CALL TO ORDER A meeting of the Maplewood Board of Appeals and Adjustments was held in the Council Chambers, Municipal Building and was called to order at 7:38 P.M. by Chairman Murdock. ROLL CALL Burton A. Murdock, Chairman Present Norman G. Anderson Present Robert T. Bruton Present John C. Greavu Present Donald J. Wiegert Present C. APPROVAL OF MINUTES 1. Minutes of Meeting No. 76 -3 (May 13, 1976) Councilman Murdock moved to approve the Minutes of Meeting No. 76 -3 (May 13 1976) as submitted. Seconded by Councilman Wiegert. Ayes - Chairman Murdock, Mayor Bruton, Councilmen Anderson and Wiegert. Councilman Greavu abstained as he did not attend the meeting. 2. Minutes of Meeting No. 76 -4 (May 20, 1976) Councilman Greavu moved to approve the Minutes of Meeting No. 76 -4 (May 20 1976) as submitted. Seconded by Councilman Wiegert. Ayes - all. D. PUBLIC HEARINGS 1. Front Yard Variance - 1720 East Shore Drive 7:30 P.M. a. Chairman Murdock convened the meeting for a public hearing on a request of Mr. Terry L. Winning, 1720 East Shore Drive for a set back variance to construct his garage five feet from the street. The Clerk read the notice of hearing along with the dates of publication. b. Manager Miller presented the staff report and stated it is recommended the proposed setback variance be approved due to the following findings: 1. The setback requirements if strictly enforced would not allow the applicant to construct a garage; 2. There is a particular hardship due to the slope and configuration of of the property; 3. There is no potential for the purchase of additonal land; 4. The variance would not injure neighboring properties and would be the last of such variance requests in the area. - 1 - 6/17 C. Chairman Les Axdahl presented the following Planning Commission recommendation: "Commissioner Sherburne moved the Commission recommend to the City Council approval of the variance for 1720 East Shore Drive as: 1. The setback requirements if strictly enforced would not allow the applicant to construct a garage; 2. There is a particular hardship due to the slope and configuration of the property; 3. There is no potential for the purchase of additional land; 4. The variance would not injure neighboring properties and would be the last of such variance requests in the area. Commissioner Fischer seconded. Ayes all." d. Mr. Terry L. Winning, 1720 East Shore Drive, the applicant, spoke on behalf of his request. e. Chairman Murdock called for persons who wished to be heard for or against. The following persons voiced their opinion: Mr. George Ashton, 1732 Edward Street. f. Chairman Murdock closed the public hearing. g. Councilman Greavu moved to approve the set back variance as requested by statt report Seconded by Councilman Wiegert. Ayes - all. E.
