A. CALL TO ORDER
A special meeting of the City council of Maplewood, Minnesota, was held in the Council
Chambers, Municipal Building and was called to order at 7:49 P.M. by Mayor Bruton.

Mayor Bruton moved to approve the Agenda as submitted.
Seconded by Councilman Anderson. Ayes - all.
D. PUBLIC HEARINGS
1. Board of Adjustments and Appeals - Lot Width Variance - 1750 English Street 7:45 P.M.
Mayor Bruton recessed the meeting at 7:50 P.M. to convene as the Board of Adjustments and
Appeals.
Mayor Bruton reconvened the meeting at 8:34 P.M.
E. UNFINISHED BUSINESS
1. Drainage Improvement - County Ditch 17 - Final Plans
a. Director of Public Works Collier presented the staff report.
b. Mr. John Dixon, Barr Engineering, presented the specifics of the final plans
for Improvement of County Ditch 17.
c. Following a lengthy discussion, Mayor Bruton introduced the following resolution
and moved its adoption:

WHEREAS, pursuant to resolution passed by the City Council on October 21,
1976, plans and specifications for County Ditch 17, Maplewood Project No. 74 -18,
have been prepared by or under the direction of the City Engineer, and he has pre-
sented such plans and specifications to the Council for approval,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF MAPLEWOOD,
MINNESOTA:

1. Such plans and specifications, a copy of which is attached hereto and
made a part hereof, are hereby approved and ordered placed on file in the
office of the City Clerk.
2. The City Clerk shall prepare and cause to be inserted in the official
paper (and in the Construction Bulletin) an advertisement for bids upon the
making of such improvement under such approved plans and specifications.
The advertisement shall be published three(3) times, at least 21 days before
date set for bid opening, shall specify the work to be done, shall state that
bids will be publicly opened and considered by the Council at the time and
date selected by the City Engineer, at the City Hall and that no bids shall
be considered unless sealed and filed with the Clerk and accompanied by a
certified check or bid bond, payable to the City of Maplewood, Minnesota, for
5% of the amount of such bid.
3. The City Clerk and City Engineer are hereby authorized and instructed to
receive, open, and read aloud bids received at the time and place herein noted,
to to tabulate the bids received. The Council will consider the bids, and the
award of a contract, at the regular City council Meeting of November 18, 1976.
4. The advertisement for bids shall be in substantially the following form:
ADVERTISEMENT FOR BIDS
The City Council of Maplewood, Minnesota, will receive sealed bids for the
construction of the following approximate quantities:
Part A 3000 L.F.
900 L.F.
200 L.F.
50 L.F.
1000 C.Y.
2000 C.Y.
12" through 27" R.C.P.
30" through 48" R.C.P.
54" through 60" R.C.P.
10 ft x 10 ft. Box Culvert
Common Excavation
Common Borrow
Part B 3500 L.F. 12" through 27" R.C.P.
200 L.F. 30" through 48" R.C.P.
4000 C.Y. Common Excavation
within the City limits on the basis of cash payment for the work. Bids will be
received for Part A, Part B, and for Parts A and B combined. Bids will be re-
ceived until 9:30 A.M., C.S.T., on the 17th day of November, 1976, at the Municipal
Building, 1380 Frost Avenue, Maplewood, Minnesota, at which time and place all bids
will be publicly opened, read aloud and considered.
Proposals must be placed in a sealed envelope with the statement thereon in-
dicating proposal for bid contained within and addressed to the City of Maplewood,
Minnesota. Proposals shall be submitted to the City Clerk on or before the above
stated time. Proposal is for the furnishing of all labor, equipment and materials
and performing all work in connection with the above stated construction.
Proposal forms, including specifications, are on file in the office of Barr
Engineering Company, 6800 France Avenue South, Minneapolis, Minnesota, 55435.
Copies of the documents may be obtained by depositing $25.00 with the Engineer.
The amount of deposit for one set of documents will be refunded to each actual
bidder who returns the plans and documents in good condition within ten days after
the opening of bids.

All bids must be accompanied by a certified check or bid bond, payable to the
City of Maplewood, Minnesota, in an amount equal to five per cent (5%) of the total
bid, conditioned that if the bidder is the successful bidder he will enter into a
contract in accordance with said bid and will furnish such performance bonds as
are specified. No bidder may withdraw his bid for at least thrity (30) days after
the scheduled closing time for the receipt of bids, without the consent of the owner.
The City Council reserves the right to reject any or all bids and to waive ir-
regularities and informalities therein and further reserves the right to award the
contract in the best interest of the City.

2. Bond Issue - Architectural Services
a. Manager Miller presented the staff report and recommended that the firm of
Setter Leach and Lindstrom, Inc. be retained by the City as the architectural
engineers for the project and that notice to proceed on the preliminary engin-
eering in an amount not to exceed $5,000 be authorized.
b. Director of Public Works Collier presented the specifics of the proposal.
C. Councilman Murdock moved to retain the firm of Setter, Leach and Lindstr
Inc. as the archetectural engineers for the project and for them to proceed
preliminary engineering and the amount not to exceed $5,000.00 be authorized
Seconded by Councilman Anderson. Ayes - all.
P. COUNCIL PRESENTATIONS
1. Water Department Property
a. Councilman Murdock stated he thought the Water Department had offered to let
the City use part of their property for recreational purposes.
b. Staff will investigate.
C. ADMINISTRATIVE PRESENTATIONS
1. Reports
a. Carver Avenue Sewer
1. Manager Miller presented the staff report regarding the alignment of the
Carver Avenue Sewer Main. He further stated the Council hold a "shirt sleeve"
session with the Metropolitan Council on November 16, 1976 to discuss the matter.
Also, that on November 16, 1976 a "shirt sleeve" session regarding the salary
study be held.
2. Mayor Bruton moved that November 16, 1976 be established for a "sh
session to discuss the Carver Avenue Sewer with the Metropolitan Counc
following a "shirt sleeve" session with staff regarding the salary stu
