Meeting No. 79 -12
A. CALL TO ORDER
A meeting of the Maplewood Board of Adjustments and Appeals was held in the Council
Chambers, Municipal Building, and was called to order at 10:25 by Chairman Wiegert.

C. APPROVAL OF MINUTES
1. Minutes No. 79 -11 (October 18, 1979)
Councilman Murdock moved to approve the Minutes of Meeting No. 79 -11 (October 18,
1979) as submitted.
Seconded by Councilman Anderson. Ayes - all.
D. PUBLIC HEARINGS
1. Variance - Birmingham Street - North of Ripley Avenue - Sax, 8:15 P.M.
a. Chairman Wiegert convened the meeting for a public hearing regarding the
request of Mr.Byron Sax for a lot area variance to construct a single dwelling
house on a 9,920 square foot lot. The Clerk stated the hearing notice was in
order and noted the date of publication.
b. Acting Manager Blank presented the staff report with the following recommenda-
tion:
1. Approval of the variance, on the basis that:
a. The intent of the ordinance is met, because of the undeveloped alley
on the rear of the property.
b. The variance is minimal.
C. Council approved a similar variance one block north in 1978.
Approval is subject to the following condition:
No building permit shall be issued for this lot, until the drainage
problem is resolved to the satisfaction of the City Engineer.

2. Council should initiate the vacation of the alley lying between
Ripley Avenue and Summer Avenue.
c. Vice Chairman Prew moved the Planning Commission recommend to the Board of
Adjustments and Appeals approval of the variance on the basis that:
1. The intent of the ordinance is met, because of the undeveloped
alley on the rear of the property.
2. Council approved a similar variance one block north in 1978.
Approval is subject to the following condition:
No building permit shall be issued for this lot, until the drainage problem
is resolved to the satisfaction of the City Engineer.
Commissioner Fischer seconded. Ayes all.
d. Mr. Bill Goyer, Attorney representing Mr. Sax, spoke on behalf of the
request.
e. Chairman Wiegert called for persons who wished to be heard for or against
the proposal. The following expressed her opinion:
Mrs. Granger, 1824 Birmingham St.
f. Chairman Wiegert closed the public hearing.
