A. CALL TO ORDER
A special meeting of the City Council of Maplewood, MInnesota, was held in the Council
Chambers, Municipal Building, and was called to order at 7:30 P.M. by Mayor Bruton.

Councilman Anderson moved to approve the Agenda as amended:

D. PUBLIC HEARINGS
Mayor Bruton recessed the meeting at 7:34 P.M. to convene as the Board of Adjustments
and Appeals.
Mayor Bruton reconvened the meeting at 7:41 P.M.
E. COUNCIL PRESENTATIONS
1. Minnesota Department of Transportation.
a. Mayor Bruton commented on a communication received from the Minne-
sota Department of Transportation requesting Council comments on the
proposed transportation plan.
b. Staff directed to obtain Council and Staff comments and to prepare
a report.

2. Zone Change - Radatz Avenue, East of Southlawn Drive - 7:45 P.M.
a. Mayor Bruton convened the meeting for a public hearing regarding
the proposed zone change of property located on Radatz Avenue
- 1 - 2/17
approximately 177 feet east of Southlawn Drive from F Farm Residence
to R -1 Single Family District. The Clerk read the notice of hearing
along with the dates of publication.
b. Manager Miller stated this proposed zone change was called as a
result of a lot division and second reading and final adoption of an
ordinance is recommended.
C. Chairman Les Axdahl presented the following Planning Commission
recommendation:
"Commissioner Sherburne moved the Planning Commission recommend
to the City Council approval of the proposed change in zoning
from F -Farm Residence to R -1 Single Family Residence District.
Commissioner Kishel seconded.
Ayes - all."
d. Mayor Bruton called for proponents. None were heard.
e. Mayor Bruton called for opponents. None were heard.
f. Mayor Bruton closed the public hearing.
g. Councilman Murdock introduced the following ordinance and moved its adoption:
ORDINANCE NO. 412
AN ORDINANCE AMENDING THE MAPLEWOOD ZONING CODE
The City Council of the City of Maplewood does hereby ordain as follows:
Section 1. That the following described property is hereby rezoned from
F (Farm Residence District) to R -1 (Single Family Dwelling District):
East 150 feet of West 460 feet of North 200 feet of part of
SW 1/4 South of Radatz Avenue in Section 2, Township 29
Range 22.
Section 2. This ordinance shall take effect upon its passage and
publication.
Seconded by Councilman Greavu. Ayes - all.

a. Mayor Bruton reviewed the mail he receives at home and at City Hall. He
isn't sure if anyone else receives _. copies. He wants his successor to be
well aware, at an early date, . what is coming up.

3. Street Improvement - McKnight Road, Radatz Avenue to Beam Avenue - 8:00 P.M.

a. Mayor Bruton convened the meeting for a public hearing concerning
the improvement by construction of curb and gutter and concrete
sidewalks on McKnight Road from Radatz Avenue to Beam Avenue. The
Clerk read the notice of hearing along with the dates of publica-
tion.
b. Mr. Wayne Leonard, Ramsey County Design Engineer,explained the
specifics of the proposed improvement.
C. Director of Public Works Collier presented the approximate costs
of the proposal. Suggested approximate cost to City residents
would be $4.82 per front foot.
d. Chairman Les Axdahl presented the following Planning Commission
recommendation:
"Commissioner Prew moved the Planning Commission recommend to the
City Council acceptance of the feasibility study as it is found in
accordance with the Comprehensive Plan.
Commissioner Howard seconded. Ayes - all."
e. Mayor Bruton called for proponents. None were heard.
f. Mayor Bruton called for opponents. None were heard.
g. Mayor Bruton closed the public hearing.
h. Councilman Greavu introduced the following resolution and moved its
adoption: (Approving the project)

WHEREAS, the City Engineer for the City of Maplewood has previously
prepared the preliminary plans for Lydia Avenue and Beam Avenue to be
connected to form a continuous link between White Bear Avenue and McKnight
Road:
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD,
MINNESOTA, as follows:
1. The report of the City Enginea:c advising this Council ghat the
construction to connect Lydia Avenue and Beam Avenue between White
Bear Avenue and McKnight Road together with all necessary utility
relocations is feasible at the appropriate time has previously been
received and is hereby utilized as the basis of the proposed improve-
ment
2. The Council will consider the aforesaid improvement in accordance
with the reports and the assessment of benefited property for all or a
portion of the cost of the improvement according to M.S.A. Chapter 429,
at an estimated total cost of the improvement of $92,000.00.

WHEREAS, after due notice of public hearing on the construction of curb and
gutter, sidewalks and street reconstruction on McKnight Road from Beam Avenue to
Radatz Avenue, a hearing on said improvement in accordance with the notice duly
given was duly held on February 17, 1977, the Council has heard all persons desiring
to be heard on the matter and has fully considered the same;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA,
as follows:
1. That it is advisable, expedient, and necessary that the City of Maplewood
by agreement with Ramsey County, construct curb and gutter, sidewalks and street
reconstruction on McKnight Road from Beam Avenue to Radatz Avenue, as described
in the notice of hearing thereon, and orders the same to be made.
2. The City Engineer is designated engineer for this improvement and is hereby
directed to prepare final plans and specifications for the making of said improve-
ment.
3. This improvement is hereby designated Project 77-1.
Seconded by Councilman Murdock. Ayes - all.

3. A public hearing will be held in the Cafetorium of the'John
Glenn Junior high School at Hazelwood Street and County Road "B"
on Tuesday, the 26th day of October, 1976, at 7:30 P.M. to consider
said improvement. The City Clerk shall give mailed and published
notice of such hearing and improvement as required by law.
NOTICE OF HEARING ON IMPROVEMENT
TO 111I0M IT MAY CONCERN:
WHEREAS, the City Council of the City of Maplewood, Ramsey County;
Minnesota, deems it necessary and expedient that a public hearing for the
improvement hereinafter described, be made,
NOW, THEREFORE, notice is hereby given that the City Council will hold
a public hearing on said improvement at the following time and place within
the said City:
Date and Time: Tuesday, October 26, 1976, at 7:30 P.M.
Location: Cafetorium, John Glenn Junior High School
Hazelwood Street and County Road "B"
The general nature of the improvement is the connection of Beam and
Lydia Avenues between White Bear Avenue and McKnight Road.
The total estimated cost of said improvement is $92,000.00.
Area to be assessed:
That area bounded by Woodlyn Avenue on the north, McKnight
Road on the east, Maplewood City limits on the south and
White Bear Avenue on the west.
It is proposed to assess every lot, piece or parcel of land benefited by
said improvement whether abutting thereon or not, based upon benefits received
without regard to cash valuation.
Persons desiring to be heard with reference to the proposed improvement
should be present at this hearing.
This Council proposes to proceed under the authority granted by Chapter
429 M.S.A.

a. Councilman Greavu commented on the "bump" at the intersection of Larpenteur
Avenue and VanDyke Street. Council asked Wayne Leonard, Ramsey Councy, to in-
vestigate.

Mailand Road and generally being 1/4 mile east of McKnight Road. The Clerk read
the notice of hearing along with the dates of publication.
b. Director of Public Works Collier presented the staff report and the specifics
of the proposal.
c. Chairman Les Axdahl presented the following Planning Commission recommendation:
"Commissioner Kishel moved that the Planning Commission recommend to the City Council
acceptance of the feasibility study, as it is found to be consistent with the
Comprehensive Plan.
Commissioner Sherburne seconded. Ayes - all."
d. Mayor Bruton called for proponents. None were heard.

and necessary appurtenances on Mailand Road and necessary extensions a hearing on
said improvement in accordance with the notice duly given was duly held on February
17, 1977, and the Council has heard all persons desiring to be heard on the matter
and has fully considered the same;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, as
follows:

construct storm sewer and necessary appurtenances running northerly from Mailand

WHEREAS, the City Engineer has prepared the aforesaid preliminary
plans for the improvement herein described:

3. This improvement is hereby designated to Maplewood Project No. 76-7.
Seconded by Councilman Wiegert. Ayes - all.
h. Councilman Anderson moved to retain the assessment rate of 22c per square foot
residential and 5C per square foot above residential for this storm sewer project.
Seconded by Councilman Wiegert. Ayes - all.
E. COUNCIL PRESENTATIONS
4. Grants
a. Councilman Murdock commented on what happens when grants are accepted and what
one police chief did in Los Angeles.
b. No action taken.
5. "Ten Commandments"
a. Councilman Murdock read "Ten Commandments" on how to conserve water.
b. No action taken.
F. ADMINISTRATIVE PRESENTATIONS
1. Resolution Correction
a. Manager Miller stated in 1972, a resolution recording an alley vacation was
recorded in error. The resolution stated "east of Edgemont Street"; it should
have stated "west of Edgemont Street." The property in question is now being
sold and St. Paul Title and Abstract Guarantee will not allow title insurance
until the document is recorded properly. Attached is a resolution needed to correct
the error.
b. Councilman Wiegert introduced the following resolution and moved its adoption:

WHEREAS, the owners of more than 50% of the property abutting on the alley in
Block 4, McGoffin's Northside Addition, north -south alley between Skillman Avenue
and Vernon Avenue west of Edgemont Street, Ramsey County, Minnesota, have filed
a petition for the vacation of the daid alley; and
WHEREAS, the hearing on said petition was proceeded by two weeks published and
posted notice; and
WHEREAS, no one has appeared in opposition to said petition; and
WHEREAS, it appears for the best interest of the public that said alley be
vacated;

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD,
MINNESOTA, as follows:
1. The report of the City Engineer advising this Council that the
proposed improvement on Mailand Road and necessary extensions by
construction of storm sewer and necessary appurtenances is feasible
and should best be made as proposed, is hereby received.
2. The Council will consider the aforesaid improvement in ac-
cordance with the reports and the assessment of benefited property
for all or a portion of the cost of the improvement according to
M.S.A. Chapter 429, at an estimated total cost of the improvement
of $256,600.00.
3. A public hearing will be held in the Council Chambers of the
City Hall at 1380 Frost Avenue on Thursday, the 17th day of Feb-
ruary, 1977, at 8:30 P.M. to consider said improvement. The notice
for said public hearing shall be in substantially the following
form:
NOTICE OF HEARING OF IMPROVEMENT
TO WHOM IT MAY CONCERN:
WHEREAS, the City Council of the City of Maplewood, Ramsey
County, Minnesota, deems it necessary and expedient that the im-
provement hereinafter described, be made,
NOW, THEREFORE, notice is hereby given that the City Council
will hold a public hearing on said improvement at the following
time and place within the said City:

the west, Lower Afton Road on the north and east and the
Crestview Addition on the east.

by said improvement whether abutting thereon or not, based upon benefits
received without regard to cash valuation.
Persons.desiring to be heard with reference to the proposed im-
provement should be present at this hearing.
