A. CALL TO ORDER
A meeting of the Board of Appeals and Ajustments of the City of Maplewood, Minnesota,
was held in the Council Chambers, Municipal Building and was called to order at 7:35
P.M. by Chairman Anderson.
B. ROLL CALL
Norman G. Anderson, Chairman Present
Roger F. Fontaine Present
John C. Greavu Present
Earl L. Nelson Present
Donald J. Wiegert Present
C. NEW BUSINESS
1. Appointment of 1978 Chairman
Mayor Greavu nominated Councilman Anderson as Chairman.
Councilman Anderson nominated Councilman Wiegert.
Councilman Anderson was appointed Chairman by: Ayes all vote.
D. PUBLIC HEARINGS
1. Variances - Lot Area do Street Access - Carey Heights Drive - 7:30 P.M.
a. Chairman Anderson convened the meeting for a public hearing regarding the
request of Mr. Richard J. Novak to construct a dwelling on a lot that does not
meet minimum lot area and does not have street access. The Clerk read the notice of
hearing and dates of publication.
b. Manager Miller presented the staff report with the recommendation of approval
of the two variances pertaining to public street access, based on the following:
1. The street access variances do not meet the "spirit and intent" of the
ordinance;
2. A precedent would be set for similar lots in other areas of the City;
3. There may be times of the year when emergency services could not gain access
to the property;
4. There is no hardship that is "unique to the individual property under
consideration."
C. Commissioner Duane Prew presented the Planning Commission report.
d. Mr. Richard Novak, the applicant, spoke on behalf of the proposal.
e. Mr. Talmadge Carey states he constructed the roadway and maintains it. He
doesn't feel he wants to pay maintenance costs for someone else using the right
of way.

_ f. Chairman Anderson called for proponents. None were heard.
g. Chairman Anderson called for opponents. None were heard.
h. Chairman Anderson closed the public hearing.
i. Councilman Wiegert moved toapprove the lot area variance and denial of the
two variancies for street access as requested by Mr. Richard Novak.
Seconded by Mayor Greavu. Ayes - all.
