A. CALL TO ORDER
A meeting of the Maplewood Board of Adjustments and Appeals was held in the Council
Chambers, Municipal Building and was called to order at 7:39 P.M. by Chairman Ander-
son.

C. APPROVAL OF MINUTES
1. Minutes No. 77 -3 (April 28, 1977)
Mayor Murdock moved that the Minutes of Meeting No. 77 -3 be approved as submitted.
Seconded by Councilman Wiegert
Motion carried.
D. PUBLIC HEARINGS
Ayes - Chairman Anderson, Mayor Murdock,
Councilmen Greavu and Wiegert.
Councilman Kent abstained.
1. Lot Width Variance - Beaumont and Fenton Streets
a. Chairman Anderson convened the meeting for a public hearing on the request of
Mr. Robert Homes for a lot width (corner lot) variance at the Northeast corner of
Beaumont and Fenton Streets. The Clerk read the notice of hearing along with the
dates of publication.
b. Manager Miller presented the staff report and recommended that the proposed
corner lot frontage variance be approved, as the applicant cannot purchase any
additional property to bring the subject property to code compliance, denial of
this request would be confiscatory. It is also recommended applicant be required
to maintain all existing code set back requirements.
C. Chairman Les Axdahl presented the Planning Commission recommendation:
"Commissioner Sherburne moved that the Planning Commission recommend to the City
Council the variance be allowed in accordance with the findings in the staff re-
port.
Commissioner Barrett seconded. Ayes all."

d. Chairman Anderson called for proponents.
A resident on Beaumont Street questioned how far back the house would be
built from the street.
e. Chairman Anderson called for opponents. None were heard.
f. Chairman Anderson closed the public hearing.
g. Councilman Greavu moved that the corner lot width variance as requested by
Mr. Robert Homes be approved Based on the following justifications:
1. Lot was platted with existing dimensions 74.46' x 200';
2. Square footage of lot is fairly large (approximately 15,000 square feet);
3. No additional property can be purchased to the north.
Seconded by Chairman Anderson. Ayes - Chairman Anderson, Councilmen Greavu,
Kent and Wiegert.
Mayor Murdock abstained.
Motion carried.
2. Public Access - Variance - Frost Avenue - 7:30 P.M.
a. Chairman Anderson convened the meeting for a public hearing for the request
of Paul Cartier for a variance to allow for the division of land locked property.
The City Clerk read the notice of hearing along with the dates of publication.
b. Manager Miller presented the staff report and recommended the proposed lot
division and variance be denied since it would result in the creation of a land
locked parcel.
c. Chairman Les Axdahl presented the Planning Commission recommendation:
"Commissioner Barrett moved to recommend denying the variance as requested; and if
indeed the applicant comes in with a different request, then this recommendation
is moot.
Seconded by Commissioner Waldron. Ayes - all."
d. Mr. Paul Cartier, the applicant, spoke on behalf of his proposal.
e. Chairman Anderson called for proponents. None were heard.
f. Chairman Anderson called for opponents. None were heard.
g. Chairman Anderson closed the public hearing.
h. Councilman Greavu moved that the variance be granted as the applicant cannot
purchase any more property contingent upon the applicant upgrading the building
within a 6 month period.
Seconded by Councilman Anderson.
Motion failed.
Ayes - Councilman Greavu.
Nays - Chairman Anderson, Mayor Bruton,
Councilmen Kent and Wiegert.
i. Board of Adjustment and Appeals request the applicant to submit building plans
and go through the necessary procedures.
