A. CALL TO ORDER
A meeting of the Board of Appeals and Adjustments of the City of Maplewood, Minnesota,
was held in the Council Chambers, Municipal Building and was called to order at 7:34
P.M. by Chairman Murdock.

C. APPROVAL OF MINUTES
1. Minutes No. 75 -4 (June 26, 1975)
Councilman Anderson moved that the Minutes of Meeting No. 75 -4 (June 26, 1975)
be approved as submitted.
Seconded by Councilman Wiegert. Ayes - all.
D. PUBLIC HEARINGS
1. Board of Appeals and Adjustments
a. Variance (Front Yard Setback - Garage) - 2177 Lydia Avenue (7:30 P,M.)
1. Chairman Murdock convened the meeting for a public hearing to consider a
request from Mr. Richard B. Wiens, 2177 Lyida Avenue, for a front yard set-
back to construct a garage 15 feet from the property line. The Clerk read
the notice of hearing along with the date of publication.
2. Chairman Les Axdahl presented the following Planning Commission recommend-
ation:
"Commissioner Prew moved that the Commission recommend to the City Council
approval of the variance and that approval be in accordance with the recom-
mendation and reasons listed in the staff report dated June 5, 1975:
1. The garage be reoriented 10 feet from the east property line as
indicated on the attached drawing;
2. The above mentioned 10 foot setback area be landscaped and a plan
submitted for approval showing location and types of materials to
be used;
3. Owner and applicant agree to the above conditions in writing.
Commissioner Barrett seconded. Ayes 6; Commissioners Howard and Fischer
abstained.
Motion carried."

3. Mr. Richard B. Wiens, the applicant, presented his views.
4. Chairman Murdock asked if anyone wished to be heard for or against the
proposal. None were heard.
5. Chairman Murdock closed the public hearing.

b. Variance (Driveway Setback) - 1222 Leland Road (7:45 P.M.)
1. Chairman Murdock convened the meeting for a public hearing for a side yard
setback variance to construct a driveway less than the 5 foot setback require-
ment at 1222 Lealand Road. The Clerk read the notice of hearing along with
the date of publication.
2. Chairman Les Axdahl presented the following Planning Commission recommend-
ation:
"Commissioner Rishel moved that the Commission recommend to the City Council
that the variance request for 1222 Lealand be granted subject to the follow-
ing conditions:
1. Any modifications to the existing garage or construction of a new
garage shall meet all setback requirements and no alley access shall
be allowed;
2. Applicant and owner shall agree to the above conditions in writing,
Commissioner Waldron seconded. Ayes all."
3. Mr. Weibel, the applicant, stated agreed to the conditions.
4. Chairman Murdock called for persons who wished to be heard for or against
the proposal. The following were heard:
Mr. Raymon Esparolini, attorney representing Mr. and Mrs. Blomster,
1215 Lealand Road, spoke against the proposal.
5. Chairman Murdock closed the public hearing.
6. Councilman Greavu moved to approve the side yard setback variance to all
Mr. Earl Weibel to construct his garage closer than the five foot required b
code subject to the following conditions:
1. Any modifications to the existing garage or construction of a new
garage shall meet all setback requirements and no alley access shall
be allowed;

2. Suggested practice of drainage be maintained;
3. Applicant and owner shall agree to the above conditions in writing.
Seconded by Councilman Anderson. Ayes - all.
c. Variance (Side Yard Setback) 1685 Stanich Place (8 :00 P.M.)
1. Chairman Murdock convened the meeting for a public hearing regarding the
variance request of Mr. Vernon A. Bullinger, 1685 Stanich Place, to construct
a garage less than the 30 foot required setback. The Clerk read the notice
of hearing along with the date of publication.
2. Chairman Les Axdahl presented the following Planning Commission recommend-
ation:
"Commissioner Flaugher moved that the Commission recommend to the City Council
approval of the setback variance at 1685 Stanich Place if proposed location
does not interfere with the view of traffic on both Stanich Place or Larpenteur
Avenue.
Commissioner Howard Seconded. Ayes all."
3. Manager Miller presented the staff report and stated it is recommended
that the variance request be denied due to the lack of justification of in-
ability to comply with Code requirements. It is suggested the alternatives
mentioned in the staff report be investigated by the applicant.
4. Mr. Vernon Bullinger, the applicant, spoke on behalf of his proposal.
5. Chairman Murdock called for persons who wished to be heard for or against
the proposal. None were heard.

Chairman Murdock closed the public hearing.
Councilman Greavu moved to approve the side yard setback variance requested
x. Vernon A. Bullinger, 1685 Stanich Place to construct a Rarage closer:
to the property than the 30 foot requirement subject to the Planning Commissions
recommendations.
Seconded by Councilman Murdock. Ayes - all.
