2. Planning Commission's 1999 Annual Report
Accepted the Planning Commission's 1999 Annual Report as presented

4. Temporary Gambling Resolution - East Metro Women's Council
Adopted the following Resolution:
RESOLUTION 00 -02 -021
RESOLUTION AUTHORIZING TEMPORARY LAWFUL GAMBLING
East Metro Women's Council at Maplewood Mall, 3100 White Bear Avenue, Maplewood, MN
BE IT HEREBY RESOLVED, by the City Council of Maplewood, Minnesota, that the premises permit for
temporary lawful gambling is approved for East Metro Women's Council, 3 521 Century Avenue North, White
Bear Lake, Minnesota.
FURTHERMORE, that the Maplewood City Council waives any objection to the timeliness of application
for said permit as governed by Minnesota Statute §349.213.
FURTHERMORE, that the Maplewood City Council requests that the Gambling Control Division of the
Minnesota Department of Gaming approve said permit application as being in compliance with Minnesota
Statute §349.213 and the City allows the Board to issue a permit before 30 days.
NOW, THEREFORE, be it further resolved that this Resolution by the City Council of Maplewood,
Minnesota, be forwarded to the Gambling Control Division for their approval.
5. Temporary Gambling Resolution - Neighbor to Neighbor
Adopted the following Resolution:

BE IT HEREBY RESOLVED, by the City Council of Maplewood, Minnesota, that the premises permit for

Councilmember Koppen introduced the following Resolution, directing the city engineer to proceed with the final
plans for Bartelmy Acres Neighborhood Street Im rovements Project 99 -13 and moved its adoption:
RESOLUTION 00 -02 -023
ORDERING IMPROVEMENT AFTER PUBLIC HEARING
WHEREAS, a resolution of the city council adopted the 14th day of February, 2000, fixed a date for a
council hearing on the proposed construction of the Bartelmy Acres Neighborhood Streets ( Bartelmy Lane,
Mary Street, Sterling Street and Magnolia Avenue), City Project 99 -13,
AND WHEREAS, ten days mailed notice and two weeks published notice of the hearing was given, and the

hearing was duly held on February 28, 2000, and the council has heard all persons desiring to be heard on the
matter and has fully considered the same;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD,
MINNESOTA, as follows:
1. That it is necessary, cost - effective and feasible, as detailed in the feasibility report, that the City of
Maplewood complete street improvements on the Bartelmy Acres Neighborhood Streets, City Project 99 -13.
2. Such improvement is hereby ordered as proposed in the council resolution adopted the 28th day of
February, 2000.
3. The city engineer is designated engineer for this improvement and is hereby directed to prepare final
plans and specifications for the making of said improvement.
4. The finance director is hereby authorized to make the financial transfers necessary to implement the
financing plan for the project. A project budget of $578,000 shall be established. The ro osed financing plans

A. Land Use Plan Amendment (M1 - G) (4 Votes)

Councilmember Koppen introduced the following Resolution, amending the comprehensive land use plan from
Ml (light manufacturing) to G Government facility, for the proposed North St. Paul Post Office Annex at 1686
Gervais Avenue, and moved its adoption:
RESOLUTION 00 -02 -024
LAND USE PLAN CHANGE RESOLUTION
WHEREAS, the United States Post Office North St. Paul applied for a change to the city's land use plan
from Ml (light manufacturing) to G (government facility) to bring the land use plan into conformance with their
proposed use as a mail distribution facility.
WHEREAS, this change applies to the property at 1686 Gervais Avenue. The legal description is:
LOTS 1 TO 241N CLUSIVE, BRIGHTON PARK, RAMSEY COUNTY, MINNESOTA, TOGETHER
WITH THE VACATED ALLEY, AND VACATED NEWBURY STREET, ACCRUING THERETO BY
REASON OF THE VACATION THEREOF,
TOGETHER WITH
LOT 6, BRONSONS SUBDIVISION, RAMSEY COUNTY, MINNESOTA, SUBJECT TO HIGHWAY.
WHEREAS, the history of this change is as follows:
1. On February 7, 2000, the planning commission held a public hearing. The city staff published a
hearing notice in the Maplewood Review and sent notices to the surrounding property owners. The

planning commission gave everyone at the hearing a chance to speak and present written statements.
The planning commission recommended that the city council approve the land use plan change.
2. On February 28, 2000, the city council discussed the land use plan change. They considered reports
and recommendations from the planning commission and city staff.
NOW, THEREFORE, BE IT RESOLVED that the city council approve the above - described change
because the proposed post office annex would comply with the commercial and industrial development policies in
the Maplewood Comprehensive Plan.
The Maplewood City Council approved this resolution on February 28, 2000.

B. Conditional Use Permit
Councilmember Koppen introduced the following_ Resolution, approving a conditional use permit for the North
St. Paul Post Office Annex at 1686 Gervais Avenue and moved its adoption. Approval is based on the findings
required by the code and subject to the following conditions

CONDITIONAL USE PERMIT RESOLUTION
WHEREAS, the United States Post Office North St. Paul applied for a conditional use permit to operate a
mail distribution facility in an existing industrial/warehouse building.
WHEREAS, this permit applies to the site located at 1686 Gervais Avenue. The legal description is:
LOTS 1 TO 24 INCLUSIVE, BRIGHTON PARK, RAMSEY COUNTY, MINNESOTA, TOGETHER
WITH THE VACATED ALLEY, AND VACATED NEWBURY STREET, ACCRUING THERETO BY
REASON OF THE VACATION THEREOF,
TOGETHER WITH
LOT 6, BRONSONS SUBDIVISION, RAMSEY COUNTY, MINNESOTA, SUBJECT TO HIGHWAY.
WHEREAS, the history of this conditional use permit is as follows: .

use permit, because:
1. The use would be located, designed, maintained, constructed and operated to be in conformity with
the city's comprehensive plan and code of ordinances.
2. The use would not change the existing or planned character of the surrounding area.
3. The use would not depreciate property values.
4. The use would not involve any activity, process, materials, equipment or methods of operation that
would be dangerous, hazardous, detrimental, disturbing or cause a nuisance to any person or
property, because of excessive noise, glare, smoke, dust, odor, fumes, water or air pollution,
drainage, water runoff, vibration, general unsightliness, electrical interference or other nuisances.
5. The use would generate only minimal vehicular traffic on local streets and would not create traffic
congestion or unsafe access on existing or proposed streets.
6. The use would be served by adequate public facilities and services, including streets, police and fire
protection, drainage structures, water and sewer systems, schools and parks.
7. The use would not create excessive additional costs for public facilities or services.

8. The use would maximize the preservation of and incorporate the site's natural and scenic features
into the development design.
9. The use would cause minimal adverse environmental effects.
Approval is subject to the following conditions:
1. All construction shall follow the site plan approved by the city. The director of community
development may approve minor changes.
2. The proposed construction must be substantially started within one year of council approval or the
permit shall become null and void. The council may extend this deadline for one y ear.
3 The city council shall review this permit in one year.
4. The applicant shall instruct all drivers to access and exit this site via White Bear Avenue to avoid the
residential neighborhood to the west. Mail deliveries to that neighborhood are exempted from this.
5. The applicant request to the Post Master that the new facility be named the Maplewood Post Office
Annex.
The Maplewood City Council approved this resolution on February 28, 2000.

C. Design Approval
Councilmember Koppen approved the plans (date- stamped Janug r 12, 2000) for the proposed North St. Paul
Post Office Annex, based on the findings required by the code. The propert y owner shall do the following:
1. Repeat this review in two years if the city has not issued a building permit for this project.
2. Before getting a building permit, the applicant shall provide a grading, drainage, utility and
erosion control plan for the city engineer's approval.
3. Complete the following before occupying the building:
a. Construct a trash dumpster enclosure for any outside trash containers. The
enclosures must be 100 percent opaque, match the color of the building and have a
closeable gate that extends to the ground. If the trash container is not visible to the
public it does not have to be screened. (code requirement)
b. Install all landscaping as shown on the approved plan.
C. Screen any new roof -top mechanical equipment that would be visible from the homes
along Gervais Avenue. All other new roof -top units that are visible from non
residential areas must be painted to match the building. (code requirement)
d. Provide handicap- accessible parking spaces as required by the ADA (American's with
Disabilities Act).
4. All work shall follow the approved plans. The director of community development may
approve minor changes.

A. Parking Lot Setback Variance
Councilmember Allenspach introduced the following Resolution, approving a ten -foot parking lot setback
variance for the proposed Maplewood Retail Site at 2305 White Bear Avenue and moved for its adoption:

VARIANCE RESOLUTION
WHEREAS, Reliance Development Company LLP applied for a parking lot setback variance from the
zoning code.
WHEREAS, this variance applies to property at 2305 White Bear Avenue. The legal description is:
Parcel 1: Tract E. except the West 263 feet, as measured at right angles to the West line of said Tract E. and
except that part of Tract E contained in the following described tract: Beginning at a point on the West line of
said Tract E, distant 104.81 feet South of the Northwest corner thereof; thence South 00'00'00" East, assumed
bearing, along said West line, 21.33 feet; thence South 84"23'47" East, 245.55 feet; thence South 80'58'04",
122.63 feet, to the right of way line of Trunk Highway No. 36 as now located and established; thence North
47'29'0 1 " West, along said right of way line, 102.02 feet; thence South 89'08'00" West, along said right of way

WHEREAS, Section 36- 28(c)(5)(a) of the zoning code requires a 15 -foot parking lot setback from street
right -of -way.
WHEREAS, the applicant is proposing a five -foot parking lot setback.
WHEREAS, this requires a variance of 10 feet.
WHEREAS, the history of this variance is as follows:
1. On February 7, 2000 the planning commission recommended that the city council approve this
variance.
2. On February 8, 2000 the community design review board recommended that the city council approve
this variance.
3. The city council held a public hearing on February 28, 2000. City staff published a notice in the
Maplewood Review and sent notices to the surrounding property owners as Y
required b law. The
council gave everyone at the hearing an opportunity to speak and present written statements. The
council also considered reports and recommendations from the city star and planning commission.
NOW, THEREFORE, BE IT RESOLVED that the city council approve the above - described variance as
recommended by the city staff that would allow a ten -foot parking lot encroachment into the normally- required
15 -foot setback area for the following reasons:
1. The proposed five- foot -wide green strip would meet the spirit and intent of the ordinance in
combination with the wide highway boulevard. The highway right -of -way ranges in width from 52
feet to 100 feet adjacent to the proposed north/northeast lot line. With the proposed five feet of
setback, there would be 57 feet to 105 feet of green space to the shoulder of the highway off ramp.
This is well over the typical green strip width between a parking lot and a street which is 25 to 30

feet (15 feet of setback and 10 to 15 feet of boulevard).
2. The parking lot setbacks proposed are substantially better than the existing ones. Currently the Bali
Hai parking lot is at the lot line, and in areas, extends into the right -of- way. The applicant's plan
would improve this current situation.
3. Complying with the code would cause the developer undue hardship because of circumstances
unique to the property. The site is difficult to fit a development since it has three street frontages
and has an irregular shape.
The Maplewood City Council adopted this resolution on February 28, 2000.

B. Conditional Use Permit
Councilmember Allenspach introduced the following Resolution, approving a conditional use permit for a
building in a M -1 (light manufacturing) district at 2305 White Bear Avenue to be closer than 350 feet to a
residential district the proposed buildina would be 200 feet from the nearest residential district and moved for
its adoption. The city bases the approval on the findings required by code and is subi ect to the following
conditions :

V]IEREAS, the history of this conditional use permit is as follows:
1. On February 7, 2000, the planning commission recommended that the city council approve this permit.
2. On February 28, 2000, the city council held a public hearing. The city staff published a notice in the paper
and sent notices to the surrounding property owners. The council gave everyone at the hearing a chance to
speak and present written statements. The council also considered reports and recommendations of the city
staff and planning commission.
NOW, THEREFORE, BE IT RESOLVED that the city council approve the above - described conditional use
permit based on the building and site plans. The city approves this permit because:
1. The use would be located, designed, maintained, constructed and operated to be in conformity with the
city's comprehensive plan and code of ordinances.
2. The use would not change the existing or planned character of the surrounding area.
3. The use would not depreciate property values.
4. The use would not involve any activity, process, materials, equipment or methods of operation that would
be dangerous, hazardous, detrimental, disturbing or cause a nuisance to any person or property, because of
excessive noise, glare, smoke, dust, odor, fumes, water or air pollution, drainage, water runoff, vibration,
general unsightliness, electrical interference or other nuisances.
5. The use would generate only minimal vehicular traffic on local streets and would not create traffic
congestion or unsafe access on existing or proposed streets.
6. The use would be served by adequate public facilities and services, including streets, police and fire
protection, drainage structures, water and sewer systems, schools and parks.
7. The use would not create excessive additional costs for public facilities or services.
8. The use would maximize the preservation of and incorporate the site's natural and scenic features into the
development design.
9. The use would cause minimal adverse environmental effects.
Approval is subject to the following conditions:

I . All construction shall follow the site plan approved by the city.
2. The proposed construction must be substantially started within one year of council approval or the permit
shall become null and void. The council may extend this deadline for one year.
3. The city council shall review this permit in one year.
4. The applicant shall install the landscaping as shown on the plan approved by the community design review
board at their meeting of February 22, 2000.
The Maplewood City Council adopted this resolution on February 28, 2000.

C. Design Approval
Councilmember Allenspach moved to approve the plans date - stamped January 7, 2000, for the proposed
Maplewood Retail Site at 2305 White Bear Avenue, based on the findings required by the code. Approval is
subject to the applicant complying with the following conditions:
1. Repeat this review in two years if the city has not issued a building permit for this project.
2. Before getting a building permit, the applicant shall submit grading, drainage, utility and erosion
control plans to the city engineer for approval.
3. The applicant shall complete the following before occupying the building:
a. Install a handicap - parking sign for each handicap - parking space.
b. Provide continuous concrete curb and gutter all around the parking lot and driveways.
C. Paint the rooftop mechanical equipment to match the building color if the units are visible.
(code requirement)
d. Construct the trash dumpster enclosure using the same materials and color as the building.
This enclosure shall have a 100 percent opaque gate.
e. Install an in- ground lawn irrigation system for all landscaped areas except for the planted
areas by the wetland behind the building. (code requirement)
f. Provide site - security lighting as required by the code. The light source, including the lens
covering the bulb, shall be concealed so not to cause any nuisance to drivers or neighbors.
4. If any required work is not done, the city may allow temporary occupancy if
a. The work is not essential to the public health, safety or welfare.
b. The city receives a cash escrow or an irrevocable letter of credit for the required work. The

amount shall be 200 percent of the cost of the unfinished work. Any unfinished landscapin
shall be completed by June 1 if the building is occupied in the fall or winter or within six
weeks if the building is occupied in the spring or summer.
5. All work shall follow the approved plans. The director of community development may approve
minor changes.
6. The three -color design of the awnings and tubular -steel detailing on the building shall be as shown
on the plans and shall not change.
7. The landscape plan shall be subject to the following conditions:
a. The applicant shall replace the four Ash Trees on the south side if they cannot be saved and
replace the two relocated evergreens on the White Bear Avenue side if they do not survive.
Tree sizes shall comply with the code. The applicant shall not remove any tree or plant
growth on public right -of -way since these trees were shown as plantings on the approved
landscape plan.
b The applicant shall resod any disturbed right -of -way.
C. The applicant shall install an in- ground lawn irrigation system in all landscaped areas.
8. The sign plan criteria shall be as follows:
a. Each tenant can have up to a 36-inch-tall wall sign on their store front on the main sign fascia
area. Tenant signs on the tower shall not exceed 48 inches in height.
b In addition to a 36-inch-tall sign on the front of the building Tenants in a corner space can
have a 36-inch-tall sign on the side elevation. Side elevation signs can only be placed over
doors, windows or towers of that tenants space.
C. Wall signs are not required to be on raceways.
d. Tenant identification signs are not allowed on the back of the building.
e. The pylon sign near Highway 36 shall not exceed 36 feet in height as measured from the base
of the sign.

of) the city engineer, who has presented such plans and specifications to the council for approval
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MAPLEWOOD
MINNESOTA:
1. Such plans and specifications, a copy of which are attached hereto and made a part hereof are
hereby approved and ordered placed on file in the office of the city clerk.
2. The city clerk shall prepare and cause to be inserted in the official paper and in the Construction
.Bulletin an advertisement for bids upon the making of such improvement under such approved plans and
specifications. The advertisement shall be published twice, at least ten days before the date set for bid openin
shall specify the work to be done, shall state that bids will be publicly opened and considered by the council at 10
a.m., on the 31 st day of March, 2000, at the city hall and that no bids shall be considered unless sealed and filed
with the clerk and accompanied by a certified check or bid bond, payable to the City of Map lewood , Minnesota
for five percent of the amount of such bid.
3. The city clerk and city engineer are hereby authorized and instructed to receive, open, and read
aloud bids received at the time and place herein noted, and to tabulate the bids received. The council will
consider the bids, and the award of a contract, at the regular city council meeting of April 10, 2000.

INTRODUCTION

DISCUSSION
Staff had written Condition 10 of the conditional use permit approval to read "The developer shall
install a 5- foot -wide bituminous path or widen the shoulder along the south side of Roselawn
Avenue between the proposed sidewalk on the site to the east line of the first driveway on the
church - property to the west of the site. The developers engineer shall show the necessary
additional bituminous on. the grading and construction plans. The city engineer shall approve the

details of these plans." This is the language that is now in the city council minutes.
Upon staff review, it was determined that this language does not accurately reflect what was said at
the council meeting. The recommended change (below) more accurately reflects the discussion at
the council meeting.
RECOMMENDATION
Revise Condition 10 of the conditional use permit approval for the Rosoto senior housing and the
city council meeting minutes of January 24, 2000. This condition shall read as follows (I have
crossed out the deletions and underlined the additions):

DISCUSSION
In 1999, there was a drop in the number of meetings held by the. CDRB. Development requests
were more prevalent in the first half of the year than the second, when many meetings were
canceled due to a lack of development requests. In spite of this, though, the CDRB reviewed a
relatively high number of new development proposals. These were: Acorn Mini Storage, Pep
Boys, Office Depot & Pier 1 Imports, Pineview Estates Condominiums, the Bruentrup Farm
Relocation site, Goodrich Golf Course Miniature Golf, First Financial office building, Waldorf
School, U.S. West Monopole at Presentation Church, Kline Volvo and U.S.. Bank. Building
addition requests included: Maplewood Auto Service, Carver Elementary- School, Hill- Murray
High School, Schroeder, Milk, Menard's and Excel Air Systems. The board also studied the site -
lighting ordinance and recommended changes to the city council which amended the code based
on their recommendation.
This past year, the CDRB experienced the loss of two long- standing members who contributed
substantially to the review board and the City of Maplewood. These were Mary Erickson and
Marie Robinson. Mary served on the board for 12 years and Marie nine. We are pleased to
welcome, however, our two new members, Jon LaCasse and Craig Jorgenson.
In the upcoming year, the board is receptive to the desires. of the council relating to unifying
design criteria for the undeveloped land west of the Maplewood Mall that is currently under the
development moratorium. There may also be a desire to evaluate the building and design criteria
as it relates to the White Bear Avenue Corridor Study.
The board is dedicated to promoting attractive development in Maplewood and will continue to
require quality building designs in the year 2000.

WHEREAS, the City of Maplewood has approved the plans for the construction
of Hazelwood Street from Gervais Avenue to County Road C.
WHEREAS, the City will be expending Municipal State Aid (MSA Project 138-
112 -02) funds on the improvement of said street; and
WHEREAS, said improvement-does not conform to the approved minimum width
standard with unrestricted parking; and
WHEREAS, release of MSA funds is dependent on specified parking restrictions.
NOW, THEREFORE, IT IS HEREBY RESOLVED that the City of Maplewood
prohibits the parking of motor vehicles on the west side of Hazelwood Street from
Gervais Avenue to County Road C, on the east side of Hazelwood Street from Gervais

Attached is a letter outlining the highlights of a proposed right of way agreement with
Metricom. This company is a wireless Internet provider that hopes to have an extensive
national system up and running in a short time. The system uses a series of radios
attached to street lights in the right -of -way.
The proposed agreement must be approved by about 75 metro area cities. To this end,
Metricom has worked with the League of Minnesota Cities and the Suburban Rate
Authority to prepare the agreement. In addition, the agreement was reviewed by the
City Attorney and found to be acceptable.
The city accepts virtually no risk in the agreement since we own no street lights. The
city would, however, receive 1 % of gross revenue from subscribers within Maplewood
and 10 free connections for city use.
It is recommended the city council approve the attached Metricom right of way
agreement and authorize appropriate city officials to execute the agreement.

RE: Metricom's Ricochet System and Use of City Right of way
Dear Ken:
Thank you for your time in meeting with me yesterday to talk about Metricom and its desire
to bring its exciting new wireless internet service, called Ricochet, to City businesses and
residents. lam writing this letter to summarize our discussion.
SYSTEM REQUIREMENTS
Metricom's wireless network is accomplished by attaching shoebox sized radios on street
lights. It usually takes approximately seven of these radios per square mile to cover an area.
The power for the radios is tapped from existing photo sensors on the street light. These
radios can also be attached to power poles. Metricom does not plan to add any new poles or
do any trenching in the right -of -way, however, Metncom will need to use the City's right -of-
ways In order to access the light poles and power poles.

BENEFITS TO CITY
The main benefit will be for residents and businesses to have the choice of a high -speed
wireless internet capability. In order to speed the rollout of our system in the Twin Cities
market Metricom is willing to go beyond the statutory limits that cities can charge for the use
of the right of way. The Agreement provides for the following payments. These are the exact
same payments being proposed and accepted by other cities:
Sec. 3.4- payment of all normal application fees for initial installation
Sec. 4. 1 - annual payment of I% of gross revenue for subscribers in the City as
a simple way to calculate the City's right of way management
costs for Metricom. This relieves the City from the need to calculate a
right -of -way management fee for Metricom, whose use is a simple 15-
minute stop to attach a radio to a pole.
Sec. 4.2- annual payment of $60 per City -owned pole upon which a radio is
attached
Sec. 4.3 Metricom pays for all of its electricity use
Sec. 4.4- Metricoin will reimburse the City for its attorney's fees to review the
Agreement up to $1,000

CITY APPROVAL PROCESS
Could you please verify. our discussion that the Council's final approval will be scheduled for
the Council meeting on March 13?
MAPPING -
The Agreement requires Metricom to supply the City with a map showing the proposed
locations of the pole top radios. We propose to supply the map after the Agreement is signed
using City GIS street mapping and power company GIS pole mapping. All radio locations,
whether on City -owned poles or power company poles, will be subject to City review and
approval.

between the CITY OF MAPLEWOOD, a Minnesota local government unit the
City ), and METRICOM, INC., a Delaware corporation ( "Metricom"). p
Recitals
A. Metricom owns, maintains, and operates, in accordance with regulations
promulgated by the Federal Communications Commission, a mobile digital data
communications radio network known as Ricochet®, utilizin g Radios (as defined in
§ 1.10 below) and related equipment certified by the Federal Communications
Commission.
B. For purpose of operating Ricochet®, Metricom wishes to locate p lace ,

attach, install, operate, and maintain Radios in the Public Right of Way as defined in
§ 1.9 below) on facilities owned by the City, as well as on facilities owned b � Y third

1 DEFINITIONS The following definitions shall ap g e nerally to the p rovisions of this

Use Agreement:
1.1 Adjusted Gross Revenues. "Adjusted Gross Revenues" means the g ross
dollar amount received by Metricom for its Services as defined in § 1.11

fee; (ii) local, state, or federal taxes that have been billed to the subscribers

from subscribers (i. e., bad debts) with billing addresses in the City that
was previously included in Adjusted Gross Revenues.
1.2 Clay. "City" means the City of Maplewood.
1.3 Fee. "Fee" means any assessment, license, charge, fee, imposition, tax, or
levy of general application to . entities doing business in the City lawfully
imposed by any governmental body (but excluding any utility users' tax,
franchise fees, communications tax, or similar tax or fee).
1.4 Installation Date. "Installation Date' shall mean the date that the first
Radio is installed by Metricom pursuant to this Use Agreement.
1.5 Laws. "Laws" means any and all statutes, constitutions, ordinances,
resolutions, regulations, judicial decisions, rules, tariffs, administrative
orders, certificates, orders, or other requirements of the City or other
governmental agency having joint or several jurisdiction over the parties
to this Use Agreement.
1.6 Metricom. "Metricom" means Metricom, Inc., a corporation duly
organized and existing under the laws of the State of Delaware, and its
lawful successors, assigns, and transferees.
1.7 MPUC " MPUC" means the Minnesota Public Utility Commission.
1.8 Municipal Facilities. "Municipal Facilities" means City -owned street light
poles, lighting fixtures, electroliers, or other City -owned structures located
within the Public Right of Way and may refer to such facilities in the
singular or plural, as appropriate to the context in which used.
1.9 Public Bight of Way. "Public Right of Way" means the space in, upon,
above, along, across, and over the public streets, roads, highways, lanes,
cartways, courts, ways, alleys, boulevards, sidewalks, bicycle lanes, and
places, including all public utility easements and public service easements
as the same now or may hereafter exist, that are under the jurisdiction of
the City. This term shall not include county, state, or federal rights of way
or any property owned by any person or entity other than the City, except
as provided by applicable Laws or pursuant to an agreement between the
City and any such person or entity. If the City adjusts its boundaries
pursuant to Minn. Stat., Chap. 414 through annexation, incorporation,
combination, detachment, or other means, this Use Agreement shall be

binding on the entire area within the City's boundaries after the
adjustment.
1.10 Radio. "Radio" means the radio equipment, whether referred to singly or
collectively, to be installed and operated by Metricom hereunder.
1.11 Services. "Services" means the mobile digital communications services
provided through Ricochetfl by Metricom, which services consist
principally of wireless Internet, e-mail and local area network access and
may include transmission of sound and video images; provided, however,
that "Services" shall not be construed, interpreted or applied to authorize
either real time telecommunications services (including telephone and
voice) or video or cable television communications services except as may
be considered standard Internet content.
2 TERM. This Use Agreement shall be effective as of the Effective Date and shall
extend for a term of nine (9) years commencing on the Installation Date, unless it is
earlier terminated by either party in accordance with the provisions herein. The term
of this Use Agreement shall be renewed automatically for three (3) successive terms of
five (5) years each on the same terms and conditions as set forth herein, unless either
party notifies the other of its intention not to renew not less than one hundred
eighty (180) calendar days prior to commencement of the relevant renewal term.
3 SCOPE OF USE AGREEMENT. Any and all rights expressly granted to Metricom under
this Use Agreement, which shall be exercised at Metricom's sole cost and expense, shall
be subject to the prior and. continuing right of the City under applicable Laws to use
any and. all parts of the Public Right of Way exclusively or concurrent) with an other

person or entity and shall be further subject to all deeds, easements, dedications,
conditions, covenants, restrictions, encumbrances, and claims of title of record which
may affect the Public Right of Way. Nothing in this Use Agreement shall be deemed to
grant, convey, create, or vest in Metricom a real property interest in land, including any
fee, leasehold interest, or easement. Any work performed ursuant to the rights

granted under this Use Agreement shall be subject to the reasonable p rior review and
approval of the City.
3.1 Attachment to Municipal Facilities. The City hereby authorizes and
permits Metricom to enter upon the Public Right of Way and to locate,
place, attach., install, operate, maintain, remove, reattach, reinstall,
relocate, and replace Radios in or on Municipal Facilities for the p

of operating RicochetO and providing Services. In addition, subject to the

provisions of § 4.3 below, Metricom shall have the right to draw electricity
for the operation of the Radios from the power source associated with
each such attachment to Municipal Facilities.
3.2 Attachment to Third -Party Property. Subject to obtainin g the permission
of the owner(s) of the affected property, the City hereby authorizes and
permits Metricom to enter upon the Public Right of Way and to attach,
install, operate, maintain, remove, reattach, reinstall, .relocate, and replace
such number of Radios in or on poles or other structures owned by public
utility companies or other property owners located within the Public
Right of Way as may be permitted by the public utility company or
property owner, as the case may be for the purposes of operating
RicocheKD and providing Services. Upon request, Metricom shall furnish
to the City documentation of such permission from the individual utilit
or property owner responsible. City agrees to cooperate with Metricom,
at no cost or expense to City, in obtaining where necessary the consents of
third -party owners of property located in the Public Right of Way.

3.3 No Interference. Metricom in the performance and exercise of its rights
and obligations under this Use Agreement shall not interfere in any
manner with the existence and operation of any and all public and private
rights of way, sanitary sewers, water mains, storm drains, g as plains,
poles, aerial and underground electrical and telephone wires, electroliers,
cable television, and other information or communications, utility, or
municipal property, without the express written approval of the owner or
owners of the affected property or properties, except as permitted by
applicable Laws or this Use Agreement. City agrees to use reasonable
efforts to require the inclusion of the same or a similar prohibition on
interference as that stated above in all agreements and franchises Cit
may enter into after the Effective Date with other information or
communications providers and carriers.
3.3.1 Interference Resolution. Any actual or anticipated radio
interference caused by either the presence of the Radios or the p resence of
any such other communications equipment or devices in the Public Right
of Way shall be resolved by Metricom and any such other p roviders
without cost to City on the basis of the applicable rules, regulations,
practices, and procedures of the FCC. City agrees to assist Metricom in the
resolution of any such interference dispute at Metricom's sole expense.

3.4 Compliance with Laws. Metricom shall comply with all applicable Laws

in the exercise and performance of its rights and obligations under this
Use Agreement. The Right -of -Way Management Reimbursement
provided for in § 4.1 below shall be in lieu of all other City fees with the
exception of any City permits required for the initial installation of the

3.5 Location and Installation of Radios. The proposed locations of Metricom's
planned initial installation of Radios shall be determined, subject to the
reasonable prior review and approval of the City, promptly after

of the Radios. Upon the completion of installation, Metricom promptly

shall furnish to the City a pole list showing the exact location of the Radios
in the Public Right of Way.
4 COMPENSATION; UTILITY CHARGFS. Metricoml shall be solely responsible for the
payment of all lawful Fees in connection with Metricom's performance under this Use
Agreement, in accordance with the terms set forth below.
4.1 Right-of-Way Management Reimbursement. In order to reimburse City for
any right -of -way management costs it may incur during the term of this
Use Agreement following the initial deployment of the Radios in
connection with Metricom's entry upon and deployment within the Public
Right of Way, Metricom shall pay to the City, on an annual basis, an
amount equal to one percent (17o) of Adjusted Gross Revenues (the "Right-
of -Way Management Reimbursement'), which amount may be collected
from subscribers of the Services with billing addresses in the City and
remitted to City as provided herein. The parties agree that such
Right-of-Way Management Reimbursement represents a fair estimate of the
costs of continuing management of the Public Right of Way utilized by
Metricom and that such Right-of-Way Management Reimbursement is* not a
franchise fee or payment for use of the Public Right of Way. The

commencing upon the date that Services are offered to commercially paying
subscribers within the City using Radios installed p ursuant to this Use
Agreement and ending on the date of termination of this Use Agreement,
and shall be due on or before the 45th day after the end of each calendar Y ear

or fraction thereof. Within forty -five (45) days after the termination of this
Use Agreement compensation shall be paid for the period elapsing since the
end of the last calendar year for which compensation has been paid.
Metricom shall furnish to the City with each payment of compensation
required by this section a statement, executed by an authorized officer of
Metricom or his or her designee, showing the amount of Adjusted Gross
Revenues for the period covered by the payment. If Metricom discovers any
error in the correct amount of compensation due, the City shall be paid
within thirty (30) days of discovery of the error or determination of the
correct amount Any overpayment to the City through error or otherwise
shall be refunded or offset against the next payment due. Acceptance by the
City of any payment due under this section shall not be deemed to be a
waiver by the City of any breach of this Use Agreement occurring prior
thereto, nor shall the acceptance by the City of any such payments preclude
the City from later establishing that a larger amount was actually due or
from collecting any balance due to the City. City may, at any time, at City's
sole option, upon ninety (90) days written notice, require Metricom to
discontinue the Right -of -Way Management Reimbursement
compensation. Upon receiving such notice Metricom shall, no later than
ninety (90) days after receiving such notice, cease snaking all
compensation payments that would have been payable after such ninety
(90) day notice period. If City requires such a discontinuation of Right -of-
Way Management Reimbursement compensation, the City may then
charge, on an annual basis, its actual Right -of -Way Management costs
(pursuant to Minnesota Statutes Sec. 237.162, Subd. 9 and Sec. 237.163,
Subd. 2 (b)), that are incurred after the expiration of the ninety (90) day
period described above. Metricom shall only be liable for such actual
annual Right -of -Way management costs to the extent such costs exceed
the annual retail value of the service subscriptions for which the City is
eligible under Section 4.5 of this Agreement.
4.1.1 Reduction of Right -of -Way Management Reimbursement by
Amount of Utility Users or Communications Tax.
Notwithstanding anything to the contrary in this Use Agreement, if
the Services are subject to a utility users tax, communications tax,
or other similar tax or fee which accrues to the City by operation of
the City's Municipal Code or other applicable law, then the amount
of the Right -of -Vijay Management Reimbursement shall be reduced

by the amount of the applicable utility users tax, communications
tax, or such other similar tax or fee.
Accounting Matters. Metricom shall keep accurate books of account at its principal
office in Los Gatos or such other location of its choosing for the purpose of determining
the amounts due to the City under § 4.1 above. The City may inspect Metricom's books
of account relative to the City at any time during regular business hours on thirty (30)
days' prior written notice and may audit the books from time to time at the City's sole
expense, but in each case only to the extent necessary to confirm the accuracy of
payments clue under § 4.1 above. Alternatively, Metricom will make available for
inspection by the City at Metricom's office located closest to the City, upon thirty (30)
days prior written notice, the relevant portions of its books and records as reasonably
necessary to confirm the accuracy of any payments due the City under this Use
Agreement. The City agrees to hold in confidence any non - public information it learns
from Metricom to the fullest extent permitted by Law.
4.2 Annual Fee. As compensation for the use of Municipal Facilities,
Metricom shall pay to the City an annual fee (the "Annual Fee ") in the
amount of Sixty Dollars ($60.00) for the use of each Municipal Facility, if
any, upon which a Radio has been installed pursuant to this Use
Agreement. Where light poles or other facilities to be used by Metricom
within the Public Right of Way are owned by a utility, such annual fee
shall be paid to the appropriate utility and not to the City. The aggregate
Annual Fee with respect to each year of the term shall be an amount equal
to the number of Radios installed on Municipal Facilities during the
preceding twelve (12) months multiplied by the Annual Fee, prorated as
appropriate, and shall be due and payable not later than forty-five (45)
days after each anniversary of the Installation Date. City represents and
covenants that City owns all Municipal Facilities for the use of which it is
collecting from Metricom the Annual Fee pursuant to this § 4.2.

4.3 Electricity Charges. Metricom shall be solely responsible for the anent

upon the Radios' usage of electricity and applicable tariffs.
4.4 Reimbursement of City's Project Review Expenses. Metricom shall
reimburse the City at City's standard rates for reasonable attorney's fees
and other project review expenses relating to the preparation and review
of this Use Agreement, promptly upon receipt of itemized bills, p aid
invoices, and other such documentation as Metricom shall reasonably
require, and in a total amount not to exceed One Thousand Dollars
($1,000). The reimbursement provided for in this § 4.4 shall not replace or
excuse Metricom from the payment of any applicable permit fee for work
undertaken pursuant to the initial installation of the Radios.
4.5 Municipal Subscriber Program. City shall have the right throughout the

term of this Use Agreement to receive up to the maximum number
specified below (based upon the City's population) of free Ricochet@ basic
service subscriptions. The number of free subscriptions which the City
may receive shall be determined in accordance with the City's official
population, as shown on the latest available census data, as follows: (a) for
municipalities with a population of less than 100,000, up to a maximum of
ten (10) free subscriptions; (b) for municipalities with a population of

between 100,000 and 249,000, - up to a maximum of fifteen (15) free
subscriptions; (c) for municipalities with a population of between 250,000
and 500,000, up to a maximum of twenty (20) free subscriptions; and

(d) for municipalities of over 500,000, up to a maximum of twenty-five 25
free subscriptions. City shall designate one p erson who shall be
responsible for ordering and receiving any subscriptions. To take
advantage of this program, the designated individual should contact
Metricom's Network Real Estate Department at the address stated in § S
below City's right to use the subscriptions shall commence at the time
that Ricochet® service is commercially available in the City and shall
extend until the expiration of the term of this Use Agreement or through

resell, distribute, or otherwise permit the use of same b an other person,

excepting a local public entity that provides public service within the
corporate boundaries of the City (e.g., municipal schools, public safety, or
fire departments, etc.). The level of benefits and service rovided to City

by Metricom as "basic service" shall not be diminished or reduced during
the terns of this Use Agreement or renewal thereof or p rior to its
cancellation or termination, as the case may be.
4.6 Most-Favored Municipality Clause. Should Metricom after the p arties'
execution and delivery of this Use Agreement enter into a right-of-way
permit and facility use agreement with another municipality of the same
size or smaller than the City as compared with cities in the Minnesota
counties of Anoka, Carver, Dakota, Hennepin, Ramsey, Scott and

Washington, which agreement contains either (a) a higher Right-of Wa

Management Reimbursement as described in § 4.2 above or (b) a higher
Annual Fee as described in § 4.2 above or (c) -a higher amount of

5 RELOCATION AND DISPLACEMENT OF RADIOS. Metricom understands and
acknowledges that City may require Metricom. to relocate one or more of its Radios,
and Metricom shall at City's direction relocate such Radios at Metricom's sole cost and
expense, whenever City reasonably determines that the relocation is needed for any of
the f
following purposes: (a) if required the construction, completion, repair,

relocation, or maintenance of a Cit project; (b) because the Radio is interfering with or
adversely affecting proper operation of City -owned light poles, traffic signals, or other

5.1 Relocations at Metricom s Request: In the event Metricom desires to

available for use in accordance with and subject to the terms and
conditions of this Use Agreement
5.2 Damage to Public Right of Way. Whenever the removal or relocation of
Radios is required or ermitted under this Use Agreement and such

removal or relocation shall cause the Public Right of Way to be damaged,
Metricom, at its sole cost and expense, shall promptly repair and return
the Public Right of Way in which the Radios are located to a safe and
satisfactory condition in accordance with applicable Laws, normal wear
and tear excepted. If Metricom does not repair the site as just described,
then the City shall have the option, upon fifteen (15) days' prior written
notice to Metricom, to perform or cause to be performed such reasonable
and necessary work on behalf of Metricom and to charge Metricom, for the

7.2 Workers Compensation Insurance. Metricom shall obtain and maintain
at all times during the term of this Use Agreement statutory workers'
compensation and employers liability insurance in an amount not less
than One Million Dollars ($1,000,000) and shall furnish the City with a
certificate showing proof of such coverage.
7.3 Insurer Criteria. Any insurance rovider of Metricom sha Il be admitted
and authorized to do business in the State of Minnesota and shall carry a
minimum rating assigned by A.M. Best & Company's Ke Rating Guide
of A Overall and a Financial Size Category of "X" ( i.e. , a g ry size of
$500,000,000 to $750,000,000 based on capital, su a conditional
p p a nd conditional
reserves). Insurance policies and certificates issued by non - admitted
insurance companies are not acceptable.

to notify Metricom of the receipt of a proposal for the installation of
communications equipment or devices in the Public Right of Way or on

11.2 Waiver of Breach. The waiver by either party of any breach or violation of
any provision of this Use Agreement shall not be deemed to be a waiver
or a continuing waiver of any subsequent breach or violation of the same
or any other provision of this Use Agreement.
11.3 Severability of Provisions. If any one or more of the p rovisions of this Use
Agreement shall be held by court of competent jurisdiction iri a final
judicial action to be void, voidable, or unenforceable, such s rovision
P ()
shall be deemed severable from the remaining p rovisions of this Use
Agreement and shall not affect the legality, validity, or constitutionality of
the remaining portions of this Use Agreement. Notwithstandin g the
foregoing, the parties agree that if a court or administrative agency of

competent jurisdiction should declare a provision(s) of Section 4 of this
Use Agreement invalid, then the parties shall each be obligated to

shall be vested exclusively in the state courts of Minnesota, County of

Attached is a letter from St. Paul Regional Water Services requesting Maplewood
consent to their agreement to install antennas on the Stillwater Road water tower. The
tower belongs to the utility, but our agreement with the utility provides for Maplewood
consent and to share the revenue.
Antennas on water towers have become commonplace. The array proposed here is
relatively tasteful and should not be an eyesore. In addition, Maplewood would receive
$600 a month in revenue.
It is recommended that the city council consent to the lease agreement covering
antennas on the Stillwater Road water tower.

I am writing at your request to verify that APT Minneapolis, Inc. has provided the Board of Water
Commissioners with a lease agreement for the above site on behalf of Aerial Communications, Inc.,
a P.C.S. communications company. Staff will present the lease to the Board for consideration at
their March 14, 2000 meeting, and will recommend they approve it.
The agreement allows the installation and operation of equipment inside the dry fluted tower column
and up to twelve antennas clustered in three sections at the top of the tower.
The agreement has a five -year term which automatically renews for three additional five -year terms,
starting at a monthly lease rate of $1,200.00 per month and increasing 4% each year. In accordance
with the October 30, 1996 agreement between the City of Maplewood and the Board, Maplewood
will receive 50% of the net revenues.
We ask that you consent to the agreement and allow APT Minneapolis, Inc. to proceed with

Enclosed is Howard R. Green Company's proposal to provide engineering services for
reroofing at the Public Works Building. The proposal outlines the scope of services that
we anticipate would be needed to assist in the design of a new roofing system.
A preliminary estimate Of construction cost is $180,000. This estimate is "ball park" and
several factors including system selection could affect these costs. This estimate also
assumes fairly good staging areas and normal working hours for the contractor.

PROPOSAL FOR ROOF ENGINEERING SERVICES
2000 ROOF REPLACEMENT
CITY OF MAPLEWOOD
ROOF DESIGN CONSULTATION
Howard R. Green Company will meet with and review the following items with the City of
Maplewood regarding the City's development of reroofing construction documents for
the Public Works building.
1. Review existing building plans, specifications, warranties, and any previous reports
concerning the existing roofing systems, if available.
2. Review code requirements and design standards with regard to:
Local Building Codes
Fire Resistance
Wind Uplift
Underwriters Laboratories (UL)
Factory Mutual (FM)
3. Evaluate various roofing design alternatives such as:
Tapered insulation to promote drainage
The installation of additional roof drains
Removal of obsolete roof top projections
Installation of new roof hatches
Develop construction cost estimates for each alternative. Assist Owner
representatives in selecting the optimum roofing system alternative.
4. Assist the Owner in reviewing and analyzing the bids received from the roofing
contractors. Assist the Owner during negotiations with the successful contractor, if
necessary.
CONSTRUCTION PHASE
1. Howard R. Green Company will promote verbal and written communications
between designated Owner personnel, the roofing contractor, the roofing
manufacturer, and Howard R. Green Company throughout the duration of the roofing
project.
2. Conduct a preconstruction meeting to review the proposed scope of work,
scheduling, answering Contractor questions, etc. Assist the Owner in coordinating
the work of the Contractor with facility operations.
3. Review product submittals from the Contractors to ensure that the materials comply
with the specifications.

4. Perform a review of the roofing construction on a part -time basis in order to observe
the quality of the workmanship and determine if the project is proceeding in
accordance with the specifications.
5. During each site visit, Howard R. Green Company personnel will prepare written
reports to document the progress of the roofing project and recommend any
necessary or desirable changes. The written reports will be reviewed with the
Contractor on a daily basis. Copies of the written reports will be submitted to
designated Owner personnel after each site visit. Digital photographs will be taken
periodically to document the methods of installation and the progress of the reroofing
project.
6. -,Perform la, review of the new roofing system. as the project nears substantial
completion. Prepare a punch list of items that need to be corrected or replaced.
Distribute written punch lists to designated Owner personnel, the roofing Contractor,
and the roofing manufacturer.
7. Conduct a final review of the project to ensure proper completion of all punch list
items.
8.. Assist the Owner in obtaining the manufacturer's and Contractor's written warranties
for the project.

In June of 1999, we negotiated a two year contract with AFSCME Local 2725
representing our clerical, technical and maintenance employees. The agreement
stated we would re -open for wage negotiations for 2000. We have recently reached a
tentative agreement on that issue, which was ratified by the membership. The
agreement is described on the attached page.
I have included the Bureau of Mediation Services Uniform Settlement Document. By
Law, this must be presented to the City Council with the proposed settlement.
Approval of this settlement is recommended. If you have any questions, please let me
know.

CONTRACT SETTLEMENT
Wage Re- opener 2000
1. W ades General wage increase of 3% for 2000, retroactive to
1 -1 -00.
The title of Maintenance Worker will receive an additional
adjustment of $.15 per hour retroactive to 1 -1 -00 to
decrease the differential between the Maintenance
Workers (Street and Parks) and the Utility Maintenance
Workers. The difference between the two classes in the
future shall be capped at $.15/hour.
2. Performance Pav Employees who worked in 1999 and still work with the
City on May 1, 2000 will receive a one time lump sum
performance payment for the year 2000. This payment
will be by separate check and will be paid by approximately
May 1. The amount will be based on the employee's 1999
performance review. Full time employees who meet the
above criteria and received an overall rating of "meets
expectations" on the 1999 review will receive $400. Those
who received an overall rating of "exceeds expectations"
will receive $600. Part -time employees will receive a pro-
rated amount based on their average hours worked per
week in 1999. Any full -time or part -time employee who
received an overall rating lower than "meets expectations"
will not receive this performance -based payment.

St. Jerome's Church needs to renew their Lawful Gambling License with the
State of Minnesota, which requires a resolution from the City of Maplewood.
Their gambling is conducted at Church of St. Jerome, 380 Roselawn Avenue
East and Dean's Tavern, 1986 Rice Street.
RESOLUTION
BE IT HEREBY RESOLVED, by the City Council of Maplewood,
Minnesota, that the premises permit for lawful gambling is approved for St.
Jerome"s Church to operate at Church of St. Jerome, 380 Roselawn Avenue
East and Dean's Tavern, 1986 Rice Street, Maplewood, Minnesota.
FURTHERMORE, that the Maplewood City Council waives any
objection to the timeliness of application for said permit as governed by
Minnesota Statute §349.213.
FURTHERMORE, that the Maplewood City Council requests that the
Gambling Control Division of the Minnesota. Department of Gaming approve
said permit application as being in compliance with Minnesota Statute
§349.213.
NOW, THEREFORE, be it Further resolved that this Resolution by the

Gladstone Neighborhood
LOCATION: Frost Avenue and Clarence Street

INTRODUCTION
Project Description
The Maplewood Fire Department is proposing to build a 12,744- square -foot, one -story fire station
north of R &M Family Meats and Maplewood Bakery. The building exterior would be brick with a
standing -seam metal roof. Refer to pages 11 -16. The site plan shows a possible future trail head
for the Gateway Trail. This is not part of the fire station project. If built, it would be a joint effort
between the City of Maplewood, Ramsey County and the State of Minnesota.
Requests
The applicant is requesting that the city council approve:
1. A comprehensive land use plan amendment from R3H (residential high density) to G
(government facility). The code requires that, to approve a conditional use permit (CUP), the
land use plan designation for a property must be in conformance with the proposed use.
2. A parking lot setback variance for the proposed 10 parking spaces that would front on Clarence
Street. The code requires a 15 -foot setback. These would be perpendicular spaces accessed
directly from Clarence Street.
3. A parking lot curbing variance for sections of the parking lot and entrance drive that are not
proposed for curbing. The code requires continuous concrete curbing for parking lots with more
than 12 spaces. The applicant is not proposing curbing in these areas for more effective
drainage.
4. A CUP for a public building. The city code requires a CUP for "public utility, public service or
public building uses." Refer to the CUP justification on page 17.
5. Building, site and landscape plans.
BACKGROUND
November 2, 1999 (election day): The Maplewood voters approved the expenditure of $1.8 million
for the construction of a new Gladstone Fire Station as part of the fire - safety referendum.
DISCUSSION
Comprehensive Plan Amendment
The city council must approve the proposed land use plan change to G if they wish to approve the
CUP. Staff recommends approval of this change since the proposed use complies with the general
development policies in the comprehensive plan. Refer to pages 18 -19.
Class 5 Wetland Exemption
The Maplewood Wetland Maps show a Class 5 Wetland on the proposed site. This wetland is
located on the west side of the proposed building adjacent to the west- facing garage doors. This is.
not a naturally- occurring wetland —the City of Maplewood created it in the 1960`s to collect runoff in
a small area. At the suggestion of the Watershed District, .staff has applied for an exemption from
the Wetland Conservation Act (WCA) wetland regulations. This wetland meets the criteria for an
exemption from the WCA since:
• This wetland is not a naturally- occurring wetland. It was created by the City of Maplewood in a
nonwetland area for the purpose of storm water retention. It is evident from 1945 aerial
photographs that the wetland was not natural.
• This wetland was not created as part of a compensatory wetland mitigation process and has not
taken on any wetland characteristics.
• This exemption would improve site runoff in terms of rate control and storm water quality. This
proposal calls for the creation of two storm water ponds. Storm water from the two larger
parking lots would sheet drain to these ponds across native grasses and plantings for
nutrient and sediment abatement. This plan would result in the substitution of a poor- quality
wetland with an improved drainage system.
• The subject wetland is very small only 1,650 square feet (approximately 30 by 55 feet).
• There are no other suitable sites for the fire station. The Maplewood Fire Department looked for
other sites for the proposed fire station. The Gladstone station must be located in this
geographical area to serve a specific area.
Parking Lot Setback and Parking Lot Curbing Variances
Parking in General
The applicant has proposed three parking areas. The 26- space parking lot south of the building is
intended for fire fighters, the 10 spaces along Clarence Street are primarily for convenient handicap
parking spaces plus six regular stalls and the 48 spaces east of Clarence Street are for trail and fire
station banquet -room use. There is no parking formula for a fire station. The proposed 84 spaces
should be enough. Additional spaces can be added east of Clarence Street at a later time if
needed.
Setback Variance
The code requires that parking lots be set back 15 feet from a street right -of -way line. The
proposed 10 spaces along Clarence would be in the right -of -way. The architect designed the site

this way for two reasons: first to provide the handicap - accessible spaces close to the front
entrance, and second, because the odd shape of the site did not offer any better options. one
option would have been to shift the building to the west and provide on -site parking at a 15-foot
setback. This would have crowded the building too close to the west lot line, however, and
consequently hinder fire -truck access into the west doors.
The city has allowed on- street parking before. This was for road -side parking in front of the
commercial building at the northeast corner of Kohlman Avenue and the Highway 61 frontage road.
Two other instances of parking within the right -of -way are the Vomella Companies parking in the
highway right -of -way at the northeast corner of Highway 36 and English Street and at Champps
Restaurant at 1 -35E and Roselawn Avenue in the freeway right -of -way.
Curbing Variance
The applicant did not propose curbing around the parking lot east of Clarence Street, along the
southerly edge of the south parking lot or along the long driveway from Frost Avenue. The city
typically requires curbing in such areas. The applicant did not propose curbing in these areas so as
not to impede drainage to the adjacent holding ponds. Their plan is to sheet drain these paved
areas across the grass to avoid the channelization of runoff and to avoid potential erosion. Sheet
drainage is becoming a preferred method from the standpoint of water quality. It allows nutrients
and sediments in runoff to disperse into the grass rather than being channelized and concentrated
by hard surfaces and curbing.
The benefit of curbing is to create a neat edge between the parking lot and the grass. Curbing also
helps to keep cars on the pavement by providing a wheel stop. The applicant could provide curbing
along the higher -grade sides of the east parking lot, but did not do so for design consistency.
Staff agrees with the proposed sheet- drainage concept but would prefer to see concrete curbs or
concrete edges provided wherever possible. Staff recommends that the applicant add curbing in
the areas shown in the sketch on page 20. This sketch shows where curbing is proposed and also
where staff would like to see it added. one variation in curbing design that staff is recommending is
that the applicant provide a flat concrete edge, perhaps one foot wide, along the east edge of this
driveway. This edge would be no taller than the pavement and would allow runoff over the top. The
intent into create a neat curb -like edge while allowing surface runoff.
The applicant is proposing to provide a parking barrier on the south edge of the southerly parking
lot. They have not designed this barrier yet, but should provide the design to staff for approval
before getting a building permit.
Conditional Use Permit
The proposed fire station would be compatible with this neighborhood and the majority of the
neighbors liked the proposal. Two neighbors expressed concerns, however, about traffic, noise,
reduction in privacy and parking lot visibility due to tree loss.
Traffic
Traffic will increase, but a fire station is not a high traffic generating use. The proposed fire station
will, in fact, create much less traffic than if this land were developed as currently zoned and
planned. The current land use plan designation (R3H —high density residential), would allow 35
apartment units. This would have a far greater impact on this neighborhood than the proposed fire
station.

Noise
Noise associated with the fire station would be the occasional fire call with siren and vehicle noise
associated with it.
Tree Loss. Reduction in Privacy and Visual Impact
Tree loss is unfortunate but unavoidable when developing a site. The neighbor north of the
proposed site is concerned about loss of privacy and negative visual impact. Fortunately, however,
the areas of most activity would be on the south and east, away from this neighbor's property.
There will also be a substantial amount of trees left on the Gateway Trail property that will provide a
heavy screen for this neighbor of the fire station and the proposed parking lot east of Clarence
Street. The applicant would also plant trees, on the north side of the building adding to the buffer.
Comment from the owner of the R &M Family Meats Property
The owner of the abutting property offered a suggestion that perhaps the city would consider
swapping the southerly point of the fire station site with the northerly point of his property. Staff will
pursue this idea with the Fire Chief to discuss it's merit_
Lieutenant Banick's Comments
Lieutenant John Banick points out that fire stations have not been a source for complaint from
neighbors. Refer to the memorandum on page 21.
Building, Site and Landscaping Design
The proposed building would be attractive. However, staff has the following recommendations for
the site and landscape plan:
1. The applicant should submit a site lighting plan indicating fixture design and illumination
intensity. The code requires such a plan for developments adjacent to residential property.
2. The landscape plan should be further developed to provide a six - foot -tall and 80 percent opaque
buffer south of the proposed east parking lot. Some of the proposed tree sizes on the
landscape plan are smaller than the code allows. The Red Maple and Red Oak trees must be at
least 2 % inches in caliper, balled and burlapped. The Amur Maple trees must be at least 1
inches in caliper, balled and burlapped.
The applicant has not shown limits to which areas would be sodded and which would be prairie
grass. The plan should show these Limits in conjunction with the holding pond layout.
3. The grading /drainage plan should be revised to show even sheet drainage across the grass
from paved areas.
4. The applicant should submit a design proposal for parking barriers and the curbing changes as
discussed above.
5. Clarence Street Right-of-Way Dedication
Clarence Street is not shown on the county half - section property line map as it crosses this site
(see page 12). It was presumably not dedicated as right -of -way since this land was publicly
owned. The right -of -way, therefore, was not secured.

This is a good opportunity to clean up the map and show the Clarence Street alignment. The
applicant should have their surveyor describe the Clarence Street right -of -way for incorporation into
a dedication document.
Park Director's Comments
Bruce Anderson, the Maplewood Director of Parks and Recreation, suggests that this , proposed fire
station have public bathrooms available for trail users and also that the easterly parking lot be
regarded as trail -use parking. Refer to Mr. Anderson's letter on page 22.
These building and parking lot use issues have merit. These should, however, be worked out later
among city staff and city council since they do not specifically affect the application.
COMMITTEE ACTIONS
February 22, 2000: The community design review board recommended approval of the parking
setback variance, the curbing variance and the design plans.
February 23, 2000: The planning commission recommended approval of the land use plan change
and the conditional use permit.
RECOMMENDATIONS
A. Adopt the resolution on page 23 amending the comprehensive land use plan from R3H
(residential high density) to G (government facility) for the property north and northwest of 1347
and 1351 Frost Avenue. This approval is for the construction of the proposed Maplewood Fire
Station No. 2 Gladstone Neighborhood. Approval is because the proposed fire station would
comply with the general development policies in the Maplewood Comprehensive Plan.
B. Adopt the resolution on pages 24 -25, approving a 15 -foot parking lot setback variance for the'
proposed Maplewood Fire Station No. 2 Gladstone Neighborhood north and northwest of 1347
and 1351 Frost Avenue. This variance would allow a parking lot within the Clarence Street right -
of -way. Approval is based on the following findings:
1. Compliance with the setback requirements would cause the applicant undue hardship
because of circumstances unique to the property. The site is oddly shaped making meeting
all parking lot setback requirements difficult.
2. The applicant would meet the spirit and intent of the code by providing handicap - accessible
parking spaces closer to the front entrance than if the spaces were moved to a different
location.
3. The city has allowed parking in the right -of -way before when the situation warranted it.
This variance is subject to the applicant submitting a curbing plan which indicates continuous
concrete curbing, concrete edging and parking barriers as shown on the curbing diagram in the
staff report. This plan must be submitted to staff for approval before the issuance of a building
permit.

C. Adopt the resolution on pages 26 -27, approving a variance from the parking lot curbing
requirements for the proposed Maplewood Fire Station No. 2 Gladstone Neighborhood north and
northwest of 1347 and 1351 Frost Avenue. This variance would waive the curbing requirement
in specific areas on the site. Approval is because sheet drainage from the two larger parking
lots is preferred for water quality in this instance.
This variance is subject to the applicant submitting a curbing plan which indicates continuous
concrete curbing, concrete edging and parking barriers as shown on the curbing diagram in the
staff report. This plan must be submitted to staff for approval before the issuance of a building
permit.
D. Adopt the resolution on pages 28 -29 approving a conditional use permit for the proposed
Maplewood Fire Station No. 2 Gladstone Neighborhood north and northwest of 1347 and 1351
Frost Avenue. Approval is based on the findings required by the code and subject to the
following conditions:
1. All construction shall follow the site plan approved by the city. The director of community
development may approve minor changes.
2. The proposed construction must be substantially started within one year of council approval
or the permit shall become null and void. The council may extend this deadline for one year.
3. The city council shall review this permit in one year.
4. The applicant shall have their surveyor provide the legal description for the Clarence Street
right -of -way and have the city attorney prepare documentation for the dedication and
recording of this right -of -way.
E. Approve the plans (stamped January 28, 2000) for the proposed Maplewood Fire Station No. 2
Gladstone Neighborhood, based on the findings required by the code. The property owner shall
do the following:
1. Repeat this review in two years if the city has not issued a building permit for this project.
2. Before getting a building permit, the applicant shall provide the following for staff approval:
a. A grading, drainage, utility and erosion control plan.
b. A revised landscape plan showing the following:
(1) Red Maple and Red Oak trees that are at least 2 %2 inches in caliper, balled and
burlapped.
(2) Amur Maple trees that are at least 1 %2 inches in caliper, balled and burlapped.
(3) Asix- foot -tall, 80 percent opaque buffer on the south side of the east parking lot.
(4) Areas that will be sodded and those that would have prairie grass.
(5) Any additional tree, shrub or turf requirements of the Ramsey - Washington Metro
Watershed District.

(6) In- ground lawn irrigation around the site on the west side of Clarence Street.
c. A revised site plan showing the following:
(1) The design of the parking barriers. There must be a parking barrier on the south
sides of both larger parking lots.
(2) A site lighting plan which indicates the fixture designs and illumination intensity.
(3) Concrete curbing and concrete edges as shown on the curbing diagram in the staff
report.
(4) The driveway from Frost Avenue moved to the west five feet to meet the required
five -foot side yard setback from. the easterly lot corner.
3. Complete the following before occupying the building:
a. Construct a trash dumpster enclosure for any outside trash containers. The enclosure
must be 100 percent opaque, match the material of the building and have a closeable
gate that extends to the ground. (code requirement)
b. Install all landscaping as shown on the approved plan.
c. Screen roof -top mechanical equipment that would be visible from the homes along
Clarence Street. All other roof -top units that are visible from non residential areas must
be painted to match the building. (code requirement)
d. Provide handicap - accessible parking spaces and signs as required by the ADA
(American's with Disabilities Act)..
4. All work shall follow the approved plans. The director of community development may
approve minor changes.

CITIZENS' COMMENTS
I surveyed the 34 property owners within 350 feet of this site for their comments. Of the ten replies,
three had no comment or objection and seven written replies were received.

2. At some time will there be a way for trail pedestrian to use the bathroom or get a drink of water?
At times we have such requests. Parking space looks like a great plan. (Maplewood Moose

4. The only concern I have is the increase in traffic especially on English Street. No one does the

look forward to having the increased traffic in the neighborhood. Additionally, I would like to be

The traffic is a negative to me, my neighbors and the trail users. I would like to see a decrease
in my property taxes to make up for the negative impact. I will now see a parking lot instead of

Findings for Land Use Plan Changes
There is no specific criteria for a land use plan change. Any land use plan change should be
consistent with the goals and policies in the city's comprehensive .plan. Refer to the policies on
pages 18 -19.
Findings for Variance Approval
State law requires that the city council make the following findings to approve a variance from the
zoning code:
1. Strict enforcement would cause undue hardship because of circumstances unique to the property
under consideration.
2. The variance would be in keeping with the spirit and intent of the ordinance.
"Undue hardship," as used in granting of a variance, means the property in question cannot be put
to a reasonable use if used under conditions allowed by the official controls. The plight of the
landowner is due to circumstances unique to his property, not created by the landowner, and the
variance, if granted, will not alter the essential character of the locality. Economic considerations

LETTER OF REQUEST
JANUARY 20, 2000
1. The station is located one block north from the existing station on Clarence. It is essential
in our response time to have the station located in close proximity to our firefighters'
homes. The station has been designed to fit into the area. The administrative (north side)
section, is a one -story gabled roof design to fit with the residential neighbors. The
apparatus bays are located (south end) facing toward the commercial building. The station
is designed as a 50 -year building with one function, being a fire station.
2. The station is again designed to fit into the neighborhood. Its design hints at the past with
a train station flair resembling the Gloster Train Station which was located near our station
site. The fire department administration conducted a meeting to introduce the design to
the immediate neighbors. Thirty people, of about 200 invited, attended this meeting which
resulted in positive feedback for the design. Five open houses were conducted for fire
prevention attach station with the; design on display. This also resulted in a positive
result. The station being designed to fit into the area as a transition from residential to
commercial is a good fit for the site. The station bay area will have glass overhead doors
front and rear to give the building a transparent look.
3. The building, in the writers opinion, would positively impact the neighborhood as existing
homes to the north are newer as well as several new homes being built on Ide Street. This
positive impact would, again in my opinion, only increase property valves. Prior to the
referendum, I received several calls from area residents expressing their hope the building
would be built to rejuvenate the neighborhood.
4. The facility would not bring any processes into the neighborhood. With the station will
come increased activity. In addition to the current use, there will be increased activity in
meetings, therefore increased apparatus and firefighter traffic. This traffic would enter and
egress for the most part to and from the south.
5. Traffic would increase in the area as it now exists for the current site. The outbound
emergency vehicle traffic generally will depart from the site to the south to Frost. Upon
return to the station, apparatus will use the access located on Frost Avenue, west of the
market building, east of the Trail.
6. The design and site would create little effect on city services as we are a city service.
Additionally, having a fire station one block to the south, the area should be accustom to
our operation. However, with this station being essentially our headquarters /or central
station, department wide meetings and activities will become more frequent. However,
this activity generally occurs Tuesday mornings and evenings, and an occasional Saturday
morning.
7. This facility would not create additional costs for services. As a replacement facility, the
costs to services maybe the same or slightly higher for lawn care and snow removal.
S. Again, the building design, colors and glass doors are to become and blend in as an integral
part of the neighborhood.
9. In my opinion, the environmental effects are minimal.

of substandard or incompatible development.
• The City coordinates its planning with neighboring communities.
• The City applies its development policies and ordinances
consistently and uniformly.
• The City coordinates land use changes with the character of each
neighborhood.
• The City regulates development near or the alteration of natural
drainage systems to manage storm water runoff.
• The City uses the Ramsey County Soil Survey to identify areas with
soils that are not suitable for building sites.
• The City may require the developer to furnish evidence from a
registered soil engineer that areas with problems can be developed
as proposed.
� The City considers the recommendations of the area Watershed
organizations in the review of development requests.
RESIDENTIAL DEVELOPMENT POLICIES
The following are the City's residential development policies:

I have reviewed the plans for the proposed Maplewood Fire Station on Clarence Street
,,::north. of Frost Avenue. I agree with Fire Chief Hewitt's assessment about the increase
in traffic to the area and it '.s minimal impact on the neighborhood. I believe most
residents in the area are familiar with the operation of a fire department in their
neighborhood and the impact on their daily lives. Over the years I do not recall one
complaint relating to the arrival or egress of firefighters or firefighting equipment to
one of our fire stations. The apartment building on Clarence at Skillman generates
considerably more traffic in the immediate neighborhood than the proposed fire station
would.
Currently, my only concern with this proposal is the exterior lighting. I did not see an
exterior lighting plan included in this proposal. Should a lighting plan become available
I would be interested in reviewing it.
I believe a new fire station on this property would improve the area and be an asset to
the community.

The proposed fire station is located at the intersection of the Gateway Trail and Ramsey County/
Burlington Northern Trail. This is the only point that these two highly used trails are crossed.
I have had some informal discussion with both the State DNR, owner and manager of the
Gateway Trail, and Ramsey County, owner and manager of the Burlington Northern Trail, to
discuss the feasibility of constructing a trailhead. This land was originally purchased with the
thought of creating a rest area, and the concept of constructing a trailhead on a shared three -way
basis has some merit. The proposed trailhead would include (at a minimum) a rest area, a paved
area including a drinking fountain, kiosk, benches, and possibly some picnic tables.
In my discussions with DNR, there are two issues that were raised regarding the parking lot on
the east side of Clarence. The first being is there merit to have that identified as an official
parking lot for the State DNR trail. I have spoken with the fire department and there are pros and
cons to use of that eastern parking lot.
The second item is public bathrooms. I have shared both of these issues with Joel Hewitt, and
believe that with the increased usage of traffic on the trails the fire department could have a
number of requests to utilize the bathrooms. I wonder if it makes any sense to have public
bathrooms, possibly as a service with an outside access. I realize there would be some cleaning
and possibly vandalism issues, but I raise this item for your consideration.

A. Maplewood Fire Station No. 2, Gladstone Neighborhood (Clarence Street)
Secretary Tom Ekstrand presented the staff report.. Steve Lukin, Assistant Fire Chief for the
City of Maplewod, answered the board's questions about the proposal.
Boardmember Shankar asked why it wasn't possible to keep the building at its planned
location but move the 10 parking stalls to the west to remain in compliance with the Clarence
Street right -of -way. Mr. Lukin replied that one of their concerns was keeping the "aesthetic
look of it." He said they wanted to save the numerous shrubs on the sub - northerly edge to
protect the trail and buffer the area from the neighboring residents.
Boardmember Shankar liked the building elevations and was "pleased with the choice of
materials." However, he was concerned with the "massiveness" of the south elevation and
wondered if some banding could be used across it. The architect for the project said they
were trying to bring in an emblem or some kind of wall signage in this area but this was
dependent on cost. She explained that this is the apparatus bay area that would be used for
future expansion. This wall measures approximately 84 x 20 feet. Mr. Ekstrand felt more
trees were needed on the landscape plan to provide a screen on the south.
Boardmember LaCasse moved the Community Design Review Board:
C. Adopt the resolution which approves a 15 -foot parking lot setback variance for the
proposed Maplewood Fire Station No. 2 Gladstone Neighborhood north and northwest of
1347 and 1351 Frost Avenue. This variance would allow a parking lot within the Clarence
Street right -of -way. Approval is based on the following findings:

(3) A six- foot -tall, 80 percent opaque buffer on the south side of the east parking

(4) Areas that will be sodded and those that would have prairie grass.
(5) Any additional. tree, shrub or turf requirements of the Ramsey - Washington
Metro Watershed District.
(0) In- ground lawn irrigation around the site on the west side of Clarence Street.
c. A revised site plan showing the following:
(1) The design of the parking barriers. There must be a parking barrier on the
south sides of both larger parking lots.
(2) A site lighting plan which indicates the fixture designs and illumination
intensity.
(3) Concrete curbing and concrete edges as shown on the curbing diagram in
the staff report.
(4) The driveway from Frost Avenue moved to the west eve feet to meet the
required five -foot side yard setback from the easterly lot cornea.

3. Complete the following before occupying the building:
a. Construct a trash dumpster enclosure for any outside trash containers. The
enclosure must be 100 percent opaque, match the material of the building and

c. Screen roof -top mechanical equipment that would be visible from the homes
along Clarence Street. All other roof -top units that are visible from non residential
areas must be painted to match the building. (code requirement)
d. Provide handicap - accessible parking spaces and signs as required by the ADA
(American's with Disabilities Act).
4. All work shall follow the approved plans. The director of community development may
approve minor changes.
5. Add a brick rollout course along the south elevation to break up the large brick wall.

V. PUBLIC HEARING
A. Maplewood Fire Station (Clarence Street): Land Use plan Amendment (R -3(H) to G) and
Conditional Use Permit
Ken Roberts, associate planner, presented the staff report. He said there was concern about a
low area that is designated as wetland on some maps. The Ramsey - Washington Metro
Watershed Board has determined, based on aerial photographs, that this is a man -made hole
`that came into existence sometime after 1945. Mr. Roberts said this area is now exempt from
many of the wetland protection standards that would be required for a naturally - occurring
wetland. Also, there is no longer a need for the wetland variance. Mr. Roberts answered
questions from the commissioners.
Joel Hewitt, fire chief, was present for the city of Maplewood. He introduced Steve Lukin, the
assistant chief; Mike Hemquist, the battalion chief of the station; Jim Franzen and Richard
Peterson, retired chiefs of the Gladstone Fire Department; Captain Pat Heffren of Station #2;
and Nancy Schulz of SEH, the architect. Mr. Hewitt said the land was purchased in October of
1998 from the CP Rail for approximately $64,000. The existing building and lot, according to
Mr. Hewitt; do not provide adequate .space for apparatus and other needs. The new facility will
be used as a central station for training and storage.
In the case of methadone labs, other hazardous materials and the need for decontamination of
equipment and supplies, Mr. Hewitt said firefighters are decontaminated at the scene. He said
that emergency medical services take up 75 percent of the fire department time. There are
several rooms in the proposed facility that would be used for decontaminating the EMS
equipment, etc. Mr. Hewitt explained that hazardous gear would be separated and possibly sent
with a HAZMAT team to be professionally decontaminated.
Chairperson Fischer opened the hearing to the public. No one wished to speak on the matter so
the public hearing was closed.
Commissioner Rossbach asked why the commission was not hearing the variance items.
Mr. Roberts replied that this was in the "gray area" and that the review board had considered the
variance at their meeting on February 22, 2000. Mr. Rossbach thought the city should be
reluctant to do things that they would not allow other people to do. He said that sheet runoff is
not and has never been the city's policy, and he wondered why it was being presented as such.
He also asked if concrete space -curbs would be used to stop cars from going on the grass. Ken
Haider, city engineer, responded to the water -runoff issue by saying that the city normally does
not have "as cooperative of a developer as we have this time." He said this site has a couple
larger infiltration areas and the city felt, from a water quality standpoint, it was better to have
sheet drainage from the parking lot. Mr. Haider wasn't sure how the cars driving on grass would
be controlled.
Commissioner Ledvina, who is also a member of the city design review board, said the board
questioned staff as to where this type of situation has been used in the past. Apparently it has
been implemented in several other city locations. The board suggested to staff that the
ordinance might be reevaluated to accommodate this type of circumstance if the city believes it
is beneficial for surface water quality. It was Mr. Ledvina's recollection that some curbing would

be required. Where this curbing is not required, there will be a concrete strip, flush with the
bituminous to provide a finished edge.
Mr. Roberts didn't know if a design has been presented to show how the sheet drainage is going
to work. He said the city is relying on the architect or engineer to show this. Commissioner
Ledvina pointed out that, as shown on the curbing diagram included in the agenda report, there
doesn't appear to be many parking areas involved in the use of the "flush edge." Commissioner
Rossbach noted that it was "only half of them." He thought it was necessary to consider the
variance when granting a special privilege to a piece of property. Chairperson Fischer thought
the planning commission could also consider a variance, even though another board had ruled
on it. She referred to previous occasions where as many as three commissions made
recommendations.
Chairperson Fischer suggested that the commission might also want to make a recommendation
that the ordinance the variances are being granted from be considered.
Commissioner Frost moved the Planning Commission recommend:
A. Adoption of the resolution which amends the comprehensive land use plan from R3H
(residential high density) to G (government facility) for the property north and northwest of
1347 and 1351 Frost Avenue. This approval is for the construction of the proposed
Maplewood Fire Station No. 2 Gladstone Neighborhood. Approval is because the proposed

In 1989 a property on Sterling Street south of Larpenteur Avenue was assessed for a 1"
water service and a sanitary sewer service. Late last year a home was built on the
property and connection to the services was attempted.
A contractor spent a day digging and looking for the pipes. Neither service was found.
Subsequently, the sewer service was found but at a location closer to the street than
originally thought. When originally constructed, the ground surface dropped off
drastically and a service of normal length would have ended up in mid air. The lot was
recently filled without concern for the service. The water service was never found.
As a gesture of good faith, the city should reimburse the builder for some of the cost to
bring service to the property. The water service cost $1,600.00 to install. Since the city
had collected the assessment and apparently not provided the pipe, the city should
bear this cost.
The sanitary sewer service was not exactly where it was supposed to be because the
topography had changed. It seems reasonable that the city bear the $750.00 cost
wasted while looking for the service on the first day.
It is recommended the city council authorize payment of $2,350.00 to Landmark,
Inc. to be funded by the appropriate utility accounts.

The above referenced project is currently being advertised for bids. The next step in
the improvement process would be to prepare the assessment roll.
The amount to be assessed is not directly dependent on the actual amount of the bid,
rather on a predetermined assessment rate established in the city's pavement
management policy. The method of assessment is the same as was outlined in the
feasibility study.
Staff recommends that the city council approve the attached resolution, ordering
the preparation of the assessment roll.

ORDERING PREPARATION OF ASSESSMENT ROLL
WHEREAS, the city clerk and city engineer have received bids for the
improvement of the Tilsen North Neighborhood Street, City Project 99 -05.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF
MAPLEWOOD, MINNESOTA that the city clerk and city engineer shall forthwith
calculate the proper amount to be specially assessed for such improvement against
every assessable lot, piece or parcel of land abutting on the streets affected, without
regard to -.cash valuation, as provided by law, and they.shall file. a copy of such
proposed assessment in the city office for inspection.
FURTHER, the clerk shall, upon completion of such proposed assessment notify
the council thereof.

The Maplewood City Council authorized the city manager to solicit request for proposals (RFP)
for the sale of the Gladstone Fire Station #2. The property was advertised for sale in the
Maplewood Review and a "For Sale" was installed in front of the building on Frost Avenue to
further solicit interest in the sale of the building and land.
BACKGROUND
With the approval of the new fire safety referendum last fall by the voters of Maplewood, the
Maplewood City Council authorized the fire chief to begin the process of building a new fire
station to replace the old Gladstone Fire Station #2 which had served the community for the past
54 years. At the February Council/Manager Workshop meeting the council agreed to have the
city manager solicit RFP's for the sale of the building and land. The city had an appraisal
completed on the building and land and it was valued at $155,000.
March 3, 2000 was the deadline for receipt of the RFP's and although the city received a number
of telephone calls about purchasing the Gladstone Fire Station only two were received. Webster
Dental submitted a RFP and agreed to purchase the building and property for $139,500. The

The owner of Webster Dental had a provision in his original purchase agreement whereby if the
adjacent fire hall is ever sold he would have the right to match the purchase price if it is higher.
The city also received a RFP from John McGovern to purchase the building and land for
$165,200. His letter explained that he would use the building for personal use and rental storage.
Webster Dental was notified of this purchase price and they agreed to exercise their option and
match the offer.
RECOMMENDATION
The city council should accept the bid proposal from Webster Dental to purchase the building
and property of the Gladstone Fire Station #2 at a price of $165,200 and direct the city manager
to begin the final work to complete the sale and to return the bid bond of Mr. McGovern.
