CALL TO ORDER A meeting of the Board of Adjustments and Appeals of Maplewood, Minnesota was held in the Council Chambers, Municipal Building and was called to order at 7:38 P.M. by Chairman Fontaine. B. ROLL CALL Roger F. Fontaine, Chairman Present Norman G. Anderson Present John C. Greavu Present Earl L. Nelson Present Donald J. Wiegert Present C. APPROVAL_ OF MINUTES 1. Minutes of Meeting No. 79 -2 (February 1, 1979) Councilman Anderson moved that the Minutes of Meeting No. 79 -2 (February 1, 1979) be approved as submitted. Seconded by Councilman Nelson. - D. PUBLIC HEARINGS Ayes - all. 1. Variance - Sign Ordinance - Maplewood State Bank - 7:30 P.M. a. Chairman Fontaine convened the meeting for a public hearing regarding a request from Maplewood State Bank for a variance to erect four directional signs which exceed the allowable sign area maximum of two square feet per sign. Director of Community Development Olson read the notice of hearing along with the dates of publication. b. Acting Manager Blank presented the staff report recommending approval of the var- iance as proposed. C. The following Community Design Review Board recommendation was given: "Board Member Sjolander moved the Board recommend to the Board of Adjustments and Appeals approval of the requested variance for Maplewood State Bank subject to the following conditions: 1. A variance should be granted for two directional signs on Beam Avenue for a maximum size of six square feet; 2. A variance should be granted for the two directional signs on White Bear Avenue for a maximum size of four square feet; 3. Owner and applicant agree to the above conditions in writing. - 1 - 2/15 Board Member Mueller seconded. Ayes - 3 Nays - 2 (Members Hoot and Herauf)." d. Chairman Fontaine asked if the applicant was present. The applicant stated he agreed to the conditions. e. Chairman Fontaine called for proponents. None were heard. f. Chairman Fontaine called for opponents. None were heard. g. Chairman Fontaine closed the public hearing. h. Councilman Anderson moved to approve the variance requested by Maplewood State Bank to erect four directional signs which exceed the allowable sign area maximum, subject to the following conditions: 1. A variance should be granted for two directional signs on Beam Avenue for a maximum size of six square feet; 2. A variance should be granted for the two directional signs on White Bear Avenue for a maximum size of four square feet; 3. Owner and applicant agree to the above conditions in writing. Seconded by Councilman Nelson. Ayes - all. i. Staff is reviewing amending the sign ordinance. 2. Variance - Lot Width - 1644 Myrtle - Kropp - 7:30 P.M. a. Chairman Fontaine convened the meeting for a public hearing regarding the request of Mr. Edward E. Dropp, 1644 Myrtle Street, for a special use permit and variance to operate a duplex in a single dwelling district on a substandard lot. Director of Community Development Olson read the notice of hearing along with the dates of public - ation. b. Acting Manager Blank presented the staff report with the following recommendations: I. Approval of the variance, based on the following findings: A. There is substantially more lot area than required by Code; B. The existing house meets or exceeds side yard setbacks. II. Approval of the special use permit, based on the following findings: 1. The density of this neighborhood is substantially less than allowed by the City Land Use Plan; 2. The proposal is consistent with the City Land Use Plan; 3. The appearance of the neighborhood will not change. The house is existing and will keep its single- family dwelling appearance. Approval is subject to the following conditions: 1. As per the Building Officials report, the following things shall be repaired: a. Leaking roof in the upper duplex; b. Loose ceiling in bedroom area; C. Deteriorated soffit and rotted and loose boards; d. Loose and rotted boards around chimney. - 2 - 1/15 2. Smoke alarms shall be installed in the upper and lower levels; 3. Inspections by the electrical and heating inspectors shall be made; 4. The above work shall be completed before June 1, 1979; 5. Owner and applicant agree to the above conditions in writing. C. Commissioner Prew presented the following Planning Commission recommendation: "Commissioner Sherburne moved the Planning Commission recommend to the City Council and the Board of Adjustments and Appeals approval of the proposed special use permit and variance for 1644 Myrtle Street. Approval of the variance is based on the follow- ing findings: 1. There is substantially more lot area than required by Code; 2. The existing house meets or exceeds side yard setbacks. Approval of the special use permit is based on the following findings: 1. The density of this neighborhood is substantially less than allowed by the City Land Use Plan; 2. The proposal is consistent with the City Land Use Plan; 3. The appearance of the neighborhood will not change. The house is existing and will keep its single- family dwelling appearance. Commissioner Barrett seconded. Ayes all." d. Chairman Fontaine asked if anyone wished to speak for or against the proposal. The following were heard: Mr. Marvin Mathews, 1592 Myrtle Street, was concerned about the activities which have taken place at 1644 Myrtle Street. e. Councilman Anderson moved to table this matter until the March 1, 1979 meeting. Seconded by Councilman Wiegert. E. ADJOURNMENT 8:04 P.M. Ayes - all. City Clerk - 3 - 2/15
