CALL TO ORDER A special meeting of the City Council of Maplewood, Minnesota, was held in the Council Chambers, Municipal Building, and was called to order at 7:02 P.M. by Mayor Bastian. Mayor Bastian convened the meeting for a public hearing regarding the construction of City -Wide Water Main Extensions and Miscellaneous Improvements, City Project 90 -07 in Areas 9; Donna Senty Drive, north of Frost: Area 10, Adele, South of Frost; Walter, Fenton to Gordon; Phalen, Frost to Sophia; East Shore Drive, Adele to south of Sophia; Sophia, East Shore Drive to Edward; Frisbie, Frank to English; Frank, Ripley to Frisbie: Area 11, Kingston, Gurney to Jackson; Abel, Larpenteur to Kingston; Beaumont, South of Kingston. b. Manager McGuire presented the staff report. 1 9 -17 -90 C. City Attorney Patrick Kelly explained the legal procedures of the public hearing. d. Mayor Bastian called for persons who wished to be heard for or against the proposal. The following were heard: Area 9. Tim Klein, 1954 Donna Senty Drive, opposed, asked hearing be delayed until Donna Senty Funk was well enough to attend the meeting Manuel Marty, 1942 Donna Senty Drive, opposed Area 10. Bob Frances, 1740 East Shore Drive, in favor George Ashton, 1732 Edward, requested something be done with the street Carl Grill, 1280 Frisbie, in favor Beverly Snyder, 1890 Phalen Place, in favor Ture Eikvar, 1100 Fenton, in favor Chris Miles, 1280 Frisbie, in favor Pat Vaughan, 1856 Phalen Place,.in favor Glenn Johnson, 1835 Phalen Place, in favor Mindy Lou MacRunnel, 1890 Adele, in favor of water, does not want road widened Virginia Davis, 1050 Frost Avenue, opposed; already has water off of East Shore Drive Ernest Hammer, 1208 Frisbie, in favor Mrs. Gretchen Francis, 1740 East Shore Drive, opposed Janet Carlson, 1884 Phalen Place, opposed. Kingston, in favor e. Mayor Bastian closed the public hearing. f. Councilmember Zappa moved to continue discussion or decision of this proiect until September 24, 1990. Seconded by Mayor Bastian. Ayes - all. D. COUNCIL PRESENTATIONS 1. Maplewood - Telephone Company 2 9 -17 -90 a. Councilmember Juker commented that a relative tried to call her and was told by an operator that was not a Maplewood listed. b. Councilmember Zappa moved to direct staff to notify A. T. & T. and U. S. West to advise employees of where Maplewood is located. Seconded by Councilmember Juker. Ayes - all. 2. R.C.L.G. a. Mayor Bastian commented on several charter amendments that were proposed. R.C.L.G. has requested the cities be polled as to their opinions. b. Councilmember Zappa moved that the City_ support the Charter Amendments with the exception of the referendum requirements bei.n lowered. Motion filed for lack of a second. c. Mayor Bastian moved to direct Councilmembers Rossbach inform the R.C.L.G. that at this time the Maplewood Council is undecided regarding the charter amendments. Seconded by Councilmember Juker. The requested amendment is to allow a person to construct a new home on a lot that already has a home on it. This new construction would be subject to the removal of the old house after completion of the new house. Reason for the Request Mr. Collins has applied for a building permit to construct a new home on his lot at 2076 English Street. This lot now has an older home on it which Mr. Collins lives in. He plans to remove the old home after finishing the new home. ,(See the site plan on page 5.) Section 36 66(a)(1) of the City Code states, "no. more than one single family dwelling and its accessory buildings on each lot." DISCUSSION This amendment would encourage the replacement of run down homes. Owners would have a place to live while building a new home. The ordinance includes several conditions. to assure that this does not create problems for the City. I have deleted Section 36 -24, which prohibits a house behind a house. This deletion will allow construction of a new home in front of or behind an existing house before the existing house is removed. Section 36 -24 is no longer needed, since the Council amended Section 36 66(a)(1) in 1988 to require no more than one house on each lot. The new ordinance requires adequate emergency vehicle access. The previous plat had twelve lots in this phase. Mr. Markfort has replaced three of the lots with an outlot. Mr. Markfort is proposing to use the outlot as a storm water retention pond. BACKGROUND On August 24, 1987, the City Council cave preliminary plat approval to the Markfort Addition subject to nine conditions of approval. On May 9, 1988, the City Council approved the final plat for the Markfort Addition final plat (f irst phase) . DISCUSSION S torm Sew One of the original conditions for approval of the Markfort Addition preliminary plat was about storm water ponding. It stated, "Final platting shall be limited to Phase I until a construction contract(s) is signed for a storm water project to drain this area to Round Lake. Phase II must be platted as an outlot until this contract is signed." The City Council did not approve the Roselawn Avenue improvement project which included the storm sewer improvements for this area. Mr. Markfort's engineer has submitted 1990 that outlines a drainage proposa; development. This report contains an runoff caused by the new development., not consistent with the City's design plan has a storm water retention pond a report dated August 28, 1 for the second phase of his analysis of the storm water This proposal, however, is standards. The proposed on the outlot in the plat. A retention pond is a low area that stores runoff but does not have an outlet to empty itself after a storm. The water level in aretention pond can vary widely depending on weather conditions. The retention pond may be dry during a drought or dry periods. On the other hand, the pond may be full during wet periods. If a storm occurs when the pond has water in it, the available storage volume may not be adequate and the pond could overflow. This might damage surrounding properties. M.r. Markfort's consultant's report does not address the likelihood of the pond overflowing. Even though the report analyzes a typical 100 -year frequency storm, it assumes that the pond is empty at the start of the storm. There is no basis in the report to make the assumption that the pond will be empty on a regular basis before random storms. The City Engineer has stated that no other solutions exist for handling the storm water run -off that are consistent with City design standards. Since the applicant has completed the first phase of the development, staff is recommending no further platting of this property due to a lack of storm sewer capacity. Ripley Street The City Council, at the meeting giving preliminary plat approval to this development, ordered the City Engineer to prepare a feasibility study. This study is about the City acquiring a 60-- foot -wide right -of -way for Ripley Avenue from the Markfort development through to McMenemy Street. The Engineer expects to have this study completed in October. Until the Council reviews this study, it is not certain if Ripley Avenue will be built to McMenemy Street or ended in a cul -de -sac in the Markfort .development. The property owner of 177 McMenemy Street . (whom the extension of by Ripley Street would effect) wants the City to decide whether they plan to build the street to McMenemy Street or not. (See his letter on page 9.) Soils The Ramsey Soil and Water Conservation District has noted that most of the soils in this proposed plat are not suitable for development. (See the letter on page 10.) Mr. Markfort should get an opinion from a certified soils engineer that shows that the proposed plat could be developed with single - family homes and a street. This report should be a condition of preliminary plat approval. RECOMMENDATION A. Deny the proposed Markfort 2nd Addition preliminary plat. This denial is on the basis that: 1. There is inadequate storm sewer system capacity in this area of the City. 2. The proposed on -site pond is not consistent with the City design standards due to a lack of an outlet. 2 B. Renew the previous preliminary plat for another year, subject to anew condition j. that would read as follows: j . Virgil Hawkins, of Meier Stewart and Associates and representing the applicant Leo Markfort, gave a presentation and explained the request for the preliminary plat revision. Mr. Hawkins said a soils report has been done by Braun Engineering which approved the soils for development. Mr. Roberts said the City Engineer was not able to attend this meeting until later in the evening, but had communicated to Mr. Roberts prior to this meeting that the drainage plan which was submitted for this project is not acceptable. 11 Planning Commission -3- Minutes 9 -17 -90 Leo Markfort, 3660 Gershwin Lane applicant for this project, said watershed problems with phase t resolved. Mr. Haider responded that past City policy has been to allow some development on a property if there is an acceptable plan to handle storm water and development of the Hmong church was allowed since they were developing only a portion of their site. Mr. Haider said that under this same. policy the first phase of the Markfort development was also allowed to develop. Mr. Markfort now wishes to develop the remaining property. Mr. Haider explained that the City becomes responsible for whatever storm facilities are installed as part of the plat and, therefore, must require facilities that meet current engineering standards. Mr. Haider said the storm sewer improvements for this area were not approved by the City Council. Mr. Haider said a feasibility study for the acquisition of right -of -way for Ripley Street was ordered by the City Council and it should be completed in October. OF Commissioner Rossbach said he is concerned that Mr. Markfort not be "penalized, yet he feels with the information available at this time, the request must be denied. Commissioner Rossbach moved the Planning Commission recommend denial of the proposed Markfort 2nd Addition preliminary plat. In addition to other re the issue of a throu street from DeSoto to McMenem must be resolved before the second phase proceeds. Alternatives Two alternatives are available. The first is a throu street on Riple from DeSoto to McMenem The second is a cul-de-sac approximatel 900 feet lon from DeSoto. Discussion Alternative 1: There is no doubt that a throu street is preferred b Public Safet and Public Works because their operations are somewhat more efficient with this alternative. A number of ne however, come with this proposal. On the west end of the street near McMenem a number of mature specimen trees would be removed due to g radin g for the street and slopin boulevards. In addition, there is a concern that traffic will become an issue since Riple Street is the onl east connection for one- mile in each direction. This ma be adverse to the residential character of the nei A final concern is cost. A throu street re construction of approximatel 300 feet of -street that creates four new lots. This is onl one lot more than the cul-de-sac alternative. If a throu street were constructed, the ri would have to be purchased. The estimated cost of construction and ac is approximatel $80,000, Alternative 2: The cul-de-sac alternative is somewhat more difficult to maintain for Public Works, and some more difficult to patrol for Public Safet There would be significantl less tree removal, particularl of the more desirable tree species. The traffic is not an issue. The cul-de-sac alternative would allow three • new lots. BACKGROUND October 24, 1988: The City Council conditionally approved the Torgerson Addition preliminary plat for seventeen residential lots. (See City Council minutes of October 24, 1988 on page 5 for approval conditions.) October 23, 1989: The City Council approved a one -year time extension for the Torgerson Addition.preliminary plat. DISCUSSION The Torgersons cannot final plat this property until the City approves a stormwater project for the area and they obtain access to DeSoto Street. The Council is considering the Torgerson's request to allow on -site ponding in lieu of the stormwater project. The Torgersons.are in the process of acquiring access to DeSoto Street. The City Engineer may approve a phased develop - ment plan, provided the applicant can demonstrate that oil -site ponding capacity will be adequate to maintain predevelopment storm water flows from this site. Any lot or street area not included in the initial phase shall be platted as an outlot until adequate storm water capacity is provided. The entire right -of -way for Burr Street and Ripley Avenue shall be p1a t Led and constructed with the first phase. b. City or applicant acquisition of the 35 by 163± foot parcel needed to construct Ripley Avenue as a full -width street, through to Desoto Street. If a City project, the applicant shall pay the cost of the feasibility study and all other City expenses to acquire this right-of-way, including attorney's fees* c. Substitute a drainage easement for Outlot Be The property lines for the adjoining lots shall be extended through the easement to the south or east boundaries of the site. The easement shall include all area that would be up to one foot above the approved 100 -year storm design elevation for this pond. This easement shall also line up with the existing drainage easement on the properties to the east. D d. Outlot A shall be combined with an adjacent property. A deed shall be in the possession of the adjoining property • owner before the plat is signed by the City. DISCUSSION Mr. Skon has not been able to get the property owner to pave a display area.. The landlord and tenant have not agreed on who should pay for it. The intent of the condition was to have the parking area by Frost Avenue I paved before allowing Mr. Skon to display vehicles for sale there. Since the display p y area has not been paved, Mr. Skon advertises his vehicles to be shown by appointment. He stores the vehicles for sale in the rear area by his business. RECOMMENDATION Renewal of the conditional use permit for one year at 1201 Frost Avenue to sell used cars. From the Saturday meeting, a number of questions we • re brought up which were responded to on the Monday, September 10th memo see attached ). As part of ,Counci memo ( see Presentations �� Harvest Park was requested to be put on the October 8 Council agenda. Background Mr. Bloomer has an irregular shaped haped lot that fronts on Barcla and has two sides of his five -sd Y ed lot adjacent. to Harvest Park. From the topographic maps, the back lot ' property has an line of Mr. . Bloomer's Y elevation of 916. There are two b to awing an elevation : his back lot line, with one h berms adjacent n of 922 and the second an elevation of 920. The low spot between the two berms has an elevation of 916. These berms and low area between them have been .part of the original • . property when it was pur- chased from the Minnesota Department of Transportation of the 92 P by the . City. The top 2 berm is approximately 3 5 feet fro back lot line , and the to of the the .p 920 berm is approximately 5 0 feet from the back lot line. Odegard, Director of Parks & Recreatio Subj: Harvest Park Date: September 10, 1990 In response to the questions that are in your memorandum dated September 10, 1990, regarding Harvest Park, I would respond as follows: 1_) When does "future playscape" get installed? The park will be under construction until at least next June of 1991. At that time, the park.should be returned to the city for any improvements we wish to make. TheYg la round P equipment is not in the present construction document. The Park and.Recreation Commission has a special sub-committee -which.works on selection of playground equipment and the. Y will be working through the winter on selection of equipment. ui sent. 2) Will there be other access points, other than Brooks? Is there a parking lotplanned by MN/DOT's area? The main access to the park at this time for the softball diamonds will be via Brooks. At some future time when the area.on County Road C north of the present softball diamonds is developed, it is anticipated that there will be some type of'access to the park, although it may be a walking trail. There is access from the south end of theark all along g Gervais.Avenue. If the exchange of properties happens with Sam Cave and a cul-de-sac is -installed at the end of the present Sextant, there will be an opening at the end of the cul-de-sac to permit people to have access b bicycle to the park. Y Y The parking lot at the south end of the property Y b MNDOT was refected by the community during their hearings, and the Park Commission decided that there was sufficientarkin on the p g bulb of the cul-de-sac and on Gervais Avenue, plus in the evening we have permission from MNDOT to use their visitor parking facilities. 3) Will more trees be cut? Why did they have to cut the trees? Moving the playscape west by 30' would seem to'have elimina the need to cut. ted When I was on the site this morning at 8:00 a.m., the em- ployees indicated that they had completed the cutting of trees. In any type of excavation, the trees, shrubs, etc, must be removed in order to permit excavation. In the case of trails, softball fields, play areas, tennis courts, the trees must be moved from the area. Moving the playscape west by 30' may have saved some of the trees, however, it would have created a great deal more excavation and, therefore, removal of more soils. The playscape appears to be on a knoll that is approximately 00' from the back lot lines of the residents and approximately 25' from the trail that goes between the I IF residents and the play area. Of the seven homes that back onto Harvest Park at the south end, it appears that six of the homes will still have heavy timber behind their homes. 4). when will replacement trees, as per City p olicY, be planted? Due to available funds, the city has done a limited amount of tree replacements in parks over the years. In the case of a large area such as Harvest Park, I would recommend that the city work with a landscape architect to develop planting p a p g plan. and fund this plan. The Environmental Protection Ordinance No. 653, Section 2 (5) Trees, indicates: "a. Development shall be designed to preserve large trees and woodlots, where such preservation would not effect the public health, safety or welfare. The City may prohibit removal of all or a part of a woodlot or large tree, subject to the limitations in section 9-189. In addition, nothing in this article shall prevent building -on . p g an existing lot of record, etc." In.paragraph b. "If large trees are cut, the density of trees shall be restored to that which existed before development, but in no case shall the applicant be required to raise q the density above ten (la) trees per acre, unless part of a re- qui.red planting screen." "Large tree: Any healthy tree that, has a trunk diameter, four feet above the ground of at least 8 inches, other than a box elder,cottonwood, poplar, or any other undesirable tree as determined by the Director of Community Development." In the case of Harvest Park, I have not seen any trees that could be considered "Large Trees" as defined by City Ordiew nance. It should also be noted that by definition, we are only required to have ten trees per acre, which would be 50 trees in the five acre area that was acquired from MNDOT be- hind these homes. When stand-in on the property and loo g p p Y king east toward the homes on Sextant, it is obvious that there are still.many trees and the homes are not visible, per indicat- ing that we are far above the number of trees er acre as indicated by the Ordinance. 5) Will.the border areas be cleaned up and brushed out? If so, when? The present contract does not include the brushing out of dead trees or cleaning up ofany area adjacent to the homes. We anticipate that when we again have the park under our direc- tion that we will be able to go in and clean out any garbage .that has been put into the park. I have.also noticed that some of the residents along Barclay are presently using our park property for storage of wood piles, and have been throw- ing their grass clippings bask into the park area..We will have to notify them to.remove their property from our park, and also stop dumping in the park. -/,-s Action by CounclIv Endorsed. For the purpose of this chapter "targeted residential picketing" means standing,marching, patrolling, or picketing b one or more persons focused in front of ,gp g p ,g Y , or about a particular residential dwelling or dwellings without the consent of the dwellings' occupants. Purpose. The City P of Maplewood has an interest in safeguarding the right of Maplewood's residents to enjoy, in their hone and dwelling, a feeling of well- being, tranquility and privacy. The City of Maplewood City Council finds that targeted residential picketing in front of or about a residential dwelling causes emotional distress to the dwelling occupant(s); obstructs and interferes with the free use ofublic rights of way; and has as its object, the harassment of the P g Y J dwelling occupant(s). The City of Maplewood City Council further finds that, without resorting to targeted residential picketing, ample opportunities exist for those otherwise engaged in targeted residential picketing to exercise constitutionallyprotected freedom of speech and expression. p p .Prohibit i. It is found that the utility billing system can be expanded to charge the fee. It is suggested that each residential unit be charged $1.00 a quarter and that large accounts and non-residential be charged $1.00 per month. The purpose of the fee is for educating the residents regarding recycling and to furnish containers. Attached is a proposed ordinance for first reading. Recycling Service charge DATE: October 3 1990 With the one dollar per quarter •recycling service charge due to be added to our utility bills, I would like to make a recommendation on how we might best use the revenue that will be collected. The 1,000 recycling bins that we previously purchased increased the participation rate in the area south of Frost Avenue by 2 1/2 times. This has been the only mechanism that has had any appreciable effect upon our recycling program since it was started. Providing recycling bins to the rest of the single- family homes should be our first priority, It should take about ayea sur to collect the,amount needed to pply the remainder of the single-family homes.with containers. If we can obtain a 50% matching funds grant from the Metro Council, the time could be cut in half.
