CALL TO ORDER A meeting of the Board of Adjustments and Appeals of Maplewood, Minnesota, was held in the Council Chambers, Municipal Building, and was called to order at 8:33 P.M. by Chair- man Murdock. B. ROLL CALL Burton A. Murdock, Chairman Present Norman G. Anderson Present Robert T. Bruton Present John C. Greavu Present Donald J. Wiegert Present C. APPROVAL OF MINUTES 1. Meeting No. 74 -9 (December 19, 1974) Councilman Wiegert moved_ to approve the Minutes of Meeting No. 74 -9 (December 19, 1974) as submitted. Seconded by Councilman Anderson. Ayes - all. D. PUBLIC HEARINGS 1. Sign Height Variance - 1145 Highway 36 a. Chairman Murdock convened the meeting for a public hearing regarding a request for a variance from the Maplewood Code to exceed the height limit for a free stand- ing sign. The Clerk read the notice of hearing along with the dates of publication. b. Manager Miller presented the staff report. c. Chairman Tom Glasow presented the following Community Design Review Board re- commendation: "Board Member Cody moved that the Board recommend to the City Council that the pro- posal for Perkins Cake & Steak be denied for the reasons given in the Manager's re- port and further, the Board would like the Council to be informed that the applicant was not present at the meeting to enable the Board to discuss different alternatives for the sign. Board Member Mihelich seconded. Board Member Murphy moved an amendment that the "open 24 hours" sign not be approved as the Board finds it unnecessary and not in keeping with the Community Design Review Board Ordinance. - 1 - 4/3 Board Member Simkins seconded. Ayes all. Voting on the motion as amended - Ayes all." d. Mr. Gene Erickner, Perkins Cake and Steak, spoke on behalf of the proposal. e. Chairman Murdock called for persons who wished to be heard for or against the proposal. None were heard, f. Chairman Murdock closed the public hearing. g. Councilman Anderson moved to approve the sign height variance as requested by Perkins Cake and Steak, -1145 E. Highway 36, for a 12 month period starting from todays date. ' Seconded by Councilman Greavu. Ayes - Chairman Murdock, Councilmen Anderson, Greayu and Wiegert. Nays - Mayor Bruton. Motion carried. E. ADJOURNMENT 8;52 P.M. t ty Clerk - 2 - 4/3
