CALL TO ORDER A meeting of the Board of Adjustments and Appeals of Maplewood, Minnesota, was held in the Council Chambers, Municipal Building and was called to order at 7:38 P.M. by Chairman Fontaine. B. ROLL CALL Roger F. Fontaine, Chairman Present Norman G. Anderson Present John C. Greavu Present Earl L. Nelson Present Donald J. Wiegert Present C. APPROVAL OF MINUTES 1. Minutes of Meeting No. 79 -1 (January 18, 1979) Councilman Anderson moved that the Minutes of be annroved as submitted. Seconded by Councilman Nelson. Ayes - all. D. PUBLIC HEARINGS 118Ml 1. Variance - Lot Area - East Fifth Street - Brisson and Bachmeier - 7:30 P.M. a. Chairman Fontaine convened the meeting for a public hearing regarding a request of Claudette Brisson and Elizabeth Bachmeier for an area variance for two lots. The Clerk read the notice of hearing along with the dates of publication. b. Acting Manager Blank presented the staff report recommending approval of the two lot area variances. C. Chairman Les Axdahl presented the following Planning Commission recommendation: "Commissioner Kishel moved the Planning Commission recommend to the Board of Adjustments and Appeals approval of the request for the variances on the basis of hardship as indicated in the applicant's application, and also there will be no violation of the density requirements of the neighborhood, there are existing public utilities which can serve the parcels involved. Commissioner Prew seconded. Ayes - 6 (Commissioners Kishel, Prew, Kroiss, Ellefson, Fischer, and Axdahl) Nays - 3 (Commissioners Howard, Barrett and Pellish)" d. Chairman Fontaine called for proponents. The following were heard: The applicants, Claudette Brisson and Elizabeth Bachmeier. - 1 - 2/1 e. Chairman Fontaine called for opponents. The following were heard: Mr. Warren Cook, 2715 E. Fifth Street; Mr. Cook presented a petition representing eleven properties in the area; Mr. George Mlynarczyk, 2706 E. Fifth Street; Mr. Eugene House, 2705 E. Fifth Street. f. Chairman Fontaine closed the public hearing. g. Chairman Fontaine moved to approve the two area variances as recommended in the staff report. Seconded by Councilman Nelson. Ayes - Councilman Fontaine and Nelson. Nays - Mayor Greavu, Councilmen Anderson and Wiegert. Motion failed. E. ADJOURNMENT 8:04 P.M. Z' � ,e . � 11 City Clerk - 2 - 2/1
