Finalube CUP Review (2180 White Bear Avenue) Reviewed and renewed the Conditional Use Permit for a public garage located at 2180 White Bear Avenue and will review again if a problem arises. 9. Goodwill Store CUP Review (2250 White Bear Avenue) Reviewed and renewed the Conditional Use Permit for the expansion of a parking lot at 2250 White Bear Avenue and will review again if a problem arises. 10. Village on Woodlynn CUP Review (2120 -2124 Woodlynn Avenue) Reviewed and renewed the Conditional Use Permit for a senior housing project located south of Woodlynn Avenue and East of Ariel Street and will review again if a problem arises. 11. Minnesota Cellular Telephone Company CUP Review (2670 Highwood Avenue) Reviewed and renewed the Conditional Use Permit for a radio /telephone communications facility at 2670 Highwood Avenue. Mayor Bastian convened the meeting for a public hearing regarding a Conditional Use Permit for Champps to expand their parking by 66 additional stalls on the east side of their current parking lot. b.- Manager McGuire introduced the staff report. c. Community Development Director Coleman presented the specifics of the report. d. Boardmember Marie Robinson presented the Community Design Review Board report. e. City Attorney Kelly explained the procedure for public hearings. f. Mayor Bastian opened the public hearing, calling for proponents or opponents. Couneilmember Rossbach introduced the following Resolution and moved its ado to ion: 97 - 08 - 101 CONDITIONAL USE PERMIT - PARKING LOT EXPANSION, 1734 ADOLPHUS WHEREAS, the Champps Americana has requested.a Conditional Use Permit to expand their parking lot into the Interstate 35 E,right -of -way; WHEREAS, this permit applies to 1734 Adolphus Street. The legal description is: SUBJECT TO STREET PART WEST OF HIGHWAY OF NORTH 465 FEET OF SOUTH 755 FEET OF SOUTHEAST 3 OF SOUTHEAST 3 OF SECTION 18, TOWNSHIP 29, RANGE 22 IN THE VILLAGE OF MAPLEWOOD WHEREAS, the history of this Conditional Use Permit is as follows: 1. On July 29, 1997, the Community Design Review Board recommended that the City Council approve this permit. 2. On August 25, 1997, the City Council held a public hearing. The City staff published a notice in the paper and sent notices to the surrounding property owners. The Council gave everyone at the hearing a chance to speak and present written statements. The Council also considered reports and recommendations of the City staff and Planning Commission . NOW, THEREFORE, BE IT RESOLVED that the City Council approve the above - described Conditional Use Permit based on the building and site plans. The city approves this permit because: 1. The use would be located, designed, maintained, constructed and .operated to be in conformity with the city' s Comprehensive Plan and Code of Ordinances. 2. The use would not change the existing or planned character of the surrounding area. 3. The use would not depreciate property values. 4. The use would not involve any activity, process, materials, equipment or methods of operation that would be dangerous, .hazardous, detrimental, disturbing or cause a nuisance to any person or property because of excessive noise, glare, smoke, dust, odor, fumes, water or air pollution, drainage, water run -off, vibration, general unsightliness, electrical interference or other nuisances. 5. The use would generate only minimal vehicular traffic on local t streets and would not create traffic congestion or unsafe access on existing or proposed streets. 6. The use would be served by adequate public facilities and services, including streets, police and fire protection, drainage structures, water and sewer systems, schools and parks. 8 -25 -97 7 7. The use would not create excessive additional costs for public facilities or services. 8. The use would maximize the preservation of and incorporate the site's natural and scenic features into the development design. 9. The use would cause minimal adverse environmental effects. Approval is subject to the following conditions: 1. All construction shall follow the site plan approved by the city. The Director of Community Development may approve minor changes. 2. The proposed construction must be substantially started within one year of Council approval or the permit shall become null and void. The Council may extend this deadline for one year. 3. The City Council shall review this permit in one year. 4. The applicant shall obtain a permit from MnDOT allowing the parking lot expansion into the I -35E right -of -way. Revise the parking plan for staff approval, before starting work, showing: a. Five handicap - accessible parking spaces on the north side of the building. These spaces must meet ADA requirements for size, loading aisles and signage. b. A gate in the freeway -side fence for MnDOT access to maintain the landscaping. 3. Obtain a permit from MnDOT to expand the parking lot into their right -of -way before starting work. 4. Screen the trash dumpsters as viewed from the north parking lot. 5. Provide landscaping in the strip between the existing and proposed asking lots. The applicant shall submit a plan for this landscaping to staff for approval. All work shall follow the approved plans. The Director of Community Development may approve minor changes. Approval is for the addition of 66 stalls, but could be increased to 88 total with approval by MnDOT and design approval by the City. Mayor Bastian convened the meeting for a public hearing regarding a Conditional Use Permit for Quality Restoration Services to have an outside storage yard for their ground restoration equipment, such as trucks and trailers. b. Manager McGuire introduced the staff report. c. Community Development Director Coleman presented the specifics of the report. d. Commissioner Milo Thompson presented the Planning Commission report. e. City Attorney Kelly explained the procedure for public hearings. f. Mayor Bastian opened the public hearing, calling for proponents or opponents. The temporary storage of work - related materials, such as dirt pil and cable spools, for example, may be permitted. These materials may be kept on site for no more than one month. No more than 25 percent of the site shall be used for the storage of such materials. 5. Normal hours of operations shall be 6:30 a.m. to 7:30 p.m. Monday p through Friday. Councilmember Koppen introduced the following Resolution and moved its a ado tion : 8 -25 -97 11 0 97 - 08 - 103 ESTABLISHMENT OF PROJECT FUNDS - HARVESTER AVENUE WHEREAS, it is proposed to reconstruct the street and construct storm sewer on Harvester Avenue and overlay the remainder of the neighborhood, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL of MAPLEWOOD , MINNESOTA: That the proposed improvement be referred to the City Engineer for analysis and that he is instructed to coordinate informal neighborhood meetings to discuss the proposed improvements with the residents and to prepare a preliminary topographic survey and to report to the Council with all convenient speed advising the Council whether a feasibility study should be prepared. Dat TO: City Manager FROM: Chad Bergo, Community Development Intern SUBJECT: Conditional Use Permit Review - Countryside Volkswagen /Saab LOCATION: 1180 Highway 36 East DATE: August 18, 1997 INTRODUCTION The conditional use permit (CUP) at 1180 Highway 36 East is due for review. The CUP allows the expanded operation of the motor vehicle maintenance and repair garages. This site is occupied by Countryside Volkswagen. Refer to pages 3 -4. BACKGROUND January 9, 1995: The city council granted the CUP and approved the expansion of Countryside WV's maintenance, service, sales and, showroom space. Refer to the minutes on page 5. The council also approved a ' right -Of -way vacation resolution assigning an 84- by 17.5 -foot section of frontage along Highway 36 to Countryside VW. February 12, 1996: The City Council reviewed the CUP and required their review again in one year. March 25, 1996: The city council granted sign variances to Countryside VW to install two additional freestanding signs and one freestanding sign that would be 3.5 feet taller than the allowed height of 25 feet. DISCUSSION The. applicant has completed all of the required work except for parking lot striping, installing stop signs and handicap parking signs and screening of the trash dumpsters. I spoke with John Schmelz on August 18, 1997, and he is aware of the required work left to do. H said that there was some trouble with the new asphalt layer they had applied to their lot and.they are waiting for the necessary improvements before striping and signage are completed. Mr. Schmelz said they moved their trash dumpsters because of the asphalt problem and will either return them to their approved location between buildings or construct a trash enclosure at the p resent location. Mr. Schmelz said all of the work will be completed by September 19, 1997. The city council should review this CUP again this fall to make sure all of the work has been finished. Once all the work has been completed, the city council should waive these periodic reviews. This final plat is the second phase of the Oak Ridge development, and would create 56 lots for houses and four outlots. This plat is along Sterling and Mary Streets, east of Montana Ave (See the maps on pages 3 - 5.) BACKGROUND On February 8, 1993, the city council approved the preliminary plat, subject to seven conditions. On January 24, 1994, the city council approved a time extension for Phase One of the Oak Ridge Estates preliminary plat. This tim extension was subject to the February 8, 1993 conditions. The council said that the city shall complete the annual review for Phases Two, Three and Four after June 1, 1994. On June 13, 1994, the city council approved a one- year.time extension for Phases 2 -4 of the Oak Ridge Estates preliminary plat. This time extension was subject to the February 8, 1993 conditions. On September 12, 1994, the city council approved the Oak Ridge Estates final plat. This plat created 37 lots for houses in the first phase of the development. O M 22, 1995, the council approved a one -year time extension for Phases 2 -4 of the Oak Ridge Estates preliminary plat. This extension was subject to th February 8, 1993 conditions. On May 13, 1996, the council approved a one -year time extension for Phases 2-4 of the plat and revised the conditions of approval. (See the council minutes on pages 7 -9.) On May 12, 1997, the council approved a one -year time extension for Phases 2-4 of the plat, subject to May 13, 1996 conditions of approval. DISCUSSION Mr. Gonyea is progressing with this phase of the plat. The contractor has installed the utilities and is now finishing the street construction. Mr. Gonyea has finished all the conditions the council required for final plat approval. RECOMMENDATION Approve the Oak Ridge Estates Second Addition final plat. (i) Before the City approves a final plat, the City will decide whether to abandon and replace the 16 -inch water main from Lot 84 to the railroad. Rejecte �..... Dat Maplewood city staff is asking the city council to vacate several unused streets and alleys. These are west of Ariel Street and south of County Road C. They include parts of Oak Avenue, Connor Avenue, Demont Avenue, Edgehill Road, German Street and undeveloped alleys between Ariel Street and White Bear Avenue. Refer to the maps on pages 3 and 4. BACKGROUND On 2- 13 -89, the city council vacated part of Oak Avenue abutting Lots 16 through 24, Block 1 for the following reasons: 1. The adjoining property owners have no interest in improving the street. 2. The adjoining properties have adequate street access. 3. This street segment is not needed for area traffic circulation or emergency vehicle access. DISCUSSION The city is requesting. these vacations because it has no plans to develop these streets and alleys. There is a large wetland south of County Road C between German Street and Ariel Street. Ramsey County owns 11.6 acres of land for open space, south of County Road C. (See the, map on page 4) Because of the wetlands and open space, it is not necessary for the city to keep these right -of -ways. The city must keep a utility and drainage easement over the vacated right -of -ways for existing sanitary and storm sewers. COMMISSION ACTION On August 4, 1997, the planning commission recommended approval of the proposed vacations. RECOM MENDATION Adopt the resolution starting on page 5. This resolution vacates the unused portions of Oak Avenue, Connor Avenue, Demont Avenue, Edgehill Road, German Street and alleys between Ariel Street and White Bear Avenue. DISCUSSION As .proposed, Subsection (b) clarifies that the proposed particular fees are allowable only when associated with a single-family dwelling. Also, staff has added set permit fees to this section for roof replacement and utility structures (such as garden sheds). Staff added Subsection (c) to clarify which maintenance items require a building permit from the city. In addition, this subsection specifically mentions certain 'improvements that do not need a building permit. The Community Development Department staff considers these revisions reasonable and beneficial to all Maplewood residents while maintaining the highest level of quality and service. RECOMMENDATION Adopt the ordinance on pages 2 and 3. DATE: August 29, 1997 INTRODUCTION The City Council at the August 11, 1997 council meeting directed staff to prepare a moratorium ordinance restricting development in Maplewood south and. east of :Interstate 494. Staff has prepared an ordinance which outlines the reasons for the moratorium and the issues which are to be studied. After the study is completed staff will review any proposed changes to the city code and /or comprehensive plan with the planning. commission for their recommendation to the City Council. RECENT ACTION On August 25, 1997, the city council approved first reading of the moratorium ordinance. They directed staff to include a phasing plan for the planning and zoning study and bring back for second reading on September 8, 1997. RECOMMENDATION The proposed ordinance has been changed to include a phasing plan for the study (see section 2.02). Staff recommends that council adopt the moratorium ordinance on page 2. This ordinance establishes a moratorium on development in Maplewood south and east of Interstate 494 until March 8, 1998. ORDINANCE NO, ORDINANCE FOR THE PURPOSE OF PROTECTING THE PLANNING PROCESS AND THE HEALTH, SAFETY AND WELFARE OF CITY RESIDENTS; AND REGULATING AND RESTRICTING DEVELOPMENT IN AREA OF MAPLEWOOD SOUTH AND EAST OF INTERSTATE 494. THE CITY COUNCIL OF THE CITY OF MAPLEWOOD ORDAINS: SECTION 1. PURPOSE 1.01 The city's zoning ordinance does not contemplate or adequately address residential development in areas without public water and sanitary sewer. 1.02 The city's zoning ordinance is unclear as to how these areas should be classified and what the minimum lot size should be. 1.03 In addition to the proper zoning classification, the comprehensive land use plan must be revised to study such issues as: - storm water runoff and drainage - traffic and street planning public safety such as police and fire - the use of septic tanks and drainfields in leu of public facilities - the use of wells and assessment of existing aquifers 1.04 There is a need for a study to be conducted so that the city can adopt a comprehensive plan and land use zoning pertaining to the development of this area of Maplewood. SECTION 2. PLANNING AND ZONING STUDY; MORATORIUM 2.01 A study is authorized to be conducted by city staff to determine how development in this section of the city should be regulated. The scope of the study should include, but is not limited to, the following: a. The minimum and /or maximum lot sizes b. The density of residential development lc. Tthe compatibility of small lots with the surrounding area d. A fiscal impact analysis of providing public services such as water, sewer, storm, streets, and police and fire protection e. Review environmental issues such as groundwater pollution and protection, tree preservation and existing aquifers 2.02 Staff will conduct this study in one or more phases. Phase One will include a base line analysis of land availability, topography, tree inventory, and physical constraints pertaining to providing public water and sewer service. Staff will present these findings to city council. Council will then determine level of detail for additional phases of the study and whether or not additional study is needed. 2.03 Upon completion of the study, the matter is to be considered by the planning commission for its review and recommendation to the city council. 2.04. A moratorium on development in this study area is adopted pending completion of the study and the adoption of any amendments to the city's zoning ordinance and comprehensive plan. No plat shall be reviewed or approved during the moratorium period nor may any rezoning, replatting, zoning, land divisions or consolidations be granted by the city during the moratorium period. Building permits may be issued on existing platted Lots or lots of record. SECTION 3. TERM 3.01 The term of this ordinance shall be six months or until such time as the council adopts amendments to the zoning ordinance and comprehensive plans relating to development in the study area. SECTION 4. VARIANCES 4.01 Variances from this ordinance may be granted by the city council based upon a determination that a proposed subdivision or deve opment would be compatible with existing or proposed land use and zoning and that such proposals would be in keeping with the spirit and intent of this ordinance. The procedures to be followed in applying for a variance from this ordinance shall be in accordance with state law on findings for variances and shall include the following: a. The applicant shall file a completed application form, together with required exhibits to the community development department. b. The application for a variance shall set forth special circumstances or conditions which the applicant alleges to exist, and shall demonstrate that the proposed development incompatible with existing or proposed land use and zoning. c. The application shall be submitted to the planning commission for their review and comment. d. The city council may in its discretion set a public hearing prior to making a final determination on the requested variance. e. The city council may impose such restrictions upon the proposed development or subdivision may be necessary to comply with the purpose and intent of this ordinance. SECTION 5. Refer to the maps on pages 3 -5 and the letter on pages 6 -7 from Eric and Lori Ahlness. Their complaints are concerning excessive noise and the outside storage of materials, vehicles and equipment. Mr. Sobota is not Complying with the city council's conditions of approval for his building and operation (refer to the minutes below). Typically, a complaint such as this is handled through orders from staff to comply with council requirements -- if compliance is not made, we would prosecute. In this instance, however, we have a nonconforming use that has expanded beyond the scope of the original proposal. The code would require a conditional use permit (CUP) for such an expansion of use, Although Mr. Sobota has not applied for a CUP, staff feels that the city council should review this case to hear Mr. and Mrs. Ahlness' complaints and discuss Mr. Sobota's operation with him. Mr. Sobota has also expressed interest in building a second building on his property. BACKGROUND Conditions of Approval May ,18, 1978: The city council approved a variance for Mr. Sobota to construct a storage building with access from Skillman Avenue, an undeveloped right -of -way east of English Street. Mr. Sobota proposed to build his driveway on this right -of -way. The council approved this, subject to the following conditions: 1. The driveway design shall be approved by the city engineer and shall be a minimum of 25 feet in width. 2. The applicant shall sign an agreement to maintain the drive to city standards including snow plowing. This agreement shall be recorded to run with the property. June 1, 1978: The city council approved the building design plans for Mr. Sobota's equipment storage building, subject to the following conditions (please note that Mr. Sobota's business was a conforming use in 1978 because the property was zoned BC, business commercial at that time — the council rezoned it to R -2, double dwelling in 1983): 1. Provision of at least six parking spaces, designed to city standards. 2. No outside storage of machinery, vehicles and supplies. 3. Pave the parking lot and drive. The city engineer may approve a substitute material if he feels that it is equivalent in performance, subject to review in one year and if a hard surface is required, the applicant will comply. 4. The drive to be at least 25 feet in width, subject to review in one year and if widening is required the applicant will comply. 5. The owner and applicant shall agree to the above conditions in writing. Tenant — MOW Green In 1990, Gary Mogren, owner of MOW Green, requested a CUP to move his business onto Mr. Sobota's site. While reviewing this request, the city attorney advised Geoff Olson, the former Community Development Director, that Mr. Sobota's business is a legal- nonconforming use and, therefore, "grandfathered in. Refer to Mr. Mogren's Fetter on page 8 and the note from Mr. Olson on page 9. DISCUSSION The ongoing outside storage is a violation of the city's present code and the 1978 conditions of approval. The city council should require that Mr. Sobota cease the outdoor storage activity or apply for a CUP for the expansion of a nonconforming use. Staff does not see any reason to allow this permit, however, should Mr. Sobota apply. This area has evolved from a commercially -zoned neighborhood, bordered by a working railroad line, to a residentially -zoned and developed neighborhood. The city council should give Mr. Sobota a deadline to comply with their original conditions of approval. Two months should be sufficient time to eliminate the outside storage of machinery, vehicles and supplies as stipulated by the city council. COUNCIL ACTION August 25, 1997: The city council tabled action on this issue to give Mr. Sobota two weeks to consider what he can do to comply with council conditions. Staff has been unable to contact Mr. Sobota about his plans for the property. As such, staff has not changed our recommendation for clean -up of the property. I apologize for not getting these developed and over to you sooner. As I expressed in our conversation, I am concerned about three areas in particular when it comes to this landscaping business in the midst of a residential area. e,pp y it for "Equipment Stora g The original request for this site was to simply put in a "equipment storage building" for a Landscaping company. This has evolved into a business center for a landscape business. The intent of the conditional use permit has been violated as demonstrated by the enclosed pictures. One of the conditions stipulated "No outside storage of machinery, vehicles, and supplies". The pictures clearly demonstrate that the landscape business has violated this stricture in spirit and deed. The landscape business routinely parks equipment, vehicles, and stockpiles landscaping supplies on site and in the open. Additionally, the business stores junk (old wire, pallets, metal and wood scrap, vehicle and machinery parts) indefinitely throughout the site. NQ.ise The landscaping business routinely has equipment loading and unloading as early as 5:00 a.m. and as late as 10 :00 p.m. These activities involve large dump trucks, bulldozers, and loaders moving rock and other material. This is very noisy. It disrupts the residential nature of our neighborhood. At times it has disrupted family gatherings in our own backyard. The Community Development Department provided me a copy of the Maplewood Code, Article III (NOISE CONTROL), Sec. 1948 through 19 -51 after I inquired about what could be done regarding this noise. It was clearly explained to me by the department that this ordinance applies to this case. The ordinance states that distinct and loud noise "between the hours of 7:00 p.m. and 7:00 a.m. Monday through Saturday and all day Sunday" is a violation of this ordinance. Despite numerous calls to the Police Department to enforce Section 19 -51 of this ordinance, the landscaping business has not altered its business practice. The hearings must be held between November 29 and December 20 but must not conflict with hearings for the county, metro special taxing districts or the three school districts in Maplewood. The dates not available for public hearings are listed in the attached letter. The second page attached lists the dates available. The hearing must be held after 5:00 p.m. if it is on a day between Monday and Friday; a Saturday hearing may be held at any reasonable time. Additional information on public hearing requirements are in the last three pages attached. The City's final property tax levy and final budget must be adopted at another hearing held on a date subsequent to the initial public hearing and the continuation hearing if one is held. The City can approve its levy and budget on a date which may coincide with another unit's truth in taxation public hearing or continuation hearing. II THAT CITIETRUTH IN TAXATION PROVISIONS S SHULD PAYABLE YEAAWARE OF FOR THE TAXES Selection of the Date, Time, and Place for the Public Hearing 1. The count auditor is responsible for the coordination of the selection of Truth in Taxation hearing dates for the cities and for the school districts within the county. This includes both initial hearing dates and continuation hearing dates. All of the initial and continuation hearing dates selected by the cities and school districts must fall within the time period of November 29, 1997 through December 20, 1997. Cities of 500 population or less are exempt from the Truth in Taxation hearing requirement. Therefore, only the cities over 500 population are involved in this hearing date selection process. The school districts make their selections first, and then the cities. No school district may select the second or third Tuesday in December (December 9, 1997 and December 16, 1997) for either its initial hearing date or its continuation hearing date, since these are the dates set aside for county initial hearings and county continuation hearings, respectively. In addition, within the seven county metropolitan area, no school district may select the first or second Monday in December (December 1, 1997 and December 8, 1997) for either its initial hearing date or its continuation hearing date, since these are the dates set aside for the metropolitan special taxing districts to hold their joint initial hearing and their continuation hearings, respectively. The same rules apple to the cities over 500 population, except that a city may select a date for its continuation hearing that conflicts with the continuation hearing date (but the initial hearing date) of another taxing authority (county, school district. or metropolitan special taxing district) if the city deems it necessary. Truth in Taxation public hearings cannot be held before November 29, 1997. Among other things, this restriction allows the counties to get the parcel specific notices delivered to property owners prior to the public hearings. Also, these hearings cannot be held after December 20, 1997. This restriction gives the county auditors time to complete the tax lists for payable 1998 and the county treasurers time to mail out the property tax statements for payable 1998 by the statutory deadline. 2. The continuation hearing date selected by a city over 500 population or by a school district must be at least 5 business days after the initial hearing date but no more than 14 business days after the initial hearing. Only one continuation hearing date is allowed. The last day that a city or a school district may hold a continuation hearing is December 20, 1997. If a December 20, 1997 date is selected by a city or by a school district for a continuation hearing, the initial hearing could be held no later than December 13, 1997. A city or a school district could hold the initial hearing on a day in the time period from December 15 to December 20, 1997, but this would disallow the holding a continuation hearing. (December 16, 1997 is excluded since this is the date for county continuation hearings.) If the- initial hearing is held within this time period, it would have to run until it is completed. �. In the case of a city over 500 population and a school distract whose boundaries overlap, the initial or continuation hearing of the city or the school district should not be scheduled for the same day that a special election will be held within the city or the school district. If this conflict occurs, the city's or school district's hearing would either have to begin at 5 :00 PM, run until 6:00 PM and then adjourn until 8:00 PM, or else not begin until 8:00 PM. This is because state law provides that public meetings cannot be held between the hours of 6:00 PM and 8:00 PM on the day that an election is conducted if there would be a conflict between the public hearing and the election. 4. The public Truth in Taxation hearing (initial or continuation) may be held on an 'N" day of the week except Sundav or a holiday. If held on a day between Mondav and Friday, the hearing must be held after 5:00 P.M. If held on a Saturday, the hearing may be held at anv reasonable time of day. 5. The public Truth in Taxation hearing (initial or continuation) of a cit over .500 population may be held on the same day as a regularly scheduled meeting (subject to the restrictions mentioned above), but must be handled as a separate hearing. 6. On or before August 20, 1997, the county auditor must notify the clerk of each city over 500 population within the count of the dates on which the school districts will be holding their public hearings, as well as their selected dates for continuation hearings in case continued hearings become necessary. (Cities that are located in two or more counties should be notified if their combined population from all of the counties in which they are located is over 500.) 7. On or before September 15 the governing body of each city must certift to the county auditor(s) of the county(ies) in which the city is located the date that it has selected for its public hearing, as well as a date for a continuation hearing in case a continued hearing becomes necessary. If not certified by this date, the county auditor (or home county auditor in the case of cities located in two or more counties) will assign the hearing dates for the city. The date for the city initial hearing must not conflict with the county hearings, with the hearings of any school district located within the city, or with the hearings of the metropolitan special taxing districts. However, a city may select a date for its continuation hearing that conflicts with the continuation hearing date of another taxing authority (county, school district, or metropolitan special taxing district) if the city deems it necessary. Since the county auditor of each county must coordinate the hearings held within his or her county to prevent conflicts, it is not sufficient for a city located in two or more counties to notify just i� the home count auditor. The county auditor of each of the counties in which the city- is located must be notified. 8. Ramsey County, the city of St. Paul, and Independent School District No. 625 are authorized and required to hold a joint public hearing. The hearing must be held on the second Tuesday in December (December 9 in 1 997). These three taxing authorities may still schedule continuation hearings, which do not have to be held jointly. Ramsey County may schedule additional initial hearings for the convenience of the citizens of the county, but if only one initial hearing is held (the joint hearing), it must be held in a St. Paul location convenient to all of the residents of Ramsey County. Adoption of Proposed Property Tax Levy 1. Each city (including cities of 500 population or less) must adopt its proposed property tax levy for the taxes payable year 1998 and certify that amount to the count auditor of the county in which the city is located (home county auditor in the case of a city located within two or more counties) on or before September 15. No extension of this deadline will be granted. The proposed property tax levy certified should be the city's proposed property tax levy for all purposes, including debt service. 2. All townships and all special taxing districts must have their proposed property tax levies certifi to the county auditor on or before September 15, but they are exempt (except for the three metropolitan special taxing districts) from the public hearing and publication requirements under Truth in Taxation. No extension of this deadline will be granted. 3. Market value based referendum taxes must be certified separately from the rest of a city's proposed property tax. 4. If two or more taxing authorities are negotiating an agreement for the sharing, merger, or consolidation of services at the time that the proposed levy is to be certified, each of them is to certify its proposed levy to the county auditor and include a notification of the specific service or services involved in the agreement that is not yet finalized. Each of these taxing authorities may amend the portion of its proposed property tax levy relating to the specific service or services involved as late as October 10 of the levy year to reflect the result of the negotiated agreement. 4.
