Prosecuting Attorney G) ADJOURNMENT MINUTES OF MAPLEWOOD CITY COUNCIL 7:30 P.M., Thursday, September 11, 1975 Council Chambers, Municipal Building Meeting No. 75 -32 CALL TO ORDER A special meeting of the City Council of Maplewood, Minnesota, was held in the Council Chambers, Municipal Building and was called to order at 7:30 P.M. by Mayor Bruton. B. ROLL CALL Robert T. Bruton, Mayor Present John C. Greavu, Councilman Present Donald J. Wiegert, Councilman Present Norman G. Anderson, Councilman Present Burton A. Murdock, Councilman Arrived at 7:33 P.M. C. APPROVAL OF AGENDA Councilman Wiegert moved to approve the Agenda as amended: 1. Move agenda Item F to before Agenda Item D; 2. Beam Avenue; 3. Insurance; 4. Deferred Assessments. Seconded by Mayor Bruton. Ayes - all. F. ADMINISTRATIVE PRESENTATIONS 1. Prosecuting Attorney a. Manager Miller stated it is recommended that Martin J. Costello of the law firm of Peterson, Bell and Converse be appointed Prosecuting Attorney of the City of Maplewood effective October _1 `1975. Submitted is a letter outlining Mr. Costello's background. Mr. Costello will bring to the position experience in the suburban Ramsey County Court system as a prosecuting attorney in the cities of Roseville and Vadnais Heights and the Town of White Bear. Mr. Cos- tello has agreed to accept a salary of $1,600.00 per month through 1975 and $1,700.00 a month through 1976. It is recommended that the appointment be confirmed. b. Council directed questions to Mr. Costello. c. Councilman Greavu moved the appointment of Martin J. Costello as prosecuting attorney effective October 1. 1975. Seconded by Councilman Wiegert. Councilman Anderson moved to defer the storm sewer assessment of Mr. Jack Odell in the amount of $50.00 for the Brookview Drive Improvement No. 73 -10 until such time as the street is improved; code number 57 17500 130 06. Mayor Bruton stated staff has received individually and collectively notices from the property owners in the area of a pending lawsuit regarding the assessments. 2. The following property owners applied for assessment changes: Parcel No. 20, Michael Langenberger - Code No. 57 76170 020 01; Parcel No. 24, Gerald L. Lindeman - Code No. 57 76170 060 01; Parcel No. 32, Her Tzai Huang - Code No. 57 76170 080 02; Parcel No. 35, Owen Greenley - Code No. 57 76170 110 02. 3. Manager Miller stated all properties were assessed in accordance with City policy as presented and adopted at the public hearing of August 14, 1975. 4. No action taken. c. Project 71 -6 - Beebe Road Improvements 1. Parcel No. 2 - William Muskie - Code No. 57 01410 050 87 a. Manager Miller recommended cancellation of the storm sewer assessment in the amount of $4,375.75. The property was previously assessed in Project No. 67 -1. The rest of the assessment (Street, Sewer, Water, etc.) were assessed in accordance with City policy. b. Councilman Wiegert introduced the following resolution and moved its adoption: 75 -9 -176 WHEREAS, pursuant to resolution 75 -8 -153 of the City Council of Maplewood, Minnesota, adopted August 14, 1975, the special assessments for the construction of storm sewer, Improvement No. 71-6, were levied against property described'las "C6d6 No., 57'01410 05087; and NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, that the assessments for Storm Sewer Improvement 71 -6, in the amount of $4,375.75, code No. 57 01410 050 87 be, and the same hereby are, cancelled. Parcel No. 101 - George Severin - Code No. 57 34700 110 08 a. $1,598.91 assessed in accordance with City policy. Application to be sent for senior citizen deferment. b. No action taken. . o E. COUNCIL PRESENTATIONS I 2. Beam Avenue Councilman Greavu wished to know how the overlay district ordinance was progessing. Manager Miller stated it was to be before the Planning Commission on Monday, September 15, 1975. It should be before the Council Thursday, September 18, 1975. 3. Insurance Coverage Councilman Greavu wondered what, if anything, does the Bituminous Insurance cover. Councilman Wiegert moved to refer the question to the Insurance Committee to work with staff to investigate the, Citys coverage and costs. Seconded by Councilman Murdock. Ayes - all. 4. Deferred Assessments Councilman Greavu asked if we deny the continuation of a deferred assessment, is this giving the right for a property owner to do anything with his property.
