A. CALL TO ORDER
A special meeting of the City Council of Maplewood, Minnesota was held in the Council
Chambers, Municipal Building and was called to order at 7:32 P.M. by Mayor Bruton.

C. PUBLIC HEARINGS
1. Brookview Drive Storm Sewer Imp. No. 73 -10 (73 -14) (Continued from August 14, 1975)
a. Manager Miller presented the staff report and also presented the background and
specifics of the Homewright escrow account.
b. Mayor Bruton reopened the public hearing to hear additional residents. The
following presented their views:
1. Mr. Jon Belisle, 2594 Brookview Drive
2. Mr. Rod Winchell, 188 O'Day
3. Mr. Richard Lofgren, 2661 Mayer Lane
4. Mr, Jacque Nelson, 196 McClelland Avenue
5. Mrs. Diane Nelson, 196 McClelland Avenue
c. Mayor Bruton closed the public hearing.
d. Following Council discussion, Mayor Bruton moved that the following rates be
established for -Imp. 73 °10 (73 -14) Brookview Drive Storm Sewer: $.OS per sq, ft.
commercial $.0125 per sq. ft. for residential based on the following reasons:
1. That the commercial lot is a huged paved area creating a run off rate that
is abnormally high in volume and force.
2. That the paved area deviated from the original plan which had been approved
and, though this was perhaps at the direction of the State Highway Depart-
ment, it still contributed to the run off in the area causing flooding and
erosion problems.
3. That the commercial enlarged the paved area even though the problems were
identified, thus they have a more substantial responsibility to the total.
project than may be normal, although this is still within our policy.
4. That the residential area requires, at least in part, additional work and
was implemented at a reduced level of improvement, at the request of the
.residential people, and thereby justifies the rates lower than City

policies because of these two proceeding items especially in light of
the resulting problems.

WHEREAS, pursuant to proper notice duly given as required by law, the City
Council has met and heard and passed upon all. objections to the proposed assessment
for the construction of Brookview, Drive Storm Sewer as described in the files of the
City Clerk as Project No. 73 -10 (73 -14) and has amended such proposed assessment as
it deems just;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA:
1. Such proposed assessment, as amended, a copy of which is attached hereto
and made a part hereof, is hereby accepted and shall. constitute the special
assessment against the lands named therein, and each tract of land therein in-
cluded is hereby found to be benefited by the proposed improvement in the
amount of the assessment levied against it.
2. Such assessment shall be payable in equal annual installments extending
over a period of nineteen (19) years, the first of the installments to be
payable on or after the first Monday in January, 1976 and shall bear: interest
at the rate of seven (7) percent per annum from the date of the adoption of
this assessment resolution. To the first installment shall be added interest
on the entire assessment from the date of this resolution until December 31,
1975. To each subsequent installment when due shall be added interest for one
year on all unpaid installments.
3. It is hereby declared to be the intention of the Council to reimburse
itself in the future for the portion of the cost of this improvement paid for
from municipal funds by levying additional assessments, on notice and hearing
as provided for the assessments herein made, upon any properties abutting on
the improvement, but not made, upon any properties abutting on the improvement
but not herein assessed for the improvement, when changed conditions relating
to such properties make such assessment feasible.
4. To the extent that this improvement benefits non - abutting properties
which may be served by the improvement when one or more later extensions or
improvements are made, but which are not herein assessed therefore, it is
hereby declared to be the intention of the Council, as authorized by Minnesota
Statutes Section 429.051, to reimburse the City by adding any portion of the
cost so paid to the assessments levied for any of such later extension or
improvements.
5. The Cleric shall forthwith transmit a certified duplicate of this assess-
ment to the County Auditor to be extended on, the property tax lists of the
County, and such assessments shall be collected and paid over in the same
manner as other municipal taxes.

f. Councilman Gre.avu introduced the following resol•utioi_ and moved its adoption:

WHEREAS, the City-Council has determined that it is necessary and expedient
that the area described as Brookview Drive and Ravine "B" be .improved by additional
fill material and increased catch basins and /or higher capacity,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY CO'(JNCIL OF MAPLEWOOD, MINNESOTA,
that the improvement as hereinbefore described is hereby referred to the City
Engineer, and he is instructed to report to the Council with all convenient speed
advising the Council in a preliminary way as to whether the proposed improvement
is feasible and should best be made as proposed, and the estimated cost of the
improvement as recommended.
Seconded by Councilman Anderson. Ayes -• all.
D. PRESENTATION
1. Senior Citizen deferment ordinance
a. Council questioned if it was necessary to adopt An ordinance pertaining to
Senior Citizen deferments.
b. City Attorney L'ais stated in his opinion it was not necessary.
