8. Resolution Authorizing Execution of Sub -Grant Agreement
Adopted the following resolution, authorizing execution of Sub -Grant Agreement
RESOLUTION 00 -08 -081
RESOLUTION AUTHORIZING EXECUTION OF SUB -GRANT AGREEMENT
BE IT RESOLVED THAT THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, enter into a
Sub -grant agreement with the Division of Emergency Management in the Minnesota Department of
Public Safety for the program entitled Infrastructure Program for FEMA 1333 DR- MINNESOTA.
Acting City Manager Ken Haider is hereby authorized to execute and sign such Sub -grant
Agreements and amendments as' are necessary to implement the project on behalf of the City of
Maplewood.

1. 7:00 P.M. Comprehensive Plan Update - Historic Resources Management Plan (4 votes)
a. Mayor Cardinal convened the meeting for a public hearing.
b. Acting City Manager Haider introduced the staff report.
C. Community Development Director Coleman presented the specifics of the report.
d. Commissioner Dale Trippler presented the Planning Commission report.
e. Mayor Cardinal opened the public hearing, calling for proponents or opponents. The
following persons were heard:

Councilmember Koppen moved to aDprove the first readin of the following ordinance changin
Section 3 6 -151 (Business Commercial) District:

AN ORDINANCE CHANGING SECTION 36 -151
(BUSINESS COMMERCIAL) DISTRICT
The Maplewood City Council approves the following changes to the Maplewood Code of
Ordinances:
Section 1. This section changes Sections 36- 151(a)(1) as follows (additions are underlined and the
deletions are crossed out):
(1) A dwelling unit for one family is permitted h with a business use. The
dwelling unit and the principal business use must be in the same structure.
Section 2. This ordinance shall take effect after the city publishes it in the official newspaper.

1. Public Works Building Roof - 1902 E. County Road B
Acting City Manager Haider introduced the staff report.
Mayor Cardinal moved to ado t the following Resolution for Award of Bid for the replacement of
the roof at 1902 East County Road B to Sela Roofing in the amount of 135.500 and that money be
transferred from the contin2encv fund in the amount of $32,500 to Acct. 101 - 115- 000 -4730:

RESOLUTION 00 -08 -082
RESOLUTION FOR AWARD OF BIDS
BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, that the bid of
SELA Roofing in the amount of $135,500 is the lowest responsible bid for replacement of the
public works building roof at 1902 East County Road B and the mayor and clerk are hereby
authorized and directed to enter into a contract with said bidder for and on behalf of the city.
The finance director is hereby authorized to make the financial transfers necessary to implement the
financing plan for the project.

1. Frank Frattalone, the applicant, discussed the traffic control issue with the council.
2. Ed Terhaar, Senior Transportation Engineer, Benshoof & Associates, Inc., also
discussed the traffic control issue with the council.

A. Comprehensive Plan Changes - (4 votes)
- R -1 (single dwellings), R -1 S (single dwellings -small lot) and M -1 (light
manufacturing) to R -3(M) (residential medium density)

Councilmember Koppen moved to adopt the following Land Use Plan Change Resolution which
changes the land use plan for the Highpoint Ridge residen develoDment, south of Countv Road
D, west of Highway 61. These changes are from R -1 (single dwellings), R -1 S (single dwellings -
small lot) and M -1 (light manufacturing ) to R-3(M) (residential medium density) for the site and
drop the planned minor collector street between County Road D and Highway 61:

Councilmember Wasiluk moved to approve the following resolution approving the land use plan
change for the proposed townhomes and the single - family homes, and leaving the proposed
apartment house area unchanged (this remains M -1
RESOLUTION 00 -08 -083
LAND USE PLAN CHANGE RESOLUTION
WHEREAS, Frank Frattalone proposed changes to the city's land use plan from R -1 (single
dwellings), R- IS (single dwellings -small lot) and M -1 (light manufacturing) to R -3(M) (residential
medium density) for the site.
WHEREAS, this change applies to property for the Highpoint Ridge PUD south of County Road D
and west of Highway 61 in Section 4, Township 29, Range 22, Ramsey County, Minnesota.
WHEREAS, the applicant also requested a change to the land use plan to drop the planned minor
collector street between County Road D and Highway 61.
WHEREAS, the history of this change is as follows:
1. On June 19, 2000, the planning commission held a public hearing. The city staff published a
hearing notice in the Maplewood Review and sent notices to the surrounding property
owners. The planning commission gave everyone at the hearing a chance to speak and

present written statements. The planning commission recommended that the city council
approve the western part of the proposed plan (west of the existing M -1 zoning line),
including the plan amendment for the area west of the M -1 line.
2. On July 10, 2000, the city council discussed the proposed land use plan changes. They
considered reports and recommendations from the planning commission and city staff.
3. On August 14, 2000, the city council again considered the above - referenced requests.
NOW, THEREFORE, BE IT RESOLVED that the city council approve changes for the following
reasons:
1. The development would be consistent with the goals and objectives of the comprehensive
plan.
2. The town house site in the development is proper for and consistent with the city's policies
for medium and high- density residential uses. These include:
a. Creating a transitional land use between the existing and proposed low density
residential and commercial land uses.
b. It is on an arterial street and is near a collector street.
3. This development will minimize any adverse - effects on surrounding properties because:
a. The proposed single dwellings will separate the proposed town houses from existing
homes.
b. There should be no significant traffic increase from this development on existing
local residential streets. The proposed street pattern keeps the town house traffic
separate from the proposed and existing single dwellings.
4. The city nor the developer plan to build the proposed collector street between County Road
D and Highway 61 because the of the existing and proposed grades, the existing power lines
and the existing pipelines make it difficult to build a street in this area.

WHEREAS, the history of this conditional use permit is as follows:
1. On June 19, 2000, the planning commission recommended that the city council approve the
western part of the proposed development for the permit.
2. On July 10, 2000, the city council held a public hearing. The city staff published a notice in
the paper and sent notices to the surrounding property owners. The council gave everyone
at the hearing: a 'chance to .,.speak and. present written statements. The council also considered
reports and recommendations of the city staff and planning commission.
3. On August 14, 2000, the city council again considered this conditional use permit.
NOW, THEREFORE, BE IT RESOLVED that the city council the western part of the proposed
development (west of the existing M -1 area) of the above - described conditional use permit,
because:
1. The use would be located, designed, maintained, constructed and operated to be in
conformity with the city's comprehensive plan and code of ordinances.
2. The use would not change the existing or planned character of the surrounding area.
3. The use would not depreciate property values.
4. The use would not involve any activity, process, materials, equipment or methods of
operation that would be dangerous, hazardous, detrimental, disturbing or cause a nuisance to
any person or property, because of excessive noise, glare, smoke, dust, odor, fumes, water or
air pollution, drainage, water run -off, vibration, general unsightliness, electrical interference
or other nuisances.
5. The use would generate only minimal vehicular traffic on local streets and would not create
- traffic congestion or unsafe access on existing or proposed streets.
6. The use would be served by adequate public facilities and services, including streets, police
and fire protection, drainage structures, water and sewer systems, schools and parks.

7. The use would not create excessive additional costs for public facilities or services.
8. The use would maximize the preservation of and incorporate the site's natural and scenic
features into the development design.
9. The use would cause minimal adverse environmental effects.
Approval is subject to the following conditions:
1. All construction shall follow the site plan and preliminary plat date - stamped June 30, 2000,
except where the city requires changes. The developer shall revise the grading, utility, tree
planting and other project and construction plans to follow the site plan and preliminary plat
dated June 30, 2000. The: city council may approve :major changes.. The director of
community development may approve minor changes.
2. The proposed construction must be substantially started within one year of council approval
or the shall end. The council may extend this deadline for one year.
3.* Have the city engineer approve final construction and engineering plans. These plans shall
include: grading, utility, drainage, erosion control, streets, trails, tree and driveway and
parking lot plans.
4. The design of the ponds shall be subject to the approval of the city engineer. The developer
shall give the city an easement for this pond and shall be responsible for getting any needed
off -site pond and drainage easements.
5. The developer or contractor shall:
a. Complete all grading for the site drainage and the pond, complete all public
improvements and meet all city requirements.
b.* Place temporary orange safety fencing and signs at the grading limits.
C. Remove the debris, junk, garbage and travel trailers from the site.
6. This approval does not include the final design approval for the duplexes, townhomes or for
the apartment buildings. The developer shall submit the final building, landscaping and site
plans for these to the community design review board (CDRB) for approval by the CDRB.
7. The city shall not issue any building permits for construction on an outlot (per city code
requirements). The developer must record a final plat to create buildable lots for any outlot
in the preliminary plat before the city will issue a building permit.
8. The city council shall review this permit in one year.

C. Preliminary Plat
Councilmember Allenspach moved to approve the western part of the Highpoint Ridge preliminary
plat (received by the city on June 30, 2000),, except the proposed apartment and townhouse site in
the existing M -1 area. The developer shall complete the following before the city council approves
the final plat:
1. Sign an agreement with the city that guarantees that the developer or contractor will:
a. Complete all grading for overall site drainage, complete all public improvements and
meet all city requirements.
b.* Place temporary orange safety fencing and signs at the grading limits.
c. Have NSP install Group V rate street lights in at least nine locations - primarily at
street intersections and street curves. The exact style and location shall be sub j ect to
the city engineer's approval.
d. Pay the city for the cost of traffic- control, street identification and no parking signs.
e. Provide all required and necessary easements.
f. Demolish or remove the existing house and garage at 1170 County Road D, and all
other buildings, scrap metal, debris and junk from the site.
g. Cap and seal all wells on site that the owners are not using; remove septic systems or
drain fields, subject to Minnesota rules and guidelines. Within one year of the
contractor installing the sanitary sewer, the owners of the existing houses on Carey
Heights Drive shall connect their houses to the sanitary sewer.
h. Complete all the curb and gutter on Duluth Street and on Carey Heights Drive on the
south side of the site. This is to replace the temporary cul -de -sac, repair the cul -de-
sac pavement and restore and sod the boulevards.
i. For the trails, complete the following:
(1) Construct an eight- foot -wide paved walkway and two -rail split -rail fencing
between Lots 4 and 5. Block 1, between the street and the proposed east /west
trail in Block 3, and along the north side of the lots in Block One (in the
easement area) as shown on the plat date - stamped June 30, 2000. The
developer shall extend the west end of the trail in Lot 3, Block One into the
city park to connect to the existing park trail. All trails between lots shall be
in a 18- foot -wide trailway or pedestrian way or in easement areas.
(2) The developer shall install atwo -rail split -rail fence on both sides of each
trail and posts at the end of the trails to prevent motorized vehicles from
using the trail.

(3) The developer shall build the trails and fencing with the streets.
(4) The city engineer must approve these plans.
j . Install signs where the driveways for the twin homes and for the town houses
intersect the public streets indicating that they are private driveways.
2.* Have the city engineer approve final construction and engineering plans. These plans shall
be revised to remove the proposed apartments and townhomes in the M -1 area and to follow
the site plan and preliminary plat dated June 30, 2000, and shall include the grading, utility,
drainage, erosion control, tree, trail, sidewalk and street plans. The plans shall meet the
following conditions:
a. The erosion control plans shall be consistent with the city code.
b. The grading plan shall show:
(1) The proposed building pad elevation and contour information for each home
site. The lot lines on this plan shall follow the approved preliminary plat.
(2) Contour information for all the land that the construction will disturb.
(3) House pads that reduce the grading on sites where the developer can save
large trees.
(4) The proposed street and trail grades as allowed by the city engineer.
(5) All proposed slopes on the construction plans. The city engineer shall
-approve the plans, specifications and management practices for any slopes
steeper than 3:1. On slopes steeper than 3:1, the developer shall prepare and
implement a stabilization and planting plan. At a minimum, the slopes shall
be protected with wood fiber blanket, be seeded with a no maintenance
vegetation and be stabilized before the city approves the final plat.
(6) All retaining walls on the plans. Any retaining walls taller than 4 feet require
a building permit from the city.
(7) Sedimentation basins or ponds as required by the watershed board or by the
city engineer.
(8) No grading beyond the plat boundary without temporary grading easements
from the affected property owner(s).
(9) A minimum of a 10- foot -wide, 10:1 bench below the normal water elevation
(NWL) of any pond designed to be a wet pond. The depth of the pond below
the NWL shall not exceed four feet.

C.* The tree plan shall:
(1) Be approved by the city engineer before site grading or final plat approval.
(2) Show where the developer will remove, save or replace large trees. This plan
shall include an inventory of all existing large trees on the site.
(3) Show the size, species and location of the replacement trees. The deciduous
trees shall be at least two and one half (2 1 /2) inches in diameter and shall be a
mix of red and white oaks, ash, lindens and sugar maples. The coniferous
trees shall be at least eight (8) feet tall and shall be a mix of Austrian pine
and other species.
(4) Show no tree removal beyond. the .approved grading and tree limits.
(5) Include for city staff a detailed planting plan and material list.
(6) Be revised to group the new trees together. These planting areas shall be
around the ponding areas, on the steep slopes, along the common property
lines between residences and along all of the proposed trails. The developer
may use the tree groupings to separate the different types of residences.
(7) Show the planting of at least 242 trees after the site grading is done.
d. The street, trail and utility plans shall show:
(1) Paved walkways and two -rail split -rail fences in a trailway or pedestrian way
as shown on the proposed plans. This shall include the trail between Lots 4
and 5, Block 1, in Block 3 (as revised), between Block 1 and Block 3 (under
the power lines), connecting to the existing park trail to the west of the site
and on the east side of English Lane (Ridge Lane) to connect to the proposed
apartment site. The parks and recreation director shall approve their locations
and design.
(2) The public streets shall be a 9 -ton design with a maximum street grade of
eight percent and the maximum street grade within 75 feet of all intersections
at two percent.
(3) All the streets, parking areas and driveways with continuous concrete curb
and gutter.
(4) All public street right -of -ways shall be at least 60- feet -wide.
(5) The completion of the curb and gutter on the north end of Duluth Street and
the existing Carey Heights Drive cul -de -sac, the repair or replacement of the
cul -de -sac pavement and the restoration and sodding of the boulevards
around the cul -de -sac.

(6) A connection between the proposed water main in Block 3 and the proposed
water main system on the southerly part of the plat. The developer also shall
make a connection between the proposed water main on Lydia Avenue at
Highway 61 and the existing water main on the west side of Highway 61,
south of Guldens.
(7) The coordination of the water main alignments and sizing with the standards
and requirements of the Saint Paul Regional Water Services (SPRWS).
Available fire flow analysis shall be determined for the water system at the
proposed apartment complex as well as through the existing 8 -inch and 12-
inch crossings of Highway 61 at Beam Avenue. Fire flow requirements shall
be verified with the Maplewood Fire Department.
(8) All utility excavations located within the proposed right -of -ways or within
easements. The developer shall acquire easements for all utilities that would
be outside the project area.
(9) A reduced number of sanitary and storm sewer manholes and water main
bends by "cutting corners" with the utility alignments. The developer's
engineer shall verify with the SPRWS the acceptable water main alignments
and crossings. Manholes may be offset from the street centerline if the result
lessens the number of structures.
(10) Provisions for public utilities and service(s) to the vacant or undeveloped
properties on the south side of the proposed Lydia Avenue.
e. The drainage plan shall ensure that there is no increase in the rate of storm water run-
off leaving the site above the current (predevelopment) levels.
3. Change the plat as follows:
a. Add drainage and utility easements as required by the city engineer.
b. Show drainage and utility easements along all property lines on the final plat. These
easements shall be ten feet wide along the front and rear property lines and five feet
wide along the side property lines.
C. Revise the lot lines in Block One and Block Three so there is a 18- foot -wide trail or
pedestrian way between Lots 4 and 5, Block One and between Lots 6 and 7 or
between Lots 8 and 9, Block Three to accommodate the proposed trails.
d. Show the existing pipeline and the NSP and pipeline easements on the final plat.
e. Show all public street right -of -ways at 60 feet wide.
f. Make as many of the property lines as is reasonably possible radial to the cul -de -sacs
or perpendicular to the street right -of -ways.

g. If necessary, increase the lot widths for the lots next to the pipeline to ensure that the
house pads will be at least 100 feet away from the pipeline. (code requirement)
h. Change the street names as follows:
(1) Carey Heights Drive shall be used only in Block 2 (Phase One) of the project. \
The north south street between Outlot A and Outlot B shall be Duluth Street.
(2) Highpoint Court shall be called Ridge Place.
(3) English Lane shall be called Ridge Lane.
(4) The cul -de -sac in Block 3 shall be called Highridge Court.

4. Secure and provide all required easements for the development including:
a. Any off -site drainage and utility easements.
b. Any necessary easements for the dedication and construction of Lydia Avenue.
5. The .developer shall complete all grading for public improvements and overall site drainage.
The city engineer shall include in the developer's agreement any grading that the developer
or contractor has not completed before final plat approval.
6. Record the following with the final plat:
a. All homeowners association documents.
b. A deed restriction prohibiting the construction of a dwelling or its attachments
within 100 feet of the Williams Brothers pipeline. This affects Lots 3 through 6,
Block 1 and Lots 7 through 18, Block 3 of the proposed preliminary plat the city
received on June 30, 2000. The developer also shall notify the purchasers of the
pipeline location.
C. A deed dedicating 10 feet of additional right -of -way along County Road D for future
street widening with the final plat. The applicant shall submit the language for this
dedication to the city for approval before recording.
d. A covenant or deed restriction with the final plat that prohibits the driveways on
Lots 1, 23 24, 25 26, and 36, Block 3 from going onto County Road D.
e. A covenant or deed restriction that prohibits any further subdivision or splitting of
the lots or parcels in the plat that would create additional building sites unless
approved by the city council.
The applicant shall submit the language for these dedications and restrictions to the
city for approval before recording.

(a) Every person desiring to be part of our deer management program (archery hunt or
sharpshooting) must become a member of Metro Bow Hunters Resource Base
(MBRB).
(b) Sharpshooting (rifles), may be utilized, and organizations desiring to provide these
services will be required to submit bids annually.

M. COUNCIL PRESENTATIONS
1. St. Paul Regional Water Services - Mayor Cardinal said that St. Paul Regional Water Services will
be contacting the city regarding some things that need to be cleaned up in the way of title. Acting
City Manager Haider said that staff has been working on this and that the final --docum-en ts have
been recorded and the titles are in the process of being transferred.
2. Dispatching - Councilmember Koppen said that he was absent when there was a vote to bring back
the dispatching services and he felt that there should have been a public hearing before this decision
was made.
3. Compost Site - Councilmember Koppen said he has gotten a lot of feedback from residents
complaining about how come the council closed the composite site without coming up with an
alternative site. Councilmember Koppen said the city should work with Ramsey County to have an
.::,alternative site. Acting City , Manager Haider said that the county has looked for alternative sites in
the past and has not come up with any.
N. ADMINISTRATIVE PRESENTATIONS

The Maplewood- Woodbury Joint Sanitary Sewer Project has been completed
and the state aid money has been received. There is a surplus of $91,280.77 in
the fund for this project because the state aid revenues were more than the
budget, expenditures were under budget and unanticipated investment interest
was earned.
It is recommended that the Council close this project, approve a transfer of
$76,808.09 to the Street Construction State Aid Fund for the surplus state aid,
approve a transfer of $14,472.68 to the Sanitary Sewer Fund to refund part of the
transfer made to this project as a subsidy, and authorize the appropriate budget
changes.

SUBJECT: Easement Agreements- Project 99 -02

The contract has been awarded for the lift station #9 replacement project. There are
still two pieces of right of way that need to be purchased for this construction. The
gravity pipe that replaces lift station 9 flows south from Larpenteur Avenue along the
railroad tracks and into the Rice and Arlington softball fields in St. Paul.
The two attached agreements provide for the right to construct and maintain the pipe.
The first agreement from Canadian Pacific Railway provides an easement along the
railroad tracks to install and maintain the pipe. The railroads real estate department
has identified a value of $31,500 for this easement. The second easement is from the
City of St. Paul, we have identified the location of the easement and commissioned an
appraisal by an independent appraiser to identify the value. The total value for the
permanent and temporary easements including the cost of the appraisal is $12,555.
It is recommended the City Council authorize the appropriate officials to enter into the
attached agreements and authorize the finance director to make the appropriate budget
adjustment for project 99 -02 to finance $44,055 in acquisition costs from the sanitary
sewer fund.

the Canadian Pacific Railway right -of -way. The land is level to
rolling and along the railroad right -of -way is heavily wooded.
This is a 10 ft. wide easement around the permanent
easement and i0or the purpose of constructing the sewer line.

In consideration of the sum of THIRTY -ONE THOUSAND FIVE - HUNDRED and No /100
Dollars ($31,500.00), the receipt whereof is hereby acknowledged, Soo Line Railroad
Company, a corporation under the laws of the State of Minnesota, having its principal place
of business at 501 Marquette Avenue, Minneapolis, Minnesota 55402, and doing business
as Canadian Pacific Railway, ( "Grantor ") hereby grants unto CITY OF MAPLEWOOD
( "Grantee "), a municipal corporation, an easement for the construction and maintenance
of a longitudinal sanitary sewer pipeline encroachment (the "pipeline "), such easement to
continue only so long as used for such purposes, in, over, under and upon the following
described real property in the County of Ramsey, State of Minnesota (the "Property "):
A permanent easement of sufficient width fora 2,100 foot long sanitary
sewer pipeline and two crossings under and across the following
described real property:
A part of Sec. 18 & 19 T29N, R22W; the centerline of said pipeline is
shown in approximation by the dark Fine connecting points and B on the
attached Exhibit "A ".
The Grantor reserves unto itself, and its successors and assigns, the right and privilege to
use said Property for the maintenance and operation of railroad tracks and facilities,*
including the right to permit other parties to use said Property, and further reserving the
right and privilege to use said Property for any and all other purposes that are not
inconsistent with the use thereof for the purpose or purposes permitted by this indenture,
and further reserving the right to prevent the placement or maintenance of any pipeline
facility upon said Property in a manner which would unreasonably interfere with the
maintenance and safe and continuous operation of railroad tracks and facilities.

PIPELINE EASEMENT (MN)

The Grantor reserves the title to said Property to itself, and the Grantee's maintenance and
use for the above purposes upon said Property, however long continued, shall not vest in
the Grantee rights adverse to those of the Grantor other than those granted by this
indenture.
The Grantee, after first securing all necessary public authority, shall at the Grantee's sole
expense, install and thereafter maintain the pipeline upon and across the Property and
underneath or across any railroad tracks located thereon at the above - described location
in a manner satisfactory to the Grantor.
The Grantee shall be responsible for determining the location and existence of any pipes,
wires, conduits, sewers, piling or other - obstructions to the construction of the Grantee's
pipeline and shall indemnify, hold harmless and defend the Grantor from and against any
and all liability for damage to the foregoing pipes, wires, conduits, sewers, piling or other
obstructions, if any, caused by the construction or maintenance of the Grantee's p i p eline.
The Grantor makes no representation by the granting of this indenture that its property is
free of any such pipes, wires, conduits, sewers, pilings or other obstructions.
The Grantee shall not carry on any work in connection with the installation, maintenance,
repair, changing or renewal of the pipeline or in close proximity to any railroad track at the
above - described location until: (i) it shall have given the Grantor at least three (3) days'
written notice, and (ii) an authorized representative of the Grantor shall be present to
supervise same. Upon bills being rendered therefor, the Grantee shall promptl y reimburse
the Grantor for all expenses incurred by it in connection with such supervision, including
all labor costs for flagmen supplied by the Grantor to protect railroad operations, and for
the entire cost of the furnishing, installation and later removal of any temporary supports
for said tracks.
The Grantee, at the Grantee's sole expense, whenever notified to do so, shall promptly
make such repairs to or changes in the pipeline, including changes in location, as the
Grantor shall for any reason deem necessary. The Grantor shall have the right, at its
election, to make emergency repairs to the pipeline, and in such event the Grantee, upon
bills being rendered therefor, will promptly reimburse the Grantor for all expenses incurred
in connection therewith.
The Grantee assumes all risk of damage to or destruction of the pipeline through any
cause whatsoever while located upon and across the Property.
The Grantee (a) shall be familiar with the requirements of, comply with, and secure at the
Grantee's own expense any permits or licenses required by, all applicable laws,
regulations, ordinances, and standards, including without limitation all Environmental Laws;
(b) shall, upon written request by the Grantor, provide the Grantor with the results of
appropriate reports and tests and with any other applicable documents to demonstrate that
the Grantee has complied with all Environmental Laws relating to the Property; (c) shall not
in any manner cause or allow the Property to become a hazardous waste treatment,
storage or disposal facility within the meaning of, or otherwise bring the Property within the

ambit of the Resource Conservation and Recovery Act, 42 U.S.C. § 6901 et seq. or any
similar state statute or local ordinance; (d) shall not, without prior written disclosure to and
approval by the Grantor, Use or authorize the Use of any Hazardous Substance on the
Property; (e) shall not cause or allow the Release or threat of Release of any Hazardous
Substance on, to, or from the Property; (f) shall promptly notify the Grantor of any actual
or suspected Release of any Hazardous Substance on, to, or from the Property, regardless
of the cause of the Release; (g) shall promptly provide the Grantor with copies of all
summons, citations, directives, information inquiries or requests, notices of potential
responsibility, notices of violation or deficiency, orders or decrees, claims, causes of action,
complaints, investigations, judgments, letters, notices of environmental liens or Response
actions in progress, and other communications, written or oral, actual or threatened, from
the United States Environmental Protection Agency, the United States Occupational Safety
and Health Administration, or other federal, state or local agency or authority, or any other
entity or individual, concerning any Release of a Hazardous Substance on, to or from the
Property, or any alleged violation of or responsibility under any Environmental Law relating
to the Property; and (h) shall promptly take all necessary action in Response to any
Release or Use of a Hazardous Substance at the Property that gives rise to any liability,
claim, cause of action, obligation, demand, fine, penalty, loss, judgment or expense under
any Environmental Law, or causes a significant public health or workplace effect, or
creates a nuisance.
To the extent permitted by applicable law, the Grantee hereby releases and agrees to
indemnify, hold harmless and defend the Grantor and its directors, officers, stockholders,
divisions, agents, affiliates, subsidiaries, predecessors, successors and assigns,. or anyone
acting on its behalf or their behalf, from and against any and all Claims (including without
limitation any Claims arising under any Environmental Law and all Claims arising at
common law, in equity or under a federal, state or local statute, rule or regulation) of every
kind, past, present and future, existing and contingent, known and unknown, arising from
any injury to persons, firms or corporations whomsoever, including injuries resulting in
death, and damage to property whatsoever, wherever such persons or property are
located, caused by or attributable to, in whole or in part, any act or omission of the Grantee
(or the Grantee's employees, agents, representatives, or invitees) in connection with the
exercise of the right and privilege herein granted, including without limitation the Use or
Release of Hazardous Substances by the Grantee and the breach by the Grantee of any
of its warranties, representations or covenants. The Grantee's obligations hereunder shall
survive the termination or expiration of this easement.
As used herein, (a) "Claim" or "Claims" means any and all liabilities, suits, claims,
counterclaims, causes of action, demands, penalties, debts, obligations, promises, acts,
fines, judgments, damages, consequential damages, losses, costs, and expenses of every
kind (including without limitation any attorney's fees, consultants' fees, response costs,
remedial action costs, cleanup costs and expenses which may be related to any Claims);
(b) "Environmental Law" or "Environmental Laws" means the Comprehensive
Environmental Response, Compensation and Liability Act ( "CERCLA "), 42 U.S.C. § 9601
et seq., the Resource Conservation and Recovery Act, 42 U.S.C. § 6901 et seq., the
Federal Water Pollution Control Act, 33 U.S.C. § 1251 et seq., the Clean Water Act, 33

U.S.C. § 1321 et seq., the Clean Air Act, 42 U.S.C. § 7401 et seq., the Toxic Substances
Control Act, 15 U.S.C. § 2601 et seq., all as amended from time to time, and any other
federal, state, local or other governmental statute, regulation, rule, law or ordinance dealing
with the protection of human health, safety, natural resources or the environment now
existing or hereafter enacted; c "Hazardous Substance" or "Hazardous Substances"
means any pollutant, contaminant, hazardous substance or waste, solid waste, petroleum
product, distillate, or fraction, radioactive material, chemical known to cause cancer or
reproductive toxicity, polychlorinated biphenyl or any other chemical, substance or material
listed or identified in or regulated by any Environmental Law; (d) "Release" or "Released"
means any actual or threatened spilling, leaking, pumping, pouring, emitting, emptying,
discharging, injecting, escaping, leaching, dumping, disposing or spreading of any
Hazardous Substance into the environment, as is is defined in CERCLA; (e)
"Response" or "Respond" means action taken in compliance with Environmental Laws to
correct, remove, remediate, cleanup, prevent, mitigate, monitor, evaluate, investigate,
assess or abate the Release of a Hazardous Substance; (f) "Use" means to manage,
generate, manufacture, process, treat, store, use, re -use, refine, recycle, reclaim, blend
or burn for energy recovery, incinerate, accumulate speculatively, , trans ort, transfer,
dispose of, or abandon a Hazardous Substance.
This indenture shall inure to the benefit of and be binding upon the successors and assigns
of the Grantor and the Grantee.

On February 22, 2000, the community design review board (CDRB) recommended approval of
the plans for the new Gladstone Fire Station. Part of their recommendation included a variance
from the concrete=curbing requirement for three edges of paving (two parking lot edges and one
side of the long driveway north of Frost Avenue). The variance was to allow sheet drainage for
better water quality in the ponds. The board also directed staff to prepare a code amendment
waiving the curbing requirement to avoid the need for future variances. (The city council
approved the fire station curbing variance on March 13, 2000.)
BACKGROUND
March 8, 1999: The city council amended the curbing ordinance to allow bituminous curbing on a
temporary basis instead of concrete curbing. An example of this would be for a phased
development where the parking lot would be expanded in the future.
DISCUSSION
The benefit of concrete curbing is to create a neat edge between the parking lot and the grass.
Curbing also helps keep cars on the pavement by providing a wheel stop. There are instances,
though, when omitting a curb would improve the quality of storm water. As in the case with the
recent fire station proposal, three pavement edges were allowed to have no curb. This allowed
sheet drainage to flow to the adjacent holding ponds through the grass where nutrients and
sediments in the runoff could be dispersed into the grass rather than channeled and
concentrated by hard surfaces and curbing.
Staff is proposing that the curbing requirement be waived where the city engineer determines
that water quality would be improved by sheet drainage.
COMMITTEE ACTION
July 11, 2000: The CDRB recommended approval of this code change.
RECOMMENDATION
Approve the code change on page 2, waiving the requirement for concrete curbing where the city
engineer determines that water quality would be improved by sheet drainage.

AN ORDINANCE AMENDING THE CONCRETE -CURBING REQUIREMENTS
The Maplewood City Council approves the following changes to the. Maplewood Code of
Ordinances:
Section 1. This section changes Section 36-22(c) as follows (additions are underlined):
All parking lots shall have continuous concrete curbing surrounding the exterior perimeter of the
parking lot and drives. Park parking lots, that are not used in the winter, and parking lots having
twelve (12) spaces or less are exempt from this requirement, unless required by the city engineer
for drainage control. The community design review board .may waive the curbing requirement in
instances where the city engineer has determined that sheet drainage_over ground would
improve storm -water qu=ty
The community design review board may allow continuous bituminous curbing temporarily on a
case-by-case basis, subject to the following conditions:
(1) Bituminous curbing may be permitted for phased or staged developments where an
adjacent future development phase would be built that would result in the removal of the curbing.
(2) Bituminous curbing shall not be allowed for more than three years from the -time of
installation, at which time it must be removed due to the construction of a future phase of
development or simply replaced with permanent continuous concrete curbing.
(3) Bituminous curbing shall not be permitted if the city engineer requires concrete curbing
for drainage control.
(4) Bituminous curbing that becomes damaged shall be repaired immediately oras soon as
the weather permits.
(5) The city may require that the developer provide escrow to cover the replacement of the
bituminous curbing with concrete curbing.
Section 2. This ordinance shall take effect after the city publishes it in the official newspaper.

INTRODUCTION
Request
City staff is proposing a zoning code change about dwelling units in combination with business
uses. This proposed change is in response to the city council's request from their meeting of
May 8, 2000.
Background
On May 8, 2000, the city council approved a conditional use permit (CUP) and the design plans for
Thomas Schaffhausen, of Sanas Capital Investments, to build a 5,300 square -foot
office/warehouse facility at 1055 Gervais Avenue. Part of Mr. Schaffhausen's request was to keep
an existing house on the property for an employee to live in. The city council approved this request
and directed city staff to prepare a zoning code change to clarify and tighten the code language
about residences in commercial zoning districts.
DISCUSSION
Section 36-151(a)(1) of the city code now says "A dwelling unit for one family in combination with a
business use" is a permitted use in the BC (business commercial) zoning district. However, there
is some question about the city's intention by adopting this code. That is, did the city intend the
d 'welling unit to be in or connected to the business building or did the city intend for the dwelling
unit to just be on the same property as the business? It is staff s interpretation that the city did not
intend the code to allow an existing single family home to remain when there is new development.
However, Mr. Schaffhausen and his attorney believe that one could interpret the ordinance to
mean that the residence and a business use on a property are permitted as long as there is
connection between the residents and the business. Staff proposes to change the code to clarify
that any dwelling unit must be in the same building as the principal commercial use on the site.

On June 19, 2000, the planning commission recommended approval of the proposed code
change.
RECOMMENDATION
Approve the code change on page two. This code change clarifies the use of dwelling units with

A. Zoning Code Change—Business Commercial (BC) Zoning District
Ken Roberts, associate planner, presented the staff report. Commissioner Rossbach compared
the remodel of the Hesley office on White Bear Avenue, where an addition was "incorporated"
into an existing house that made it look like one building, and the Fresh Paint building on
Gervais. This buildings did not resemble the house in any manner. Mr. Rossbach felt the staff's
recommendation would not have redevelopment "blend in more." He suggested a change that
would permit a single family residence designed into a commercial building for use of an
occupant who is an employee of the business. He also thought it could be specified that the
design blend with the existing building.
Commissioner Trippler advocated deleting the phrase "when in sight of or structurally connected
to" and insert "a dwelling unit for one family may be included in the structure when it is an
integral part of the principal building for a business use." Commissioner Frost thought this
wording also was debatable and ambiguous. Mr. Roberts suggested taking Out the portion of
the staff proposal that said "or structurally connected to" and Leave "when in sight of the principal
building of a business use." Mr. Rossbach did not want to have a commercial building and an
old house sitting on the same lot. Commissioner Ledvina agreed with Mr. Rossbach.
Commissioner Thompson speculated about the need for this change if White Bear Avenue is
updated. Mr. Rossbach clarified that he thought a structure could be used either as a
commercial building or as part of a commercial building but it should be incorporated so that it
looks like the rest of the project. Two different styles of building should not be on the same lot.
Mr. Roberts confirmed that an applicant would be allowed to retain the appearance of his home
and use it as an office if it met the building code. He could also live in this home. Mr. Roberts
proposed that a sentence saying "the dwelling unit may not be in a separate building from the
business use" could be added. Commissioner Trippler suggested "the dwelling unit for one.
family may be located in the principal building of a business use. The dwelling unit and the
principal business building must be located in the same structure."
Commissioner Rossbach said a lot of consideration was being given to living in the structure but
not about it being architecturally tied into the proposal. The board discussed various areas
where an existing house could potentially have a commercial structure added in the future.
They also discussed a business having an office on the second level that is converted to living
space.
Commissioner Frost moved the Planning Commission recommend approval of the ordinance
changing Section 36-151 (Business Commercial) District as follows:
(1) A dwelling unit for one family when inside the principal building of a business use. The
dwelling unit may not be in a separate building from the business use.
There was no second.
Commissioner Rossbach moved the Planning Commission table this item until the next meeting
to allow staff and the commission to consider it further and get better verbiage.
Commissioner Pearson seconded. Ayes all

City staff is proposing an addition to Chapter 7 ANIMALS AND .FOWL of City Code. This
proposed addition is in conjunction and in support of the "Deer Management Plan" adopted
by City Council.
Background
On May 22, 2000 the City Council approved. a 5 year Deer Management Plan. This
management plan incorporated many methods for reducing and managing deer populations at
appropriate acceptable levels for the available habitat and social tolerance. In order to support
and enforce the plan code additions are necessary.
Recommendation
Review, and approve the code additions on page two. This code addition will support the
deer management plan approved by City Council on May 22.

The Maplewood City Council approves, the following additions to the Maplewood Code of Ordinances:
Chapter 7
Sections 7-215--7-220 Reserved
Article VII. DEER MANAGEMENT
Sec. 7-221. Prohibiting feeding of deer
It shall be unlawful for any person or group to place, or permit to be placed on the ground or within four (4) feet of the ground
surface, either on property owned or controlled by such person or on property owned by others, unless it is screened. in a manner
which prevents deer from feeding thereon, any grain, fodder, salt licks or any other food including feed for birds, which may
reasonably be expected to result in, deer feeding thereon.
(a) Exceptions
1. Feeding programs or efforts undertaken by to City of Maplewood in accordance with the deer management plan or
by the Department of Natural Resources for same;
2. Veterinarians, City animal control officers or county, state or federal game officials who,, in the course of their
duties, have deer in their custody; and
3. Any food places upon the property for the purpose of entrapping or otherwise taking deer where. such trapping or
taking is pursuant to a permit issued by the Minnesota Department of Natural Resources.
Sec. 7-222 Regulations
No person shall, within the limits of the City, hunt or engage in the business of deer removal, unless such person shall be acting on the
City's behalf and obtained a special permit in conjunction with the City of Maplewood's Deer Management Program.
Sec. 7-223 Application of the deer management program.
(a) Every person desiring to be part of our deer management program (archery hunt or sharpshooting) must become a member of
Metro Bow Hunters Resource Base (MBRB).
(b) Sharpshooting (rifles), may be utilized, and organizations desiring to provide these services will be required to submit bids
annually.
Sec. 7-224 Violations of Article or rules, obstruction of deer management program or order of City council; etc.
(a) No person shall obstruct or interfere with the City's authorized deer management program or threaten, intimidate, obstruct or
interfere with any authorized deer management program or agent providing such services to the City of Maplewood.
(b) No person shall touch, damage, manipulate, disengage, make inoperative, or otherwise tamper with a deer trap or other deer
removal equipment or material which is being- used. as part of the City's authorized deer management programa
(c) No person shall be within 100 feet of a deer trap or other deer removal equipment or material being used as part of -the City's
authorized deer management program unless the person is on land which he/she owns or has the express permission of the
City, the City's authorized agent, or the owner of the property where the trap or removal equipment or material is located,.
(d) No person shall enter any area which the City or County has closed to the public as part of the City's authorized deer
management program if. the City has provided notice of such closure by conspicuously posted signs or other reasonable
means.
Sec. 7-225 Violations and Penalties.
(a) Any person violating, or otherwise refusing to comply with any provisions of this Ordinance shall be guilty of a
misdemeanor and subsequent penalties shall apply.
Sec. 7-226 This ordinance shall take effect after the City publishes it in the official paper.

It has recently been discussed by the City Council, the current ordinance is difficult to
understand and enforce. It prohibits parking more than two hours in the same place
between the hours of 2 a.m. and 6 a.m. This is an unusual ordinance and causes
much confusion with residents and folks that have been ticketed for overnight parking.
Changing the ordinance to prohibit parking between the hours of 2 a.m. and 6 a.m.
completely seems more understandable and would be easier to enforce.
It is recommended the City Council make the following change to the city code.

SUBJECT: Public Safety Communication Center Classes with Pay and
Benefits
Based on the Council's recent decision to re-create the Public Safety Communication
Center, I am proposingto create three classifications: Public Safety Communication
y
Supervisor, Public Safety Dispatcher, and Public Safety Dispatcher Trainee.
These positions will initially be non-union positions at the following salary ranges:
Public Safety Communications Supervisor $43,700.80 - $50,003.62 annual
Public Safety Dispatcher $15.09 - $18.36 hourly
Public Safety Dispatcher Trainee $14.37
The Trainee classification will be used as needed when the City is unable to find
sufficient numbers of acceptable experienced candidates for the Public Safety
Dispatcher classification and immediately to assist in staffing the Center by January

An applicant without the required experience can be hired into this classification for a
period of one year. At the end of that year, if the employee is performing
satisfactorily and is recommended to pass probation, they will automatically be
reclassified as a Public Safety Dispatcher and placed at the starting rate. In no case
will an employee stay as a trainee longer than one year.
If the trainee clearly performs at a competent level prior to one year, the employee
may be reclassified early. The original probationary period will continue until one
year is completed, except as allowed for any employee in the Personnel Policies or
labor agreement.
We gill also attempt to fill positions with experienced dispatchers into the Public
Safety Dispatcher class.
Benefits: Benefits for the Supervisor position will be as follows:
Health, Dental and Life Insurance -same as non-union &, MSA employees
Vacation -same for all regular employees
Holidays - 10 plus 2 personal holidays
Sick Leave - 15 days per year
LTD -same for all regular employees
Deferred Compensation - .City contribution same as MSA employees
Exempt Status - Exempt (No overtime)
Wellness Program -same for all regular employees
Pension -same for all regular coordinated PERA members
Merit Pay -same as regular non-union &MSA employees
Benefits: Benefits for the Dispatcher Trainee and Dispatcher positions will be as
follows:
Health, Dental and Life Insurance -same as AFSCME employees

Vacation - same for all regular employees
• Holidays - 10 plus 2 personal holidays; When a holiday falls on a scheduled
work day, the employee will receive regular holiday pay and will receive the
day before or after off. If an employee takes an approved vacation day on a
holiday, they will receive accrued vacation pa in lieu of the da off. If the

employee is out on approved sick leave, they will receive accrued sick leave in
lieu of the day off.

RECOMMENDATION
It is recommended that the City Council create these three job classes with the
corresponding 2000 salary ranges and benefits.
