Meeting No. 77 -1 A. CALL TO ORDER A meeting of the Maplewood Board of Adjustments and Appeals was held in the Council Chambers, Municipal Building, and was called to order at 7:35 P.M. by Chairman Anderson. B. ROLL CALL Norman G. Anderson, Chairman Present Robert T. Bruton Present John C. Greavu Present Burton A. Murdock Present Donald J. Wiegert Present C. APPROVAI. OF MINUTES 1. Meeting No. 76 -10 (November 18, 1976) Councilman Greavu moved that the Minutes of Meeting No. 76 -10 (November 18. 1976) be annroved as submitted. Seconded by Councilman Murdock. Ayes - all. D. PUBLIC HEARINGS 1. Setback Variance - 1869 Birmingham Street - 7:30 P.M. a. Chairman Anderson convened the meeting for a public hearing regarding the request of Mr. Thomas Ryan, 1869 Birmingham Street for a front yard setback variance. The Clerk read the notice of hearing along with the dates of publication. b. Manager Miller presented the staff report and stated the exist- ing.house is a non - conforming structure as it does not meet the 30 foot setback requirement. Since the proposed addition would add to the non - conforming status of the building and set a preci- dent for further requests of this nature, denial of the proposal is recommended. C. Chairman Les Axdahl presented the Planning Commission recommendation: "Commissioner Sherburne moved the Planning Commission recommend to the City Council approval of the requested variance at 1869 Birmingham based on the following findings: 1. To allow a logical energy efficient expansion of an existing structure; 2. The existing and expanded structure are in conformance with other structures in the immediate area; 3. The proposed expansion does not impair traffic visibility - 1 - 2/17 Seconded by Councilman Murdock. E. ADJOURNMENT 7:40 P.M. - 2 - Ayes - all. �- City Clerk 2/17 at the corner. Commissioner Kishel seconded. Ayes all." d. Chairman Anderson called for proponents. The following were heard: Mr. Russell Allen, 1879 Birmingham Street e. Chairman Anderson called for opponents. None were heard. f. Chairman Anderson closed the public hearing. g. Councilman Greavu moved to approve the front yard setback variance as requested by Mr. Thomas Ryan 1869 Birmingham Street based on the reasons given in the Planning Commission recommendation. Seconded by Councilman Murdock. E. ADJOURNMENT 7:40 P.M. - 2 - Ayes - all. �- City Clerk 2/17
