CALL TO ORDER A meeting of the Board of Appeals and Adjustments of the City of Maplewood, Minnesota, was held in the Council Chambers, Municipal Building and was called to order at 7:35 P.M. by Chairman Anderson. ROLL CALL Norman G. Anderson, Chairman Present Roger F. Fontaine Absent John C. Greavu Present Earl L. Nelson Present Donald J. Wiegert Present C. APPROVAL OF MINUTES 1. Minutes No. 77 -15 (December 8, 1977) Councilman Wiegert moved that the Minutes of Meeting No. 77 -15 (December 8 1977) be approved as submitted. Seconded by Mayor Greavu. Ayes - all. 2. Minutes No. 78 -1 (January 26, 1978) Councilman Wiegert moved that the Minutes of Meeting No. 78 -1 (January 26, 1978) be approved as submitted. Seconded by Mayor Greavu. Ayes - all. D. PUBLIC HEARING 1. Variance - Lot Area and Width - 1897 Birmingham Street - 7:30 P.M. a. Chairman Anderson convened the meeting for a public hearing regarding the request of Daisy Flicek for lot area and width variance for the property at 1897 Birmingham Street. The Clerk read the notice of hearing along with the dates of publication. b. Manager Miller presented the staff report and stated staff recommends denial of the lot area and width variances, based on the following findings: 1. The subject property does not involve circumstances that are unique to the individual property. 2. The proposed variance would be contrary to the spirit and intent of the ordinance. 3. The proposed variance would set a precedent for further splitting into substandard lots that would exceed the density standards of the RL District. - 1 - 2/16 c. Chairman Les Axdahl presented the following Planning Commission recommendation: "Commissioner Sherburne moved the Planning Commission recommend to the Board of Appeals and Adjustments denial of the variances based on the findings in the staff report. Commissioner Barrett seconded. Ayes - 5; Nays - 1 Commissioner Fischer abstained." d. Mrs. Daisy Flicek, Daisy Realty, applicant and owner of the property, spoke on behalf of the proposal. e. Chairman Anderson called for proponents. The following were heard: Mr. Pat Vincelli, 1889 Birmingham Street. f. Chairman Anderson called for opponents. None were heard. g. Chairman Anderson closed the public hearing. h. Mayor Greavu moved to approve the lot width and area variances for the lots legally described as Lots 26 27 and 28 Block 15 Gladstone Addition. (To constr a new dwelling and maintain an existing dwelling at 1897 Birmingham Street on two lots that are below the minimum lot requirements.) Seconded by Councilman Nelson. Ayes - Chairman Anderson, Mayor Greavu and Councilman Nelson. Nays - Councilman Wiegert. Motion carried. E. ADJOURNMENT 7:53 P.M. City Clerk - 2 - 2/16
