Stebner's property, also known as 1683 Abel Street ( PIN No. 18-29-22-34-0047 WHEREAS, the amount levied a the Stebner's propert was in the total assessment of $3,125.00. WHEREAS, the Stebner's filed a Notice of Appeal pursuant to Minnesota Statute Chapter 429. WHEREAS, the matter came before the Honorable Gordon W. Shumaker, Jud of District Court on September 26, 1991, as District Court File No. C7-91-6322. WHEREAS, the Honorable Gordon W. Shumaker issued an Order and Jud on October 4, 1991, vacatin and settin aside the assessment in the amount of $2,625.000 NOW, THEREFORE, BE IT RESOLVED: 1. Councilmember Zappa introduced the followin Ordinance and moved its adoption, ORDINANCE NO. 695 AN ORDINANCE CHANGING THE BUILDING SEPARATION REQUIREMENTS IN TOWN HOUSE DEVELOPMENTS THt.MAPLEWOOD CITY COUNCIL APPROVES THE FOLLOWING CHANGES TO THE CITY'S CODE OF ORDINANCES: Section 1. Chan subsection 36-125 ( 6 ) applyin to town house 0 developments, as follows. ( 6 ) Side Yard Re As applied to the total development site, a side y ard shall be no less than twent (20) feet in width. Section 2. Chapman is requesting a one -year time extension for the Miggler Addition preliminary plat. (See his letter on a e 5. P g ) This . plat has eight commercial lots . (See the preliminary plat on Page 4 . ) BACKGROUND September 22, 1986 The Council approved the Miggler Addition preliminary plat for nine commercial lots with several conditions. April 27, 1987, The City Council changed the plat to drop a lot. The City Council also changed the zoning map for this area. This was so the line between the M -1 (light manufacturing) and Co (commercial off ice) zoning districts lined up with a lot line in the plat. (See the zoning map on page 3 and the map on page 4.) September 14, 1987 The City Council approved a one -year time extension for the preliminary plat, subject to the September 22, 1986 conditions. September 26, 1988 The City Council approved a one -year time extension for the preliminary plat with revised conditions. Collins. - From: Director o r . y I Date - ® - _= Subject: Edgerton Ponds Subdivision Road (Hartman Homes) Date: January 7, 1992 Introduction Hartman Homes is building a subdivision of homes known as Edgerton Ponds, and quest 'ons have arisen regarding the condition of the street extending east of Desoto Street and aligning with Ripley Avenue. Backqround At their extended December 23 Council meeting, the Maplewood City Council requested further information on Public Safety requirements for the unapproved road at the Edgerton Ponds subdivision. The Uniform Fire Code is adopted under 299F.001 of the Minnesota State Statutes. Under the subdivision of this statute, it states that local government may adopt an ordinance which is equal to, in addition to, or more stringent than the Fire Code. Therefore, based on Minnesota State Statute, 9 the Fire Code sets the minimum standards, and Maplewoo d has adopted the Uniform Fire Code as our standard. Section 10:301 ( e) states, in part, that when fire protection facilities are to be installed by the developer, such facilities, including al l surface access roads shall be installed and made serviceable prior to and during the time of construction. In order to accomplish this, the Public Safety Department depends upon the Engineering Department to evaluate the proposed road surfaces. When access to or within a structure or an area is unduly difficult because of secured openings or where immediate access is necessary for life- saving or fire - fighting purposes, the chief may require a key box to be installed in an accessible location. Division III INSTALLATION AND MAINTENANCE OF FIRE - PROTECTION, LIFE- SAFETY SYSTEMS AND APPLIANCES Installation x (a)']� Required. The chief shall designate the type and number of ire z appliances to be installed and maintained in and upon all buildings and premises in the jurisdiction other than private-dwellings. This shall be done according to the relative severity of probable fire, including the rapidity with which it may spread. Such appliances shall be of a type suitable for the probable class of fire associated with such building or premises and shall have approval of the chief. (b) Special Hazards. In occupancies of an especially hazardous nature or where special hazards exist in addition to the normal hazard of the occupancy, or 49 4t 5 10.301 - 10.302 UNIFORM FIRE CODE where access for fire apparatus is unduly difficult, additional safeguards may be required consisting of additional fire appliance units, more than one type of appliance, or special systems suitable for the protection of the hazard involved. Such devices or appliances may consist of automatic fire alarm systems, auto matic sprinkler or water spray systems, standpipe and hose, fixed or portable fire extinguishers, suitable asbestos blankets, breathing apparatus, manual or auto- matic covers, carbon dioxide, foam, halogenated and dry chemical or other special fire - extinguishing systems. Where such systems are installed, they shall be in accordance with the applicable Uniform Fire Code Standards or standards of the National Fire Protection Association when Uniform Fire Code Standards do not apply. (c) Water Supply. An approved water supply capable of supplying the required fire flow for fire protection shall be provided to all premises upon which buildings or portions of buildings are hereafter constructed. When any portion of the building protected is in excess of 150 feet from a water supply on a public street, as measured by an approved route around the exterior of the building, there shall be provided, when required by the chief, on -site fire hydrants and mains capable of supplying the required fire flow. Water supply may consist of reservoirs, pressure tanks, elevated tanks, water mains orother fixed systems capable of providing the required fire flow. In setting the requirements for fire flow, the chief may be guided by the provision in Appendix III -A of this code. The location, number and type of fire hydrants connected to a water supply capable of delivering the required fire flow shall be provided on the public street or on the site of the premises to be protected as required and approved by the chief. Embertson �lfv Subject: Licensing of Rental Housing � On Tuesday, December 17, 1991 I went to the City of Brooklyn Park and interviewed Ms. Kris Graham (Housing Inspection Supervisor) and Ms, Marjorie Barnard (Housing Inspector) on their Rental Housing Licensing Program. Brooklyn Park has had a licensing program for approximately eight years. Two years y ears ago the hired their.first Inspector and created their Housing Inspection Department under the Community Development Department. Their licensing covers all rental properties from single - family. dwellings to multi -uni t complexes. All units are licensed on an individual b Their lists of complaints deals primarily with single- family dwellings and duplexes, with very few complaints from apartment occupants. Another item of concern is the maintenance and upkeep of the area outside ( roadways, parking lots, lighting, the deterioration of landscaping, etc.)., all of which has a reflection on the appearance of the City in which it is located. Under their Housing Code, they have provided programs to the tenants involving other City departments (Parks and-Recreation - craft programs, Police - Crime Watch, Fire - proper use of fire extinguishers). Recently, they developed a coalition for rental property owners, providing a program for them (such as having a lawyer speak on various laws for the prope owner, information on programs that will assist them in making repairs to their buildings, etc.). Many times property owners would make the repairs if they could benefit from lower cost loans and knew they existed and how to obtain information about them. This would also benefit the City, provided the person responsible for housing inspections was trained in t h i s field to be aware of the programs offered. Their primary concerns are fire and life safety issues. However, they are also taking steps to avoid the blight that invades a City or area by deterioration that can grow to epidemic proportions. Another item that has been brought to attention is that, by cooperation of departments and communications, property owners have been renting out single - family dwellings and duplexes and have taken tax credits as well (such as homestead) that are not due them. In conclusion, if the City went into this program, it would require an additional P erson to handle this. function and create a Housing Inspection Department. During the summer months, additional staffing could be done by student interns who are enrolled in a Housing Inspection course (from schools such as the U of M). If a format is established such as above, then I feel this program would be beneficial to the City. The City Y does not require a license to operate rental housing. The Council thought licensing might be an alternative to requirin code compliance through the truth-in-housing program for these buildings. BACKGROUND Housing Complaints Most of the housing complaints received by the City are about single dwellings, rather than apartments. Over the p ast five years, we have received 493 single - dwelling complaints and only 77 complaints about apartments. Part of this is because there are.more single dwellings in the City than apartment units. However, th.ere es a higher proportion of complaints about single dwellings than apartments. Only 14% of all complaints received were about apartments, while they account for about 25% of the City's housing units. One of the reasons for the lower rate of p Y complaints in apartments may be the annual ins ections b the Fire Marshal's office. Most of the single- dwelling complaints are about keeping the yard clean. The following is a breakdown of complaints by type over the last five years: Garbage &,Refuse Junk Vehicles Grass & Weeds Miscellaneous 251 118 67 57 Most complaints about apartments deal with problems in the units, such as water leaks, broken windows, fire alarms, broken appliances or no heat. The three apartment projects with the highest number of complaints over the last five years are: i. The County Road B and Barclay Apartments - nine complaints; 2. Larpenteur East Apartments (Larpenteur Avenue and I -35E) - ei.ght complaints; 3. The Canary Hills Apartments (Century Avenue, north of Maryland Avenue) - six complaints. We have not had many complaints from any apartments over the last two years. We have had.only an average of about one complaint a year from each of the three apartment projects listed above. A recent complaint from the Larpenteur East Apartments has resulted in court action against the owner by the City. This project has many housing code violations. Current Inspection „Program The Fire.Marshal's office inspects each rental building with three or more units once.a year. Their inspections are only in the common areas, such as halls, storage rooms and boiler rooms. They do not inspect individual units. The Environmental Health Officer does inspect individual units or the common areas when he gets a complaint. He also inspects individual units in problem buildings when time permits, usually during the winter. In addition, the Metro HRA does a yearly inspection of the unit of each tenant that is on the Section 8 rental program. There are, however, only thirteen tenants on this program in Maplewood. A City inspector will require correction of any code violations, ALTERNATIVES (from least to most restrictive) 1. Do not require licensing of rental housing, but continue the current inspection programs. 2. Require a City license to operate rental housing. The City could deny the license if the owner did not correct code violations found in our current inspection ro ram. The p g license fees would help the City pay for current inspection costs. 3. Require a City license to operate rental housing, subject to passing an annual City inspection of the yard and all or 2 part of the building. This is similar to the programs that Saint Paul and Minneapolis use. (See the reference section on page 5 for more information about the rental licensing and inspection programs in these cities.) DISCUSSION Licensing and Inspections There are two reasons to license apartments. The first reason is to get money to hire a housing inspector to do more inspections of apartment buildings, including individual units. The City already has a limited inpection program. There is not enough need to do more inspections of individual apartment units. Most of our housing problems are with single dwellings. Property owners would pass the cost of a license on to the tenants through rent increases. The second reason for licensing is to give the City more power in enforcing the housing code. Rather than sending housing violations to the court, the City could use the threat of pulling a license to enforce the Code. The City, however, has not had a problem with the courts enforcing the housing code. We have only had to send three cases in five years to the courts. The Court issued a fine on one, one was against a tenant who disappeared and the last is the current case against Larpenteur East Apartments. Licensing has more value for St. Paul and Minneapolis. They have many amore and older apartments with more code violations. The City may want to consider licensing in the future, if housing code violations in apartments - increase as buildings get older. Until then, the Council should approve alternative one. This would be the most cost effective. Truth -in- housing The City should continue the truth -in- housing program for rental buildings. This program helps protect the buyers of rental buildings as it does for home buyers. Rental property buyers may not be more knowledgeable about building conditions than home buyers. Many of the.people buying rental housing are investors without knowledge of housing problems. The inspections by private inspectors will supplementing staff inspections at no cost a good time to get Code compliance, since hands. help the City by to the City. This is there is money changing 3 Housing Code One of the problems we have, had with housing inspections is the City's housing maintenance code. The City Council adopted the rental housing maintenance code on June 5, 1980. There are several items not covered by the code that staff feels should be. Much of the language in'the code is out - dated. If the City strengthened and'up -dated the code, it would help staff and the City in dealings with rental housing problems. Areas of concern with the code include the maintenance of landscaping and yards, driveways, parking areas, fences and exterior storage.. The maintenance requirements should include requirements for interior areas on removing graffiti, the repair of the provided appliances, refuse and garbage disposal, window locks and screens. The Fire Marshal has also requested an update to the sections of the code about fire safety. I have attached a revised code. RECOMMENDATION 10 Do not require licensing but continue our present inspection program, including special inspections of individual units in problem buildings as time permits (Alternative One). 2. Continue to require compliance with the rental housing code as part of the City's truth -in- housing program. 3. Adopt the attached ordinance which updates the rental housing maintenance code. 4 REFERENCE Saint Paul uses a certificate of occupancy program for buildings with three or more rental housing units. Saint Paul has a provision in their City Code requiring rental properties to meet all Code requirements or they may revoke the certificate of occupancy. This includes the Fire, Zoning, Housing and Building Codes before the City will renew a certificate of occupancy. Saint Paul must approve a building's certificate of occupancy once every two years. This is done by having an inspector from the Fire Marshal's office do an inspection of the property. This inspection is done at least one time every two years. In Minneapolis, every rental dwelling (including single dwellings and.rental units in duplexes) must have a rental license issued by the City. Minneapolis began their program on January 1, 1991 so they are just getting it under way. Minneapolis issued all rental properties a temporary license until the City can make an inspection of each property. In Saint Paul, if the City revokes a building's certificate of occupancy, the property owner cannot legally operate the building as a rental property. This system motivates the owners of rental property to correct the problems without displacing tenants. That is, the rental property owners know that they must meet the codes or the City may revoke their certificate of occupancy. Saint Paul may condemn the violating units or the entire building if they revoke a certificate of occupancy and the owner does correct the problems. In Minneapolis, rental properties must pass an inspection by a City inspector to keep their rental license. A point system from the Housing Maintenance Code is the basis for this. If a property in Minneapolis does not have a rental housing license, the owner cannot legally use it as a rental property. Thus if the City revokes, suspends or does not renew a rental housing license, the City must give orders to have the affected units vacated. This position was not filled in an effort to balance the city budget after the state aid payments were cut. This position is also budgeted for 1992. KGH i Attachment Request additional Street Maintenance person: This division presently has a foreman and eight saintenance persons. Staffing as been at this g level since 1968. It is the only department /division that has not increased its staff in the last 23 Y ears. The need is probably best typified by the growth of the city. Reliable records of the roadway miles in the city in 1968 do not seem to exist however, records for 1974 indicate a 23.3 percent increase in center line wiles. Assuming a 30 percent increase in ane miles 'Asi 0 nce 1968 is not.unreasonable. It is these lane miles which must be maintained. .Miles of roadway is certainly the major factor to be taken into account. But the condition of the roadways Y must also be considered when determining the amount of work to be performed. Condition very closely equates to age, and undeniably our roadways are aging. Certainly an additional man will appear to indicate a higher pp g r maintenance cost per year, but the result of more maintenance will manifest in a longer service ' g life of the existing roadways and will tend to spread replacement cost over a - longer - period of time. Maplewood's roads are the city's most expensive asset, and should be well maintained in order to preserve their value. Worthy of mention is the fact that there will be some (difficult to quantify) savings in overtime durin g the snow season. This account is one of the most difficult accounts to estimate. DIRCI IS SInN In 1991 the City Council decided that the first meeting of the month would be cable cast live. Other options to explore are: Cable cast live both regular City Council meetings (the second and fourth Mondays of the month) . Since the camera equipment is permanently installed in the Council Chambers, we are limited to cable casting only meetings conducted in that room. Play back the taped Council meetings. With the installation of the new playback equipment, the tapes of the meetings can easily be programmed to play anytime during the day or week. Cable cast live the Planning Commission meetings. The production services account with SCC is the funding source for the cable casting costs. If SCC terminates its lease, the Council will have to consider another source of money to continue cable casting. There is probably enough credit in the account for the remainder of 1992. Now is the appropriate time to make the appointments. DISCUSSION City Prosecutor The current law firm used for prosecution services is Peterson, Bell., Converse and Jensen. Public Safet staff is ver satisfied with the services provided b Martin Costello which include trainin of sworn officers as well as representin the cit in Court. There has been an increase in workload for the Cit prosecutors durin the last several y ears, and Peterson, Bell, Converse and Jensen have re an increase in their retainer. Based on 1991 information about the number of complaints, court appearances and hours spent on Maplewood cases, it is recommended that the Cit Council reappoint Peterson, Bell, Converse and Jensen to serve as the Cit prosecutor in 1992 and that the monthl retainer be increased from $4,600 to $5,000. This is a 8,70 increase. Civil Matters The Cit contracts with the law firm of Banni & Kell for civil le matters. The Cit is ver satisfied with the firm's performance. The Cit pa for Banni & Kell services on an hourl rate which was increased last y ear. It is recommended that the Cit Council reappoint Banni & Kell to serve as the Cit attorne in 1992 and make no chan in the hourl rates.
