CALL TO ORDER A meeting of the Board of Appeals and Adjustments of the City of Maplewood, Minnesota, was held in the Council Chambers, Municipal Building and was called to order at 7:38 P.M. by Chairman Murdock. B. ROLL CALL Burton A. Murdock, Chairman Present Norman G. Anderson Present Robert T. Bruton Absent John C. Greavu Present Donald J. Wiegert Present C. APPROVAL OF MINUTES 1. Minutes No. 75 -6 (September 16, 1975) Chairman Murdock moved to approve the Minutes of Meeting No. 75 -6 (September 16, 1975) as submitted. Seconded by Councilman Wiegert. Ayes - all. D. PUBLIC HEARINGS 1. Board of Adjustments and Appeals a. Height Variance - 1965 Barclay Street 7:30 P.M. 1. Chairman Murdock convened the meeting for a public hearing regarding a request for a variance to erect a structure (Citizen Band Radio Tower) that would exceed code height regulations. The Clerk read the notice of hearing along with the dates of publication. 2. Manager Miller presented the staff report with the recommendation the variance be denied as the applicant has presented insufficient justification. 3. Chairman Les Axdahl presented the following Planning Commission recommend- ation: "Commissioner Barrett moved that the Commission recommend to the City Council approval of the height variance for 1965 Barclay Street. Commissioner Fischer seconded Motion carried." Ayes 7 Nays - Commissioners Howard and IZent." 4. The applicant, Mr. Richard Juker, spoke on behalf of his proposal. - 1 - 10/30 5. Chairman Murdock called for persons who wished to be heard for or against the proposal. The following expressed their opinions: 1. Mrs. Richard Juker, 1965 Barclay Street; 2. Mrs. Grave Capra, 1960 Manton Street; 3. Mr. Elmstrom, 1376 Belmont Lane. 6. Chairman Murdock closed the public hearing. 7. Councilman Anderson moved to approve the request of Barclay for a tower structure of 45 feet with an overal t Seconded by Councilman Greavu. Ayes - all. b. Lot Width Variance - Ripley Avenue and Curve Street - 7:45 P.M. 1. Chairman Murdock convened the meeting for a public hearing regarding a request of Philip Oswald, 2026 Hazelwood Avenue to construct a home on a corner lot with dimensions less than required by Municipal Code. The Clerk read the notice of hearing along with the dates of publication. 2. Manager Miller presented the staff report with the recommendation that the variance be approved due to the fact the plat was approved and the subject property considered a buildable lot. 3. Chairman Les Axdahl presented the following Planning Commission recommend- ation: "Commissioner Prew moved that the Commission recommend to the City Council that this variance for the property located at Ripley and Curve be approved on the basis that the proposed building can be built and required setbacks can be met; and it is unlikely that Curve Street will be developed. Commissioner Howard seconded. Ayes - all." 4. Mr. Philip Oswald, the applicant, spoke on behalf of his proposal. 5. Chairman Murdock called for persons who wished to be heard for or against the proposal. None were heard. 6. Councilman Anderson moved to family dwelling at the southeast requested by Mr. Philip Oswald. ove the variance to corner of Seconded by Acting Mayor Wiegert. Ayes - all. E. ADJOURNMENT 8:07 P.M.
