Mr. Olson explained that the state does not re a separation between g roup homes for six or fewer persons. Therefore, based on an opinion from the Attorne General's office, it is the cit attorne opinion that the Cit cannot re a separation between g roup homes* Councilmember Zappa su that the Cit lobb to chan the law controllin separation between g roup homes so that all cities follow the same g uidelines, re of the cit size or class desi Discussion focused on the size of the house on the lot, parkin considerations, and the enforcement of violations for all residences. It was decided to submit this item to the HRA for consideration. 4, CODE CHANGE: SINGLE AND DOUBLE DWELLINGS Geoff Olson presented the staff report. The issues of home orientation, homes set farther back than the adjacent homes, and too much lot covera and house size were discussed. It was suggested P.C. /C.C. Joint Meeting -2- Minutes 6 -18 -91 that the wordage regarding the existing predominant setback on the same street be changed to the same side of the street. It was decided to refer this code change back to the Planning Commission and HRA for further consideration before submitting it to Council. 5. PLANNED UNIT DEVELOPMENTS /CONDITIONAL USE PERMITS FOR COMMERCIAL ZONING DISTRICTS Commissioner Rossbach presented the background on the updating of the Planned Unit Development (PUD) ordinance. Mr. Rossbach informed the meeting that the Planning Commission hoped, with this updating process, to create more involvement for the City in the PUD process. The continued use of an overlay zoning district to control PUDs and conditions for creating transitional zoning areas for PUD use were discussed. Mr. Rossbach suggested that PUD areas could be zoned in an overlay district to keep the density in a concentrated area in order to preserve open space areas. Staff noted that PUDs are now a conditional use permit, but the suggestion with this updating process is that PUDs be controlled by initiating an overlaying PUD zone. Past PUD proposals and existing PUDs in the City were discussed. It was noted that the City's conditional use permit is effective and gives the City substantial control. It was decided that the Planning Commission will write an initial draft of the PUD ordinance which will create an overlay zoning district for specific areas of the City. This draft of the ordinance will then be reviewed by the City Council. Mayor Bastian said he knows of no legal challenges to PUDs in Minnesota, but said he would check to see if other states have had legal challenges to PUDs. Commissioner Fischer asked Mayor Bastian to also check to see under what circumstances the developer can change the conditions of the PUD and, in addition, what authority the City has to amend the PUD. 6, OPEN SPACE Mayor Bastian reported that an open space committee will be appointed to define open space, identify sites for acquisition and specify the costs to acquire specific property. The Council hopes to present this as a referendum for the public to vote on as part of the 1992 general election. Possible alternatives for obtaining funding to purchase land for open space would be grants, special legislation, metropolitan park funding and donations. P.C. /C.C. Joint Meetin -3- Minutes 6-18-91 7, LONG-RANGE VISION OF THE CITY Councilmember Zappa asked staff if the update of the comprehensive plan is nearin completion. Staff said the comprehensive plan will be submitted to the Plannin Commission in the next few weeks for their review. After the plan is approved b the commission and council it will be submitted to the Metropolitan Council,. Avenue --T . H. 120 to McKnight Road, Project 91 03— Approve Plans DATE:: July 1, 1991 The.subject are presented for approval and authorization to advertise for bids is requested. Background The bituminous surface of Conway still rides quite well and, from a distance, looks acceptable. However on closer inspection the pavement is extensively cracked under the wheel paths. The cause of this.cracking has been investigated. The original bituminous has hardened with age making it less flexible. Consequently, it cracks under applied Loads or changes in temperature. The appropriate corrective action is.milling the existing surface to a fairly deep level of 2 1/4 inch removal. This will be replaced with new virgin.material The miscellaneous repairs to be included with the job are repair and painting of the rusted retaining wall railings. The original railings were made of corten steel which is supposed to rust and thereby form a protective coating. However, in this installation it.has resulted in disfiguring the concrete and cut stone retaining wall. The existing corroded.anchor bolts will also be replaced. All work is eligible for municipal state aid funding. The estimated construction cost is $21.1,400. With engineering costs, the total project cost is $249,500. MEMORANDUM ReJ sot .,,.,. TO. City Manager Dste FROM Director of Community Development SUBJECT: Budget Transfer - Grass and Weed Cutting DATE: June 25, 1991 INTRODUCTION I am requesting a budget transfer of $500 to pay for grass cutting on private lots. These are lots where the City has Ordered the owners cut their grass or weeds and they have not done the work. In these cases, City Code allows the City to cut the grass or weeds and assess the cost to the property. In the past, the Public Works Department has done the cutting. They no longer. have the time, so we must contract the work to a private company. Since the City used to do the work, I had not budgeted any money to hire someone to do the cutting. SUBJECT: Budget Transfer DATE: July 1 1991 INTRODUCTION I am requesting a budget transfer of $2 , 398 to pay for additional part.ti.me clerical hours for the. Community Development Department BACKGROUND Our department has had extra clerical hours during the construction season for the.last two years. In - addition to handling building permits, the extra clerical help has been needed to handle recycling calls. This program started several years ago and has significantly.increased the telephone calls for the clerical people. The Manager again approved these extra hours for one of. the clerk. typists with the 19911 budget. The increase was from two to three days a week for six months. See the attached final budget revisions from the Manager.) Unfortunately, there is not enough money in the 1991 budget to cover this cost. There was an error in calculating he hours g during budget preparat DISCUSSION Because of the heavy workload in our department during the construction season, it is important to correct this problem. The work load is especially hard on the clerical staff when one of them goes on vacation or is sick. We then must have higher- paid planners or the environmental health officer helping with the phones. They should be using this time to do their normal work. A Deferred Loan is a loan which need not be repaid. unless the borrower sells transfers, or ceases to live in the improved property within ten years of the date of the loan. After the ten -year period expires, the loan is forgiven. The program, which was created in 1981, is entering its sixth phase. The program is primarily funded through appropriations from the State Legislature. The funding level for the 1991 -93 program phase will be $8 million. There will also be a special $ fund specifically targeted for accessibility improvements. As per the Council's request, the bids were revised to Option A and required P q • all metal framing and metal finish work. The electrical work and roof drains are to be completed by separate contracts. On June 14, 1991, the revised specs were sent to three contractors, with one contractor rejecting the offer by phone. The remaining two bidders submitted the following: 1. Schreiber Mullaney Construction Co. $39,560 2. Innovative Building Concepts, Inc. $42,348 Innovative Concepts has added costs for roof insulation, where Schreiber Mullaney has not added the cost for this and expects the existing roof contractor to do this so as not to get into any warranty conflicts. The roof drains should be installed by S.A.I. Construction Company, as the cuttin g of the roof must. be done by the roofing contractor so as not to void the warranty. The cost of the roof drains, piping, and required masonry work is $6,000. The electrical work consists of the removal of all the existing fixtures and wiring in the work- related area and replacing the east, south, and west walls of the building with high pressure sodium lamps with photo sensors. Installation of these lamps will add to the safety of the parking lots and security of the building. Electrical costs, will be $1,149. The Council requested that staff make several changes proposed by the Mayor. I have made these changes. MEMO:ANDUM TO FROM : . SUBJECT: DATE: INTRODUCTION City Manager Ken Roberts, Associate Planner Flood Pl Ordinance June 5, 1991 The Minnesota Department of Natural Resources (D.N.R.) and the Federal Emergency Management Agency (FEMA) are requiring Maplewood to revise its flood plain ordinance by July 12. The changes to the flood plain ordinance are necessary because of changes in federal regulations. The purpose of this ordinance is to maintain Maplewood's eligibility in the National Flood Insurance Program. The State requires that cities subject to recurrent flooding participate and maintain eligibility in this program. BACKGROUND The City adopted the existing flood plain ordinance on July 28, 1986. The ordinance establishes regulations to minimize flood damage. DISCUSSION Most of the changes are technical and administrative. They. should help to clarify the rules as well as cover situations that the existing ordinance does not cover. The most important additions to the ordinance are about on -site water systems (Section 36 - 499 (b) (8)) and about variances (Section 36 - 503) . Other important additions are about penalties for violations (Section 36505) and about travel trailers and travel vehicles (Section 36-507) . RECOMMENDATION Approve the attached ordinance. kr /memo 31. mem Attachments: 1. Flood Plain Ordinance .2. Flood Plain Maps 2 ORDINANCE NO. The Public Safety Department surveyed the intersection, and the staff recommendation is not to install stop signs. In response to the request for stop signs at the intersection of Howard and Holloway, the Public Safety Department observed the intersection four separate times on two different days. The traffic counts and speeds are part of the attached report. Holloway Avenue is a Ramsey County road. RECOMMENDATION The City Council has two options: refer the matter to Ramsey County requesting that they review the request or take no action. Staffs recommendation is to take no action at this time. April 30, 1991 MEMORANDUM To: City Manager Michael McGuire From Director of Public Safety Kenneth V. Collins Subject: Stop Sign - Holloway and Howard On April 8, 1991, I received a memorandum from you with a letter attached from a Holloway resident requesting a stop sign at Howard and Holloway. We have monitored that area for a two -day period during varying times. A computer check of this location revealed one property damage accident in the area since 1987. At this point, I do not believe there is a sufficient public safety concern to warrant stop signs being placed at the intersection of Howard and Holloway. Please investigate this matter and report back to me on your findings. MAM:kas Attachment We would like the Maplewood City Council to consider our neighborhoods request for a STOP sign to be placed on the corner of Howard.and Holloway, stopping traffic travelling on Holloway. We feel -one is needed to control the speed of the large number of young drivers coming from the apartment buildings at the end of Holloway. This We feel will make Holloway a. safer street for the many small children who live.on it. We do not feel that having more Police patrol the area will solve the problem simply because of the natural turnover that happens at apartment complexes. Thank You for your consideration. This option is not recommended for 1 two reasons. The City Clerk's area handles a arge volume of walk - in and hone - in cuss • p custo and the increased load Of the receptionist duties would over burden the depar personnel. When the receptionist position was created, it freed up about 20 hours per week in the City Clerk's area that were previously used for switchboard duties. Those employee hours are now used in the City Clerk/Deputy Registrar function. The second reason is the increased customer service /public relations benefit of the receptionist's position would be completely lost. 2. Continue to use employees from temporary p ry agencies. The attached map shows the area to be overlayed. Note that the Sterling Street cul -de -sac has not been included. These two streets, when taken with the work being done under Project 90 --07, City- Wide.Improvements, will complete the area between County Road B and Highway 36 and White Bear Avenue and the east corporate limit. The estimate for these two streets is.960 tons or approximately $19,200. A patch on Beebe Road near the water booster station has also been included. This patch is 85.feet by 32 feet and six inches thick, therefore beyond the hand placement capabilities of city forces. The tonnage is approximately 100 tons at a cost of $2000.
