MAPLEWOOD CIVIL SERVICE COMMISSION
MINUTES
February 2, 2009
1. Call meeting to order
The February 2, 2009 meeting was called to order at 5:02 p.m.

2. Elect Secretary and Rotate Chair
Chair Palkovich moved that Commissioner Liddell become the Commission Chair for 2009 and
Commissioner Gunn become the Commission Secretary for 2009. Lisa Liddell seconded the motion.

3. Approval of November 19, 2008 Meeting Minutes
Secretary Gunn moved to approve the November 19, 2008 Meeting Minutes. Commissioner Palkovich
seconded the motion. Ayes - All
Commissioner Palkovich asked Chief Thomalla for input on the language amendment submitted by the
City Attorney, Alan Kantrud. Chief Thomalla asked for clarification as to when to break a tie between
two candidates. Secretary Gunn suggested that the tie be broken when the list of candidates is approved.
Commissioner Palkovich moved to accept:
AN ORDINANCE AMENDING THE MAPLEOOD POLICE CIVIL SER VICE COMMISSION R ULES
AND REGULATIONS, SECTION 10
The POLICE CIVIL SERVICE COMMISSION of Maplewood does hereby:
Section]. Section 10 titled "CREATION AND MAINTENANCE OF ELIGIBILITY LIST' is amended with
the following modification:
Section 10 (c) is hereby relabeled as Section' 10(d).
And,
Section 2 Section 10 titled "CREATION AND MAINTENANCE OF ELIGIBILITY LIST' is amended with
the addition of the following language to read:
(c) In the event that two or more candidates are ranked in such a manner as to create a,
"tie, " between each other or themselves, the contest shall be decided by the toss of a coin
by the Chair. The candidate with the surname closest to the beginning of the alphabet
shall be assigned the, "heads "result and the other candidate the, "tails, " result. In the
event that more than two candidates are subject to this section, the contest shall be
conducted in the same manner with the first two contestants selected based on
alphabetical ranking, the victor of which shall then compete with the remaining
candidate.

4. Review and Approve Revised Deputy Police Chief Job Description
Commissioner Palkovich asked why the "Provides supervision for the Communications Manager" was
removed from the job description. Chief Thomalla stated that the Maplewood Police Department no
longer has a communication center. Commissioner Palkovich moved to approve the Deputy Police Chief
Job Description. Secretary Gunn seconded the motion. Ayes - All
5. Review and Approve Posting and Exam Process for Deputy Police Chief
Secretary Gunn asked why Lieutenants were left out of the group the Deputy Police Chief would
supervise. Chief Thomalla said that should be added in. Ms. Rameaux stated there was a clerical error
and apologized for the mix up. The body of the posting would have the job description of the Deputy
Police Chief. Commissioner Palkovich moved to accept -the posting for the Deputy Police Chief.
Secretary Gunn Seconded the motion. Ayes — All
Chief Thomalla reminded the Commission that they needed to approve the exam process as part of this.
Chief Thomalla stated they would remove any internal influence in the exam process, that there would be
outside panel members, likely other chiefs from other cities, but he would like to reserve the right, with
the Commission's approval, to sit in on the interviews to hear the candidates' responses only, with no
input. Commissioner Palkovich asked if it would be possible for any of the Commission members to sit in
on the interviews. Chief Thomalla said that would be up to the Commission to decide. Commissioner
Palkovich moved to accept and approve the exam process for the Deputy Police Chief. Secretary Gunn
seconded the motion.

6. Review and Approve Revised Lieutenant Job Description
Chief Thomalla reviewed the changes to the job description. Chief Thomalla stated that the position of
Deputy Chief was approved as part of the 2009 budget. Chair Liddell moved to accept and approve the
Lieutenant job description. Secretary Gunn seconded the motion. Ayes — All
7. Review and Approve Revised Sergeant Job Description
Chief Thomalla reviewed the changes made to the job description. Secretary Gunn moved to approve the
amended Sergeant job description. Commissioner Palkovich seconded the motion.

8. Review and Approve Posting and Exam Process for Sergeant
Chief Thomalla explained the promotability index and the process of its formation. Chair Liddell moved
to accept and approve the posting for the Police Sergeant position. Secretary Gunn seconded the motion.

Secretary Gunn moved to accept and approve the exam process for the Police Sergeant position.

9. Review & Approve Backgrounds for Police Officer Candidates & Certify Names for Vacancies
There was discussion regarding all the background investigations, in particular the suitability of
Candidate #1. Commissioner Palkovich was not in favor of approving and certifying Candidate #1.
After much discussion, Chair Liddell moved to accept the background investigation on Candidate #1.
Commissioner Palkovich seconded the motion. Ayes - All
Commissioner Palkovich moved to not certify Candidate #1. Secretary Gunn seconded the motion.

Commissioner Palkovich has some issues with Candidate #2. After some discussion Chair Liddell moved
to accept the background investigation on Candidate #2. Secretary Gunn seconded the motion.

Secretary Gunn moved to certify Candidate #2. Chairperson Liddell seconded the motion.

Chief Thomalla stated that the reason Candidate #35 is being considered is due to the fact that he is a
paramedic. The Bylaws allow for reach -down of paramedics on the eligibility list. Chair Liddell moved
to accept the background investigation on Candidate #35. Commissioner Palkovich seconded the motion.

Commissioner Palkovich moved to certify Candidate #35. Chair Liddell seconded the motion.

Chair Liddell moved to accept the background investigation on Candidate #6. Commissioner Palkovich
seconded the motion. Ayes - All

10. Other
Chair Liddell flipped a coin to break a tie between the two candidates #12 on the Police Officer Eligibility
List. The coin landed with heads up. Based on the recently amended process for breaking a tie, the first
#12 shall remain 12 and the second #12 shall become #13. Chief Thomalla stated that there was currently
one police officer opening, up to three within the next month due to retirements and eventual promotions.
There was some discussion regarding diversity within the department. Chief Thomalla stated he'd like to
see more diversity. During this process, we've already lost two during the background process. He stated
the department currently has 5 Asian officers, 1 African American officer, and 1 officer with some
Hispanic background. The department's authorized strength is 55 officers.
