CALL TO ORDER A special meeting of the City Council of Maplewood, Minnesota, was held in the Council Chambers, Municipal Building and was called to order at 7:30 P.M. by Acting Mayor Wiegert. B. ROLL CALL Donald J. Wiegert, Acting Mayor Present Robert T. Bruton, Mayor Absent Norman G. Anderson, Councilman Present John C. Greavu, Councilman Present Burton A. Murdock, Councilman Present C. APPROVAL OF MINUTES 1. Minutes No. 76 -25 (July 22, 1976) Councilman Murdock moved that the Minutes of Meeting No. 76 -25 (July 221976) be approved as corrected: Page 2 - E 1 -b delete "and future Council, etc." Seconded by Councilman Anderson. Ayes - all. 2. Minutes No. 76 -26 (July 27, 1976) Councilman Anderson moved that the Minutes of Meeting No. 76 -26 (July 27 1976) be approved as submitted. Seconded by Councilman Murdock. Ayes - all. 3. Minutes No. 76 -27 (July 29, 1976) Councilman,Murdock moved that the Minutes of Meeting No. 76 -27 (July 29 1976) be approved as submitted. Seconded by Councilman Anderson. Ayes - all. D. APPROVAL OF AGENDA Acting Mayor Wiegert moved that the Agenda be approved as submitted. Seconded by Councilman Murdock. Ayes - all. E. PUBLIC HEARINGS 1. Street Vacation - Londin Lane, Old Alignment to Lower Afton Road - 7:30 P.M. a. Acting Mayor Wiegert convened the meeting for a public hearing re- garding the vacation of Londin Lane, the old Alignment to Lower Afton Road. The Clerk read the notice of hearing along with the dates of publi- cation. 8/19 0 C. d. e. f. 9. Manager Miller presented the staff report with the recommendation that the proposed vacation of Londin Lane (Old Alignment of Lower Afton Road) be approved. Chairman Les Axdahl presented the following Planning Commission recom- mendation: "Commissioner Kishel moved that the Planning Commission recommend to the City Council the vacation as requested be granted in that it does make for good planning and complies with the approval of the prelimin- ary plat previously discussed by the Commission. Commissioner Waldron seconded. Ayes all." Acting Mayor Wiegert called for proponents. None were heard. Acting Mayor Wiegert called for opponents. None were heard. Acting Mayor Wiegert closed the public hearing. Councilman Greavu introduced the following resolution and moved its adoption: 76 -8 -151 WHEREAS, a request to vacate Londin Lane (Old Alignment of Lower Afton Road) has been received; and WHEREAS, the hearing on said request was preceeded by two weeks published and posted notice; and WHEREAS, no one has appeared in opposition to said request; and WHEREAS, it appears for the best interest of the public that said street be vacated: NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, that Londin Lane (Old Alignment of Lower Afton Road) be and the same is hereby vacated. Seconded by Councilman Wiegert. Ayes - all. 2. Zone Change (F to R -1) - 2691 Gem Street. a. Acting Mayor Wiegert convened the meeting for a public hearing on the re- quest of Gordon Martin, 2691 Gem Street, for a Zone Change from F (Farm Residence) to R -1 (Single Family Dwelling). The Clerk read the notice of hearing along with the dates of publication. b. Manager Miller presented the staff report and recommended that the rezoning from F to R -1 on Parcels A and B be approved as directed by previous City Council action. It is further recommended that the parcel separating Par- cels A and B and the "not a part" parcel also be rezoned to R -1, Single Family Residential to avoid a spot zoning pattern in this area. - 2 - 8/19 c. Chairman Les Axdahl presented the following Planning Commission recommendation: "Commissioner Sherburne moved the Commission recommend to the City Council approval of the zone change for properties described as: Ex W 558 ft and ex E 554 ft the N 220 ft of S 733 ft of SE 1/4 of SE 1/4; subj to Kennard St the N 400 ft of S 1243 ft of W 408 ft of SE 1/4 of SE 1/4; Ex W 558 ft and Ex E 554 ft the N 110 ft of S 843 ft of SE 1/4 of SE 1/4; subj to Gem St and Ex W 408 ft and Ex N 30 ft of E 100 ft of W 508 ft the N 200 ft of S 1043 ft of part of SE 1/4 of SE 1/4 W of L of Sd St; all in Section 3, Township 29, Range 22 from F Farm Residence to R -1, Single Family Residential District. Councilman Anderson as described in the hea Seconded by Councilman Murdock. Ayes - all. 3. Zone Change (R -1 to R -3) - 2335 Stillwater Road - 8:00 P.M. to rezone the nronerties a. Acting Mayor Wiegert convened the meeting for a public hearing regarding a request of R. Bruce Kaspar to rezone his property at 2335 Stillwater Road from R -1 (Single Family Dwelling) to R -3 (Multiple Dwelling). He wishes to construct tri -plex. The Clerk read the notice of hearing along with the dates of publication. b. Manager Miller presented the staff report and stated it is recommended that the proposed zone change be denied as being premature in that water service is not avail- able to the area, that provision of such service is dependent upon a street improvement project and such project is unscheduled and indefinite at this time. C. Chairman Les Axdahl presented the following Planning Commission recommendtion: "Commissioner Sherburne moved the Commission recommend to the City Council approval of the zone change in that it is in conformance with the overall Comprehensive Plan. Municipal Fire fighting water is available within the criteria of the Public Safety Department and also the proposed structure can be served by an individual water supply. Commissioner Kishel seconded. Voting on motion: Ayes 5; Nays 3 (Commissioners Waldron, Barrett and Axdahl) Commissioner Prew moved the Planning Commission recommend to the City Council they give serious consideration to the installation of public water supply in Stillwater Road which would serve the particular and adjacent properties and thus avoid the potential precedence of encouraging private wells for such development. Commissioner Kishel seconded. Voting on motion: Ayes all with Commissioner Barrett voting Nay." d. Acting Mayor Wiegert called for persons who wished to be heard for or against the proposal. Manager Miller stated he had received a call from Mr. Melvin Clas, 2367 Bush Street, opposing the zone change. f. Acting Mayor Wiegert closed the public hearing. g. Nay - Acting Mayor Wiegert. F. UNFINISHED BUSINESS 1. Assessment Corrections a. Sidewalk Improvement No. 74 -1 1. Engineering Office Assistant Bill Cass presented the staff report. He also stated Ramsey County Open Space had purchased properties at 2721 and 2755 White Bear Avenue and the question arose if they would be eligible to have a portion deferred. 2. Councilman Anderson introduced the following resolution and moved its adoption: 76 -8 -152 WHEREAS, pursuant to proper notice duly given as required by law, the City Council has met and heard and passed upon all objections to the proposed assessment for the construction of Sidewalk on White Bear Avenue as described in the files of the City Clerk as Sidewalk Improvement No. 74 -1 and has amended such proposed assessment as it deems just, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA: 1. Such proposed assessment, as amended, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be bene- fited by the proposed improvement in the amount of the assessment levied against it. - 4 - 8/19 2. Such assessment shall be payable in equal annual installments extending over a period of nine (9) years, the first of the install- ments to be payable on or after the first Monday in January, 1977, and shall bear interest at the rate of seven (7) percent per annum from the date of the adoption of this assessment resolution. To the first installment shall be added interest on the entire assessment from the date of this resolution until December 31, 1974. To each subsequent installment when due shall be added interest for one year on all unpaid installments. 3. It is hereby declared to be the intention of the Council to reimburse itself in the future for the portion of the cost of this improvement paid for from municipal funds by levying additional assessments, on notice and hearing as provided for the assessments herein made, upon any properties abutting on the improvement but not made, upon any properties abutting on the improvement but not herein assessed for the improvement, when changed conditions re- lating to such properties make such assessment feasible. 4. To the extent that this improvement benefits non - abutting prop- erties which may be served by the improvement when one or more later extensions or improvements are made, but which are not herein assessed therefore, it is hereby declared to be the intention of the Council, as authorized by Minnesota Statutes Section 429.051, to reimburse the City by adding any portion of the cost so paid to the assessments levied for any of such later extension or improvements. 5. The Clerk shall forthwith transmit a certified duplicate of this assessment to the County Auditor to be extended on the property tax lists of the County, and such assessments shall be collected and paid over in the same manner as other municipal taxes. Seconded by Councilman Murdock. Ayes - all. b. Street Improvement No. 74 -5 - Ferndale Street, Maryland Avenue to Stillwater Road. 1. Engineering Office Assistant Bill Cass presented the staff report. Staff recommends that all properties that do not have frontage on Ferndale be deleted from the assessment rolls. All parcels numbered 22 and up are recommended to be deleted. The parties to be assessed are as follows: Thomas Homes, Inc. Assessment Nos. 1 through 13 R. E. Weinhold, Assessment No. 14 Lillian Zipper /Daniel Haakinson, Assessment No. 15 and 16 Katherine Wormly, Assessment No. 17 James Bradford, Assessment No. 18 and 19 Donald Hughes, Assessment No. '20 Evelyn Miller, Assessment No. 21 - 5 - 8/19 2. Councilman Anderson moved to adopt assessment roll as recommended and introduced the following resolution and moved its adoption: 76 -8 -153 WHEREAS, pursuant to proper notice duly given as required by law, the City Council has met and heard and passed upon all objections to the proposed assessment for the construction of water main services, sanitary sewer ser- vices and storm sewer on Ferndale Street from Maryland Avenue to Stillwater Road, as described in the files of the City Clerk as Sewer Improvement No. 74 -5, and has amended such proposed assessment as it deems just, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA: 1. Such proposed assessment, as amended, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. Such assessment shall be payable in equal annual installments extending over a period of nineteen (19) years, the first of the installments to be payable on or after the first Monday in January, 1977, and shall bear interest at the rate of seven (7) percent per annum from the date of the adoption of this assessment resolution. To the first installment shall be added interest on the entire assessment from the date of this resolution until December 31, 1977. To each subsequent installment when due shall be added interest for one year on all unpaid installments. 3. It is hereby declared to be the intention of the Council to reimburse itself in the future for the portion of the cost of this improvement paid for from municipal funds by levying additional assessments, on notice and hearing as provided for the assessments herein made, upon any properties abutting on the improvement but not made, upon any properties abutting on the improvement but not herein assessed for the improvement, when changed conditions re- lating to such properties make such assessment feasible. 4. To the extent that this improvement benefits non - abutting prop- erties which may be served by the improvement when one or more later extensions or improvements are made, but which are not herein assessed therefore, it is hereby declared to be the intention of the Council, as authorized by Minnesota Statutes Section 429.051, to reimburse the City by adding any portion of the cost . so paid to the assessments levied for any of such later extension or improvements. 5. The Clerk shall forthwith transmit a certified duplicate of this assessment to the County Auditor to be extended on the property tax lists of the County, and such assessments shall be collected and paid over in the same manner as other municipal taxes. Such proposed assessment, as amended, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. Councilman Greavu introduced the following resolution and moved its adoption: 76 -8 -155 WHEREAS, pursuant to proper notice duly given as required by law, the City Council has met and heard and passed upon all objections to the pro- posed assessment for the removal of Diseased Shade Trees as described in the files of the City Clerk as Control Program Improvement No. 75 -6 and has amended such proposed assessment as it deems just, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA: 1. Such proposed assessment, as amended, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the pro- posed improvement in the amount of the assessment levied against it. 2. Such assessment shall be payable in equal annual installments extending over a period of five (5) years, the first of the install- ments to be payable on or after the first Monday in January, 1977, and shall bear interest at the rate of seven (7) percent per annum from the date of the adoption of this assessment resolution. Councilman Greavu introduced the following resolution and moved its adoption: 76 -8 -156 WHEREAS, pursuant to proper notice duly given as required by law, the City Council has met and heard and passed upon all objections to the proposed assessment for the construction of Sanitary Sewer and Water Mains, Services and Sidewalks on Beam Avenue from Bellaire to Chippewa Street, as described in the files of the City Clerk as Improvement No. 71 -19, and has amended such proposed assessment as it deems just, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA: 1. Such proposed assessment, as amended, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. Councilman Greavu introduced the following resolution and moved its adoption: 76 -8 -158 WHEREAS, pursuant to proper notice duly given as required by law, the City Council has met and heard and passed upon all objections to the proposed assessment for the completion of As -Built Plans - Wiensch Townhouse Complex as described in the files of the City Clerk as Improvement No. 75 -15 and has amended such proposed assessment as it deems just, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA: 1. Such proposed assessment, as amended, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. The Clerk shall forthwith transmit a certified duplicate of this assessment to the County Auditor to be extended on the property tax lists of the County, and such assessments shall be collected and paid over in the same manner as other municipal taxes.
