V. COMMUNICATIONS
a. Truth-in-Sale of Housing Process-Review and Discussion
Michael Moser, of M. J. Moser Inspection and Consulting, gave a presentation explaining that he
has been involved as a building contactor and in Truth-in-Housing inspections for 27 years. Mr.
Moser explained the Truth-in Housing evaluation and process. Mr. Moser discussed the
differences in enforcement and fees between metro cities.
Commissioner Pearson asked if Mr. Moser feels that Sec. 12-466 of the ordinance relating to
concealed items and limitations should be changed. Mr. Moser responded that he doesn't feel it is
possible to change this, since if you cannot see an item you cannot do anything about it. Mr. Moser
said that the guidelines are specific and the inspection report is a snapshot of the condition of the
property at the time.

Commissioner Pearson asked if the housing evaluators are required to be bonded. Mr. Moser
responded that they are not bonded, but are required to be insured for a specific amount.
Commissioner Richter asked if foreclosed or real-estate owned properties are required to have
Truth-in-Housing evaluations. Mr. Moser responded that evaluations are required on the sale of
any property, but in St. Paul a property is sometimes allowed to be sold to a family member without
an evaluation.
Commissioner Ulrich suggested that the city's insurance policy for liability coverage is probably
outdated and should be reviewed and updated. Planner Ekstrand said he would notify the city
attorney for review of this issue.
Commissioner Richter mentioned Mr. Moser's comments regarding it being redundant for a seller
to be required to complete the disclosure report form for both the state and Maplewood.
Commissioner Pearson said the state would probably not require the specific information relating
to Maplewood land issues, such as easements and wetlands, which are required on the city form.
Planner Ekstrand said he feels the form is worthwhile and there are no added costs to the seller
associated with completing the form. Mr. Ekstrand said he often receives phone calls from sellers
about land issues when they are filling out the form. .
VI. UNFINISHED BUSINESS
Commissioner Ulrich asked if staff has the updated report on foreclosed and vacant homes.
Planner Ekstrand said he will check with staff to see if those numbers are available.
VII. NEW BUSINESS
Commissioner Andreoli mentioned neighbors in the Maryknoll area being concerned with an auto
repair business going into a neighboring garage. It was suggested that one of the concerned
neighbors should call the planning staff to discuss this.

Code Enforcement Status Report
June 1, 2009
INTRODUCTION
As requested by the HRA, attached is the code enforcement report listing the number of
enforcement cases worked on by the department of community and parks development
(formerly community development). The data provided gives a comparison of previous
years dating back to 2006. In addition, a more detailed break down between 2008 and
2009 year-to-date stats were provided.
Staff presents this information to the HRA to give the committee an idea of the code
enforcement activity in the city. Typically, the types of complaints and code violations
we regularly respond to involve issues like, long grass, junk cars, trash in yards, fallen
fences, and the like.
DISCUSSION
These matters affect the quality of our city's housing stock and neighborhoods. Staff will
continue to be dedicated to upholding the city's property maintenance and nuisance
complaint ordinances to maintain healthy and safe neighborhoods and to protect our
resident's investment in their properties.
RECOMMENDATION
No action required.

Truth-in-Sale of Housing Process-Review

INTRODUCTION
At the May 13, 2009 HRA meeting, the committee heard a presentation by Mike
Moser, of M. J. Moser Inspections, on the city's truth-in-sale of housing
inspection process. Mr. Moser, a licensed housing inspector for this program,
discussed the process of housing inspections and offered some suggestions.
The HRA members also raised some questions and made some suggestions.
This is staff's follow-up on the following points:
Mike Moser's Suggestions
1. Forego the two page seller's disclosure report. He feels it is not needed.
2. Discontinue the double fee if the inspection report is not filed within 15 days.
3. Reduce the $30 filing fee which he feels is higher than other communities.
4. Put truth-in-sale of housing forms on the city's web page.
5. Allow electronic filing of truth-in-sale of housing reports.
HRA Comments/Questions
1. Are truth-in-sale of housing reports logged into the department's permit data
system?
2. We should explore our insurance coverage requirements as required in the
ordinance. Current amounts of insurance are $250,000 per claim and
$250,000 of general liability.
3. Consider adding disclosure of easements on the property in the seller's
disclosure report.
Response to Mr. Moser's Questions
1. The city should continue to require the submittal of this form. This form
includes information that a potential buyer needs to be aware of to educate
them on the nature of the property from other than a house- or construction-
quality standpoint.
2. We haven't had to require a double fee yet. Staff sees no harm in keeping
this requirement as it may help to get the reports submitted promptly.
3. We haven't gotten complaints on the $30 fee from others. The city council
raised this fee from $25 to $30 at the first of the year when reviewing all
community development department fees. Since the council sets fees at the
beginning of each year, staff cannot change them and does not recommend
pursuing any change at this time.
4. The city's web page contains a list of all licensed housing evaluators for
review by residents, as well as all necessary forms. The completed
evaluation forms are logged into the city's building permit data system under
the address of the home, but these are not available on the city's web page.
5. The city is currently not set up to take on-line or over-the-phone payments by
credit card. Therefore, we must continue to process reports, and take
payment, either by mail or over the counter.
Response to HRA Questions
1. As stated above, the completed evaluation forms are logged into the city's
building permit data system under the address of the home. These are
available upon request, but are not posted on the city's web page.
2. Staff is checking with the city attorney on the question of whether the required
insurance amounts are appropriate. We have not yet connected, but staff will
have that information to present at the meeting.
3. Staff will add the requirement for the disclosure of any known easements on
the Seller's Disclosure Report. I have attached the current form, as is, but
suggest the addition of the following as #9:

ARTICLE XI. TRUTH IN SALE OF HOUSING
Sec. 12-462. Purpose.
The purpose of this article is to protect the public health, safety and welfare and to promote
decent, safe and sanitary dwelling accommodations. To help accomplish this, the city is
requiring the disclosure of housing information and defects as a condition of the sale of
housing. City inspectors may use this information to require the correction of code violations.

Sec. 12-463. Definitions.
The following words, terms and phrases, when used in this article, shall have the meanings
ascribed to them in this section, except where the context clearly indicates a different meaning:
Adequate water flow means enough pressure to maintain at least a one-quarter-inch
diameter (pencil-sized) flow of water from each of at least three or more plumbing fixtures at
the same time.
Contractual agreement means an agreement, written or otherwise, between a buyer and
seller for the conveyance of or the intent to convey all or part of a housing unit or residential
building. A contractual agreement shall include but not be limited to an earnest money
contract, deed or purchase agreement.
Housing unit means a single dwelling, a double-dwelling unit, a townhouse unit, a
condominium unit as defined by state law, or any other attached housing unit designed for the
occupancy of one family. A housing unit shall not include a manufactured home.
Owner means a person having a vested interest in the housing unit or residential building
in question. This includes his duly authorized agent or attorney, before a sale.
Residential building means a building containing one or more housing units.
Sale means the conveyance of a housing unit or residential building to a new owner.

Sec. 12-464. Applicability.
This article shall not apply to any newly constructed housing or residential building when
the title is conveyed to the flISt owner, except that no owner shall conveyor contract to convey
a newly constructed housing unit or residential building without first providing to the buyer:
(1) A list of the names, addresses and telephone numbers of all contractors and subcon-
tractors who constructed the building.
(2) The items in section 12-464(b)(2)a, (b)(2)b, (b)(2)c, (b)(2)e, (b)(2)f, (b)(2)g, (b)(2)h and
(b)(2)i.

Sec. 12-465. Disclosure report.
(a) An owner shall not show a housing unit or residential building to a prospective buyer
without publicly displaying and making available a truth-in-sale-of-housing disclosure report.
This report shall be at the housing unit or residential building at the time of showing and
within three days of listing. A copy of the disclosure report shall be issued to the buyer before
the execution of a contractual agreement. A copy of such report must be filed within 15 days
with the city to be valid. A double filing fee shall be collected by the city if the report is not filed
within 15 days.
(b) A housing disclosure report shall be prepared by the city. It shall include the following:
(1) An evaluation by a city-certified housing inspector of specific parts ofthe building and
property listed on the housing disclosure report. This list shall include but not be
limited to items addressed in the housing maintenance, siding and junk removal
ordinances. The city shall be responsible for determining whether there is an
ordinance violation.
(2) A signed statement by the owner that includes the following information:
a. Any damage to the building or its contents by flooding or sewer backup and any
evidence of chronic water seepage of which the owner has knowledge.
b. The nature, extent and cause of any water seepage or flooding of any portion of
the property.
c. Whether or not there are pending housing orders from the city about the property.
d. Whether there is a homestead classification for real estate taxes payable.
e. Any other known defects or problems that are not visible.
f. Any deed restrictions or covenants running with the property.
g. Whether the property is subject to the city's pipeline, shoreland or floodplain
ordinances.
h. The location and status of all known wells, including a map, stating whether the
well is in use or abandoned and sealed.
i. Whether the property is next to a high-voltage transmission line. If so, the
disclosure form shall include the following statement: "The subject property is
located near a high-voltage electric transmission line. Purchasers should be
aware that there is ongoing research on exposure to a magnetic field generated by
high-voltage lines. At this time no risk assessments have been made."
(c) A truth-in-sale-of-housing disclosure report shall be valid for no more than one year from
the date of approval by the city. However, if there is substandard maintenance or subsequent
damage to the building, the director of community development may require a new inspection.

Sec. 12-466. Limitations.
(a) In making a housing inspection pursuant to this article, the inspector shall consider any
concealed facilities to be adequate. The inspector shall base his evaluation on the functional
operation of the facility and the condition of the equipment that is viewed. No other warrant
is expressed or implied.
(b) No one shall consider anything in a truth-in-sale-of-housing disclosure report to imply
that a residential building or housing unit meets all minimum building standards. In addition,
no one shall consider anything in the report to imply a warrant of the condition of the housing
evaluated. The inspector warrants that he has used reasonable care and diligence in
inspecting and evaluating the building.

Sec. 12-467. Certificate of competency.
(a) No person shall fill out a truth-in-sale-of-housing disclosure report in the city without
having a valid certificate of competency or truth-in-housing evaluator's license from the city.
The city must issue the certificate of competency or license. The city will only approve people
as housing inspectors or evaluators who are licensed as truth-in-housing evaluators in Saint
Paul or Minneapolis. The housing inspectors must submit a copy of their truth-in-housing
license and any certification papers to the city from the City of Saint Paul or the City of
Minneapolis. The city must license each housing inspector or evaluator who works in the city.
The city will automatically revoke or cancel a housing inspector's license if it is revoked or
cancelled for violation of law or violation of the housing evaluators' code of ethics in either
Saint Paul or Minneapolis. The city may require the passing of a test that shows the
inspector's knowledge of the housing code. The city may then issue a certificate of competency
which is valid for one year. The city may issue renewals of all such certificates. If a certificate
of competency lapses for one year or more, the person who held such certificate shall reapply
to the city for renewal of such certificate. No holder of a certificate of competency or license
from the city shall allow another person to use such certificate or license.
(b) The city council may revoke the certificate of competency of a housing inspector for
cause. At least ten days before the hearing, the city shall send written notification to the
mailing address used in the inspector's application. The notice shall list the date, time and
place of the hearing and of the specific reasons for the suspension. The community develop-
ment director may, at his discretion, suspend the certificate of competency of a housing
inspector pending a suspension hearing.

Sec. 12-468. Insurance.
(a) For the purposes of this article, no certificate of competency shall be issued or renewed
without satisfactory proof of insurance insuring the applicanUevaluator.
(b) The city shall be included as a named insured on the required insurance, and any
additional cost for including the city shall be at the expense of the applicanUevaluator.

(c) The applicant's/evaluatorls insurance shall remain in force continuously thereafter, and
no certificate of competency shall be deemed to be in effect during any period oftime when such
insurance and proof thereof are not also in effect.
(d) Each applicant/evaluator shall have an individually named insurance policy.
(e) The insurance policy shall provide coverage of not less than $250,000.00 per claim or
$500,000.00 per year, aggregate, against any and all liability imposed by law resulting from
the performance of the duties as a certified truth-in-sale-of-housing evaluator.

Sec. 12-469. Housing evaluation fees.
The city council shall set up a fee schedule by resolution for the filing of truth-in-sale-of-
housing disclosure reports.

Sec. 12-470. Violations.
Any person failing to meet and follow the requirements of this article shall be guilty of a
misdemeanor and, upon conviction, shall be punished in accordance with section 1-15.

This article shall only apply to pools installed after October 21, 1971.

Swimming pool means any manmade pool capable of being used for human swimming.

(a) A building permit under this chapter shall be required for any swimming pool in the city
with a capacity in excess of 5,000 gallons.

2009 Annual Tour
June 2, 2009
The planning commission has set its annual tour for Wednesday. July 1. 2009. A
coach bus will leave city hall at 5:30 p.m. sharp and return at about 8:30 p.m. The tour
will include projects and developments that are under construction or that have been
recently finished as well as other areas or sites of interest in Maplewood. The planning
commission is inviting the city council, city manager, department heads, all advisory
committees and staff liaisons to the various committees. We will stop along the way for
a box dinner from Panera Bread. We hope you can attend.

2. If you would prefer a vegetarian sandwich in your box dinner.

INTRODUCTION
As you may already know, Rita Andreoli has submitted her resignation to the HRA.
Please refer to her attached letter.
I have prepared a resolution of appreciation for Rita for the committee's review. Rita
served as a member of the HRA for nearly two years. The city council appointed Rita to
the HRA on August 8, 2007.
RECOMMENDATION
Approve the attached resolution of appreciation for Rita Andreoli.

Dear Ms. Sarah Buringame:
In regards to your submitted release consent form of my personal contact information for use by the general public,
i.e., my personal address along with my phone number and/or email address, I request my personal information to
remain well guarded and unpublished for general use.
I am single and live alone with no surrounding family. I consider myself a volunteer with civic mindedness for the
HRA City of Maplewood rather than an appointment. After receiving the information about the stature you provided,
the question I have would be about my efforts for the HRA appear to me now to be better defined as an unpaid
emplovee who is required by state stature to relinquish my personal contact information to the general public for
their discretionary use in addition to being addressed and/or contacted at the HRA open public forums? If my
interpretation is correct, then I am in strong belief the required additional public contact information for me should
not be through my personal address information, but rather achieved only through City assigned avenues, such as
a free em ail address or a snail mail in box at City Hall or via through real-time webcam. These simple alternate
suggestions would be the equivalent to any given employer who'd provide the very basic needs to their employees
for customer contact information. To drive this point further, I reference the example of vandalism that occurred to
Senator Ron Coleman's home during his campaign last year....with the exception his position was as a MN state
paid elected official who has the additional benefit of surrounding family within his home as well as the means for
added security! However, means should not be the issue, but the right to privacy and safety while serving as a
volunteer situation should be the issue. It is a strange world we now live in and all avenues of personal information
should be restricted with obvious common sense and requiring MY personal information for use by the general
public with unbridle restrictions while I serve as a volunteer does not give me a sense of comfort.
While in assistance with the HRA, it would appear my desires for my rights to privacy and protection are in opposition to
the MN State Stature 13.601 that appears to indicate for my volunteer efforts my personal address AND my personal
te!ephone and/or email address are required for public use. Since my intention is and has been strictly as a volunteer
effort with civic mindedness for the HRA in the City of Maplewood while this volunteer position appears to come without
offering me the basic rights for my personal protection relating to my civic duties as appears according to the MN State
Stature 13.601, and providing my assessments of this stature discord are correct, I am, therefore, respectfully
requesting to relinquish my volunteer assistance I provide for the HRA in the City of Maplewood. To state my intent as
defined within the stature; I resign my "appointment" to the HRA board of the City of Maplewood, MN.

WHEREAS, Rita Andreoli has been a member of the Maplewood Housing and
Redevelopment Authority for nearly two years, since her appointment to the HRA by the
city council on August S, 2007 until May IS, 2009, and has servedfaithfully in that
capacity; and
WHEREAS, the Housing and Redevelopment Authority has appreciated her
experience, insights and good judgment; and
WHEREAS, Ms. Andreoli has freely given of her time and energy, without
compensation, for the betterment of the City of Maplewood; and
WHEREAS, Ms. Andreoli has shown dedication to her duties and has
consistently contributed her leadership and effort for the benefit of the City.
NOW, THEREFORE, IT IS HEREBY RESOL VED for and on behalf of the
