CALL TO ORDER A meeting of the Maplewood Board of Appeals and Adjustments was held in the Council Chambers, Municipal Building and was called to order at 7:35 P.M. by Chairman Murdock. B. ROLL CALL Burton A. Murdock, Chairman Present Robert T. Bruton Present Norman G. Anderson Present John C. Greavu Absent Donald J. Wiegert Present C. APPROVAL OF MINUTES 1. Meeting No. 76 -2 (April 22, 1976) Chairman Murdock moved that the Minutes of Meeting No. 76 -2 (April 22 1976) be approved as corrected: Page 1: Add item D -1 -c corrected to read: "Commissioner Sherburne moved the Planning Commission recommend to the City Council approval of the proposed variance due to: 1) irregular shape of the lot; 2) below current minimum corner lot size; 3) signatures of neighbors approving the request; 4) letter from neighbor to the north requesting the garage not be built to the north of the property; 5) place- ment on any other area would further subdivide an already small lot; 6) the proposal would aesthetically fit the neighborhood better than any other alternative ". Seconded by Councilman Wiegert D. PUBLIC HEARINGS Ayes - all. 1. Variance (Abutment of Dedicated Street) - 2130 Arcade Street - 7:30 P.M. a. Chairman Murdock convened the meeting for a public hearing regarding the re- quest of Mr. Voya Peletich for a variance from Section 1005.10(5) which states all lots shall abut on a publicly dedicated street. The Acting Clerk read the notice of hearing along with the date of publication. b. Manager Miller presented the staff report recommending the variance be approved as it is in keeping with the Councils most recent action on similar requests in the neighborhood. c. Chairman Les Axdahl presented the following Planning Commission recommendation: "Commissioner Sherburne moved the Planning Commission recommend to the City - 1 - 5/13 Council the proposed lot division and variance be approved as it is in keeping with the Council's most recent action on similar requests in this neighborhood. Commissioner Waldron seconded. Ayes - all." d. Mr. Voya Peletich, the applicant, spoke on behalf of his proposal. e. Chairman Murdock called for persons who wished to be heard for or against the proposal. None were heard. f. Chairman Murdock closed the public hearing. g. Councilman Wiegert moved to approve the variance as requested by Mr. Voya Peletich, 2130 Arcade Street. Seconded by Councilman Anderson. Ayes - all. 2. Variance (Parking and Setback) - Century Avenue and Upper Afton Road - 7:45 P.M a. Chairman Murdock convened the meeting for a public hearing regarding the re- quest of Super America, 11 South Century Avenue, of a variance from the required front and side yard setbacks and a variance from the required number of parking stalls. The Acting Clerk read the notice of hearing along with the dates of publication. b. Manager Miller presented the staff report recommending the proposed variances not be granted due to the fact that the applicant has not demonstrated any unique characteristics attributable to the site and therefore, granting of the variances would constitute a special privilege. c. Chairman Les Axdahl presented the following Planning Commission recommendation: "Commissioner Sherburne moved the Planning Commission recommend to the City Council denial of the requested variances due to the fact that the applicant has not demonstrated any unique characteristics attributable to the site and therefore, granting of the variances would constitute a special privilege. Commissioner Pellish seconded. Ayes 7; Nay 1 (Commissioner Kishel)" d. Mr. John Haganson, Manager of Engineering for Super America, spoke on behalf of the request. e. Chairman Murdock called for persons who wished to be heard for or against the proposal. None were heard. Chairman Murdock read a letter from School District 622 objecting to the proposal. f. Chairman Murdock closed the public hearing. g. Councilman Anderson moved to deny the request of Super America for a set back variance and parking stall variance based on the Planning Commission recom- mendation. Seconded by Mayor Bruton.
