and understood in a reasonable manner. We appreciate the fact that when appearing at Council meetings, it is
understood that everyone will follow these principles: Show respect for each other, actively listen to one another, keep
emotions in check and use respectful language.

Councilmember Juenemann noted a correction on page 5 of the minutes, change
negations to negotiations in the first paragraph.

F. APPOINTMENTS AND PRESENTATIONS
1. Presentation by Ramsey County Sheriff Matt Bostrom
Ramsey County Sheriff Matt Bostrom addressed the council to give an overview of the
different functions of the Sheriff’s Department. He also gave an update about what the
Ramsey County Sheriff’s Department has been working on and some of the projects
they will be working on in 2015.
Inspector Mark Wiegel from the Ramsey County Sheriff’s Department addressed the
council and reported on the work he is currently doing with the legislature regarding Data
Privacy.
2. Presentation of a $2,500 Donation from Maplebrook Pet Care Center for the
Purchase of Ballistic Vests for Police K-9’s
Police Chief Schnell gave the staff report. Dr. Kristina Andrusko-Bipes and Dr.
Amberleigh Barker, owners of Maplebrook Pet Care Center addressed the council to
present Mayor Slawik with a check from the fundraiser put on by Maplebrook Pet Care
Center and gave information about the fundraiser.
3. Approval of Resolution Recognizing October As National Domestic
Violence Awareness Month and Support for Engagement in the Proposed
City-County Joint Domestic Violence Prosecution Effort
Interim City Manager Coleman introduced the report. Police Chief Schnell gave the
specifics of the report. City Attorney Kantrud gave additional information.
Councilmember Juenemann moved to approve the Resolution Recognizing October as
National Domestic Violence Awareness Month and Support for Engagement in the
Proposed City-County Joint Domestic Violence Prosecution Effort.

Supports Engagement in the Proposed City-County Joint Prosecution Effort
WHEREAS , domestic violence is a crime that invades the homes and destroys
the lives of many citizens in the City of Maplewood; the countless problems of domestic
violence are not confined to any specific group or groups of people but intersects all
economic, racial, and societal areas; and
WHEREAS, one of the most effective methods in helping victims of domestic
violence is to engage in prevention and educational activities; the recognition and
protection of the rights of victims’ due process are vital components of deterrence along
with an increase in the public’s awareness about domestic violence; and
WHEREAS , in Minnesota , during 2013, at least 25 women were killed by a
current or former husband, boyfriend, or intimate partner and at least 7 men were
murdered in a case where the suspected, alleged, or convicted perpetrator was a
current or former intimate partner and at least 6 family members/friends children were
murdered; and
WHEREAS , in the City of Maplewood police officers respond to more than 500
domestic violence-related calls for service each year ; and
WHEREAS, it is recognized that as a community we cannot assume there is
nothing we can do to prevent and/or meaningfully intervene in domestic violence;
NOW, THEREFORE, BE IT RESOLVED, that the City of Maplewood recognizes
October as National Domestic Violence Awareness Month, a time to give thoughtful
consideration to domestic and family violence being among the most serious public
safety issues of our time; and
BE IT FURTHER RESOLVED, that we encourage our fellow citizens, non-
governmental organizations, and local faith communities to become involved in
domestic violence prevention and encourage the use of available resources such as
Harriet Tubman Center, which can help families touched by domestic violence; and
FINALLY, BE IT FURTHER RESOLVED, that the City Council of the City of
Maplewood supports and encourages the establishment of a clear and coordinated
domestic violence response protocol related to domestic and family violence and
actively supports full engagement and participation in the proposed City – County Joint
Prosecution effort.

5. Approval of Proclamation Recognizing Suburban Community Channel's
30th Year of Community Media
Councilmember Abrams read the proclamation then gave a brief overview of the week
events that took place recognizing community cable. Mayor Slawik talked about a part
of the event where she and Mayor Jo Emerson from White Bear Lake were asked to
participate in the green screen readings and they were also asked to consider to do a
monthly show.
Councilmember Abrams moved to approve the Proclamation Recognizing Suburban
Community Channel's 30th Year of Community Media.

Whereas, community cable television provides citizens, local non-profits and
governmental and other institutions with access to electronic communications training,
equipment, facilities and delivery systems; and enable civic dialogue and participation
via cable communications;
Whereas, community cable television provides viewers with local coverage of
municipal meetings as well as other valuable governmental programming;

Whereas, community cable television contributes to the quality of life in our
community;
Whereas, the Ramsey Washington Suburban Cable Commission (“Cable
Commission”) during its thirty year history of offering community television has made
significant contributions to the citizens and government of Maplewood;
Whereas, the Ramsey/Washington Counties Suburban Cable Commission
(“Cable Commission”) is planning on behalf of its member municipalities “Celebrate
Community Media Week “- September 15 - 19, 2014;
Now, therefore it be resolved that the City of Maplewood hereby proclaims the
week of September 15, 2014 as Celebrate Community Media Week in our community
and additionally invites and encourages residents to join in celebrating 30 Years of
Community Media by attending the week long Open House and activities for the public
to be held at the SCC Community Media Center, 2460 East County Road F, White Bear
Lake, Minnesota.

2. Approval of a Fee Waiver for a Temporary Food Sales Permit for Ramsey
County Sheriff's Foundation
Councilmember Juenemann moved to approve to waive the fee of $555.00 associated
with the Temporary Food Sales Permit for the Ramsey County Sheriff’s Foundation
“Fright Farm” located at the Ramsey County Fairgrounds, 2020 White Bear Avenue.

3. Approval of Temporary Lawful Gambling Permit(s) for the Church of the
Presentation of the Blessed Virgin Mary, 1725 Kennard Street
Councilmember Juenemann moved to approve the Temporary Lawful Gambling Permits
for the Church of the Presentation of the Blessed Virgin Mary to be used on October 6,
2014 for their Mini-Cad Dinner Event to be held at Gulden’s Restaurant & Bar, located at
2999 Highway 61 North; and on November 22, 2014 for their Turkey Bingo Event to be
held at the Church of the Presentation of the Blessed Virgin Mary, located at 1725
Kennard Street.

5. Approval of a Conditional Use Permit Review – Hill Murray School, 2625

Hill Murray School again in one year.

6. Approval of Contract between the City of Maplewood and ISD 622 for
Aquatic Programming Services
Councilmember Juenemann moved to approve the Contract Between the City of
Maplewood and ISD 622 for Aquatic Programming Services and authorizes the Interim
City Manager to execute the contract.

7. Approval to Amend Lease Agreement with Subway, 2100 White Bear
Avenue N
Councilmember Juenemann moved to approve the temporary amendment to Section
Four of the Lease Agreement between the City of Maplewood and Subway for a period
not to exceed six-months to reduce Subway’s lease payment from $950.00 per month to
$500.00 per month starting in September of 2014 and continuing thru February 2015;
and provide council with an update including an action plan with a list of options going
forward next February 2015.

8. Approval to Enter into Agreement for Sharpshooting of Deer
Parks and Recreation Director Konewko gave the staff report.
Councilmember Juenemann moved to approve entering into an Agreement with Ramsey
County for Sharpshooting Deer in an amount up to $30,000, City Project PM15.010 and
direct the Interim City Manager to execute the agreement.

9. Approval of Permissible Use Agreement Between the City of Maplewood
and TC Sports, LLC for the use of Carver Community Gym

Councilmember Juenemann moved to approve the Resolution Directing Modification of
Existing Construction Contract, Change Order No. 2, for the South Fire Station
Improvements, City Project 12-14.

DIRECTING MODIFICATION OF EXISTING CONSTRUCTION CONTRACT
PROJECT 12-14, CHANGE ORDER NO. 2
WHEREAS, the City Council of Maplewood, Minnesota has heretofore ordered
made Improvements Project 12-14, South Fire Station Improvements (originally termed
Fire Station 1), and has let a construction contract pursuant to Minnesota Statutes, and
WHEREAS, it is now necessary and expedient that said contract be modified and
designated as Improvement Project 12-14, Change Order No. 2.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
MAPLEWOOD, MINNESOTA, that:
1. The mayor and city engineer are hereby authorized and directed to modify the
existing contract by executing said Change Order No. 2 which is an increase of
$17,033.00.
The revised contract amount is $3,693,587.00.

11. Approval of Budget Adjustment to Code Compliant Entrance at 1902 City

Councilmember Juenemann moved to approve the budget adjustment to the proposed
work in an amount of $2,519.00 for a total revised budget of $26,405.00, City Project 14-

Fire Chief Lukin gave the staff report. IT Director Fowlds and Finance Director Bauman
answered questions of the council.

installation of fiber optics for the South Fire Station.

14. Approval to Purchase Security System for South Fire Station
Councilmember Juenemann moved to approve to purchase the security system for the
South Fire Station in an amount not to exceed $14,000.

Powers Agreement

$3,828.41 on an annual basis.

16. Approval to Accept Donation From Maplebrook Pet Care Center for the
Purchase of Ballistic Vests for Police K-9’s
Councilmember Juenemann moved to approve the Resolution Accepting the Donation
made by Maplebrook Pet Care Center in the amount of $2,500 to purchase Ballistic
Vests for the Police K-9’s.

WHEREAS, Maplebrook Pet Care Center has presented to the Maplewood
Police Department a donation in the amount of $2,500; and
WHEREAS, this donation is intended for the purpose of purchasing bullet-
resistant vests for Maplewood Police K-9’s; and
WHEREAS, the Maplewood City Council is appreciative of the donation and
commends Maplebrook Pet Care Center owners and staff for their civic efforts,
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of
Maplewood, Minnesota, that:
1. The donation is accepted and acknowledged with gratitude; and
2. The donation will be appropriated for the Police Department as designated; and
3. The appropriate budget adjustments be made.

AUTHORIZING EMINANT DOMAIN PROCEEDINGS ON CERTAIN PROPERTIES
FOR COUNTY ROAD B TRAIL PROJECT
WHEREAS, on January 27, 2014 the City Council passed a resolution supporting
the 2014 Safe Routes to School Infrastructure Grant Application and
WHEREAS, On April 4, 2014 the City received notification that the City was
selected for the SRTS Infrastructure Grant and
WHEREAS, On May 12, 2014 the City Council authorized the County Road B
Trail and Safety Improvements and
WHEREAS, it has further been determined that the project continues to be
necessary, cost effective and feasible and,
WHEREAS, to construct the trail improvement it has been deemed necessary to
acquire property for construction purposes in the form of “temporary easements” and/or
“permanent easements” from the following properties and their respective owners:

AMENDMENT TO ORDINANCE
REGULATING DANGEROUS DOGS
Secs. 10-186—10-188. Reserved.
Sec. 10-189. Dangerous/potentially dangerous dogs.
The provisions of Minn. Stats. § 347.50—347.56, inclusive, are hereby adopted as
the potentially dangerous and dangerous dog regulations for the City of Maplewood.
Where a conflict exists between the provisions of the City Code and the provisions of
Minn. Stats. §347.50—347.56, inclusive, the provisions of the Minnesota Statutes shall
apply.
(1) Definitions: For the purpose of this section, the terms defined have the meaning
given to them:
a. Dangerous dog means any dog that has:
1. without provocation, inflicted substantial bodily harm on a human being on
public or private property; or
2. killed a domestic animal without provocation while off the owner’s property;
or
3. been found to be potentially dangerous, after the owner has notice that the
dog is potentially dangerous, the dog aggressively bites, attacks, or
endangers the safety of humans or domestic animals.
b. Potentially dangerous dog means any dog that:
1. when unprovoked, inflicts bites on a human or domestic animal on public
or private property; or
2. when unprovoked, chases or approaches a person, including a person on
a bicycle, upon the streets, sidewalks, or any public or private property,
other than the dog owner’s property, in an apparent attitude of attack; or
3. has a known propensity, tendency, or disposition to attack unprovoked,
causing injury or otherwise threatening the safety of humans or domestic
animals.
c. Proper enclosure means securely confined indoors or in a securely enclosed
and locked pen or structure suitable to prevent the animal from escaping and
providing protection from the elements for the dog. A proper enclosure does
not include a porch, patio, or any part of a house, garage, or other structure

that would allow the dog to exit of its own volition, or any house or structure in
which the windows are open or in which door or window screens are the only
obstacles that prevent the dog from exiting.
d. Owner means any person, firm, corporation, organization, or department
possessing, harboring, keeping, having an interest in, or having care, custody,
or control of a dog.
e. Substantial bodily harm has the meaning given it under Minn. Stats. §609.02,
subdivision 7a.
f. Great bodily harm has the meaning given it under Minn. Stats. §609.02,
subdivision 8.
g. Provocation means an act that adult could reasonably expect may cause a
dog to attack or bite.
(2) Initial determination. The city's designated animal control authority shall be
responsible for initially determining (initial determination) whether a dog is a
potentially dangerous dog or a dangerous dog. The animal control authority may
retain custody of a dog which has been initially determined to be a dangerous dog
pending the hearing as hereinafter provided. The initial determination shall be
conclusive unless the owner appeals the initial determination as hereinafter
provided.
(3) Notice of initial determination. The notice of initial determination shall be
personally served on the owner of the dog or on a person of suitable age at the
residence of such owner. The notice of initial determination shall describe the dog
deemed to be potentially dangerous or dangerous, shall identify the officer making
the initial determination and shall inform the owner of the owner's right to appeal
the initial determination.
(4) Request for hearing and hearing. An owner may appeal the initial determination
by filing a request for hearing with the city manager within five days of the owner's
receipt of the notice of initial determination. A hearing shall be held within seven
days after the city's receipt of the request for hearing. The city manager shall
assign a hearing officer, who shall not be the person who made the initial
determination. At the hearing, the hearing officer shall consider the reports and
comments of the animal control authority, the testimony of any witnesses, witness
statements and the comments of the owner of the dog. After considering all of the
evidence submitted, the hearing officer shall make written findings and shall
determine whether the dog is a potentially dangerous dog or a dangerous dog
(final determination). The findings shall be made within five days of the date of the
hearing and shall be personally served upon the owner of the dog or upon a
person of suitable age at the residence of the owner.
(5) Seizure of dangerous dog or potentially dangerous dog. The animal control
authority shall immediately seize any dangerous or potentially dangerous dog if,
within 14 days after the service of the notice of final determination declaring a dog
to be a dangerous dog:

a. The owner has not registered the dog in compliance with the provisions of
subsection 10-189(8a) or (10a).
b. The owner does not secure the proper surety bond or liability insurance
pursuant to subsection 10-189(8a)(2) or (10a)(4).
c. The dangerous or potentially dangerous dog is not maintained in a proper
enclosure.
d. The dangerous dog is outside a proper enclosure and not under the physical
restraint of a responsible person.
(6) Reclaiming a dangerous dog or potentially dangerous. A dangerous or potentially
dangerous dog may be reclaimed by the owner of the dog upon payment of the
impounding and boarding fees and upon presentation of proof to the animal
control authority that the requirements of subsection 10-189(8a) or (10a), have
been satisfied. A dangerous or potentially dangerous dog not reclaimed under this
provision within seven days may be disposed of as provided in Minn. Stats.
§35.71, subd.3, and the owner shall be liable to the animal control authority for
costs incurred in confining and disposing of the dangerous dog.
(7) Substantial/great bodily harm. Upon a final determination and notwithstanding the
provisions of subsections 10-189(2)—(6), a dangerous dog that inflicted
substantial bodily harm or great bodily harm on a human being on public or
private property without provocation may be destroyed in a proper and humane
manner by the animal control authority.
(8) Dangerous dog restrictions.
a. Registration required. No person may keep a dangerous dog in the City of
Maplewood unless the dog is registered with the city clerk as provided in this
section. The city clerk shall issue a certificate of registration to the owner of
the dangerous dog if the owner presents the following information:
1. Proper enclosure. A proper enclosure exists for the dangerous dog and
there is a posting on the premises with a clearly visible warning sign,
including a warning symbol to inform children, that there is a dangerous
dog on the property.
2. Bond/insurance. A surety bond issued by a surety company authorized to
conduct business in the State of Minnesota in a form acceptable to the
animal control authority in the sum of at least $300,000, payable to any
person injured by the dangerous dog, or a policy of liability insurance
issued by an insurance company authorized to conduct business in the
State of Minnesota in the amount of at least $300,000, insuring the owner
for any personal injuries inflicted by the dangerous dog.
3. Microchip. The owner has had a microchip identification implanted in the
dangerous dog, and the name of the microchip manufacturer and
identification number of the microchip must be provided to the animal
control authority. If the microchip is not implanted by the owner, it may be

implanted by the animal control authority, with the costs borne by the dog's
owner.
4. Warning symbol. The owner has posted a warning symbol to inform
children that there is a dangerous dog on the property. The design of the
warning symbol must have been approved by the Minnesota
Commissioner of Public Safety.
5. Tag. The dangerous dog must have a standardized, easily identifiable tag
identifying the dog as dangerous and containing the uniform dangerous
dog symbol affixed to the dog's collar at all times. The design of the tag
must have been approved by the Minnesota Commissioner of Public
Safety.
6. Photograph. The owner of the dangerous dog shall make the dog available
to be photographed for identification by the animal control authority at a
time and place specified by the animal control authority.
7. Proof of Disclosure. The owner of a dangerous dog who rents property
from another where the dog will reside must submit proof of disclosure
from the property owner that the property owner was notified, prior to
entering into the lease agreement and at the time of any lease renewal,
that the person owns a dangerous dog that will reside at the property.
(9) Dangerous dog regulations.
a. Annual fee. The owner of a dangerous dog shall pay an annual fee as
determined by council ordinance, in addition to any regular dog licensing fees,
to obtain a certificate of registration for a dangerous dog under this section.
b. Annual renewal. The owner of a dangerous dog must renew the registration of
the dog annually until the dog is deceased and pay the annual renewal fee as
determined by city council ordinance. If the dog is removed from the City of
Maplewood, it must be registered as a dangerous dog in its new jurisdiction.
c. Death/transfer from city. The owner of any dangerous dog must notify the
animal control authority in writing of the death of the dog, of its transfer to a
residence outside of the City of Maplewood or of its transfer within the City of
Maplewood within 30 of the death or transfer.
d. Notice to landlord. The owner of a dangerous dog who rents property from
another where the dog will reside must disclose to the property owner, prior to
entering into the lease agreement, and at the time of any lease renewal, that
the person owns a dangerous dog that will reside at the property.
e. Sale. The owner of a dangerous dog must notify the purchaser that the animal
control authority has identified the dog as a dangerous dog. The seller must
also notify the animal control authority in writing of the sale and provide the
animal control authority with the new owner's name, address, and telephone
number.

f. Muzzling. If the dangerous dog is outside a proper enclosure, the dog must be
muzzled and restrained by substantial chain or leash and be under the
physical restraint of a reasonable person. The muzzle must be made in a
manner that will prevent the dog from biting any person or animal but that will
not cause injury to the dog or interfere with its vision or respiration.
g. Sterilization. The animal control authority may require a dangerous dog to be
sterilized at the owner's expense. If the owner does not have the dangerous
dog sterilized, the animal control authority may have the animal sterilized at
the owner's expense.
(10) Potentially dangerous dog restrictions.
a. Registration required. No person may keep a potentially dangerous dog in the
City of Maplewood unless the dog is registered with the city clerk as provided
in this section. The city clerk shall issue a certificate of registration to the
owner of a potentially dangerous dog if the owner presents the following

(12) Annual review requests. If there are no additional reports of the behavior
described in subsections (1a) or (1b) of this section within a twelve-month period
from the date of the designation as a dangerous dog or a six-month period from
the date of the designation as a potentially dangerous dog, the dog's owner may
request a review, in writing, of the declaration designation. The owner must
provide documented evidence for review that the dog's behavior has changed due
to environment, health, age, training, neutering or other relevant factor. The
review request and supporting documentation must be submitted to the
Maplewood animal control authority, which shall rule on the review request based
on the record. The owner of the dog shall be notified in writing of the review
results within ten (10) business days of receipt. An administrative fee shall be paid
prior to the review. In cases where the owner has successfully completed a
training program approved by the animal control authority, the administrative fee
may be reduced or waived. The fees for such review shall be imposed, set,
established and fixed by the city council, by resolution, from time to time.

Councilmember Juenemann moved to approve the resolution setting the maximum City
tax levy for payable 2015 at $19,069,350 and setting the date for the Public Hearing on
the 2015 Levy and Budget for Monday, December 8, 2014 at 7:00 pm as part of the
Regular City Council Meeting; this levy, combined with the proposed EDA levy of
$89,270, will result in a total levy of $19,158,620 which is a 3.4% increase over 2014.

RESOLUTION PROVIDING PRELIMINARY APPROVAL OF A
PROPOSED TAX LEVY PAYABLE IN 2015

SETTING BUDGET PUBLIC HEARING DATE
WHEREAS, State law requires that the City Council give preliminary approval of a
proposed tax levy for 2014 payable in 2015 by September 30, 2014 and
WHEREAS, the City Council has reviewed preliminary information on the
Proposed 2015 Budget and has determined the amount of the proposed tax levy payable
in 2015 which is the maximum amount that will be levied.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF MAPLEWOOD, MINNESOTA THAT:
1. The proposed tax levy for 2014 payable in 2015 in the amount of $19,069,350 is
hereby given preliminary approval and shall be certified to the Ramsey County

RESOLUTION TRANSMITTING THE CITY OF MAPLEWOOD’S SUPPORT OF THE
LOCALLY PREFERRED ALTERNATIVE (LPA) TO THE RCRRA, WCRRA, and
METROPOLITAN COUNCIL
WHEREAS, the Gateway Corridor is a proposed project that will provide for transit
infrastructure improvements in the eastern portion of the Twin Cities, and;
WHEREAS, the purpose of the project is to provide transit service to meet the
existing and long-term regional mobility and local accessibility needs for businesses and
the traveling public within the project area by providing all day bi-directional station-to-
station service that compliments existing and planned express bus service in the corridor,
and;
WHEREAS, the Gateway Corridor is located in Ramsey and Washington
Counties, Minnesota, extending approximately 12 miles, and connecting downtown Saint
Paul with its East Side neighborhoods and the suburbs of Maplewood, Landfall, Oakdale,
Lake Elmo, and Woodbury, and;

WHEREAS, the Gateway Corridor Commission (GCC), in partnership with the
Metropolitan Council and other project stakeholders, completed the Gateway Corridor
Alternatives Analysis (AA) Study that in addition to the No-Build alternative recommended
one bus rapid transit (BRT) and one light rail transit (LRT) alternative be advanced for
further study in the federal and state environmental review process, and;
WHEREAS, the Federal Transit Administration (FTA); the Washington County
Regional Railroad Authority (WCRRA), serving on behalf of the GCC; and the
Metropolitan Council have initiated the environmental review process for the Gateway
Corridor project, with FTA designated as the lead federal agency for this project, and;
WHEREAS, the Gateway Corridor project recently received the important
Presidential designation as a Federal Infrastructure Permitting Dashboard Project, and;
WHEREAS, the Gateway Corridor project recently completed the Scoping phase
of the environmental process, which resulted with the Policy Advisory Committee (PAC)
and the GCC recommending further study of the No-Build alternative, four BRT
alternatives operating within a dedicated guideway (A-B-C-D1-E1, A-B-C-D2-E1, A-B-C-
D2-E2, A-B-C-D2-E3) and a managed lane alternative in the Draft Environmental Impact
Statement (EIS) at the request of the FTA and Federal Highway Administration (FHWA),
and;
WHEREAS, the BRT alignments that advance into the Draft EIS will be further
defined and evaluated to minimize impacts to surrounding properties and the I-94 corridor
which may include operating in existing lanes with mixed traffic at pinch points where
right-of-way is constrained, enhance economic development potential, and reduce capital
costs while providing required operating efficiency, with attention to mobility options f or
environmental justice populations, and;
WHEREAS, through the Scoping process, the PAC and the GCC recommended
that the LRT alternative be eliminated from further study due to its higher costs while
generating a similar ridership, and;
WHEREAS, the identification of a Locally Preferred Alternative (LPA) is a critical
first step in pursuing federal funding for the Gateway Corridor project, and;
WHEREAS, the adoption of the LPA into the Metropolitan Council’s
Transportation Policy Plan will conclude the FTA Alternatives Analysis process, and;
WHEREAS, the LPA will be one of the Build alternatives identified and studied in
the Draft EIS, and;
WHEREAS, the LPA includes the definition of the Gateway Corridor mode and a
conceptual alignment which can be refined through further engineering efforts, and;
WHEREAS, the LPA selection process does not replace or override the
requirement to fully examine alternatives and determine the adverse impacts that must be
avoided or mitigated under the federal and state environmental review process, and;
WHEREAS, the comments submitted by agencies, the business sector, and the
public during the Scoping phase, as well as the additional comments received from

adjacent communities since the Scoping phase, will be addressed accordingly through
the Draft EIS process, and;
WHEREAS, the PAC and GCC each passed resolutions on July 24, 2014
recommending BRT Alternative A-B-C-D2-E2 (see attached figure) as the proposed LPA
for review at the August 7 PAC sponsored LPA public hearing and inclusion in the
Metropolitan Council’s Draft 2040 Transportation Policy Plan, and;
WHEREAS, the Gateway Corridor PAC/GCC held a public hearing on August 7,
2014 as part of the LPA decision making process. A total of 35 comments were received
through the proposed LPA review process, and;
WHEREAS, the Cities will be working collaboratively and with support from the
GCC to complete a market analysis and station area plans for the areas around the BRT
Guideway stations as a part of the Draft EIS process, and;
WHEREAS, that through the Draft EIS process the PAC and GCC will continue to
evaluate and focus on transit service connections to the dedicated BRT system (A-B-C-
D2-E2) including an efficient feeder bus network, as well as the number of location of
stations throughout the Gateway Corridor to maximize service, accessibility and
surrounding economic development opportunities, while minimizing impacts, and;
WHEREAS, the PAC and GCC each passed resolutions on September 11, 2014
affirming their recommendation of BRT Alternative A-B-C-D2-E2 as the Gateway Corridor
LPA, with the clarification that the dedicated BRT would be located generally on the
Hudson-Road-Hudson Boulevard alignment that crosses to the south side of I-94
between approximately Lake Elmo Avenue and Manning Avenue (see attached figure).
NOW THEREFORE BE IT RESOLVED that the City of Maplewood supports the
LPA recommendation of the PAC and GCC and identifies the dedicated BRT alternative
generally on the Hudson Road – Hudson Boulevard (A-B-C-D2-E2) alignment that
crosses to the south side of I-94 at approximately Lake Elmo Avenue to Manning Avenue
as the Locally Preferred Alternative for the Gateway Corridor project.
BE IT FURTHER RESOLVED that the City of Maplewood commits to undertaking
and developing station area plans with the support of the GCC for the proposed BRT
guideway station areas within its jurisdiction based on the results of a market analysis,
community input, and Metropolitan Council guidelines and expectations for development
density, level of activity, and design.
BE IT FURTHER RESOLVED that the City of Maplewood commits to working with
the Washington County Regional Railroad Authority, on behalf of the Gateway Corridor
Commission, and the Metropolitan Council to address the comments submitted by
agencies, adjacent communities, the business sector, and the public during the Scoping
phase, as well as additional comments received during the development of the LPA,
through the Draft EIS process, and the following areas of particular importance to the City
of Maplewood:
1. Mitigation of traffic impacts on McKnight Road, Century Avenue, and nearby
public and private roadways.
2. Enhanced pedestrian and bike facilities throughout the project area to connect

non-motorized modes of travel to proposed station(s); including the need for
improved connections under Interstate 94 at both McKnight Road and Century
Avenue.

Maplewood be forwarded to the Metropolitan Council for their consideration.

Councilmember Abrams reported that the last Parks Planning Meeting will be held
Wednesday, September 24 from 6-8pm at the Londin Lane Fire Station.
5. 3M Visit and Event
Mayor Slawik reported on the visit that she and Police Chief Schnell had with Doug
Stang, Director in Government Affairs at 3M. She also reported that Wednesday,
September 24th is the 75th Anniversary of the World’s First Reflective Traffic Sign and 3M
will be holding a special ceremony on Wednesday afternoon.
6. Revolution TAB and Rush Line
Mayor Slawik reported on the TAB meeting she attended last week. Public Works
Director/City Engineer Thompson gave additional information. She then reported on the
Rush Line meeting that she attended and informed residents that there will be another
open house for Rush Line.

Each week in October one randomly selected resident from each of Maplewood’s five recycling
districts will “Get Caught Recycling!” Winners receive $50, a fun skunk finger puppet for kids in
the house, and neighborhood recycling bragging rights. The contest was announced in the Fall
Seasons and October Maplewood Living newsletters. Winners of the contest will be announced
in future newsletters.
Discussion
Tennis Sanitation’s 2014 Recycling Work Plan includes recommendations to improve the City’s
recycling program. One recommendation is to target recycling education to neighborhoods with
low recycling participation. The Get Caught Recycling contest helps the City meet that goal by
awarding and spotlighting residents that do recycle.
Another tool for improving the City’s recycling and trash programs is community feedback. To
obtain that feedback the City has created a Solid Waste Survey that is posted on line at
www.ci.maplewood.mn.us/solidwastesurvey. Residents are encouraged to share their thoughts
on the City’s recycling and trash programs with their responses to questions in the survey.
Each completed survey will be entered into a drawing for $50. Results of the survey will be
presented to the Environmental and Natural Resources Commission and City Council in early
2015 during the annual recycling and trash program reviews.
Budget Impact
The City will award a total of $250 in prize money for the five Get Caught Recycling awards and
one Solid Waste Survey entry award. The prize money will be funded through the City’s
Recycling Program budget and will help the City meet its recycling goals.
Recommendation
Approve the “Get Caught Recycling” contest and $250 budget for the Get Caught Recycling and
Solid Waste Survey entry awards.

Introduction
Parks staff has been working with area playground providers to provide designs for a new
playground structure at Timber Park and Robinhood Park.
Background
Timber Park
In mid September, City staff sent a Request for Proposal (RFP) to six playground vendors in the
state. The RFP was fairly simple. We gave them a $60,000 budget and asked them to come
up with a design for the age range on 5-12 years old. We received six proposals from four
companies all meeting the $60,000 budget. The project team of City staff narrowed the
proposals down to two. This was based on play value and meeting the specifications of the
RFP. At that meeting, it was decided that the two proposals to be presented to the residents
would be from Gametime represented my MN/WI Playground and Little Tikes Commercial
represented by Parkitecture.
On October 2, Staff presented the two proposals at Timber Park to neighborhood residents.
Each resident regardless of age was asked to place a sticker on the proposal they liked the
most.
All the companies that turned in proposals were very competitive. However, the proposal from
Gametime represented by MN/WI playground was the overwhelming favorite of both staff and
the residents.
Robinhood
In the summer of 2013 Robinhood Park was vandalized and the train at the site was burned
down. In the fall of 2013, the damaged structure was replaced with a new train from Burke
represented by St. Croix Recreation. The remaining components of this structure are in poor
condition and need to be replaced, many of the structures are rotting at the footings. Staff has
worked with St. Croix Recreation to purchase new equipment off the state contract that will
match the existing new train. The proposal from St. Croix came to $20,788 with a state contract
discount of $1,633.04 bringing the structure cost to $19,124.96. In addition to the structure cost,
there is a $5,557.60 installation and freight fee bringing the total project cost to $24,682.56.

Funding for this project will come from the Parks Allocation of General Tax Levy Dollars in the
Capital Improvement Fund.
Recommendation
Staff has the following two recommendations:
1. Staff recommends the Council authorize the City Manager to enter into a contract for

chosen by the residents at Timber Park.
2. Staff recommends the Council authorize the City Manager to enter into a contract with
St. Croix Recreation to purchase and install new playground equipment at Robinhood

Introduction
The council will consider authorizing this work for an emergency storm sewer repair at a cost of
$40,256.28 which the Fire Chief and Street Superintendent have conveyed will be fully
reimbursed by FEMA after a recent site visit.
Discussion
The storm sewer system located adjacent to 2567 Mayer Lane in the Upper Afton neighborhood
failed during heavy rainfall events in June. The heavy rainfall has resulted in numerous sink
holes and erosion problems.
The 30” diameter pipe runs down to Battle Creek from Mayer Lane in an existing 20’ wide
drainage easement. The sink holes that have appeared due to pipe failure have been filled in
by our maintenance crews as a temporary solution until the pipe is replaced.
Two estimates were submitted for the work. The estimate from Capra’s Utilities, Inc. is
$40,256.28 and the other from Miller Excavating is $49,560.00.
Budget Impact
The storm sewer repair work will qualify for reimbursement from FEMA. This includes Capra’s
costs in addition to any internal city forces labor and equipment costs.
Recommendation
Staff recommends City Council authorize Capra’s Utilities to perform the necessary storm sewer
repair work at 2567 Mayer Lane and submit all necessary claims to FEMA for reimbursement.

Introduction
In 2012 and 13 the City of Maplewood agreed to be the fiscal agent for the Tubman Center’s
State Grant to rehabilitate the former Monastery located in east Maplewood into a residential and
service center for victims of domestic violence. As part of that effort, the City and Tubman were
required to enter into certain Agreements with one another as well as with the State of Minnesota.
In 2014 the Legislature authorized additional grant monies to Tubman for its Maplewood facility.
The First Amendment to Grant Agreement, the First Amendment to Ground Lease, and First
Amendment to Lease and Use Agreement are necessary to account for the additional $720,000
allocated to Tubman by Minnesota Laws of 2014, Ch. 294, Sec. 18, Subd. 6.
Discussion
These amendments are required by the State as part of the grant process and to account for the
additional monies provided. None of the original terms in the agreements or lease have changed,
materially.
Budgetary Impact
There will be no budgetary impact from these amendments.

THIS FIRST AMENDMENT TO GRANT AGREEMENT (“First Amendment”), is

RECITALS
A. The Public Entity and State Entity entered into that certain General Obligation

18, 2013 (“Grant Agreement”) under which the State Entity made and issued the G.O. Grant to
the Public Entity for the leasing of and improvements to the Tubman Facility.
B. The parties wish to amend certain terms and conditions of the Grant Agreement
according to the terms of the First Amendment.
C. All capitalized terms contained herein shall have the meanings provided in the
Grant Agreement, if not defined herein.
AGREEMENT
NOW THEREFORE, in consideration of the foregoing and other good and valuable

and State Entity hereby amend the Grant Agreement as follows:
1. Recital B. Recital B of the Grant Agreement is hereby stricken and restated in its
entirety as follows:
Under the provisions contained in Minnesota: Laws of 2012, Ch. 293, Sec. 18,
Subd. 3 (the “2012 GO Bonding Legislation”), the State of Minnesota has
allocated $2,000,000.00 (the “2012 G.O. Grant”) to the Public Entity. Under the
provisions contained in Minnesota: Laws of 2014, Ch. 294, Sec. 18, Subd. 6 (the
“2014 GO Bonding Legislation”), the State of Minnesota has allocated
$720,000.00 (the “2014 G.O. Grant”) to the Public Entity. The 2012 GO Bonding
Legislation and the 2014 GO Bonding Legislation are herein collectively referred
to as the “GO Bonding Legislation.” The 2012 G.O. Grant and the 2014 G.O.
Grant are herein collectively referred to as the “G.O. Grant.” The G.O. Grant is to
be given to the Public Entity as a grant to assist it in the renovation of the Facility
(described below), as authorized by such legislation; and
2. Source and Use of Funds. Attachment III of the Grant Agreement, describing the
source and use of funds for the project, is hereby replaced in its entirety by Attachment III
attached to this First Amendment.
3. American-Made Steel. Minnesota Laws 2014, Chapter 294, Article 2, Section 22,
requires public entities receiving an appropriation of public money for a project in that act to

ensure those facilities are built with American-made steel, to the extent practicable. The Public
Entity shall comply with this requirement, and shall furnish any documentation pursuant thereto

Laws of 2014, Ch. 294, Sec. 18, Subd. 6; and established by official action of the
City by Resolution 12-7-772A – “Resolution for the Establishment of a
Governmental Program In Conjunction with Tubman for the Administration of
the State Grant Awarded through the State Bonding Process for Improvements” –
is a grant of funds to modernize and improve the infrastructure in The Tubman
Facility (the “Governmental Program”), which shall achieve Landlord’s goal of
supporting Tubman’s programming. Landlord and Tenant acknowledge and
agree that the goal of the Governmental Program will be to maintain regionally
renowned shelter/short-term transitional housing for individuals experiencing
family violence (“Program Goal”) and that the success of The Tubman Facility
requires that Tenant have a safe and modern facility and it is the intent of the
parties hereto that Tenant shall be empowered to upgrade its existing facilities.
c. This Lease is being entered into in accordance with the provisions of
Minnesota: Laws of 2012, Ch. 293, Sec. 18, Subd. 3; Minnesota: Laws of 2014,
Ch. 294, Sec. 18, Subd. 6; and Minn. Stat. § 16A.695, and rules, regulations, and
orders issued pursuant thereto in order to carry out this public purpose.

2. Ground Lease. The second paragraph of Section 2 of the Lease and Use
Agreement is hereby stricken and replaced in its entirety by the following:
Tenant acknowledges that Landlord’s interest in the Premises is pursuant to that
certain fifty (50) year Ground Lease entered into on December 18, 2013 by and
between Tubman, as Ground Landlord, and Landlord, as Ground Lessee (the
“Original Ground Lease”), as amended by the First Amendment to Ground
Lease, of even date herewith. The Original Ground Lease and the First
Amendment to Ground Lease described above are herein collectively referred to
as the “Ground Lease.” Tenant also acknowledges that Landlord’s interest in the
Premises will be subject to the Grant Agreement and Declaration described in
Section 3 hereof. Tenant acknowledges that its rights in the Premises are subject
to the Ground Lease and the Grant Agreement and Declaration.
3. Grant Agreement. Section 3 of the Lease and Use Agreement is hereby stricken

Landlord and Tenant acknowledge that the costs of design and construction of
renovations on the Premises of the Tubman Facility Improvements (as defined
more fully in Section 21 of this Lease and generally described on the attached
Exhibit B, variously referred to herein as the “The Tubman Facility
Improvements” or the “Improvements”) will be funded, in part, through the
proceeds of a state grant in the aggregate amount of $2,720,000 (“State Grant
Proceeds”) from the State of Minnesota acting by and through the Department of
Administration on behalf of the Department of Human Services (the “State”).
The State Grant Proceeds have been provided to the Landlord pursuant to the
terms of a General Obligation Bond Proceeds Grant Agreement – End Grant for
the Tubman Facility Project, dated December 18, 2013 (the “Original Grant
Agreement”), as amended by the First Amendment to Grant Agreement, of even
date herewith. The Original Grant Agreement and the First Amendment to Grant
Agreement are herein collectively referred to as the “Grant Agreement.” The
Tubman Facility is “state bond financed property” as such term is defined in the
Grant Agreement and is subject to the General Obligation Bond Financed
Declaration recorded in the Office of the Ramsey County Registrar of Titles on
December 19, 2013 as Document No. 4437574 (the “Declaration”). All
capitalized terms that are not otherwise defined in this Lease shall have the

SUBJECT: Approval of Amendments to the Ordinance Regulating Cat and Dog Permits
Introduction
Cat and Dog Permits are issued through the Citizen Services Department and currently expire
on December 31st, even years. Past practice has been to assess owners a late penalty charge
of $1.00 after December 31st.
Background
Staff is proposing to update the Cat and Dog Ordinances as outlined in the attached draft
ordinance and to increase the late penalty charge to $5.00 for those not renewing by the
expiration date.
Budget Impact
None.
Recommendation
Staff is recommending Council approve the first reading of the proposed amendments
regulating the term, renewal, and late penalty charge for Cat and Dog Permits; Chapter 10,
Article IV, Division 2, Sec 10-278 (Term; renewal; late penalty charge) and Chapter 10, Article
III, Section 10-93 (Term) and waive the second reading. Staff is also recommending council
approve increasing the late penalty charge to $5.00 for those not renewing by the expiration
date.

Sec. 10-278. Term; renewal; late penalty charge.
The permit year under this division shall commence on March 1 of each year and
terminate on the last day of February of the following year. A new permit shall be obtained
each even year by every owner and a new fee paid. A permit, if not revoked, shall be valid
until the end of the permit yearperiod. Renewal permits must be obtained prior to March
1the expiration date, and there shall be a late penalty charge on all renewal permits issued
after April 1 of each yearthe expiration date.

Introduction
Each year the Maplewood City Council solicits requests for charitable gambling funds. Every
year the requests for funds have exceeded the available funds. That is the case this year. The
city received 24 applications with $67,207.50 in requests.
Background
The City Council reviewed the applications on September 22nd. Upon reviewing the
applications, the Council submitted recommendations for award amounts to staff to be tallied.
Staff has tallied the recommendations and has provided suggested award amounts for the
Council to consider. Any request that received four or more votes for $0 in awarded funds is
removed from consideration.
Budget Impact
The amount of funds available in the 2015 budget is $30,000.
Recommendation
Staff recommends that the City Council review and approve the suggested award amounts
below.
