INTRODUCTION
Mr. Tom Weiner, representing Cardinal Home Builders, is asking the city council to vacate part of a
street right-of-way. This vacation is for the unused right-of-way on the southeast corner of McKnight
Road and Reaney Avenue. Please see the maps on pages 4 - 7 and the statement on page 8.
BACKGROUND
The city, county and state rebuilt Stillwater Road between Minnehaha Avenue and Lakewood Ddve
in 1990 and 1991. This project resulted in the current street layout in the area, including changing
the intersection of McKnight Road and Reaney Avenue. (See the construction plan on page 6.)
DISCUSSION
Cardinal Home Builders is requesting this vacation because the city and the neighbors no longer
have a use for this right~of-way for a public street. Maplewood, Ramsey County and the state have
no plans to develop or use this right-of-way for a public street. The additional land area that this
vacation would provide the adjacent landowners would allow them to expand their parking lot. (See
the future parking lot plan on page 7).
RECOMMENDATION
Adopt the resolution .on page nine. This resolution vacates the unused right-of-way on the southeast
comer of McKnight Road and Reaney Avenue. The city should vacate this right-of-way because:
1. It is in the public interest.
2. The city and the adjacent property owners have no plans to build a street in this location.
3. The adjacent properties have street access.

The City acquired this parcel in 1967 for street purposes. With the reconstruction of the
intersection in 1990 by the City. County. and State it became excess property, and the
understanding with the City at that time was that it would be turned over to us for additional
parking. Since that time any maintenance such as grass cutting on the property has been done
by us. We now wish to install the additional parking spots and additional landscaping, so are
requesting this parcel be formally vacated so we can proceed.

WHEREAS, Tom Wiener, representing Cardinal Home Builders, applied for the vacation of the
following-described right-of-way:
The unused street right-of-way on the southeast corner of McKnight Road and Reaney Avenue
(covered in Document Number 1655145) described as follows:
That part of Lot 16, County Auditor's Subdivision No. 77, Ramsey County, Minnesota, lying
northwesterly and northerly of the following described line:
Beginning at the southwest comer of said Lot 16; thence North 44 degrees, 08 minutes, 22
seconds East, bearings based on the Ramsey County Coordinate System (deeded as North 45
degrees, 05 minutes, 30 second East), a distance of 141.75 feet (deeded as 141.65 feet) to a point
that is 100 feet east of the west line and 15.00 feet south of the north line of said Lot 16; thence
North 72 degrees, 20 minutes, 59 seconds East (deeded as North 73 degrees, 19 minutes East) a
distance of 52.26 feet (deeded as 52.25 feet to a point on the north line of said Lot 16 that is 150.00
feet east of the west line and there terminating. (All in Section 25, Township 29, Range 22 West,
Ramsey County, Minnesota).
WHEREAS, the history of this vacation is as follows:
On April 1, 2002, the planning commission recommended that the city council approve
the vacation.
On April 22, 2002, the city council held a public hearing. The city staff published a notice
in the Maplewood Review and sent a notice to the abutting property owners. The council
gave everyone at the hearing a chance to speak and present written statements. The
council also considered reports and recommendations from the city staff and planning
commission.
WHEREAS, after the city approves this vacation, public interest in the property will go to the
following abutting property:
That part of Lot 16, County Auditor's Subdivision No. 77, Ramsey County, Minnesota described as
follows:
Beginning at the southwest comer of said Lot 16; thence North 44 degrees 08 minutes 22
seconds East, bearings based on the Ramsey County Coordinate System (deeded as North 45
degrees 05 minutes 30 seconds East), a distance of 141.75 feet (deeded as 141.65 feet) to a point
that is 100.00 feet east of the west line and 15.00 feet south of the north line of said Lot 16; thence
North 72 degrees 20 minutes 59 seconds East (deeded as North 73 degrees 19 minutes East) a
distance of 52.26 feet (deeded as 52.25 feet) to a point on the north line of said Lot 16 that is
150.00 feet east of the west line; thence North 89 degrees 01 minute 48 seconds East (deeded as
East) along said north line of Lot 16, a distance of 10.39 feet; thence South 32 degrees 51 minutes
34 seconds West, a distance of 53.80 feet; thence South 49 degrees 53 minutes 45 seconds West,
a distance of 66.47 feet; thence South 40 degrees 08 minutes 56 seconds East, a distance of

NOW, THEREFORE, BE IT RESOLVED that the city council approves the above-described
right-of-way vacation for the following reasons:

The city and the applicant have no plans to build a street in this location.

"Hillcrest Village"-Smart Growth Study Update
White Bear Avenue between Ripley Avenue in Maplewood and Hoyt Avenue in
St. Paul

HILLCREST VILLAGE SMART GROWTH STUDY
Over the past year, the community development staff has been involved in a "Smart Growth"
study with the Metropolitan Council. The Metropolitan Council is studying six commercial
neighborhoods in the metro area. The Hillcrest Shopping Center, including the contiguous part
of Maplewood north of Larpenteur Avenue, is one of these. The Smart-Growth study is a new
initiative that involves citizens in shaping the future growth and redevelopment of their
neighborhoods. The goal is to create livable neighborhoods where homes, jobs and services are
linked by walkable streets.
BACKGROUND
On April 26, 2001, the Metropolitan Council, Calthorpe and Associates (an urban planning group)
and HGA (a local architectural firm) held a workshop at Woodland Hills Church in Maplewood.
This workshop allowed area residents, business owners and St. Paul and Maplewood staff and
government personnel to participate by offering their desires and preferences on how they would
like this area to redevelop.
On May 24, 2001, the group met again at Woodland Hills Church to present the consultants' two
development alternatives to the community. Refer to pages 3-4. Since this last session, the
consultants have been working on a final development concept taking into account comments
from the participants and the community.
On July 2, 2001, the planning commission reviewed the two development alternatives and had
the following comments:

1. Realignment of North St. Paul Road to meet White Bear Avenue at a dght angle.
2. Grocery store.
3. The walkable/bikeable aspects of the plans.
4. The large Neighborhood Square ("village green" concept)
5. The townhouses--provided they are affordable to the average person and not overpriced.
6. Attempts at traffic calming and slowing on White Bear Avenue.
Features the PC did not like
1. The potential nuisance of parking spaces behind buildings visible to residential units.
