CALL TO ORDER A meeting of the Maplewood Board of Appeals and Adjustment was held in the Council Chambers, Municipal Building, and was called to order at 7:43 P.M. by Chairman Murdock. B. ROLL CALL Burton A. Murdock, Chairman Present Norman G. Anderson, Present Robert T. Bruton, Present John C. Greavu, Absent Donald J. Wiegert, Present C. APPROVAL OF MINUTES 1. Minutes No. 76 -5 (June 17, 1976) Chairman Murdock moved that the Minutes of Meeting No. 76 -5 (June 17, 1976) be approved as submitted. Seconded by Councilman Wiegert. Ayes - all. 1). PUBLIC HEARINGS 1. Gas Hut, Inc., County Road B and White Bear Avenue - Setback Variance - 7:45 P.M. a. Chairman Murdock convened the meeting for a public hearing regarding the request of Gas Hut, Inc, for a setback variance. The Clerk read the notice of hearing along with the dates of publication. b. Manager Miller stated Maplewood Code requires a 60 foot front yard setback for fuel stations. Gas Hut, Inc. is requesting a variance to allow a42 ft. front yard setback. Manager Miller presented the staff report with the recommendation the proposed variance be approved due to the following findings: 1. The strict enforcement of the setback requirements would deny the property owner the right to construct a building on the lot. 2. Past governmental action granting approval to the proposal. 3. No other alternative location on the property to locate the buildings and comply with the Codes. 4. The hardship relates specifically to the property. C. Commissioner Prew presented the following Planning Commission recom- mendation: - 1 - 7/8 "Commissioner Pellish moved the Planning Commission recommend to the City Council approval of the proposed variance based on the following findings: 1. The strict enforcement of the setback requirements would deny the property owner the right to construct a building on the lot. 2. Past governmental action granting approval to the proposal. 3. No other alternative location on the property to locate the buildings and comply with the Codes. 4. The hardship relates specifically to the property. Commissioner Sherburne seconded. Ayes - all." d. Mr. Grayson Tuck, representing Gas Hut, Inc. spoke on behalf of the proposal. e. Chairman Murdock called for persons who wished to be heard for or against the proposal. No one was heard. f. Chairman Murdock closed the public hearing. g. Councilman Anderson moved n the following_findings: 1. The strict enforcement of the setback requirements for this use would deny the property owner the right to construct a building on the lot. 2. Past governmental action granting approval to the proposal. 3. No other alternative location on the property to locate the buildings and comply with the Codes. 4. The hardship relates specifically to the property. Seconded by Councilman Wiegert. Ayes - all. E. ADJOURNMENT 7:56 P.M. Clerk - 2 - 7/8
