A. CALL TO ORDER
A meeting of the Board of Adjustments and Appeals of Maplewood, Minnesota, was held
in the Council Chambers, Municipal Building and was called to order at 8:08 P.M. by
Chairman Wiegert.

C. APPROVAL OF MINUTES
1. Minutes of Meeting No. 79 -6 (May 3, 1979)
Mayor Greavu moved that the Minutes of Meeting No. 79 -6 (May 3 1979) be approved as
submitted.
Seconded by Councilman Nelson. Ayes - all.
2. Minutes of Meeting No. 79 -7 (May 17, 1979)
Councilman Anderson moved that the Minutes of Meeting No. 79 -7 (May 17, 1979) be
approved as submitted.
Seconded by Mayor Greavu.
D. PUBLIC HEARINGS
Ayes - all.
1. Variance: West of Kenwood Drive - Naughter - 8:00 P.M.
a. Chairman Wiegert convened the meeting for a public hearing regarding the re-
quest of Mr. John Naughter for a variance to construct a single family dwelling
on property less than the required 75 foot width. The Clerk read the notice of
hearing along with the dates of publication.
b. Manager Evans presented the staff report with the following,recommendation:
Approval of the 15 foot lot width variance and 1900 square foot lot area var-
iance based on the following findings:
1. Denial of the requested variances would result in taking of the subject
lot;
2. The strict enforcement of the ordinance would cause undue hardship;
3. Approval of the requested variances would be in keeping with the intent
and spirit of the ordinance.

C. Chairman Les Axdahl presented the following Planning Commission report:
"Commissioner Prew moved that the Planning Commission recommend to the Board
of Adjustments and Appeals approval of the two requested variances for the
subject property based on the following:
1. Denial of the requested variances would result in a taking of the subject
lot;
2. The strict enforcement of the ordinance would cause an undue hardship;
3. Approval of the variances would be in keeping with the intent and spirit
of the ordinance.
Subject to the following:
1. The applicant acknowledge his intent to build within the existing requirements
for setback.
Commissioner Kishel seconded. Ayes - all."
d. The applicant, Mr. John Naughter, spoke on behalf of his request. He also
stated the garage had been changed so it would be built to the south.
e. Chairman Wiegert called for proponents. None were heard.
f. Chairman Wiegert called for opponents. The following were heard:
Mr. Carl Peterson, 1951 W. Kenwood Drive, asked questions and expressed
his concern regarding drainage. He does not object to the variances.
g. Chairman Wiegert closed the public hearing.
h. Councilman Murdock moved to approve
Naughter for property described as Lot 3
following findin¢s:

1. Denial of the requested variances would result in taking of the subject
lot;
2. The strict enforcement of the ordinance would cause an undue hardship;
3. Approval of the variances would be in keeping with the intent and spirit
of the ordinance.
4. Development of this lot conforms to the original platting and conforms to
existing usage in the block.
