CALL TO ORDER A special meeting of the City Council of Maplewood, Minnesota was held in the Council Chambers, Municipal Building and was called to order at 7:31 P.M. by Mayor Bruton. B. ROLL CALL Robert T. Bruton, Mayor Present John C. Greavu, Councilman Present Donald J. Wiegert, Councilman Present Norman G. Anderson, Councilman Present Burton A. Murdock, Councilman Present C. PUBLIC HEARINGS 1. Water and Sanitary Sewer Improvement - County Road B (Project 72 -15) 7:30 P.M. a. Mayor Bruton convened the meeting for a public hearing regarding adoption of assessment roll for County Road B Water and Sewer Improvement No. 72 -15. The Clerk read the notice of hearing along with the dates of publication. b. Director of Public Works Collier presented the specifics of the proposed assessment roll and how the rates were computed. The assessment rates are: Water Mains 9.50 per front foot 1" Water Service 187.50 each Sanitary Sewer 23.13 per front foot 4" Sanitary Sewer Service 181.13 each C. Mayor Bruton explained the assessment roll hearing procedures. Applications for deferment or adjustments are available and should be turned in at City Hall no later than September 4, 1974. Council will review them on September 12, 1974. d. Mayor Bruton called for proponents. None were heard. e. Mayor Bruton called for opponents. The following residents asked questions regarding the assessments. Mr. Tom Peck, 120 E. County Road B Mr. Marvin Schmitz, 160 E. County Road B f. Mayor Bruton closed the public hearing. Councilman Murdock introduced the following resolution and moved its tine assessment roll subiect to adjustments) 74 - 8 - 185 WHEREAS, pursuant to proper notice duly given as required by law, the City Council has met and heard and passed upon all objections to the proposed assessment for the construction of County Road B Water and Sanitary Sewer Imp- rovement as described in the files of the City Clerk as Project No..72 -15 and has amended such proposed assessment as it deems just. 1 - 8/22 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA; 1. Such proposed assessment, as amended, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. Such assessment shall be payable in equal annual installments extending over a period of nineteen (19) years, the first of the installments to be payable on or after the first Monday in January, 1975 and shall bear interest at the rate of seven (7) percent per annum from the date of the adoption of this assessment resolution. To the first installment shall be added interest on the entire assessment from the date of this resolution until December 31, 1975. To each subsequent installment when due shall be added interest for one year on all unpaid installments. 3. It is hereby declared to be the intention of the Council to reimburse itself in the future for the portion of the cost of this improvement paid for from municipal funds by levying additional assessments, on notice and hearing as provided for the assessments herein made, upon any properties abutting on the improvement but not made, upon any properties abutting on the improvement but not herein assessed for the improvement, when changed conditions relating to such properties make such assessment feasible. 4. To the extent that this improvement benefits non - abutting pro- perties which may be served by the improvement when one or more later extensions or improvements are made, but which are not herein assessed therefore, it is hereby declared to be the intention of the Council, as authorized by Minnesota Statutes Section 420.051, to reimburse the City by adding any portion of the cost so paid to the assessments levied for any of such later extension or improvements. 5. The Clerk shall forthwith transmit a certified duplicate of this assessment to the County Auditor to be extended on the property tax lists of the County, and such assessments shall be collected and paid over in the same manner as other municipal taxes. Seconded by Councilman Wiegert. Ayes - all. Mayor Bruton recessed the meeting. Mayor Bruton reconvened the meeting at 7:49 P.M. E. ADMINISTRATIVE PRESENTATIONS 1. Director of Public Works Collier stated the Metropolitan Sewer Board has re- quested two actions of the City of Maplewood to facilitate the construction of the Belt Line Interceptor. As the City of Maplewood is anxious for this project to commence as soon as possible, immediate approval of the two items is recommended. The two items are: 1. An agreement for the City of Maplewood to construct the Belt Line Interceptor in the vicinity of Beam Avenue and T,H. 61. This portion of the interceptor should be constructed at this time in conjunction with the Roadway improvements. This will reduce the cost to the Metropolitan Sewer Board and reduce the inconvenience of future sewer construction across - 2 - 8/22 the roadway to the City, The agreement calls for the City's contractor to install the pipe and reimbursement to be made by the Sewer Board.. 2. The City staff requested a relocation of the new sanitary sewer in the vicinity of T.H. 36 and 61 so as not to disturb the recently constructed front- age road on the Northeast quadrant. In order to accomplish this the Sewer Board will require an easement over City property in that vicinity which pre- sently serves as a lift station. A permanent easement over a triangular parcel of approximately 20 feet by 30 feet is required plus a temporary easement over an additional width of approximately 60 feet. Councilman Wiegert moved authorization to enter into an agreement with Metro Sewer Board to construct the Belt Line Interceptor_ in the vicinity of Beam Avenue and T.H.. 61 as submitted. Seconded by Councilman Anderson. Ayes -- all. Councilman Wiegert moved the granting of an easement to the Metro Sewer Board over the specified City Property as presented, waiving the City's relocation riQ ts. Seconded by Mayor Bruton. Ayes - all. 2. City Attorney Donald Lais stated that at the hearing regarding the water shed district, the Chairman indicated that aiy communities who wanted to submit names could do so, and the names would be considered to serve in the event that a water shed district is formed. Communities have until 9 -21 -74 to submit names, C. PUBLIC HEARINGS (Continued) 2. Street Improvements - Ripley Avenue (Project 71 -20) 8:00 P.M. a. Mayor Bruton convened the meeting for a public hearing regarding adopting the assessment roll for Street Improvement - Ripley Avenue Project 71 -20. The assessment rates are: Streets $21.98 per front foot Storm Sewer .02 square foot C. Mayor Bruton explained the procedures for the assessment hearing. Applications for deferment or adjustment of the assessment are available and should be returned no later than September 4, 1974. Council will review them on September 12, 1974. d. Councilman Wiegert introduced (adopting storm sewer assessment In it - 3 - 8/22 74- 8 -186A WHEREAS, pursuant to proper notice duly given as required by law, the City Council has met and heard and passed upon all objections to the proposed assessment for the construction of Street Improvements - Ripley Avenue as des- cribed in the files of the City Clerk as Project No. 71 -20 and has amended such proposed assessment as it deems just, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA; 1. Seconded by Councilman Murdock. Ayes - all, E. ADMINISTRATIVE PRESENTATIONS (Continued) 2. Discussion continued regarding the Battle Creek Water Shed. No action taken at this time. F. COUNCIL PRESENTATIONS 1. Councilman Wiegert stated he wished to compliment those who were involved in getting the assessment rolls and reports ready. 2. Councilman Wiegert stated he was approached by a member of the Ice Arena Committee asking permission for the committee to talk to some architects, 3. Councilman Wiegert questioned if we are,.;getting anywhere relative to supplying background information for our legislators regarding the levy limit. - 5 - 8/22 4. Councilman Anderson questioned the need for cutting the weeds at the Maplewood Bowl as well as the removal of the gravel on the bank.. Staff will investigate. `: °y;' 5. Councilman Anderson questioned what was happening regarding the fence by the Clinic on Cope Avenue. Staff will investigate. 6. Councilman Anderson stated the billboard on Stillwater Avenue by Gethsemane Lutheran Church does not appear to be in use and is in bad shape. Staff stated it is being used but will investigate the condition of the sign. 7. Councilman Anderson stated something should be done regarding the traffic hazard on White Bear Avenue in front of the Maple Wheel and the Sportscenter. Councilman Anderson introduced the following resolution and moved its adoption_: 74 - 8 - 187 RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA that Ramsey County is hereby requested to investigate the feasibility of the placement of a continuous media on White Bear Avenue from Cope Avenue to County Road "B ". Seconded by Councilman Wiegert. Ayes - all. 8. Councilman Anderson stated last week Council questioned how the contract neg- otiations were coming and wished the Manager to comment. Manager Miller stated he is compiling a packet to submit to the Council. 9. Councilman Anderson questioned the law regarding the City Elections for even or odd years. Attorney Lais stated if the City wished to change from odd year elections, the question would have to go to the voters. 10. Councilman Greavu wondered if the City should look into the possibility of rezoning the southwest corner of McKnight Road and Minnehaha Avenue. Councilman Greavu moved to refer the matter to the Planning Commission to re- evaluate the zoning of that corner. Seconded by Councilman Murdock. Ayes - all. 11.
