CALL TO ORDER A meeting of the Board of Appeals and Adjustments of Maplewood, Minnesota, was held in the Council Chambers, Municipal Building and was called to order at 7:36 P.M. by Chairman Anderson. B. ROLL CALL Norman G. Anderson, Chairman Present John C. Greavu Present Charles M. Kent Present Burton A. Murdock Present Donald J. Wiegert Present APPROVAL OF MINUTES 1. Minutes No. 77 -5 (May 26, 1977) Councilman Wiegert moved that the Minutes of Meeting No. 77 -5 (May 26, 1977) be approved as submitted. Seconded by Chairman Anderson. Ayes - all. D. PUBLIC HEARINGS 1. Variance - Lot Width (Access) South of Carver Avenue a. Chairman Anderson convened the meeting for a public hearing regarding a request of Mr. Carl Page, 2272 Carver Avenue for a variance from the Maplewood Municipal Code. The Clerk read the notice of hearing along with the dates of publication. b. Manager Miller stated staff attempted to process this request speedily, and in so doing inadvertently caused an error in determining what type of variance was necessary. The applicant requested permission to build a home on a piece of property south of Carver Avenue served only by a private driveway. The assumption made by staff was that the driveway was a part of the applicant's property on which he wished to build. This was an incorrect assumption on our part and changed the need for a variance from lot width to access. This discovery was made after the notice was prepared and published. In reviewing the request, the Planning Commission was informed that the applicant was negotiating with Ramsey County Open Space regarding the property in question and was not sure whether or not the property in question would be purchased for the Fish Creek Open Space Area. The Planning Commission took no action on the matter and requested further information of staff on this subject. It is therefore recommended that this item be referred back to the Planning Commission for further review and recommendation. c. Chairman Anderson asked if the applicant was present.
