A. CALL TO ORDER
The Council /Manager meeting of the Maplewood City Council: was held in the
Maplewood Room, City Hall. The meeting was called to order by Mayor Bastian at
5:30 p.m.

D. SETTLEMENT OF PENDING LAWSUIT
Councilmember Zappa moved to enter into a Closed Session to discuss settlement of
a pe_ ding lawsuit. Seconded by Mayor Bastian and approved.

Mayor Bastian reconvened the meeting at 6:51 p.m. Councilperson Carlson moved to
recess for a short dinner break. The motion was seconded by Mayor Bastian and
approved.

E. HAZMAT
City Manager McGuire distributed and reviewed a memo regarding Hazardous
Materials Requirements for the fire service, and discussed the option of contracting
with the St. Paul Fire Department. Following considerable discussion, Councilmember
Carlson moved that the Ci Manage proceed on a dual track with anew seven -
member committee consisting of the three Fire Chiefs, City. M_ anager McGuire, Chief
Collins Fire Marshal Embertson and EmerQencv Management Director Cude, to
resolve .or replace the fire departments hazmat responsibility within 30 days of their
first meeting, with Councilmember Juker to be an. ex officio member, and to approach
St. Paul or others for aguote for service. The motion was seconded by
Councilmember Juker and approved.

AUTHORIZING THE EXECUTION AND DELIVERY OF AMENDMENTS
RELATING TO THE X1,100,000 COMMERCIAL DEVELOPMENT REVENUE NOTE OF 1982
(EMERALD INN OF MAPLEWOOD)
AND DOCUMENTS RELATING THERETO
WHEREAS, pursuant to a Final Note Resolution adopted by the City Council on
October 7, 1982 (the "Resolution "), the City issued its $1,100,000 Commercial
Development Revenue Note of 1982 (Emerald Inn of Maplewood) dated as of October
14 1982 (the "Note "), to provide financing for Emerald Inn of Maplewood, A
Minnesota Partnership (the "Borrower ") , to acquire, construct and equip a 66-unit
Emerald Inn Hotel located at the intersection of Interstate 694 and White Bear

Avenue in Maplewood (the "Project") which is owned by the Borrower. The proceeds
of the Note were loaned to the Borrower pursuant to a Loan Agreement dated
October 14, 1982 (the "Loan Agreement "). The Note was purchased by First
National Bank of Minneapolis, now known as First Bank National Association (the
"Bank "). Pursuant to a Pledge Agreement dated October 14, 1982 (the "Pledge
Agreement "), the City assigned the Loan Agreement to the Bank. The obligations
of the Borrower under the Loan Agreement including the obligation to repay the
Note are secured by a combination Mortgage, Security Agreement and Fixture
Fi nanci ng Statement dated October 14, 1982, executed by the Borrower i n favor of
the Bank (the "'Mortgage"), by an Assignment of Rents and Leases dated October 14,
1.982, executed by the Borrower in favor of the Bank (the "Assignment ") and by a
Guaranty dated October 14, 1982, executed by Frederick H. Chute, Sr., Frederick
H. Chute, Jr., Edmund P. Chute, David M. Chute, Ann M. Chute, John Chute,
Constance Chute Dowling, Michael L. Schwartz, Judson Dayton, Duncan Dayton,
Richard A. Yurek, Thelma J. Yurek, Lorraine T. Becker, Francis J. Becker, Rose
Ann Yurek, Arthur B. Johnson, and Maryann P. Johnson in favor of the' Bank (the
"Guaranty "); and
WHEREAS, the Bank has agreed to sell the Note and transfer and assign
all of its right, title and interest in and to the Note, the Mortgage, the
Loan Agreement, the Pledge Agreement, the Guaranty and the Assignment to
George J. Rei 1 i ng, Sr., and Mary Jane Rei 1 i ng, as joint tenants with the
right of survivorship (collectively, the "Purchaser "); and
WHEREAS, the Purchaser and the Borrower have agreed to reduce the
interest rate on the Note and to amend certain of the terms of repayment of
the Note as set forth in the Amendment No. 1 to Note which has been
submitted to the Council for approval (the "Note Amendment") and have agreed
to amend the Loan Agreement, the Pledge Agreement, the Mortgage and the
Assignment pursuant to Amendment No. 1 to Loan Documents (the "Loan
Documents Amendment ") which has also been submitted to the Council for
approval.
NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of
Maplewood as follows:
1. The City shall proceed forthwith to execute and deliver the Note
Amendment and the Loan Documents Amendment substantially in the
forms and upon the terms set forth in the forms on file with the
City. The Mayor and City Clerk are authorized and directed to
execute the Loan Documents Amendment and Note Amendment and
deliver them to the Purchaser.
2. The Mayor and City Clerk and other officers of the City are
authorized and directed to prepare and furnish to the Purchaser
certified copies of all proceedings and records of the City
relating to the Note and such other affidavits and certificates
as may be required to show the facts relating to the legality of
the Note, Loan Documents Amendment and Note Amendment as such
facts appear from the books and records i n - the off i cers' custody
and control or as otherwise known to them.
3. The approval hereby given to the Loan Documents Amendment and
Note Amendment and other various documents referred to above
includes approval of such additional details therein, as may be
necessary and appropriate and such modifications thereof,
deletions therefrom and additions thereto as may be necessary
and appropriate and approved by the City Attorney and the City
officials authorized herein to execute said documents prior to

their execution; and said City officials are authorized to
approve such changes on behalf of the City.. The execution of
any instrument by the appropriate officer or officers of the
City herein authorized shall be conclusive evidence of the
approval of such documents in accordance with the terms hereof.
In the absence of the Mayor or City Clerk, any of the documents
authorized by this Resolution to be executed may be executed by
any other City Council member or officer of the City. The city
Clerk is hereby authorized to register the transfer of the Note
from the Bank to the Purchaser as provided on the Note, as
amended and the Resolution and to register the Note in the name
of the Purchaser.
7. Park and Recreation Commission Annual Plan
Accepted the 1992 Annual Report and 1993 Activity Plan of the Maplewood Park
and Recreation Commission,
Councilmember Zappa moved that in. the Parks and Recreation Commission Annual
Report and Activity Plan, all the parks addresses be listed.

G. PUBLIC.HEARINGS
10 7:00 P.M. (7:20 P.M.): Preliminary Plat - Highwood Meadows
a. Mayor Bastian convened the meeting for a public hearing regarding a
revision of the existing Condition One and a one -year time extension for
the preliminary plat for Highwood Meadows development.
b. Manager McGuire stated the applicant, Mr. Kayser, is in the hospital and
could not attend the meeting.
c. Manager McGuire presented the staff report.
d. Director of Community Development Olson presented the specifics of the
report.
e. Mayor Bastian opened the public hearing, calling for proponents or
opponents. The following persons were heard.

Revision of Condition One
g. Councilmember Zappa moved eliminating Condition 1 (The City Signing
construction contracts for Sterling Street from Hi i l wood Drive to Val 1 ear
View Avenue and for Schaller. Drive from Sterling Street to Lakewood
Drive.) and approving revised conditions as follows:
1. Complete a signed developer's agreement, with required surety,
for all required public improvements, erosion control and tree
planting. This agreement also shall include:

a. The placement of temporary fencing and signs during
construction around woodlots that the developer will save.
b. The installation of street lights in six locations,
primarily at street intersections. The exact location and
type of light shall be subject to the City Engineer's
approval.
c. The installation of no- parking signs along the west side of
Sterl ing Street from Highwood Avenue to the north end of the
plat°
d. The construction of an eight- foot -wide bituminous walkway
and chain link fencing between Lots .32 and 33, Block 3, if
the City decides to buy Outlot E, F or G.
2. Make the following changes to the plat:
a. Add a thirty- foot -wide drainage and utility easement along
the west property line of Lot 10, Block 7.
b. Add four (4) twenty- foot -wide drainage and utility easements
in the following locations:

c. Dedicate a twenty- foot -wide walkway between Lots 32 and 33,

3. Grant to the City three temporary 100 - foot - diameter cul -de -sac
bulb easements for Valley View Avenue, Sterling Street and
Crestview Drive.
4. Submit final grading, utility, drainage, erosion control and
street plans to the City Engineer for approval. The erosion
control plan shall address the recommendations of the Soil
Conservation District and the Ramsey - Washington Watershed
District. The grading plan shall include proposed building pad
elevation and contour information for each home site. It shall
also include contour information for the area that th street
construction will disturb. The grading plan shall illustrate
housing styles which minimize grading on sites that the
developer w i l l save. The grading plan shall show the depth and
location of the William's Brothers pipeline. The City Engineer
may approve deviations from the approved grading plan, provided
the changes follow the intent of the overall grading plan.
5. Provide a tree planting plan for the plat. This plan shall show
the location of trees that the developer will plat. All trees
that the developer will plat shall be at least two and one -half
inches in diameter.

6. Revise the plat to provide a 60- foot -wide street right -of -way
from Schaller Drive to Outlot A of Valleyview Estates. The,
plans for this change shall be subject to the approval of the
Director of Community Development,
7. Submit recordable deed restrictions to the City along with the
recording fees. These deed restrictions are to prohibit the
construction of a dwelling or its attachments within 100 feet of
the William's Brothers pipeline, (This affects Lot 1, Block 4
and Lots 1 -7, Block 5.) The developer shall also notify the
purchasers of the pipeline location.
8. Change six of the proposed lot lines so they are perpendicular
to the street centerline or radial to the center of the cul-de-
sacs.
9. Change the names of Birdsong Lane and Crestview Lane to
Crestview Drive,
10. Change the names of Wildflower Court and Wildflower Lane to
Matterhorn Drive.

request from Good Value Homes to build 24 town homes south of Holloway
Avenue between Beebe Road and Furness Street.

Lot Area and Frontage Variances
h. Councilmember Zappa introduced the following Resolution and moved its
adoption:

ZONING VARIANCE
WHEREAS, Good Value Homes is applying for a variance. from the zoning ordinance.
WHEREAS, this variance applies to the property bounded by Holloway Avenue,
Furness Street and Beebe Road. The legal description is.
That part of the North half of the Northwest Quarter of the Northeast
Quarter of the Southeast Quarter lying West of a line described as
beginning at a point on the North l i n e of said Southeast Quarter distant
1241.94 feet West from the Northeast corner of said Southeast Quarter,
said point of beginning being the intersection point of the Easterly
right -of -way line of the Minneapolis and St. Paul Suburban Railroad
Company with said North l i n e of the Southeast Quarter, thence South 0
degrees 9 minutes West along said Easterly right -of -way l i n e a distance
of 285.54 feet; thence Southerly along a tangential curve to the left
having a radius of 1860.08 feet to an intersection with the South line
of said North half of the Northwest Quarter of the Northeast Quarter of
the Southeast Quarter and there terminating;
That part of the North half of the Northeast Quarter of the Northwest
Quarter of the Southeast Quarter lying East of a line described as
beginning at a point on the North line of said Southeast Quarter distant
1321.94 feet West from the Northeast corner of said Southeast Quarter;

WHEREAS, Section 36 -88 of the Maplewood Code of Ordinances requires a minimum lot
area of 12,000 square feet and a minimum frontage of 85 feet for double dwellings.
WHEREAS, Good Value Homes is proposing to build double dwellings on lots as small
as 6,006 square feet with frontages of 66 feet.
WHEREAS, the history of this variance is as follows:
1. The Community Design Review Board discussed this variance on January 12,
1993. They recommended that the City Council approve this variance.

2. The Planning Commission discussed this variance on January 4, 1993. They
recommended that the City Council approve this variance.
3. The City Council held a public hearing on January 25, 1993. City staff
published a notice in the Maplewood Review and sent notices to the
surrounding property owners as required by law. The Council gave everyone
at the hearing an opportunity to speak and present written statements. The
Council also considered reports and recommendations from the City staff and
Planning Commission.
NOW, THEREFORE, BE IT RESOLVED that the City Council approve the above-described
variance for the following reasons:
1. There is an unusual hardship. A homeowners' association will own and
maintain the land that the developer would normally use to meet the lot area
and frontage requirements.
2. This variance would meet the intent of the ordinance, since the project
would meet the City's density requirements.

Preliminary Plat
i. Councilmember Zappa moved to approve the preliminary plat subject to
completion of the ,fol l owi ng Conditions:
1) Have the City Engineer approve the final construction plans. These
plans shall include the grading, street, utility, erosion control,
tree and drainage plans. The Engineer must approve the tree plan
before any grading begins or the City Council approves the final
plat. The erosion control plan shall be consistent with the Ramsey
Soil and Water Conservation District erosion and Sediment Control
Plan.
2) Sign an agreement with the City that guarantees that the developer
will complete all public improvements and meet all City
requirements. This agreement shall require that the developer:
(a) Construct the storm sewer outlet and connection to the Beebe
Road storm sewer
(b) Place temporary fencing and signs Z feet from drip line around
all trees that the developer will save.
(c) Install permanent signs around the edge of the wetland buffer
zone. These signs shall state that there shall be no mowing,
vegetation cutting, filling or dumping of lawn waste.
(d) Clean out debris from pond.
3) Make the following changes on the plat:
(a) Dedicate a 20- foot -wide drainage and utility easement to the
City over the storm sewer pipe between Beebe Road and the pond.

(b) Change Furness Avenue to Furness Street.
4) Record covenants or deed restrictions with the final plat that.
Inform property owners about the wetland on the site and prohibit
any mowing, vegetation cutting, filling or dumping, including yard

WHEREAS, the purpose of the new Federal legislation was to provide a
clear and comprehensive national mandate for the elimination of
discrimination against individuals with disabilities.
WHEREAS, the City Council directed a special ADA review committee
composed of residents to evaluate all City buildings and programs for
compliance with ADA guidelines.
WHEREAS, the Americans With Disabilities Act Performance Team (ADAPT)
recommends that the City install automatic power front entry doors to City
Hall to enable persons with handicaps, the elderly, and others who need
assistance opening doors.

WHETS, National Afro - American History Month will be observed
across America and abroad during February 1993, and
WHEREAS, the National Theme of this year's observance will be
'Afro American Scholars: Leaders, Activists, and Writers." TM
WHEREAS, this observance alludes partly to Afro American scholars
having to play a broader role as a leader of his race and activist and writer in
his community than most other scholars. He has had to emerge from the
ivory towers of academe to do battle in the struggle for rights and to overcome
oppression.
WHEREAS, this observance will also provide an opportunity for
students and the lay public to study how Afro American scholars brought to
their work a sensitivity developed from having to do battle to gain acceptance
as scholars and to rise above perceptions of color that erect barriers, to them,
that scholars of the majority group seldom face.
NOW, THEREFORE, BE IT RESOLVED, that the City Council and
I, Gary W. Bastian, Mayor of the City of Maplewood, do hereby proclaim the
month of February 1993 as

INTRODUCTION
The City Council should approve a budget transfer of $16,840 from the contingenc g Y
account. This budget transfer is to pay the remaining 1992 bills from the consulting
inspectors.. There is no money left in the consulting inspectors' budget.
DISCUSSION
It has. been difficult to estimate a budget amount for the consultin g inspectors. There
are.. two reasons:
1. The inspectors' billings vary with the amount of construction. Forecasting the
amount of construction is difficult because it varies with the economy.
2. The City collects permit fees before construction starts, but does not pay the
inspector until he does the final inspection. This means that the City may collect
a permit fee in a different year than when the City pays the inspector. With a
`large building, the time between collecting the permit fee and paying the
inspector may be a year or mare.
We. hope to minimize this problem in the future. Starting in 1993, the Director of
Finance is setting aside permit fees for electrical, plumbing and mechanical inspections
in a special account. Since the inspectors get 80% of the permit fees, the City will have
money set aside to pay for plumbing, electrical and mechanical inspections.
RECOMMENDATION
- Approve a budget transfer of $16,840 from the contingency account to account 101-
703 -4480 (fees for service.

Can January 25, 1993, the City Council made the following decisions about the Oak
Ridge project:
1. Decided not to order an environmental impact statement
2. Approved changes in the land use plan and zoning map
3. Vacated Hoyt Avenue
4. Denied front setback variances
5. Approved increased front setback variances for Lots 5 and 6
The Council directed the staff to prepare specific motions for February 8 on the Code
variations for long cul -de -sacs, the preliminary plat and the Code variation for 28 -foot-
wide streets. I have revised the staff recommendations based on councilmembers'
comments at the January 25 meeting. The developer has revised the plans to reduce
the Arlington Avenue cul -de -sac to 1227 feet and drop two lots. (See the enclosed
plans.) The preliminary plat motion includes the entire project. However, the City can
delay approving the final plat for the lots that are east of the pipeline until March 1,
1994. (See condition C.7. on page 5.) Condition C.2 (p) on page 4 requires that the
developer not sell Lots 21 -22 and Lots 29 -31 until the City Council approves their sale.
The. City shall not approve these lots for sale unless:
(1) Home construction has started on at least fifteen lots, and
(2) Lots 21 -22 and 29 -31 meet FHA's specification 79G (homes must be built three
feet above the water table).
I revised condition C.2 (b) on page 3 to require fencing and signs at the grading line,
rather than the drip line of the trees. Requiring fencing at the drip line would require
that the developer cut down any trees with branches overhanging the grading line.
REC4MMENDATTCJN
A. Adopt the resolution on page 7. This resolution approves Code variations for the
Arlington Avenue, Currie Street and Myrtle Street cul -de -sacs, because:
1. The variations will save an existing wetland and a woodlot with forty
large trees.
2. The City approved a similar variation for two cul -de -sacs in the Budd
Kolby Second Addition.
B. Adopt the resolution on page 9. This resolution approves a Code variation for a
1160-foot-long cul -de -sac for Montana Avenue, because:
1. There is no practical alternative.
2. The cul-de -sac length will be reduced when the property to the north is
developed.
C. Approve the Oak Ridge preliminary plat (received by the City on February 1,
1993). Before the City Council approves the final plat, the developer shall
complete the following conditions:
1. Have the City Engineer approve the final construction and engineering
plans. These plans shall include the grading, utility, drainage, erosion
control, tree and street plans. These plans shall meet the foll owing
conditions:
(a) The erosion control plan shall be consistent with the Ramsey Soil
and Water Conservation District Erosion and Sediment Control
Plan.
(b) The developer shall only grade the land that the CityEngineer
determines is needed to construct streets, utilities, sedimentation
basins, mitigation areas or rough grading of steep slopes.
(c) The City Engineer must approve the final tree plan before anyone
starts to grade the site.
(d) Sedimentation basins shall provide 0.10 acre -feet of storage above
normal elevation for each tributary acre, based on the Maplewood
Comprehensive Storm Water Management Plan If slopes are
steeper than 10 horizontal to 1 vertical, the developer shall fence
the sedimentation basin. The developer shall plant evergreen trees
around the sedimentation basin. To provide room for storing
sediment, the developer shall excavate the sedimentation basins to
four feet below normal water elevation. Sedimentation basins shall
be a part of outlots dedicated to the City.
2. Sign an agreement with the City that guarantees that the developer or
contractor will:
(a) Complete all public improvements and meet all City requirements.
(b) Place temporary fencing and signs at the grading line shown on the
grading Plan.
(c) Construct the following eight-foot-wide bituminous walkways at
the same time as the developer builds the adjacent streets:
(1) On Sheet one of the plat: between Lots 6 and 7, 19 and 20,
and 13 and 14.
(2) on Sheet two of the plat: between Lots 75 and 76, 54 and
55 67 and 68 and on the pipeline between Lots 54 and 68.
The developer may build a wooden observation deck at the
end of the trail between Lots 19 and 20.
(d) Have NSP install the street lights shown on the preliminary plat.
(e) Before constructing utilities, televise and inspect the existing trunk
sanitary sewer within the plat. The developer shall make any
repairs that the City Engineer requires. The City shall pay the
developer to inspect and repair this sewer.
(fl Allow the City access to abandon the existing sanitary sewer man-
hole ( #31) in the wetland in Outlot B.
(g) Replace all fine alluvial soils (soils other than sand or gravel) with
sand within the two feet under the bottom of the aggregate base of
the street.
(h) Install perforated drains in sand subcuts at each catch basin lead
crossing.
(i) Before the City approves a final plat, the City will decide whether
to abandon and replace the 16 -inch water main from Lot 84 to the
railroad.

(j) Construct a new stormwater outlet from the Outlot B pond through
a culvert crossing the petroleum pipelines to the proposed wetland
mitigation area. From the east end of the mitigation area, build a
24inch- diameter stormwater pipe through the park into the Outlot
C wetland. (The stormwater outlet from Outlot B is non- fiinction-
al.)
(k) Construct a storm sewer between Lots 10 and 14 and Lots 9 and
15 around the wetland to the Arlington Avenue storm sewer.
(1) Install p signs around the edge of the wetland buffer
strips. These signs shall mark the edge of the buffer strips and
state that there shall be no mowing, vegetation cutting, filling or
dumping of lawn waste.
(m) Before the City Council approves a final plat for phase two, the City
shall decide whether to require that the developer insert a plastic
pipe in the top of both of the existing outlet pipes for Outlot C
under the railroad tracks.
(n) Pay the City for the cost of directional signs and no parking signs
on one side of the streets.
(o) Clean the junk and tires out of the wetlands.
(p) Agree not to sell Lots 29 -31 and 21 -22 on Sheet One until the City
Council approves their sale. The City shall not approve these lots
for sale unless:
(1) Home construction has started on at least fifteen lots, and
(2) Lots 29 -31 and 21 -22 meet FHA's specification 79G (lowest
floor level must be built three feet above the water table).
3. Make the following changes on the plat and related plans:
(a) Move the proposed sedimentation basin between Lots 111 and 113
so it fronts on a street or connect this area with a pipe to the
sedimentation basin between Lots 94 and 95.
(b) Show a utility easement on Lot 116. This easement should extend
fifteen feet west from the water main.
(c) Cul-de -sac bulbs shall have 47 -foot radius curb returns.

(d) Show drainage easements around the wetlands that the developer
is proposing for stormwater drainage.
4. Record covenants or deed restrictions with the final plat that do the
following:
(a) Prohibit the construction of a house or its attachments within 100
feet of the Williams Brothers pipeline or within 20 feet of a
wetland boundary.
(b) Inform property owners about any pipelines or wetlands on the site
and prohibit any mowing, cutting, filling or dumping, including
yard waste, on the wetland or on a ten -foot buffer strip around the
wetland. The Director of Community Development may reduce the
buffer zone for lots with an unusual hardship. The director shall
notify the City Council of any reductions and allow them fifteen
days to appeal the decision
5. Deed outlots A. B, C, D and E according to the phasing of the plat. The
developer shall have the right to complete the wetland mitigation that is
shown on the outlots.
6. If the City decides to buy the "Future City Park" in outlot B and has not
paid the developer for the park before recording the plat, the City will
sign an agreement to do so. If the City decides not to buy the park, the
developer shall show the park as an outlot for future platting or apply for
a new pr ary plat.
7. Sign an agreement with the City that pertains to all lots that would be
east of the pipeline. This agreement shall state that:
(a) The developer or contractor shall not do the following with these
lots until March 1, 1994 without the City's approval:
(1) Apply for final plat approval.
(2) Grade or remove trees.
(b) The City shall not conduct the annual review for phase two until
June 1, 1994.
If the developer decides to final plat part of the preliminary plat, the Director of
Community Development may waive any conditions that do not apply to the final
plat.

D. Approve the resolution on page 11. It approves a Code variation for 28 -foot-
wide streets. This variation is subject to no parking on one side of the streets

INTRODUCTION
The City Council asked the staff to study the City's roof - equipment screening ordinance.
BACKGROUND
Code Requirement
Section 36 -27(b) (3) states the following:
Except for mobile homes, town houses, single and double dwellings, all mechanical
equipment on the ground or roof shall be screened on all sides so as not to be visible
from public streets or adjoining property.
Such screening shall be designed and constructed of a material (s) that is compatible
with the principal building and subject to Community Design Review Board approval.
Other Cities
I surveyed nineteen suburbs to find out what they require for screening mechanical
equipment. Fifteen required that businesses screen their roof equipment. Refer to the
survey results on page 3.
ALTERNATIVES
1. Do not require screening, but require that mechanical equipment be painted to
match the building color.
2. Require a roof design that will hide the equipment without using screens.
3. Require screening, but allow the Community Design Review Board to waive this
requirement where screening would not improve a building's appearance or
protect surrounding property values. Roof equipment that is not screened must
be painted.
4. Make no changes. Continue to require roof - screening in all cases.
DISCUSSION
Usually, screening mechanical equipment improves the appearance of buildings. Good
examples are Iced Lobster, Chili's, Maplewood East and the Aspen Medical Group at
1850 Beam Avenue. Most cities we surveyed require this screening.
Roof- screening can be a problem:
1. Poorly designed or unpainted screens can. look worse than the mechanical
equipment. The Maplewood Office Park on Kennard Street and Beam Avenue is
an example. The brown - painted mechanical units were less noticeable than the
wooden screens. These screens would look better if the owner had them painted
dark brown to match the building.
2. Screens need maintenance. Damaged screens hurt a building's appearance.
3. Roof- mounted screens may create a roof leak if the fasteners puncture the roof.
A puncture may void a roof warranty. Contractors usually weight their screens
in place or attach them to the mechanical equipment, rather than permanently
fastening them to the roof. We are not aware of any building that has had a
roof leak because of roof screening.
The Council should change the ordinance to allow the Community Design Review Board
to waive the screening requirement where it is not needed. An example is where the
equipment is only partially visible or small compared to the building size. In this
situation, screens may be more noticeable than the equipment.
If the City does not require screening, the City should require that the building owner
paint the mechanical equipment to match the building. Even if equipment is screened,
the City should require that the building owner paint the equipment to match the
screen color. The screen, in turn , should match one of the building colors. Mechanical
equipment is often visible through openings in or over the top of screens.
I have added a section that requires screening where a parking lot is constructed next to
property that is used or planned for single or double dwellings.

Adopt the ordinance on page 7.

policies are mixed and provide little direction.
• Shoreview —the public works department removes the snow from all sidewalks
and trails.
• Woodbury —the parks and recreation department removes the snow from 28
miles of designated trails. Another 10 miles of trails receive no winter
maintenance.
• Roseville —the parks and recreation department removes snow from all
pathways as time permits.
• North St. Paul --an ordinance requires adjacent property owner to remove snow
from sidewalks within 12 hours after a storm. The city removes all the snow
from downtown streets and sidewalks.
• New Brighton —the public works department plows all streets in 4 hours, then
plows sidewalks, except those sidewalks near schools are plowed before school
begins.
• Oakdale —no winter sidewalk maintenance.
Based on the discussion that occurred at the December 28, 1992, council /manager
meeting, I suggest the following:
• After all streets are plowed (usually second day) the White Bear Avenue

other pedestrian way free of snow and ice shall be

Introduction
.Private mailboxes and paper tubes in the public right of way create a number of problems
for the public works maintenance and construction work. This report reviews the problem
and presents a recommended solution.
Background
Many mailboxes were originally constructed from the cheapest materials available. Like all
things, mailbox posts corrode and age. There are many that are in poor condition.
When a lot of .existing mailboxes are installed, insufficient care is taken to place them at
proper height and setback. The practice of each property having a separate post for
mailboxes, and often times several channel posts for paper tubes, makes many posts in the
boulevard.
These characteristics produce the following problems. Mail delivery is slower due to more
individual stops and poor access due to varying height and setback. Many mailboxes break
from the weight of the snow bank being pushed up against the deteriorated post. The street
,maintenance division exercises a high level of care to avoid actual collision with mailboxes.
However, the lack of a curb to "feel" while plowing, together with the irregular placement
and large number of posts, adds considerable difficulty to the work of plowing. In the
minority of instances where the box or paper tube is actually hit by the .plow, the mailbox is
not designed to deflect any of the impact.
In most construction projects, the mailboxes must be removed from the boulevard to allow
work. Even careful removal wrecks many posts. On recent projects, the contractor has
been paid to replace severely deteriorated mailbox posts with a standard 4" x 4" wood post.
A copy of the detail from the County Road B/TH 61 Storm Sewer plans is attached for
reference.
In the end a motley collection of mostly old and a few new boxes are placed in the
boulevard. It may seem contradictory that the city expends hundreds of thousands of dollars
to improve the function and appearance of streets and then places a large number of old,
often ugly, mailboxes and paper tubes in the_ newly sodded boulevard.
A potential alternative is to replace all mailboxes within a construction area with a
standardized, high - quality post assembly. It would hold the mailboxes and paper tube for
two residences on a single post. It would be galvanized and of heavy metal pipe to be
corrosion and damage resistant. It would incorporate a swing feature to deflect a collision
with minimal damage and return to position. These mailboxes would be placed at a
uniform height and distance to the road.
Standard Plate 600 was revised to show a mailbox with these attributes. A copy- of the
standard plate is attached. A prototype was built by both Truck Utilities and Manufacturing,
Inc. and North St. Paul Welding. These prototypes will be displayed at the council meeting
(to 'save cost the prototypes were not galvanized).
The advantages include minimizing snowplow damage, improving mail delivery, providing a
service to residents, and enhancing the appearance of city streets. A letter in support of the
proposal from the manager of the North St. Paul post office is attached.
Budget t Impact
Based on experience of fabricating prototypes, the cost for manufacturing the post assembly
is about $100. The in -place cost would be about $125, or $63 per residence. The
proposal is to replace all mailboxes within construction projects as a cost to the project
without added cost to residents. On the upcoming County Road C project, this would be an
extra cost of about $3200 to be borne by the city.
If the systematic maintenance by area concept of the Pavement Management Study is
adopted, then consideration to replacing all boxes should be given. If all boxes were
replaced over 16 years, the cost would be about $28,000 per year. The completion of
such a program would lend a uniform, fin.ished.appearance.to, the city streets.
Recommendation
The city could continue its present policy that mailboxes in the right of way are placed at the
jeopardy of the owner. It is unreasonable to then expect that a number of mailboxes will not
fall down or be hit during plowing. Repairs and replacement are at residents' cost. Within
construction projects, only the worst boxes would be replaced with less expensive wood
posts.

be given to a systematic program to replace all boxes at ❑uniform height and offset. The
choice depends on desired level of service to residents and value of enhanced appearance
of city streets versus the availability: of additional funds.

MAPLEWOOD MALL MERCHANTS ASSOCIATION DONATED $13,000.00 FOR THE
FIREWORKS DISPLAY LAST YEAR. WE HAVE SPOKEN TO THEM AND THEIR
REPRESENTATIVE HAS STATED THAT THEY WOULD NOT BE WILLING TO DONATE
ANY FUNDS UNLESS WE DEVELOP THE CELEBRATION INTO AN ALL DAY EVENT
AS HAD BEEN DONE IN PREVIOUS YEARS.
LAST YEAR WE APPROACHED LOCAL COMMUNITY ORGANIZATIONS REQUESTING
FUNDS FOR THE JULY 4TH CELEBRATION AND WE HAVE BEEN TOLD TO GO TO
THE CITY AND TAKE IT OUT OF THE 10% THAT IS DONATED ALREADY FOR
THAT PURPOSE. ADDITIONAL CONTRIBUTIONS HAVE BEEN PROVIDED BY THE
MUSICIANS UNION, BUT THEY HAVE ALSO REDUCED THEIR SHARED FUNDING.
DISCUSSION:
ATTACHED YOU WILL FIND TWO PROPOSALS FOR JULY 4TH CELEBRATIONS. ONE
PROPOSAL IS FOR AN ALL —DAY EVENT AND THE OTHER IS FOR AN EVENING
EVENT. AT THE TIME OF BUDGET PREPARATION FOR 1993, WE PLANNED TO
CONTINUE AN EVENING ONLY PROGRAM AND EXPECTED REVENUE FROM THE
MAPLEWOOD MALL MERCHANTS ASSOCIATION FOR THE FIREWORKS DISPLAY.
IF THE CELEBRATION IS CHANGED TO AN ALL DAY EVENT WE WILL NEED TO
REQUEST THAT APPROPRIATE FUNDS BE SECURED FROM THE GAMBLING FUND TO
COVER THE EXPENDITURES THAT WILL BE INCURRED.

At the December 14 meeting, the City Council awarded the Ramsey County Library
System $27,500 of charitable gambling proceeds for the purchase and installation of a
CD - ROM Local Area Network This system will allow the simultaneous sharing of
databases among four users at one time.
The Library Director has invited the City Council to attend the dedication ceremonies of
the new library on Sunday afternoon, March 7, 2:00 - 4:00 p.m. and the Grand
Opening festivities on its first day of operations on Monday, March 1 at 1:00 p.m. The
Library Board would like to include the Mayor and City Council in the agenda for these
events.
Library personnel have notified us that the system requires three months of lead time
for installation. Since they ordered the equipment in mid- December after the City made
the donation, the network will not be installed in time for the grand opening.
However, staff will be planning some sort of fun presentation that will recognize the
City's donation.
RECOMMENDATION
It is recommended that the City Council consider in which event they would like to
formally participate in a presentation which will acknowledge the City's donation of
$27,500 to the Ramsey County Library System: Monday, March 1, or Sunday, March 7.

2. Wages: Increase Top Patrol Rate as follows:

3. Deferred Compensation: Effective 1 -1 -94, increase City -paid deferred
compensation to $65 per month. Effective 1 -1 -95, increase City -paid deferred

4. Article 20 - Injury-on Dutv: Revise as underlined: "Employees inj paid

Compensation payments.
5. Article B -II - Sick Leave: Add new section (b) as follows:
Sick Leave Conversion - On December 31st of each year afull-time employee
with 800 hours or more of accumulated sick leave shall be eligible to convert
sick leave accumulated in the previous 12 months to vacation or deferred
compensation at the employee's current pay rate on the basis of two (2) hours of
sick leave for one (1) hour of vacation or deferred compensation. Such
conversion shall not exceed a total of forty-eight (48) hours of vacation and
deferred compensation.
Employee's maximum sick leave accrual shall be frozen at the level of sick leave
on record at the date the employee first utilizes this conversion option.
6. Article B -IV - Holiday: Eliminate reference to "statutory" holida s and replace
Columbus Day with the Friday after Thanks it
7. New Article 22 - Tuition Reimbursement: The Employer agrees to pay one half
(1/2) of the cost of tuition and books upon successful completion (C grade or
pass) and 75% reimbursement of tuition and books upon completion with a "B"
grade or better, during the term of this Agreement, for accredited course work at
the high school, vocational, undergraduate, or graduate college level which is
determined by the Employer to be job related. All course work covered b y this
Article shall be during non - working hours.
