOTA, that.City Project 86 -22 is complete and
maintenance of these improvements is accepted by the city.

Backaround
The followin table compares the amounts. to be paid b the cit under the
proposed cooperative a with the cit costs estimated based upon the
Ra Count desi memorandum. The increase in estimated utilit and
storm sewer costs were more than offset b the decrease in street and curb
and gutter costs. The total cit cost is less based upon the proposed
cooperative a It should also be noted that under Item 13 of the
proposed a Ramse Count will pa for the -replacement of about 450
feet of existin sanitar sewer west of the railroad brid This existin
VCP sewer is in mar condition. The proposed additional cover over the
pipe due to the brid approach emb would exceed the pipe's
structural capacit Ramse Count will pa to replace the pipe with new
ductile iron pipe.

Project cost is estimated construction cost with 25 percent for

The attached resolution . to restrict parking formalizes the proposed roadway.
design presented at the public hearing. The proposed roadway design is 40
feet wide from curb to curb with two '12 foot wide driving lanes and a
striped 8 foot "no parking" shoulder on each side..
The plans have been approved by state aid. Bridge funding is expected to
be available to the county by spring 1991. Construction is expected to
begin in spring 1991.
Recommendation
It is recommended that the mayor be authorized to execute the cooperative
agreement. It is recommended that the resolution to request Ramsey County
to restrict parking be adopted. '

THIS AGREEMENT, by and between, City of Maplewood, Minnesota, a
municipal corporation, hereinafter referred to as the "City," and
Ramsey County, a political subdivision of the State of Minnesota,
hereinafter referred to as the "County"*
WITNESSETH:
WHEREAS, the County and the City desire to construc and rebuild
Roselawn Avenue between Rice Street and Jackson Street from the
Southwest Corner of the North Half of Section 18, Township 29N, Range
22W to the center point of said Section 18; and
WHEREAS, Roselawn Avenue from Rice Street to Jackson Street is
in. the City; and
WHEREAS, the work contemplated under this agreement has been
divided into two separate plans which provide for the bridge
replacement and road reconstruction; and
WHEREAS, the replacement of Bridge No. 6629 with Bridge No.
62559 has been designated by the Minnesota Department of
Transportation as eligible for certain construction costs
reimbursement from the Federal Bridge Replacement and County State
Aid Highway (CSAH) funds and identified. as S.P. 62- 626 -03. Bridge No.

WHEREAS, this road project has been designated by the Minnesota
Department of Transportation as eligible for certain construction
costs reimbursement from the County State Aid llighw.ay funds and
identified as S.A.P. 62- 626 -04; and
WHEREAS, this road project has been designated by the Minnesota
Department of .Transportation. as. eligible for certain construction
costs reimbursement from the Municipal State Aid Highway funds and
identified as S.A.P. 138 - 020 -13; and
WHEREAS, plans for this project S.P. 6.2-- 626 -.03, Bridge. No.
62559, S.A.P. 62--- 626 -04 and S.A.P. 138- 020 -13 .showing proposed
alignment, profiles, grades and cross sections for the improvement of
county State Aid Highway 26 within the limits of the City as a County
State Aid Highway project have been presented to the City; and
WHEREAS, the rading provisions require acquisition of certaing
right of way and temporary construction and slope easements prior to
construction; and
WHEREAS, the projects include, in addition to other things,
right. of way acquisition, grading, concrete curb and gutters, storm
sewer, bridge replacement, and City utility adjustments; and.
WHEREAS, the Minnesota Department of Transportation has
determined allowable credit for storm sewer outfall lines previously
constructed rior to the project, and the resulting portion of this
storm sewer system eligible for County State Aid and Municipal State
Aid Highway funds.
NOW, THEREFORE, IT IS HEREBY PlUTUALLY AGREED AS FOLLOWS:
1. The county shall prepare the necessary plans,
specifications and proposals, take bids and with concurrence of the
City recommend award of a contract for the construction of Bridge
No. 62559 to be awarded by the Minnesota Department of
Transportation; the County shall perform the construction inspection.
29 Upon completion of Bridge No. 62559, the County shall own
and maintain the bridge; however, the Soo Line Railroad shall be
responsible for usage and operation of the rail opening and shall
provide normal maintenance and access for that usage.
3. The County shall prepare the necessary plans, descriptions
and estimates and with the approval of the `City and the Minnesota
Department of Transportation acquire the necessary right of ways for
the bridge replacement from the Soo Line Railroad in accordance with
procedures for reimbursement from State Aid funds. County acquired
right of way from the Soo Line Railroad will include provisions to
perpetuate the existing culvert on the west-side of the tracks but
will not .include provisions for the City utility crossing of the
Railroad right of way.
40 Right of way required for the Bridge construction is
estimated to be 100% eligible for CSAH funds reimbursement and this
portion shall be paid by the County.

130 The County shall pay for the sanitary sewer replacement
between engineers station 3 +70 (MH -2) and 8 +20 (MH1 --25)0
14. The City shall assist the County in the inspection of the
sanitary sewer and watermain construction. The City shall lead
discussions with the City of St. Paul Board of water Commissioners on
interpretation and administration of the plans and specifications
relating to the waterworks facilities within the City.
150 All City utilities or facilities modified or added to those
provisions presently made in the plans and specifications may be
incorporated in the construction contract by supplemental agreementandshallbepaidforasspecifiedinthesupplementalagreement0
16. Upon completion of the work on the sanitary and watermain
systems, the City shall own and maintain the systems.

17. The County shall pay one hundred percent (100 %) of. the cost
of the center twenty --four feet ( two twelve --foot travel lanes) except
as provided above,
18 . The City shall pay to the County seventy- five percent (75%)
of all costs not otherwise provided for above and the County shall
pay. the remaining twenty -five percent (25 %) . These items of the
roadway improvements outside , - the center twenty -four feet are
Identified in the plan statement of estimated quantities under the
Maplewood MSAP No. 138-- 020 -06 column and in the Engineers Estimate
construction costs.
19. Quantity and cost distribution identified above-. is shown in
the engineer's estimate. Actual costs shall be -based on the
contractor's unit prices and the quantities constructed,
20• All liquidated damages assessed the contractor in
connection with the work performed on the project shall result in a
credit shared by the City and the County in the same proportion as
their respective total share of construction work is to the total
construction cost without any deduction for liquidated damages.
21. The City shall pay ten percent (l0 %) of its share of the
construction cost, as determined by the. contract proposed to be
awarded, to the County as a preliminary engineering fee. This fee
shall be due after receipt of bids and prior to award of the
construction contract,
22, The City shall pay to the County $1,451..00 for additional
land survey services performed by the: County consultant for
descriptions of the City utility easements. This tee shall be in
addition to the preliminary engineering fee.
23. In addition to the preliminary engineering fee, the City
shall pay eight percent (8%) of its share of. the construction cost,
as determined by the final contract amounts, to the County as a
construction engineering fee. This fee shall be due upon
notification to the City of the estimated final amounts due to the
contractor
24. All charges for services such as inspection and supervision
within the City by the City of St. Paul Board of Water Commissioners

25• The City shall not assess or otherwise recover any portion
of its cost for this project through levy on County - -owned property.
26, The County shall, when a construction contract is proposed
to be awarded, prepare a revised estimate and cost participation
breakdown based on construction contract unit prices and submit a
copy to the City. The City agrees to advance to the Treasurer of
Ramsey County an amount equal to the City total construction cost
share plus preliminary engineering and land surveying costs, The
contractor shall then be paid by the County,

27. Upon completion of the work, the County-shall prepare a
revised estimate of cost participation breakdown based upon the
contract unit prices and the actual units of work estimated to have
been performed and submit a copy to the .City . The construction
engineering costs to be paid the County by the City shall be based on
this estimated final construction cost. The County shall add to the
City's estimated final construction costs the . preliminary engineering
and, land surveying based on the . contract as awarded and construction
engineering costs, make necessary adjustments for liquidated
damages, if any, and deduct City funds previously advanced for the
project by the City. The City agrees to pay to the County any
amounts due, be 'it more or less than the estimated sum of the first
revised. estimate. In the event the calculations. show that the City
has advanced funds in greater amount than is due. the County, the
County shall refund the amount to the City without.interest.
28. Preliminary plans reviewed at the public hearing and final
plans and.specifications are hereby in all things approved.

Introduction
Attached is a resolution to designate Beam Avenue /Walter Street
from 400 feet west of Trunk Highway 61 to County Road D as part
of the city's municipal state aid system.
Background
The Beam Avenue improvements were.ordered on the basis of funding
as a municipal state aid project. The project has.received
concept approval from state aid officials. To assign a state aid
project number and authorize expenditure of funds, it is
necessary that the council adopt the attached resolution that
formally requests designation as a municipal state aid roadway.
The segment of roadway within 400 feet west of T.H. 61 will also
be reconstructed as part of this project. Designation of this
segment as a MSA street is not necessary since 'it is already
designated as a county state aid highway.. The 'city may use its
MSA f unds under an of f -' system trans f er to fund. this work. In the
future, the county has agreed to change its route designation for
County Road D (CSAH 19) to another intersection po ' L of T . H . 61.
Recommendation
It is recommended that the attached resolution be adopted..

Every year before October 10th a list of delinquent sewer
rental bills are sent to the County of Ramsey to -be levied to the
real estate taxes. The period of the delinquent bills is from July
1, 1989 to June 30, 1990. This year 399 accounts are to be certified

INTRODUCTION
Request
Mr. John Collins of 2076 English Street is requesting an amendment
to the City Code. The requested amendment is to allow a person to
construct a new home on a lot that already has a home on it. This
new construction would be subject to the removal of the old house
after completion of the new house.
Reason for the Request
Mr. Collins has applied for a building permit to construct a new
home on his lot at 2076 English Street. This lot now has an older
home on it which Mr. Collins lives in. He plans to remove the old
home after finishing the new home. ,(See the site plan on page 5.)
Section 36 66(a)(1) of the City Code states, "no. more than one
single family dwelling and its accessory buildings on each lot."
DISCUSSION
This amendment would encourage the replacement of run down homes.
Owners would have a place to live while building a new home. The
ordinance includes several conditions. to assure that this does not
create problems for the City.
I have deleted Section 36 -24, which prohibits a house behind a
house. This deletion will allow construction of a new home in
front of or behind an existing house before the existing house is
removed. Section 36 -24 is no longer needed, since the Council
amended Section 36 66(a)(1) in 1988 to require no more than one
house on each lot. The new ordinance requires adequate emergency
vehicle access.
RECOMMENDATION
Adopt the attached ordinance.

report for this requested code amendment to allow John

Commissioner Rossbach asked that Condition e, of the
resolution regarding emergency vehicle access to the

SUMMARY
INTRODUCTION
Mr. Markfort is requesting that the City Council approve a
revision to a previously approved preliminary plat. The previous
plat had twelve lots in this phase. Mr. Markfort has replaced
three of the lots with an outlot. Mr. Markfort is proposing to
use the outlot as a storm water retention pond.
BACKGROUND
On August 24, 1987, the City Council cave preliminary plat
approval to the Markfort Addition subject to nine conditions of
approval.
On May 9, 1988, the City Council approved the final plat for the
Markfort Addition final plat (first phase) .
DISCUSSION
Storm Sew
One of the original conditions for approval of the Markfort
Addition preliminary plat was about storm water ponding. It
stated, "Final platting shall be limited to Phase I until a
construction contract(s) is signed for a storm water project to
drain this area to Round Lake. Phase II must be platted as an
outlot until this contract is signed." The City Council did not
approve the Roselawn Avenue improvement project which included the
storm sewer improvements for this area.
Mr. Markfort's engineer has submitted

This proposal, however, is
standards. The proposed

A retention pond is a low area that stores runoff but does not
have an outlet to empty itself after a storm. The water level
in aretention pond can vary widely depending on weather
conditions. The retention pond may be dry during a drought or
dry periods. On the other hand, the pond may be full during wet
periods. If a storm occurs when the pond has water in it, the
available storage volume may not be adequate and the pond could
overflow. This might damage surrounding properties.
M.r. Markfort's consultant's report does not address the
likelihood of the pond overflowing. Even though the report
analyzes a typical 100 -year frequency storm, it assumes that the
pond is empty at the start of the storm. There is no basis in
the report to make the assumption that the pond will be empty
on a regular basis before random storms.
The City Engineer has stated that no other solutions exist for
handling the storm water run -off that are consistent with City
design standards. Since the applicant has completed the first
phase of the development, staff is recommending no further
platting of this property due to a lack of storm sewer capacity.
Ripley Street
The City Council, at the meeting giving preliminary plat approval
to this development, ordered the City Engineer to prepare a
feasibility study. This study is about the City acquiring a
60-- foot -wide right -of -way for Ripley Avenue from the Markfort
development through to McMenemy Street. The Engineer expects to
have this study completed in October. Until the Council reviews
this study, it is not certain if Ripley Avenue will be built to
McMenemy Street or ended in a cul -de -sac in the Markfort
development. The property owner of 177 McMenemy Street . (whom the
extension of by Ripley Street would effect) wants the City to
decide whether they plan to build the street to McMenemy Street or
not. (See his letter on page 9.)
Soils
The Ramsey Soil and Water Conservation District has noted that
most of the soils in this proposed plat are not suitable for
development. (See the letter on page 10.) Mr. Markfort should
get an opinion from a certified soils engineer that shows that the
proposed plat could be developed with single - family homes and a
street. This report should be a condition of preliminary plat
approval.
RECOMMENDATION
A. Deny the proposed Markfort 2nd Addition preliminary plat.
This denial is on the basis that:
1. There is inadequate storm sewer system capacity in this area
of the City.
2. The proposed on -site pond is not consistent with the City
design standards due to a lack of an outlet.

B. Renew the previous preliminary plat for another
year, subject to anew condition j. that would read as follows:
j . Submit to the City a written opinion from a certified
soils expert which describes the soil correction procedures
necessary to prepare the lots for building, The City
Engineer shall require these corrections in the developer's
agreement.

Per our conversation last week regarding the Ripl Street extension from
Leo Markfort's property through 1774/1780 McMenemy to McMenemy Street,
you indicated that Mr. Markfort's new pl.ans show . a temporary cul de sac
With future plans for Ripley Street. This has been in the plans since
April 1987.
Since this started, my mother, who lived at 1780 McMenemy, has passed
away. I would l i k e to sell this property, but cannot unti 1 this road
problem is resolved.
When this is brought up at the council meeting, I would l i k e either a
permanent cul de sac or the proposed road decided on so that I may go
ahead with my plans and settle her estate.

b. Preliminary Plat Revision: Markfort 2nd Addition
Ken Roberts, Associate Planner, presented the staff
report for a requested revision of one of the
conditions of a previously approved preliminary plat.
The Commission discussed the preliminary plat
conditions and the storm -water drainage plans.
Virgil Hawkins, of Meier Stewart and Associates and
representing the applicant Leo Markfort, gave a
presentation and explained the request for the
preliminary plat revision. Mr. Hawkins said a soils
report has been done by Braun Engineering which
approved the soils for development.
Mr. Roberts said the City Engineer was not able to
attend this meeting until later in the evening, but had
communicated to Mr. Roberts prior to this meeting that
the drainage plan which was submitted for this project
is not acceptable.

by the City. Secretary Olson said Ken Haider, Director
of Public Works, informed him that the Hmong church
drainage plans were approved for development for only
one half of the property because of problems with the
on -site ponding, as was the case with the Markfort
property.
Commissioner Rossbach moved the Planning Commission
table this item until later, in order that the
Commissioners questions can be.answered by the
Engineering Department.

b. Preliminary Plat Revision: Markfort 2nd Addition
Since Ken Haider, Director of Public Works, was now
present, this item was again considered by the Planning
Commission.
Chairman Axdahl asked Mr. Haider to explain the storm
water ponding and drainage plans for the Markfort and
Hmong church properties. Mr. Haider responded that
past City policy has been to allow some development on
a property if there is an acceptable plan to handle
storm water and development of the Hmong church was
allowed since they were developing only a portion of
their site. Mr. Haider said that under this same.
policy the first phase of the Markfort development was
also allowed to develop. Mr. Markfort now wishes to
develop the remaining property. Mr. Haider explained
that the City becomes responsible for whatever storm
facilities are installed as part of the plat and,
therefore, must require facilities that meet current
engineering standards. Mr. Haider said the storm sewer
improvements for this area were not approved by the
City Council. Mr. Haider said a feasibility study for
the acquisition of right -of -way for Ripley Street was
ordered by the City Council and it should be completed
in October.

Commissioner Rossbach said he is concerned that Mr.
Markfort not be "penalized, yet he feels with the
information available at this time, the request must be
denied.
Commissioner Rossbach moved the Planning Commission
recommend denial of the proposed Markfort 2nd Addition
preliminary plat. This denial is on the basis that:

While it may appear that the proposed stormwater pond is sized overly large
compared to the size of the Church property's "no outlet" ponds, it may be
the case that the Church property's ponds were sized using a smaller design
storm event.

The first phase of the Markfort Addition has been completed, The
second phase is now under consideration. In addition to other
re the issue of a throu street from DeSoto to
McMenem must be resolved before the second phase proceeds.
Alternatives
Two alternatives are available. The first is a throu street on
Riple from DeSoto to McMenem The second is a cul-de-sac
approximatel 900 feet lon from DeSoto.
Discussion
Alternative 1: There is no doubt that a throu street is
preferred b Public Safet and Public Works because their
operations are somewhat more efficient with this alternative. A
number of ne however, come with this proposal.
On the west end of the street near McMenem a number of mature
specimen trees would be removed due to grading for the street and
slopin boulevards. In addition, there is a concern that traffic
will become an issue since Riple Street is the onl east
connection for one- mile in each direction. This ma be
adverse to the residential character of the nei
A final concern is cost. A throu street re construction
of approximatel 300 feet of -street that creates four new lots.
This is onl one lot more than the cul-de-sac alternative. If a
throu street were constructed, the ri would have to
be purchased. The estimated cost of construction and ac
is approximatel $80,000,
Alternative 2: The cul-de-sac alternative is somewhat moredifficulttomaintainforPublicWorks, and some moredifficulttopatrolforPublicSafet
There would be significantl less tree removal, particularl ofthemoredesirabletreespecies.
The traffic is not an issue.

BACKGROUND
October 24, 1988: The City Council conditionally approved the
Torgerson Addition preliminary plat for seventeen residential
lots. (See City Council minutes of October 24, 1988 on page 5
for approval conditions.)
October 23, 1989: The City Council approved a one -year time
extension for the Torgerson Addition.preliminary plat.
DISCUSSION
The Torgersons cannot final plat this property until the City
approves a stormwater project for the area and they obtain access
to DeSoto Street. The Council is considering the Torgerson's
request to allow on -site ponding in lieu of the stormwater
project. The Torgersons.are in the process of acquiring access
to DeSoto Street.
RECOMMENDATION
Approval of a one -year time extension for the Torgerson Addition
preliminary plat subject to the original conditions of approval.

cul -de --sac in excess of 1 000 feet of length, the basis t c ;

a. Approval would adversely affect the spirit' 'of the subdivision
code and the comprehensive plan, because public safety's
ability to provide timely emergency vehicle service could
be hampered or jeopardized.
b. A full - width, through street is a reasonable alternative.
This alternative was planned for by the City when approval
was granted for the Twin Oaks Addition to the north and the
Markfort Addition to the west.
C, Approval is not essential to the reasonable development of
this subdivision.
d. Council has required full- width, through streets to be
guaranteed across adjoining properties as a condition of
approval for other similar proposals.

9. Mayor Greavu moved to approve the Torgerson Addition preliminary
lat sub •ect to satisfaction of the following conditions before -appli -
cation for final plat approval:
a. The City signing a contract(s) to construct the downstream
drainage improvements to outlet this and ajoining property
to Round Lake. The City Engineer may approve a phased develop -
ment plan, provided the applicant can demonstrate that oil -site
ponding capacity will be adequate to maintain predevelopment
storm water flows from this site. Any lot or street area not
included in the initial phase shall be platted as an outlot
until adequate storm water capacity is provided. The entire
right -of -way for Burr Street and Ripley Avenue shall be p1a t Led
and constructed with the first phase.
b. City or applicant acquisition of the 35 by 163± foot parcel
needed to construct Ripley Avenue as a full -width street,
through to Desoto Street. If a City project, the applicant
shall pay the cost of the feasibility study and all other City
expenses to acquire this right-of-way, including attorney's
fees*
c. Substitute a drainage easement for Outlot Be The property
lines for the adjoining lots shall be extended through the
easement to the south or east boundaries of the site. The
easement shall include all area that would be up to one foot
above the approved 100 -year storm design elevation for this
pond. This easement shall also line up with the existing
drainage easement on the properties to the east.

d. Outlot A shall be combined with an adjacent property. A
deed shall be in the possession of the adjoining property
owner before the plat is signed by the City. The deed to
transfer ownership of this outlot shall stipulate.that
this property is to be combined with adjoining property
to form one parcel , to be described by one Property tax
description number.
e. The following street names shall be shop n:
1) The north half of the existing Ripley Avenue right- -
of -way shall be shown between the west line of Bradley
Avenue and the east boundary of the site.
2) "Ripley Avenue" shall be shown west of the south
extension of the west line of proposed Lot One, Block One.
3) The remainder of the through street shall be named
Burr Street ".

4) The cul -de -sac shall be named "Summer Court ".
f . Reduce the width of Lots One, Two, Five and Six, Block "I "wo,
to the minirpum permitted to maximize the rear yard area
for Lots Three and Four
g. City Engineer approval of final grading, drainage, utility
and erosion control plans. These plans shall include, but
not be limited to:
1) Identification of the trees to be saved. These trees
shall also be identified on the site.
2) Revision of the grading plan and /or install storm.
sewer along the north boundary of the site to insure that
drainage from this site does not flow into the properties
to the north.
3) Where possible to obtain grading easements on adjoin-
ing property, make a more gentle.transition along the -site
boundary to the lots adjoining to the north and northeast..
4) Provide survey evidence that Ripley Avenue will line
up with existing Ripley Avenue, west of,DeSoto Street.
h. Submission of signed developer's agreement and surety for
all required public improvements, including but not limited
to: a full -width street through to DeSoto Street and on-
site utility and drainage improvements; any required tree
planting; erosion control measures; relocation of the NSP
utility pole that will be within the new Ripley Avenue
right-of-way, and, relocation of the driveway for 1822
Desoto Street to Ripley Avenue.

BACKGROUND
On April 13, 1987, the City Council ranted t 'g his CUP subject tofiveconditions.This original approval required avin of theportionoftheparkinlotdisplaying

On July 11, 1988, the City Council •y 1 revised and renewed this CUP,subject to the following conditions:
1. No vehicle shall be displayed for sale until '

DISCUSSION
Mr. Skon has not been able to get the property owner to pave a
display area.. The landlord and tenant have not agreed on whoshouldpayforit. The intent of the condition was to have theparkingareabyFrostAvenue

paved before allowing Mr. Skon todisplayvehiclesforsalethere. Since the displaypy area has not
been paved, Mr. Skon advertises his vehicles to be shown byappointment. He stores the vehicles for sale in the rear area byhisbusiness.
RECOMMENDATION
Renewal of the conditional use permit for one year at 1201 Frost
Avenue to sell used cars. Approval is subject to the originalconditions.
