CALL TO ORDER A meeting of the Maplewood Board of Adjustments and Appeals was held in the Council Chambers, Municipal Building and was called to order at 7:35 P.M. by Chairman Anderson. B. ROLL CALL Norman G. Anderson, Chairman Present Robert Bruton Present John Greavu Present Burton Murdock Present Donald J. Wiegert Present C. APPROVAL OF MINUTES 1. Minutes No. 77 -2 (April 14, 1977) Councilman Murdock moved that the Minutes of Meeting No. 77 -2 (April 14 1977) be approved as submitted. Seconded by Councilman Wiegert. D. PUBLIC HEARINGS 1. Variance - Setback - 1427 Skillman Avenue 7:30 P.M. Ayes - all. a. Chairman Anderson convened the meeting for a public hearing on the request of Mr. Jerry Hicks for a corner lot set back variance. The Clerk read the notice of hearing along with the dates of publication. b. Manager Miller presented the staff report and recommended the proposed variance be denied as the applicant has not provided sufficient justification. The applicant has listed the following reasons for not expanding in another direction: "South House is presently 30 feet from the lot line per minimum code. Front expansion ruins the clean lines of the roof and front of the house. North Garage with attached enclosed patio is only 10 feet from house which would allow a small room by attaching the house and garage. This is unattractive due to the different heights of the roof peaks. Moving the garage to the back of the lot and building on the exist- ing garage footings would be very expensive and unpractical. East The minimum code from the side lot line is 5 feet. I am presently 12 feet away which would allow only a 7 foot addition. This is also umpractical. Basement Basement living is unsafe besides damp and cold. I do not have enough window area or an outside exit. Second This would require extensive work in structural, plumbing, electri- Story cal, and masonry proving to be expensive." - 1 - 4/28 c. Chairman Les Axdahl presented the following Planning Commission recommendation: "Commissioner Prew moved that the Planning Commission recommend to the City Council that the setback variance request for 1427 Skillman Avenue be approved and that this approval is justified on the basis of: 1. The addition and improvement to bring the house up to the present square foot area code requirement would be beneficial to the property and the neighborhood in general; 2. The proposed addition would not be looked at as a potential safety hazard in regard to traffic because of the nature of the existing intersection of Birmingham and Skillman and the existence of a stop sign on Birmingham. Commissioner Rossow seconded. Ayes all." d. Mr. Jerry Hicks, the applicant, spoke on behalf of his request. e. Chairman Anderson called for proponents. None were heard. f. Chairman Anderson called for opponents. None were heard. g. Chairman Anderson closed the public hearing.. h. Councilman Greavu moved to approve the request of Mr. Jerry Hicks 1427 Skill- man Avenue for a set back variance and that this approval is justified on the basis of: 1. The addition and improvement to bring the house up to the present square foot area code requirement would be beneficial to the property and the neighborhood in general; 2. The proposed addition would not be looked at as a potential safety hazard in regard to traffic because of the nature of the existing intersection of Birmingham and Skillman and the existence of a stop sign on Birmingham; 3. The set back variance would be in accordance with other existing variances in the neighborhood. Seconded by Mayor Bruton. E. ADJOURNMENT 7:49 P.M. Ayes - all. Cit Clerk - 2 - 4/28
