CALL TO ORDER A meeting of the Maplewood Board of Appeals and Adjustments was held in the Council Chambers, Municipal Building and was called to order at 7:37 P.M. by Chairman Murdock. B. ROLL CALL Burton A. Murdock, Chairman Present Norman G. Anderson Present Robert T. Bruton Present John C. Greavu Present Donald J. Wiegert Present C. APPROVAL OF MINUTES 1. Minutes No. 76 -1 (February 19, 1976) Councilman Anderson moved to approve the Minutes of Meeting No. 76 -1 (February 19, 1976) as submitted. Seconded by Councilman Greavu. Ayes - all. D. PUBLIC HEARINGS 1. Sideyard Setback Variance - 2579 East Brookview Drive - 7:30 P.M. a. Chairman Murdock convened the meeting for a public hearing regarding the re- quest of Mr. David Arnold, 2579 East Brookview Drive, for a sideyard setback var- iance to construct a garage that would encroach a total of 20 feet into the re- quired side yard setback of 30 feet. The Clerk read the notice of hearing along with the dates of publication. b. Manager Miller presented the staff report with the recommendation the pro- posed variance be denied due to applicant's failure to substantiate that com- pliance with code requirement would constitute any hardship and the fact that other alternative locations for the garage are available that would observe code requirements. C. Chairman Les Axdahl presented the following Planning Commission recommendation: "Commissioner Sherburne moved the Planning Commission recommend to the City Council approval of the proposed variance due to: 1) irregular shape of the lot; 2) below current minimum corner lot size; 3) signatures of neighbors approving the request; 4) letter from neighbor to the north requesting the garage not be built to the north of the property; 5) placement on any other area would further subdivide an already small lot; 6) the proposal would aesthetically fit the neigh- borhood better than any other alternative. Commissioner Pellish seconded. Ayes - Commissioners Waldron, Pellish, Kishel, Axdahl, Prew, Fischer and Sherburne. Nays - Commissioners Howard & Barrett. Motion carries." - 1 - 4/22 d. Mr. David L. Arnold, 2579 E. Brookview Drive, applicant, spoke on behalf of the request. e. Chairman Murdock called for persons who wished to be heard for or against. None were heard. f. Chairman Murdock closed the public hearing. g. Councilman Anderson moved to approve the sideyard setback variance requested by Mr. Arnold, 2579 E. Brookview Drive, as recommended by the Planning Commission. Seconded by Councilman Greavu. Ayes - all. E. ADJOURNMENT 7:44 P.M. Gity Clerk - 2 - 4/22
