CALL TO ORDER The Council /Manager meeting of the Maplewood City Council was - held in the Maplewood Room, City Hall. The meeting was called to order by Mayor Bastian at 5:44 p.m. B. APPROVAL OF AGENDA The following items were added to the agenda: L. Format For Future Meetings 1. Staff Recommendation for Single Family Home Setback 2. SIDEWALK AND BUS STOP PLOWING Director of Public Works Haider presented a report on possible alternatives for the plowing lowin of sidewalks and bus stops within the City including liability, financing, and on- g goin maintenance issues that accompany each alternative. City Attorney Kelly provided his legal opinion about the City's. responsibilities. for sidewalk. maintenance. Following considerable discussion about the two different means of providing pedestrian trails, sidewalks verses expanded roadways with marked shoulders, pp Council erson Za a moved that the Engineer be directed to investigate different p alternatives for the clearer of existing sidewalks and bus stops and different policies for the construction of future _pedestrian trails and bring this item back to the City Council for ;action. The motion was seconded by Mayor Bastian and approved. Ayes: All City Engineer Haider and City Attorney Kelly left the meeting at 6:20 p.m. E. REVIEW OF NON -UNION SALARY RANGES City Manager McGuire distributed information on the current salary ranges for non - union - employees. There was considerable discussion about the dollar value of total compensation packages, benefits, merit pay, longevity, wage freezes, and the proper time of the year to consider benefit changes. Staff stated that the appropriate time to discuss benefit changes was during the City Council's labor contract negotiating strategy sessions with City Manager McGuire and Human Resource Director Blackstone, which occur prior to the expiration of current contracts. F. UPDATE OF COMPARABLE WORTH PLAN AND COMPLIANCE City Manager McGuire and Director of Human Resources Blackstone reviewed the City's non - compliance determination from the Department of Employee Relations (DOER). They presented two adjustments to the plan which would bring the City's plan into compliance at this time. It was the consensus of the Council to adopt the revised plan with the two adjustments. G. EMPLOYEE COMPUTER PURCHASE PLAN City Manager McGuire presented information about a proposed employee computer purchase plan that was tabled from a previous meeting in 1992. After some discussion, it was the consensus of the City Council to take no action on the proposal,. Director of Human Resources Blackstone Left the meeting at 7:16 p.m. 2 H. I.S.D. 623 COOPERATIVE AGREEMENT City Manager McGuire presented information about a proposed agreement that representatives from I.S.D. 623 and the cities of Maplewood, Shoreview, and Roseville have negotiated. In return for a $250,000 investment, the School District will include the following items in the renovation of Edgerton Elementary School: an enlarged gym, enhanced locker rooms space, office and storage, and exclusive City use of these areas after school until midnight, weekends, and summer time. Commercial PAC funds would be used for this project which will provide a satellite mini- community center to residents on the west side of the City. Councilperson Zappa moved that the ON Council provide conceptual approval and directed staff to place this item on the March % meeting g The motion was seconded by Councilperson Carlson and approved) Ayes: All Ill HAZMAT UPDATE City Manger McGuire distributed information from Director of Emergency Management Larry Cude about hazardous materials spills in 1992 and a proposal for a Maplewood Hazmat Response Team with limited Fire Department participation. Following some discussion, it was the consensus of the City Council that a time extension be granted to staff for continued negotiations of an agreement that has the Fire Departments providing Level 1 and 2 responses and that the City contract with an outside agency to provide Level 3 and clean -up operations. There was also some discussion about the Public Safety Future Meeting, and staff was directed to include the Director of Public Safety, a police officer, Fire Marshal, the three Fire Chiefs*, three volunteer fire fighters, Director of Emergency Management, the City Council and possibly a facilitator. J. DIVERSITY TRAINING Mayor Bastian stated that he would like to have the City Council participate in a cultural diversity training program possibly with the Human. Relations Commission. Staff was directed to research existing programs for their participation. K. 1993 COUNCIUSTAFF WORKSHOP City Manager McGuire asked the Council for their interest in a 1993 Council /staff Workshop. It was the consensus of the Council that the City Manager and the City Councilmembers make a list of the topics that should be covered in a one day workshop and schedule it for the summer, 1993. 3 L. FORMAT FOR FUTURE MEETINGS - LENGTH AND .NUMBER PER MONTH Due to the late hour, discussion of meeting formats was postponed. 1. Staff Recommendation for Single Family Home Setback This item was not discussed. 2. Meeting with AKR City Manager McGuire requested that the City Council schedule a meeting with representatives from AKR to review final design development plans for the community center. Mayor Bastian moved that the City Council meet with AKR on Thursday, March 4, 1993 from 4:00 to 5•_00 p.m. followed b the pre-agenda from 5:00 to 5:30 p.m. and the special public hearing for Maple Wood Estates at 6:00 p.m. The motion was seconded by Councilperson Rossbach and approved. .4 Ayes: All City Manager McGuire asked the City Council for their thoughts about .the City sending. a police sergeant to the FBI Academy for training. It was the consensus of the Council that this was an acceptable form of City- sponsored training and that the City Manager should investigate the possibility of requiring the employee to stay in the employ of the City for a minimum of three years after the training is completed. Tax Increment Transfer Authorized a transfer of $288,535 from the Tax Increment Fund to the Park Development Fund as reimbursement for expenses that are financed by tax increment revenues, and approved the appropriate budget adjustments. 5. Carryover of Appropriation for Insurance Deductible from 1992 to 1993 Authorized a budget carryover from 1992 to 1993 of the X200,000 appropriation to finance claims below the City's insurance deductible (and which was unused in 1992). 6. Zappa introduced the following_ Resolution and moved its adoption: W 93 -02 -16 ORDERING ASSESSMENT ROLL HEARING WHEREAS, the Clerk and the Engineer have, at the direction of the Council, prepared an assessment roll for the construction of Southlawn Avenue, Beam Avenue to County Road D. City Project 85 -17, and the said assessment is on file i n the office of the City Clerk. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA: 1. A hearing shall be held on the 22nd day of March, 1993, at the City Hall at 7:30 p.m. to pass upon such proposed assessment and at such time and place all persons owning property affected by such improvement will be given an opportunity to be heard with reference to such assessment. 2. The city Clerk is hereby directed to cause a notice of the hearing on the proposed assessment to be published in the official -newspaper,,at least two weeks prior to the hearing, and to mail notices to the Owners of all property affected by said assessment. 3. The notice of hearing shall state the date, time and place of hearing, the general nature of the improvement, the area to be assessed, that the proposed assessment roll is on file with the Clerk and that written or oral objections will be considered. Mr. Leonard stated he would contact North St. Paul as to no parking on County Road C from Ariel to Highway 120 as requested by Council. d. Councilmember Zappa introduced the following Resolutions and moved their adoption so.long as there is no deviation from the lass as approved at t h i s meeting. • 92 -02 -17 APPROVING AMENDED COOPERATIVE AGREEMENT NUMBER 92016A FOR RECONSTRUCTION OF COUNTY ROAD C WHEREAS, Ramsey County has presented amended Cooperative Agreement Number 92016A for the reconstruction of County Road C. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, that the Mayor and City Manager are directed to execute said amended Cooperative Agreement Number 92016A. 93 - 02 - 18 APPROPRIATION OF MUNICIPAL STATE AID STREET FUNDS S.A.P.NO. 138 - 010 -05 WHEREAS, it has been deemed advisable and necessary for the City of Maplewood, Min.nesota to participate in the cost of a construction project located on Trunk Highway 61 within. the limits of said municipality, and WHEREAS, said construction project has been approved by the Commissioner of Transportation and identified in his records as S.A.P. No. 138- 010 -050 NOW, THEREFORE, BE IT RESOLVED: That we do hereby appropriate from Qur Municipal State Aid Street Funds the sum of $45,000 (estimated) to apply toward the construction of said project and request the Commissioner of Transportation to approve this authorization.. 93 -02- 19 APPROPRIATION OF MUNICIPAL STATE AID STREET FUNDS S.A.P. No. 138 - 010 -050 NOW, THEREFORE, BE IT RESOLVED: That we do hereby appropriate from our Municipal State Aid Street Funds the sum of 5420,000 (estimated) to apply toward the construction of said project and request the Commissioner of Transportation to approve this authorization. 93 - 02 - 20 REQUEST FOR MINNESOTA DEPARTMENT OF TRANSPORTATION TO PARTICIPATE IN FUNDING WHEREAS, Ramsey County has caused to be prepared plans for the reconstruction of County Road C and portions of the T.H. 61 right of way within the City of Maplewood, and WHEREAS, it is deemed appropriate for the Minnesota Department of Transportation to fund portions of the cost of the proposed Park and Ride facility, signal renovations., storm sewer, bridge and frontage road: NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, that the Minnesota Department of Transportation if requested to participate in the funding of S.A.P. 62- 623 -34 and S.A.P. 62- 623 -35. 2 -22 -93 6 93 -02 -21 PLAN APPROVAL WHEREAS, plans for Project No. 62- 623 -36 showing proposed alignment, profiles, grades and cross - sections for the construction, reconstruction or improvement of County State -Aid Highway No. 23 within the limits of the City as a State Aid project have been prepared and presented to the City. Council Zappa stated he would like to see an amendment to the Setback Ordinance to include letters of awareness from the neighbors of property owners who are requesting a setback variance. b. The objective is to have the pay rates for all temporary and part -time employees set at one time in one resolution. BACKGROUND Past policy has set the minimum pay rate for each position to be the amount specified under minimum wage law. It is proposed that this policy be continued. The current minimum wage rate is $4.25 per hour. It is proposed that the maximum pay rates for each position be increased by 2 -1/2% and a minimum of $.15 per hour effective March 1, 1993, with the following exceptions. For the Secretary, Administrative Assistant, Accounting Clerk, and Clerk - Typist positions, the maximum is equivalent to the starting pay rate for a full -time regular employee. In addition, we have added the classifications of Video Coordinator and Video Technician, since SCC will no longer be providing this service. RECOMMENDATION Adoption of the attached resolution is recommended. tmc Attachment RESOLUTION WHEREAS, according to the Minnesota Public Employees Labor Relations Act, part -time employees who do not work more than 14 hours per week and temporary employees who do not work in excess of 67 days in a calendar year are not covered by union contract wage rates. Adopt the resolution on page 16. This resolution approves a conditional use permit to add onto the Nature Center. The Permit is based on the standards required by code and is subject to the following conditions: 1. All construction shall follow the site plan that the City stamped November 25, 1992. The Director, of Community Development may approve minor changes. (Code requirement) 2. The proposed construction must be started within one year or this permit shall become void. The Council may extend this deadline for one year. (Code requirement) 3. The City Council shall not review this permit again unless a problem develops or a time extension is needed. 4. The addition shall be at least 80% screened from the house to the east. (Code requirement) B. Approve the building design plans date - stamped November 25, 1992 for a 1,400 - square -foot addition onto the Maplewood Nature Center. Pa CITIZENS' COMMENTS I surveyed the owners of the twenty properties within 350 feet of the nature center. Eight owners replied. One had no comment and seven objected. We received the following comments from residents: (The Director of Parks and Recreation has responded to the residents' concerns on page 14. I have added comments from other staff members below.) �r 1. a. Some of the neighbors south of Brand Street have storm water ponding in their yards. Fix this problem first. Staff comments: The City Engineer said that some of the homes along Brand Street have a long - standing, unresolved drainage problem. The proposed addition would not effect their drainage. b. People sometimes park in the Nature Center parking lot after the bars close to drink and raise hell. They throw beer cans out that end up in my yard. Put a stop to this. The police should patrol this area more at night. Staff comments: Police Chief Collins said he will have the Nature Center parking lot patrolled more often. C. Don't spend money on this addition. Spend the money instead in needed areas. This is not needed. (anonymous resident on 7th Street) 2. The building they have now is big enough for their needs. It should stay the same as it is now. No changes. (Roeske, 2600 Brand Street) 3. It's time you people stop spending our money. The buck stops here. Enough is enough with taxes. You're killing me. A few years ago we asked for a permit to build alive -foot air lock over our front door. We were told NO. It would be out of line with the other houses. Yet Mr. Pilla (910 Ferndale St.) was allowed to build on the corner of Ferndale and Brand. That house is really out of Line. Fair? (Block, 2694 Brand Street) Staff comments: Captain Cahanes, of the Maplewood Police Department, said that there have not been any reports of persons endangering others in the Nature Center since the City fenced it. Odegard, Director of Parks & Recreation Subj: Addition To Maplewood Nature Center, 2 659 Eas • t 7th Street Date: October 19, 1992 Introduction The Park and Recreation Commission and staff have discussed for years the overcrowded conditions at the Maplewood Nature Center. With the continued interest in nature and the environment, more people are attending classes and using the center. It is re- quested that the City Council approve proceeding with the a re - rat of bids and specif ications p P p fications for an addition to the nature center building. Background The nature center has been in an operation as interpretive P p ive and environmental education center since approximately 1979. In the early days of its educational endeavors, the city was closely associ Y ated with Independent School District 1622. to offer classes to the school district. With budgetary considerations, the Com- munity Education Department made a decision to no longer provide . funds for the nature center nor the busing of students from their schools to the nature center. This created a major change in our programming. As a result, we found ourselves reachin g far more people and providing many more classes to the public than we ever experienced under the previous format. Our present staff of one full -time naturalist, two permanent art -time naturalists, p lists, and a permanent part - time clerk - typist have expanded our programs to provide activities that are much broader in scope. Through the budget process, we have been able to expand our number of hours Of service to the community with offerings in the sp ring, p g' summer and f all on Saturdays and Sundays. The number of people who are coming to the nature center for bird watching, ature walks, alks, quiet and meditation, and observance of our indoor exhibits has increased immensely. Although the area for the receptionist is very small we feel it is important p to have someone near the entryway to meet eo le and direct them to activities p s i.n the center, as well as to outdoor activities. It is felt that by having a second assroom we will be able to expand our educational offerings, oth durin the da g.� n g y and even in gs. The new classroom area will have a sink, mange, and small refrigerator that will be used during presentations and a .eri- iaents. The space will � p be available for use by groups when it is not in need for evening classes by the nature center staff. The nature center is dependent upon volunteers for additional help with its classes and this classroom will provide a space for working with volunteers. The attached architect plans are for the first phase of the design development, which is allowing s to design the g g addition and obtain design approval from the staff and City Council and was accomplished at a budget of $2, 600*00. Please refer to your Comment Sheet, l a. While I sympathize with people who have storm water problems in their yards, I do not feel that this is caused by the Na- ture Center, nor affects the expansion of the Nature Center. b. I think the writer of this comment indicated the answer in that there should be closer police patrol of this area. Beer cans in front yards are not caused by the Nature Cen- ter. If people were drinking in the parking lot, they would be more likely to throw the cans in the Nature Center lot than carry them down the street and throw them in some - one'.s front yard. I live on a residential street and pick up beer cans in my front yard that probably come from par- ties in the neighborhood. c. I think it is important that people realize that their prop- erty tax dollars are not being used for this improvement. It is being financed through Commercial PAC monies and Tax Increment Funds. 2. The attendance at the Maplewood Nature Center, which has . been kept over the past ten years, indicates that use of the building has increased from 10,177 in 1981 to 21,179 in 1990. While we have seen continued growth in our School Programs, Youth Programs, Community Programs, Public Pro - grams and building attendance, we feel there is a justified need for an addition to the Nature Center. Present staff offices are in a small storage room and require additional space. With the growth in the programming, and especially in the schools that now come in larger passenger buses (60 passengers vs 40 passengers), we need additional class- room area. 3. This is again a need to help people understand that we are not spending their property tax dollars, but we are funding this addition from Commercial PAC monies, as well as Tax Increment Funds, 14 Attachment 6 4. While there may be serious proplems throughout the city, there is also a serious problem at the Nature Center in pro- viding adequate space for staff and providing service in the way of Nature Programs for our citizens_. The addition is approximately 1400 square feet. I think we have responded to these concerns. We do not anticipate additional salaries or costs of staff, other than those programs which in turn would be covered by fees. To the best of.our knowledge, we have not had any reports of people being attacked or being antagonized by others using the Nature Center. We would encourage anyone who has ex perienced any kind of disruption in their enjoyment of the Nature Center to contact our office and to immediately re- port it to our Police Department. 15 CONDITIONAL USE PERMIT RESOLU110N WHEREAS, the City of Maplewood applied for a conditional use permit to construct a 1,404- square -foot addition onto the Maplewood Nature Center., WHEREAS, City Code requires a conditional use permit for a public building. WHEREAS, City Code requires a conditional use permit to build this addition within 50 feet of the side lot line. WHEREAS, this addition would be forty feet from the side lot line. WHEREAS, this permit applies to 2659 East Seventh Street. The legal description is: Lot 18, Block 4, Midvale Acres WHEREAS, the history of this conditional use permit is as follows: 1. On February 16, 1993, the Planning Commission recommended that the City Council I this permit. 2. The City Council held a public hearing on 1 1993. The City staff published a notice in the official newspaper and sent notices to the surrounding property owners. The Council considered reports from the City staff and Planning Commission. NOW, THEREFORE, BE IT RESOLVED that the City Council approve the above - described conditional use permit, because: 1. The use would be located, designed, maintained, constructed and operated to be in conformity with the City's Comprehensive Plan and Code of Ordinances. 2. The use would not change the existing or planned character of the surrounding area. 3. The use would not depreciate property values. 4. A conditional use permit (CUP) for a storage yard. Mr. Monette would use the storage for materials such as lumber, masonry, steel and miscellaneous equipment. (Refer to Mr. Monette's statement on page 13.) 246 Building plans. The proposed building would have vinyl horizontal lap siding and asphalt shingles. Mr. Monette has not picked a color for the siding. He proposes to pave a driveway, six -car parking lot and a short drive on the north side of the building. Mr. Monette plans to seed the yard on the east side of the building. The storage yard would be unpaved. Mr.. Monette would enclose the storage yard with a fence. BACKGROUND Mr. Monette's business is currently at 2050 White Bear Avenue. The City purchased his building. The City plans to demolish the building and use the land for the Community Center site. DISCUSSION Outside Storage If Mr. Monette builds a screening fence along the south, east and north sides of the storage yard, it would meet the criteria for a CUP. The storage yard would be compatible with the surrounding uses. There is already a storage yard to the west. The proposed building and fencing would screen the yard from adjacent uses. The Department of Natural Resources (DNR) requested a solid wood fence along the north line and an earth -tone color on the building. The fence would supplement the tree buffer and improve the view from the trail. This fence should be eight - feet -tall, because the trail is higher than the storage yard. No Truck Traffic Sign Posting The City has posted Atlantic Street to prohibit truck traffic. The City Council required this sign at the request of the previous owner of 1940 Atlantic Street. At that time, Blake Excavating was driving trucks on Atlantic Street. Mr. Monette's building and yard would prevent Mr. Blake from using Atlantic Street. The current owner of 1940 Atlantic Street (Mr. Breheim) objects to Mr. Monette's business and the use of Atlantic Street for trucks. (See Mr. Breheim's letter on page 14.) Mr. Monette told me that his truck traffic would consist of two pickup trucks (the larger one is one -ton rated), occasional deliveries by truck and a few semi -truck deliveries each-year. The Director of Public . works said that this traffic would have little effect on the street. To assure the owner of 1940 Atlantic Street, the City should limit the truck traffic with the conditional use permit. SUMMARY On the positive side, Mr. Monette's plan will improve the appearance of this property. an the negative side, traffic would increase on Atlantic Street. The only property that the traffic would effect is 1940 Atlantic Street. The benefits from Mr. Monette cleaning up and improving his site outweigh the slight increase in traffic. RECOMMENDATION A. Adopt the resolution on page 15. This resolution approves a conditional use permit for outside storage at the southwest corner of Atlantic Street and the DNR trail. Approval of the permit is based on the findings required by Code and is subject to the following conditions: 1. All construction shall follow the site plan that the City stamped December 24, 1992. The Director of Community Development may approve minor changes. 2. The proposed construction must be substantially started or the proposed use utilized within one year of Council approval or the permit shall become null and void. The Council may extend this deadline for one year. 3. Truck traffic shall be limited to pickup trucks, delivery vans and no more than four semi -truck deliveries each year. 4. The City Council shall review this permit in one year. K B. Approve the plans stamped December 24, 1992 for Monette Construction Company, Inc. Tom Monette shall do the following: 1. Repeat this review in two years if the City has not issued a building permit for this project. 2. Replace property irons that are removed because of this construction. 3. Provide one handicap- parking space and install a handicap- parking sign that complies with the Americans with Disabilities Act. 4. Construct a trash dumpster enclosure as City Code requires for outside trash storage, unless the Community Design Review Board waives this requirement. The enclosure shall be large enough to hold all dum P sters planned for the site. The enclosure must match the color of the building and have a closeable gate. 5. Sod, rather than seed, the yards on the south, east and north sides of the building. 6. Install an in- ground sprinkler system for all lawn and landscaped areas as the Code requires. 7. Make the building color an earth tone, subject to staff approval. 8. Install site security lighting as the Code requires. 9. Screen the site as follows: a. Build an eight- foot -tall, decorative wood screening fence along the north side of the outside storage yard. b. Build a screening fence along the south and east sides of the storage yard. The fence along the south side shall run from at least the east end of the storage yard to the point where the fence angles north around the existing metal building. C. I The screening fences shall meet the requirements of City Code. d.. The applicant shall submit fencing and landscaping plans to the Community Design Review Board for approval. 10: Erect temporary fencing around the existing trees before doing any grading. 3 11. Drain all stormwater runoff from impervious surfaces to an underground, on -site stormwater collection system that is connected to a public stonnwater item. 12. Submit a cash escrow or an irrevocable letter of credit to the City for any required work that is not completed by occupancy. The required escrow amount shall be 150% of the cost of the hed work. Tom Monette shall give Staff an agreement that will allow the City to complete any wished work. C. Direct the Public Works Department to remove the sign that prohibits truck traffic on Atlantic Street, south of Frost Avenue. 4 CITIZENS' COMMENTS I surveyed the 60 property owners within 350 feet of the proposed site. Twenty -eight owners replied. Fourteen were in favor and fourteen objected. In Favor 1. In favor, but concrete block with a decorative front would be more eye appealing. (homeowner, 1955 English Street) 2. It will clean up the area as of now that parcel is mounds of dirt and rubble with weeds growing. (Hirsch and Woth, 1217 Frost Avenue) 3. The Minnesota of Natural Resources is in favor, but asks that Mr. Monette do the following: a. Cleanup and fence the property line. b. Make the new building an earth -tone color. C. Install a privacy fence along the north lot line. 4. OK as depicted. Suggest privacy fence to screen the storage area from the state trail. The rear of the businesses in that area are real eyesores. Blakes in particular. (Herron 1106 Ryan Avenue E.) 5. This would put vacant land to good use. I suggest a high wooden fence around the storage area. (Comford, 77 E. Stevens, St. Paul) Opposed 1. The permit required that one truck be Y removed by November 1, 1991. This was done. The permit also required that Mr. Laura ' Launderville build a garage to store the tow tr ucks. He did this. A condition of the CUP and license was that the would Y end on November 1, 1992 Mr. Laun derville had planned to move to another conditions r location. (Refer to the ltions on page 8.) November 5, 1991: The City staff approved afour -foot front setback variance for this lot. The variance allowed Mr. Launderville to build a garage addition. The City required this garage as a CUP condition. The City issued a building permit for the garage addition on November 18, 1991. February 24, 1992: The Council continued the license and CUP until May 2 19 2. The Council wanted to review because Y 9 the permit again Mr. Launderville finished the garage o had not g g r removed a storage shed as required. May 11 1992: The Council again reviewed the license and CUP Mr. Launde .. Y had. met all the conditions, except completing the g arag e. The Council decided ' g g ed to r ev i ew the license and CUP again on June 8, 1992. June 8, 1992 The City Council reviewed the license and CUP ag ain. Mr. Lau g nderville was meeting all the required conditions, including garage. ncludin the e. g November 1, 1992: The license and CUP expired. DISCUSSION Need for a License and Permit The Laundervilles believe they do not need a CUP because their trucks were a legal use when they started their business in 1980. The Cit ode allows a lawful wful use to continue if the City changes the Code. In 1980, the Cit ode allowed resid ents to park commercial trucks on their property, if the trucks were in a garage. Mr. Laun ' g g der s i trucks were not n a garage and were, therefore not legal. Since Mr. ' g Laundervvllle did not have a lawful use in 1980, he must comply with the current ordinance. P Y Compliance with Current Standards The tow truck would meet the standards for a CUP. The business has become more compatible with the neighborhood. When Mr. Launderville started his busi In 1980, he had two tow trucks stored outside. He now has one truck stored in a garage. He no longer runs the business from his home. The only ffect on then neighborhood elghborhood is the occasional coning and going of one truck. This causes no mor re noise or traffic than the other people on the block who drive to and from work. Neighborhood opinion Most of the neighbors are now for Mr. Launderville's business. The number has increased since our 1990 survey. Seven neighbors are now for g his requests and three are against. In 1990 six neighbors we re far the requests and eight were against. RECOMMENDATIONS Adopt the resolution on page 11. This resolution approves a conditional nditronal use permit to store one one -ton tow truck at 2194 Van Dyke Street. In addition to the standards required by the Code, we are recom aendin that the Council ouncil approve the permit for the following reasons: 2 1. The truck is parked in a garage. 2. The truck would not increase the traffic or noise in the neighborhood. The resolution includes the following conditions: 1. The tow truck shall be parked in the garage when it is on the property. 2. Mr. Launderville shall not store towed vehicles on this site, unless he or his family own the vehicles. 3. There shall be no outdoor storage of junk or inoperable vehicles or vehicle parts on the property. 4. There shall be no storage or repair of vehicles on the site, except those owned by people living on the property. 5. There shall be no overnight parking of vehicles an Van Dyke Street. (City Code requirement.) 6. The City Council shall review this permit in one year to make sure that the conditions are being met. 3 NEIGHBORHOOD SURVEY We asked the surrounding property owners for their opinion. We sent surveys to the property owners within 350 feet of the Launderville's property. Out of 22 properties, we received twelve replies. Seven replies were for the requests, two had no comment and three were against the requests. Those people for the requests had the following comments: 1. It is his right to have the truck close to him. (Everson - Copperas, Texas) 2. I have not had any problem in the past with Ronald Launderville parking his truck at his home. (Steward - 2210 Van Dyke Street) 3. Let him have his vehicle at home for convenience. It is usually off the street and not hurting anyone, it is his livelihood. (Ryan - 2230 Van Dyke Street) �. As long as the permit is limited to one tow truck and not other wrecked cars and the property is maintained in good appearance, we have no objection. We are against this permit request because nothing much has changed since his last permit request two years ago. Most of the time, we still see two tow trucks operating from Launderville's place during the day. Repairs are being done in the driveway and on the street at times. Sandhurst is still cluttered u p with all kinds of vehicles including a school bus. We do not see any willingness of compliance on Launderville's part. We wish to have our residential zone status upheld, let his business go to where it belongs, a business -zoned area. (Riechert - 2172 Van Dyke Street) 2. We are definitely not in favor of Mr. Launderville's application for the following reasons: 1. I cannot believe the City would even consider such a request considering the meeting last year when Mr. Launderville presented an Earnest Money Contract representing to all that he was buying property to operate his business. I believed then that this was just a ploy to get everyone to believe he was sincere. he did not - intend then to move and the pending application confirms my beliefs. 2. I believe that Mr. Launderville constructed a garage on the property with the intent to continue his business operation at his residence. 3. Why does the City have planning and zoning restrictions, if they are not goia� be enforced in appropriate cases? I believe the City has residential and business zoning for the purpose of giving homeowners privacy and keeping the value of their homes and enjoying the quality of life a residential area is intended to provide. I object to giving Mr. Launderville an extension because in another year Mr. Launderv will be submitting arequest for yet another extension or for some other special benefit. This is a fact demonstrated by his many requests in the past with the City and community. Give him this and he will just want more. BACKGROUND Code Requirement Section 36 -27(b) (3) states the following: Except for mobile homes, town houses, single and double dwellings, all mechanical equipment on the ground or roof shall be screened on all sides so as not to be visible from public streets or adjoining property. Such screening shall be designed and constructed of a material(s) that is compatible with the principal building and subject to Community Design Review Board approval. Other Cities I surveyed nineteen suburbs to find out what they require for screening mechanical equipment. Fifteen required that businesses screen their roof equipment. Refer to the survey results on page 3. ALTERNATIVES 1. Do not require screening, but require that mechanical equipment be painted to match the building color. 2. Require a roof design that will hide the equipment without using screens. 3. Require screening, but allow the Community Design Review Board to waive this requirement where screening would not improve a building's appearance or protect surrounding property values. Roof equipment that is not screened must be painted. 4. Make no changes. Continue to require roof- screening in all cases. DISCUSSION Usually, screening mechanical equipment improves the appearance of buildings. Good examples are Red Lobster, Chili's, Maplewood East and the Aspen Medical Grou p at 1.850 Beam Avenue. Most cities we surveyed require this screening. Roof- screening can be a problem: 1. Poorly designed or unpainted screens can look worse than the mechanical equipment. The Maplewood office Park on Kennard Street and Beam Avenue is an example. The brown- painted mechanical units were less noticeable than the wooden screens. These screens would look better if the owner had them painted dark brown to match the building. 2. Screens need maintenance. Damaged screens hurt a building's appearance. 3. Roof- mounted screens may create _a roof leak if the fasteners puncture the roof. A puncture may void a roof warranty. Contractors usually weight their screens in place or attach them to the mechanical equipment, rather than permanently fastening them to the roof. We are not aware of any building that has had a roof leak because of roof screening. The Council should change the ordinance to allow the Community Design Review Board to waive the screening requirement where it is not needed. An example is where the equipment is only partially visible or small compared to the building size. In this situation, screens may be more noticeable than the equipment. If the City does not require screening, the City should require that the building owner paint the mechanical equipment to match the building. Even if equipment is screened, the City should require that the building owner paint the equipment to match the screen color. The screen, in turn, should match one of the building colors. Mechanical equipment is often visible through openings in or over the top of screens. The total available funding is $200,000 with a maximum individual grant amount of $1 0,000. Background Maplewood has been somewhat active in controlling excessive I /I. Over the years, spot repairs of leaking sewer pipes have been made. A recent example of a city I/I project is the District 22 improvements north of County Road C. The work for this project consisted of lining the existing pipes and sealing manholes. This project and others reduce the billings from the MWCC for treating sewage. As part of a continuing effort to eliminate excessive I/I the Engineering and Utility Divisions planned some activities this year. We now have the opportunity to obtain a matching grant up to $10,000. Using available personnel smoke testing of certain areas is planned. This test method is fairly common. Smoke is used to identify illegal connections. Colored smoke is forced into the sewer pipes by a fan. If a backyard catch basin, roof drain, or other illegal connection exists the colored smoke will come out the connection. This is usually a very cost - effective method used to identify rain water entering the sanitary sewer, thus driving up the treatment charge. The other planned activity is actual home by home inspection to determine whether or not sump pumps are connected to the sanitary sewer. Only certain areas would be inspected. The information gathered would give some indication whether or not this is a large problem in Maplewood. In addition, those illegal connections would be removed thus lowering the treatment cost. DESCRIPTION The Metropolitan Waste Control Commission is offering a limited number of grants up to $10,000.00 to communities served by the MWCC for community sponsored projects to reduce excessive infiltration and inflow (I/I) from entering the Metropolitan Disposal System (MDS). Each grant will require a matching dollar expenditure on the project from the recipient community. The grant eligible work must be completed within one year after the date of agreement. The total amount allocated for grants is $200,000.00. There are no funds allocated for continuation of this grant offer once the $200.,000.00 has been committed. If the number of applications received through the initial offer is insufficient to encumber $200,000.00, the Commission reserves the right to offer to raise the $10,000.00 grant ceiling to the initial qualifying applicants. All communities that discharge wastewater to the MDS are eligible to apply. Applications will be reviewed by the MWCC staff who will make a recommendation to the MWCC Board of Commissioners on the priority of the proposed project. The application procedure and the staff's criteria for priority classes Ior I/I Control Projects are outlined herein. The MWCC Board of Commissioners will review the staff's recommendations and establish the final list of grant recipients through official Board action. Recipient communities will be required to enter into an agreement, with the Commission, authorized by resolution of their City Council or Township Board. (The word "City" used hereafter includes eligible Townships.) The City's requirements, under the agreement, will include that the City provide assurances that the funds are applied to the stated purpose, that the project is cost - effective that costs be accurately accounted, and that a written report be submitted to the MWCC upon completion of the work. The agreement will also provide the MWCC the right to audit City records pertaining to the grant funds and matching local share. The goal of this grant offer is to assist communities to implement I /Icontrol improvements which provide a metropolitan benefit in addition to the local benefit. Because the funds are limited for this offer, the MWCC places a reater priority physical g p Y on P y improvements over desk -top studies. This means that communities that already have an understanding of where problems exist and how they can be corrected will be in a better position to justify their proposal. The MWCC also intends that the administration of these grant agreements be streamlined concomitant with the limited grant amount and the one -time nature of the offer. -1- II. GENERAL CRITERIA FOR FUNDING PRIORITIES Proposed projects will be evaluated by the MWCC staff who will make a recommendation on the priority classificat of the project. Within a priority class, projects will be ordered, based on the date when a completed application was received by the MWCC. The MWCC staff will prepare a recommended priority list for consideration by the MWCC Board of Commissioners. Projects targeted to produce , a metropolitan benefit will receive higher priority than those where a metropolitan benefit is unlikely. Elimination of a sewage bypass resulting from I/ would be an example of a project with metropolitan benef it, both for the reduction of a health hazard and the risk of the MWCC losing 9 federal 1 and state assistance for construction of treatment . .facilities.. Another example of metropolitan benefit is a project high peak flow rates, resulting from P desi ed to reduce hi I /I. The recent "Systemwide Infiltration /Inflow Evaluation" by the MWCC is one source of information on communities where above peak flow rates are estimated to be above avers e. Communities may also submit their own information demonstrating high peak flow rates. Projects designed to immediately remove I/I will receive priority over projects designed only to analyze the source of I/I problems. Grant recipients will need to demonstrate that the y Y alread have an , understanding of the source of the I/I and how it can be reduced. Peak rates of inflow have a greater imp act on metropolitan P p wastewater facilities than the long term average rate g roundwater infiltration. Therefore, projects designed to immediately reduc p eak g Y e p rates of inflow will receive higher priority than those designed to eliminate the average rate of groundwater infiltration. Great priority will be assigned to projects that are comprehensive in scope, or involve a substantial effort b , y the community. For example, implementation of a community -wide sump pump inspection and disconnection program would receive priority over a project to repair several leaky sewer lids. Attach supplemental information to describe the I/I problem, the details of the proposed project, and how the project meets the priority criteria of this grant offer and other pertinent information as requested on the application form. Applications must be post - marked no later than May 1, 19930 IV. GRANT OFFERS Grant offers will be made approximately in the third week in June, 1993. A written grant offer will be sent-to each qualifying Y g community which will contain the grant agreement lan a e. Actual award of a g • grant will be contingent upon City Council action authorizing the grant agreement between the MWCC and City, -3- V. GRANT AWARD AND PAYMENTS Upon receipt of the grant agreement authorized by City Council action and executed by the City, the MWCC will issue payment to the City of 75 percent of the grant. Issuance of the balance of the MWCC share of the grant will be contingent upon (1) submittal of documentation of project expenditures showing the MWCC plus City share totals is equal or greater than 2 times the grant amount, and (2) submittal of a written report to the MWCC describing the work that was performed under the grant.'- If thetotal project cost is greater than 1.5 and less than 2 times the grant amount, the MWCC will reduce the grant amount to match the City share. . If the project costs less than the initial 75 percent grant amount plus a matching City dollar amount, the City shall refund to the MWCC the portion of the grant amount that was not matched by City Y funds The refund to the MWCC shall be made by the date specified in the grant agreement. The grant agreement will provide the MWCC the right to audit City records pertaining to the grant funds and matching local share. VI. There are two parties that are interested in purchasing the lot from the City. The purpose of this report is to obtain the Council's thoughts about the sale of the lot and further direction on the next step. BACKGROUND The City was recently contacted by the new residents at 1646 Burke Avenue. When they purchased their home, they understood that their property included Lots 1, 2, and 3. Further research revealed that the City owns Lot 1, the westerly lot between their home and John Glenn School property. The new residents at 1646 have asked the City to sell them Lot 1, and they are anxious for the City to make that decision. Staff contacted Independent School District 622 to see if they had an interest in the lot. The Director of Business Affairs has told us that they are interested in the parcel, also. The next step in the process would be to obtain an appraisal of the property and continue negotiations with the two interested parties. We will proceed with this project if the Council is interested in selling the property. RECOMMENDATION It is recommended that the City Council provide staff with their comments about the sale of the property. Request to replace Canine DATE: March 3, 1993 Introduction Because of an unknown medical .problem off ices John Banick's canine partner, Kodiak, had be put to sl ee.p on January 29, 1993. This left a vacancy in our canine unit, and we are requesting to fill that vacancy. Background The Maplewood Police Department formed its canine unit in 1977 when the.first officer /dog team was trained. Two other canine teams were added in 1984 and 1985. The first trained canine team was retired in 1987 and replaced in 1988. Our canine unit remained at three teams until September of 1992 when the second canine was retired, and the decision was made not to replace it and to reduce our number of canine units to two. The canine units are a very valuable .part of our police department. Their bas duties are searching, tracking, apprehension, and cr ime deterrence through the psychological effect of their presence. Hundreds of hours of personnel time have been saved through the use of the canines. Because of it's olfactory a b i l i t i e s , the highly trained dog is able to locate a hidden individual, evidence, or drugs in far shorter time than it would take team of four or more officers. In addition to the law enforcement duties, the canine teams are an effective tool A n the promotion of positive community relations in their contacts with schools, civic groups and the .public at large. Two canine units g ive us complete nighttime patrol coverage, and greater flexibility in making these assignments. Date MEMMOUNWaft Several issues came up at the March 4 hearing on the Maplewood Estates Second Addition, THE 1969 PUD The City Council asked the City Attorney to research the current status of the 196 planned unit development (PUD). The Attorney checked the past records, including the Council minutes. The Council approved the PUD on May 15, 1969. The PUD was approved as a phased development, with five phases. This was documented in a memorandum from the Director of Planning to the Planning Conunission, dated July 31, 1970. One of the PUD conditions states that the PUD would become null and void if more than twelve months expired between construction phases. The City issued the last occupancy permit in 1973. Therefore, the PUD for the remaining undeveloped grope expired in 1974. The City Attorney's opinion is that the PUD for the developed hase is still valid..:. P ed p SURFACE DRAINAGE FROM NO RTH ST. PAUL The Maplewood City Engineer called the North St. Paul City Engineer about reported drainage problems. To the best of the North St. Paul engineer's knowledge, there have been no reports of surface drainage problems in the area. We specifically discussed the catch basin and ditch at the corner of Ripley Avenue and Mary Jo Lane. There have been no reports or problems at this location. SCHOOL BUSES ON STEItIdNG STET I stated at the meeting that school buses do not re its poor condition. I based this statement on the attached letter fr m school dist of One of the residents stated that my statement was not accurate. mct. ERRORS IN THE STAFF REPORT Several neighbors testified about errors in the staff report. I have been able to confirm two errors. Neither error affects the recommendations. 1, Page 9 of the staff report states that the- Open Space Committee ranked this site 19 out of 66 sites. This is not correct. At the time of the staff report, the Committee had ranked this site fourth. Their latest ranking shows this site tied the second phase of the Oak Ridge developments for third place with 2.
