a. CALL TO ORDER
A meeting of the Board of Adjustments and Appeals of Maplewood, Minnesota, was held
in the Council Chambers, Municipal Building and was called to order at 7:33 P.M. by
Chairman Murdock.

C. PUBLIC HEARINGS
1. Sideyard Setback Variance - 1134 Lealand Road 7:30 P.M.
a. Chairman Murdock convened the meeting for a public hearing regarding
the request of Mr. Thomas L. Elmquist, 1134 Lealand Road for a variance from
the required setback for driveways. The Clerk read the notice of hearing
along with the dates of publication.
b. Director of Community Developement Robert Reed presented the staff re-
port and stated it is recommended that the proposed variance be approved
subject to the following conditions:
1. The driveway shall observe a two foot setback from the
westerly property line.
2. The applicant shall provide evidence that the trees adjacent and
westerly of the westerly property line of subject property shall not
be adversely affected by the construction of the proposed retaining
wall. If such evidence is not available, provision shall be made for
an alternate development plan which will substantially observe the
required five foot set back from the westerly property line in that
portion southerly of the rear of the existing residence.
3. The owner and applicant shall agree to the above conditions in
writing.
C. Chairman Duane Prew presented the following Planning Commission re-
commendation:
"Commissioner Kent moved that the Planning Commission recommend to
the City Council approval of the variance as requested subject to the
conditions in the staff report.
Commissioner Batie seconded.
Commissioner Kent moved an amendment to the motion to include "the
driveway and retaining wall shall agree" .
Commissioner Batie seconded.
Voting on the motion, as amended," Ayes all,

d. Chairman Murdock called for proponents.- No one was heard.
e, Chairman Murdock called for opponents. The following were heard,
Mrs. Art Peterson.
f. The applicant, Mr. Thomas Elmquist spoke on behalf of his request.
g. Chairman Murdock closed the public hearing.
h. Councilman Wiegert moved to approve the variance with the Planning
Commission recommendation.
Motion withdrawn.
i. Councilman Anderson moved to table for further review.
Seconded by Councilman Greavu. Ayes - Councilmen Anderson, Greavu
and Wiegert
Nays - Chairman Murdock.
Motion carried.
k. Councilman Wiegert moved approval of the setback variance request of
Mr. Thomas Elmquist subject to the recommendation of the staff and Planning
rnmmiRcinn.
Seconded by Chairman Murdock. Ayes - all
APPROVAL OF MINUTES
Councilman Wiegert moved that the Minutes of Meeting No. 74 -6 (August 29, 1974)
be approved as submitted.
Seconded by Councilman Greavu. Ayes - all.
