CALL TO ORDER A meeting of the Board of Appeals and Adjustments of Maplewood, Minnesota, was held in the Council Chambers, Municipal Building and was called to order at 7:53 P.M. by Chairman Anderson. B. ROLL CALL Norman G. Anderson, Chairman Present Roger F. Fontaine Present John C. Greavu Present Earl L. Nelson Present Donald J. Wiegert Present C. APPROVAL OF MINUTES 1. Minutes NO. 78 -4 (May 4, 1978) Councilman Fontaine moved that the Minutes of Meeting No. 78 -4 (May 4, 1978) be approved as submitted. Seconded by Mayor Greavu. Ayes - all. D. PUBLIC HEARINGS 1. Variance - Building - Unmaintained Street - West of 2034 English Street - 7:30 P.M. a. Chairman Anderson convened the meeting for a public hearing regarding the request of Mr. James Sabota for a variance to construct a storage building on a lot that does not abut a publicly maintained City street. Manager Miller read notice of hearing along with the dates of publication. b. Manager Miller presented the staff report with the recommendation for approval of the variance, subject to the following conditions: 1. The driveway design shall be approved by the City Engineer and shall be a minimum of 25 feet in width; 2. The applicant shall sign an agreement to maintain the drive to City stand- ards including snow plowing. This agreement shall be recorded to run with the property. c. Chairman Axdahl presented the following Planning Commission recommendation: "Commissioner Kishel moved the Planning Commission recommend to the Board of Ad- justment and Appeals approval of the proposed variance subject to the following conditions: 1. The driveway design shall be approved by the City Engineer and shall be a minumum of 25 feet in width; 2. The applicant shall sign an agreement to maintain the drive to City Stand- ards including snow plowing. This agreement shall be recorded to run with - 1 - 5/18 the property. Commissioner Prew seconded. Ayes all." d. Chairman Anderson called for proponents. The following were heard: Mr. James Sabota, the applicant and owner; Mr. Richard Anderson, previous owner. e. Chairman Anderson called for opponents. The following were heard: Mrs. Constance DeJohn, 2044 English Street. f. Chairman Anderson closed the public hearing. g. Councilman Fontaine moved to approve Mr. Sabota's request to construct a that part of Lot 25, northwesterly of a line 30 feet northwesterly trom and parallel to railroad tracks as located over and across said lot, and all of Lots 26 and 27, Block 1, Gladstone Addition, subject to the following conditions: 1. The driveway design shall be approved by the City Engineer and shall be approved by the City Engineer and shall be a minimum of 25 feet in width; 2. The applicant shall sign an agreement to maintain the drive to City Standards including snow plowing. This agreement shall be recorded to run with the property. Seconded by Mayor Greavu. J1.
