ADJOUPoN- MINUTES OF MAPLEWOOD CITY COUNCIL 7:30 P.M., Thursday, July 31, 1975 Council Chambers, Municipal Building Meeting No. 75 -25 A. CALL TO ORDER A special meeting of the City Council of Maplewood, Minnesota, was held in the Council Chambers, Municipal Building and was called to order at 7:30 P.M. by Mayor Bruton. B. ROLL CALL Robert I. Bruton, Mayor John C. Greavu, Councilman Donald J. Wiegert, Councilman Norman G. Anderson, Councilman Burton A. Murdock, Councilman C. APPROVAL OF AGENDA Present Present Present Arrived at 9:23 P.M. Present Mayor Bruton moved to approve the agenda as submitted. Seconded by Councilman Wiegert. Ayes - all. D. PUBLIC HEARINGS 1. Shade Tree Control Program (7:30 P.M.) a. Mayor Bruton convened the meeting for a public hearing regarding assessments for a public hearing regarding assessments for the Shade Tree Control Program. Engineering Assistant Cass read the notice of hearing along with the dates of publication. b. Manager Miller explained the procedures regarding assessing of the Dutch Elm Tree Removal project. c. Mayor Bruton stated persons desiring consideration of their assessment should fill out adjustment forms and return it to the City offices by August 11, 1975. They will be considered at the meeting of August 28, 1975. d. Mayor Bruton called for persons who wished to be heard. The following voiced their opinions: Mr. Donald Hokenson, 1851 Clarence Street. e. Mayor Bruton closed the public hearing. f. Councilman Greavu introduced the following resolution and moved its adoption: 75 -7- 124 WHEREAS, pursuant to proper notice duly given as required by law, the City Council has met and heard and passed upon all objections to the proposed assessment - 1 - 7/31 for the removal of Dutch Elm Diseased Trees as described in the files of the City Clerk as Shade Tree Control Program 74 -6 and has amended such proposed assessment as it deems just; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA: 1. Such proposed assessment, as amended, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. Such assessment shall be payable in equal annual installments extending over a period of five (5) years, the first of the installments to be payable on or after the first Monday in January, 1976, and shall bear interest at the rate of seven (7) percent per annum from the date of the adoption of this assessment resolution. To the first installment shall be added interest on the entire assessment from the date of this resolution until December 31, 1975. To each subsequent installment when due shall be added interest for one year on all unpaid installments. 3. It is hereby declared to be the intention of the Council to reimburse itself in the future for the portion of the cost of this improvement paid for from municipal funds by levying additional assessments, on notice and hearing as provided for the assessments herein made, upon any properties abutting on the improvement but not made, upon any properties abutting on the improvement but not herein assessed for the improvement, when changed conditions relating to such properties make such assessment feasible. 4. To the extent that this improvement benefits non - abutting properties which may be served by the improvement when one or more later extension or improvements are made, but which are not herein assessed therefore, it is hereby declared to be the intention of the Council, as authorized by Minn- esota Statutes Section 429.101 and 18.023 Subdivision 6 to reimburse the City by adding any portion of the cost so paid to the assessments levied for any of such later extension or improvements. 5. The Clerk shall forthwith transmit a certified duplicate of this assess- ment to the County Auditor to be extended on the property tax lists of the County, and such assessments shall be collected and paid over in the same manner as other municipal taxes. Seconded by Councilman Wiegert. Ayes - all. 2. Deferred Assessments a. Carlton Street Improvements (7:30 P.M.) b. Sanitary Sewer No. 8 (7:30 P.M.) c, Atlantic Street Improvements (7:30 P.M.) d. Water Improvement No. 6 (7:30 P.M.) e. Sanitary Sewer No. 7 (7:30 P.M.) 1. Mayor Bruton convened the meeting for a public hearing on the Deferred Assessments for Carlton Street Improvements, Sanitary Sewer No. 8, Atlantic - 2 - 7/31 Street Improvements, Water Improvement No. 6, and Sanitary Sewer No. 7. Engineering Assistant Cass read the notice of hearing along with the dates of ,publication. 2. Mayor Bruton explained the procedures on deferred assessments. Persons desiring consideration of their assessments should fill out Deferred Assess- ment Forms and return it to the City Office. Council will consider them at the meeting of August 28, 1975. 3. Mayor Bruton called for persons who wished to be heard. The following persons voiced their opinions: a. Attorney representing Mr, and Mrs. Reuben Ristrom, 1633 Lark Avenue, (Sanitary Sewer No. 8) b. Mr. Edward Masloski, 1915 DeSoto Street, (Water Improvement No. 6) c. Mr. Jahnoval, contract purchaser at 1111 E. County Road C, (Sanitary Sewer No. 7) d. Mr. William Dunn, attorney, (Sanitary Sewer No. 7). 4. Mayor Bruton closed the public hearings, 5. Resolutions adopting Assessment Roll pending adjustments and corrections a. Carlton Street Improvement Councilman Wiegert introduced the following resolution and moved its adoption: (subject to adjustments or corrections) 75 - 7 - 125 WHEREAS, pursuant to proper notice duly given as required by law, the City Council has met and heard and passed upon objections to the proposed assessment for the construction of streets as described in the files of the City Clerk as Carlton Street Improvement and has amended such proposed assess- ment as it deems just; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA: 1. Such proposed assessment, as amended, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. Such assessment shall be payable in equal annual installments extend- ing over a period of years, the first of the installments to be payable on or after the first Monday in January, 1976 and shall bear in- terest at the rate of seven (7) percent per annum from the date of adoption of this assessment resolution. To the first installment shall be added interest on the entire assessment from the date of this resolution until December 31, 1975. Such proposed assessment, as amended, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. Such proposed assessment, as amended, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. Water Improvement No. 6 Councilman Wiegert introduced the following resolution and moved its adoption: (subject to adjustments and corrections) 75 -7 -128 WHEREAS, pursuant to proper notice duly given as required by law, the City Council has met and heard and passed upon all objections to the proposed assessment for the construction of water mains and appurtenances as described in the files of the City Clerk as Water Improvement No. 6 and has amended such proposed assessment as it deems just; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA: 1. Such proposed assessment, as amended, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. Sanitary Sewer No. 7 Councilman Wiegert introduced the following resolution and moved its adoption: (subject to adjustments and corrections) 75 - 7 - 129 WHEREAS, pursuant to proper notice duly given as required by law, the City Council has met and heard and passed upon all objections to the proposed assessment for the construction of Sanitary Sewer Mains and Appurtenances as described in the files of the City Clerk as Sanitary Sewer Improvement No. 7 and has amended such proposed assessment as it deems just; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA: 1. Such proposed assessment, as amended, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. Such assessment shall be payable in equal annual installments extend- ing over a period of Twenty -Two (22) years, the first of the installments to be payable on or after the first Monday in January, 1976 and shall bear interest at the rate of seven (7) percent per annum from the date of the adoption of this assessment resolution. To the first installment shall be added interest on the entire assessment from the date of this resolution until December 31, 1975. To each subsequent installment when due shall be added interest for one year on all unpaid installments. 3. Such proposed assessment, as amended, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land hterein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. The Clerk shall forthwith transmit a certified duplicate of this assessment to the County Auditor to be extended on the property tax lists of the County, and such assessments shall be collected and paid over in the same manner as other municipal taxes. Water Improvement No. 69 -21 Councilman Murdock introduced the following resolution and moved its adoption: (subject to corrections and adjustments) 75 - 7 - 143 WHEREAS, pursuant to proper notice duly given as required by law, the City Council has met and heard and passed upon all objections to the proposed assessment for the construction of water mains and appurtenances as described in the files of the City Clerk as Water Improvement No. 69 -21 and has amended such proposed assessment as it deems just; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA: 1. Such proposed assessment, as amended, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. Such assessment shall be payable in equal annual installments extend- ing over a period of fourteen (14) years, the first of the installments to be payable on or after the first Monday in January, 1976 and shall bear interest at the rate of seven (7) percent per annum from the date of the adoption of this assessment resolution. Ot the first installment shall be added interest on the entire assessment from the date of this resolution until December 31, 1975. To each subsequent installment when due shall be added interest for one year on all unpaid installments. 3. It is hereby declared to be the intention of the Council to reimburse itself in the future for the portion of the cost of this improvement paid for from municipal funds by levying additional assessments, on notice and hearing as provided for the assessments herein made, upon any proper- ties abutting on the improvement but not made, upon any properties abutting on the improvement but not herein assessed for the improvement, when changed conditions relating to such properties make such assessment feasible. - 22 - 7/31 4. To the extent that this improvement benefits non - abutting properties which may be served by the improvement when one or more later extensions or improvements are made, but which are not herein assessed therefore, it is hereby declared to be the intention of the Council, as authorized by Minnesota Statutes Section 420.051, to reimburse the City adding any portion of the cost so paid to the assessments levied for any of such later ex- tension or improvements. 5. Manager Miller presented the feasibility report for construction of storm sewer and sanitary sewer on Hazelwood Avenue between Beam Avenue and County Road D. Acceptance of the report is recommended and a hearing date be established. b. Councilman Wiegert introduced the following resolution and moved its adoption: 75 -7 -144 WHEREAS, the City Engineer for the City of Maplewood has been authorized and directed to prepare preliminary plans for the improvement of Hazelwood Avenue be- tween Beam Avenue and County Road "D" by construction of storm sewer, sanitary sewer, and the necessary street reconstruction; and WHEREAS, the said City Engineer has prepared the aforesaid preliminary plans for the improvement herein described: NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA, as follows: 1. The report of the City Engineer advising this Council that the proposed improvement on Hazelwood Avenue between Beam Avenue and County Road "D" by construction of storm sewer, sanitary sewer, and the necessary street recon- struction is feasible and should best be made as proposed, is hereby received. 2. The Council will consider the aforesaid improvement in accordance with the reports and the assessment of benefited property for all or a portion of the cost of the improvement according to M.S.A.
