CALL TO ORDER A special meeting of the City Council of Maplewood, Minnesota, was held in the Council Chambers, Municipal Building and was called to order at 7:32 P.M. by Mayor Bruton. B. ROLL CALL Robert T. Bruton, Mayor Present John C. Greavu, Councilman Present Donald J. Wiegert, Councilman Present Norman G. Anderson, Councilman Present Burton A. Murdock, Councilman Arrived at 8:15 P.M, C. PUBLIC HEARINGS 1. Water Improvement - Londin Lane (Project 71 -12) 7:30 P.M. 2. Street and Sewer Improvements - Londin Lane (Project 72 -23) 7:30 P.M. a. Mayor Bruton convened the meeting for a public hearing regarding adoption of the assessment rolls for Londin Lane Water Improvement No. 71 -12 and Londin Lane Street and Sewer Improvement No. 72 -23. The Clerk read the notice of hearing along with the dates of publication, b. Mayor Bruton explained the procedures of the assessment hearing. Applications for deferment or adjustment of the assessments are available and should be returned to City Hall by September 4, 1974. Council will review them September 12, 1974. c. Director of Public Works Collier presented the specifics of the proposed assess- ment rolls and how the rates were computed, The rates for these assessments are: Water Improvement 71 -12 Mains - $9.50 per front foot; 1" Service - $255.80 each; 8" Service - $595,85 each; 12" Service - $1020.93 each. Street and Sewer Improvement 72 -23 Streets - $23.60 per front foot; Sanitary Sewer - $7.18 per front foot; 6" Service - $302.00 each; 8" Service - $361.00 each; Service Wyes - $29.44 each; Storm Sewer Residential - $.02 square foot Commercial - $.04 square foot. - 1 - 8/20 d. Mayor Bruton called for proponents. None were heard. e. Mayor Bruton called for opponents. The following were heard: Mr. Arnold Johnson, 2299 Londin Lane; Mr. Bernard Troje, Director of Correction and Detention Authorities, Ramsey County; Mr. Jim Wirth, R & W Realty. He also presented a letter. f. Mayor Bruton closed the public hearing. g. Councilman Wiegert introduced the following resolution and moved its adoption: (adopting assessment roll subject to adjustments - Water Improvement No. 71 -12) 74 - 8 - 181 WHEREAS, pursuant to proper notice duly given as required by law, the City Council has met and heard and passed upon all objections to the proposed assessment for the construction of Londin Lane Water Improvement as described in the files of the City Clerk as Project No. 71 -12 and has amended such proposed assessment as it deems just, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA: 1. Such proposed assessment, as amended, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. Such assessment shall be payable in equal annual installments extending over a period of Nineteen (19) years, the first of the installments to be payable on or after the first Monday in January, 1975 and shall bear interest at the rate of seven (7) percent per annum from the date of the adoption of this assessment resolution. To the first installment shall be added interest on the entire assessment from the date of this resolution until December 31, 1975. To each subsequent installment when due shall be added interest for one year on all unpaid installments. 3. It is hereby declared to be the intention of the Council to reimburse it- self in the future for the portion of the cost of this improvement paid for from municipal funds by levying additional assessments, on notice and hearing as provided for the assessments herein made, upon any properties abutting on the improvement but not herein assessed for the improvement, when changed con- ditions relating to such properties make such assessment feasible. 4. To the extent that this improvement benefits non - abutting properties which may be served by the improvement when one or more later extensions or improve- ments are made, but which are not herein assessed therefore, it is hereby de- clared to be the intention of the Council, as authorized by Minnesota Statutes Section 420.051, to reimburse the City by adding any portion of the cost so paid to the assessments levied for any of such later extension or improvements. - 2 - 8/20 5. The Clerk shall forthwith transmit a certified duplicate of this assess- ment to the County Auditor to be extended on the property tax lists of the County, and such assessments shall be collected and paid over in the same manner as other municipal taxes. Seconded by Councilman Greavu. Ayes - all. h. Councilman Wiegert introduced the following resolution and moved its adoption: (adopting assessment roll subject to adjustments - Street Improvement No. 72 -23) 74 - 8 - 182A WHEREAS, pursuant to proper notice duly given as required by law, the City Council has met and heard and passed upon all objections to the proposed assessment for the construction of Londin Lane Street Improvement as described in the files of the City Clerk as Project No. 72 -23 and has amended such proposed assessment as it deems just, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA: 1. Such proposed assessment, as amended, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. Councilman Wiegert introduced the following resolution and moved its adoption: (adopting assessment roll subject to adjustments - Sewer and Storm Sewer Improvement No. 72 -23) 74 -8- 182B WHEREAS, pursuant to proper notice duly given as required by law, the City Council has met and heard and passed upon all objections to the proposed assessment for the construction of Londin Lane Sewer and Storm Sewer as described in the files of the City Clerk as Project No. 72 -23 and has amended such proposed assessment as it deems just, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA: 1. Such proposed assessment, as amended, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein in- cluded is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. Seconded by Councilman Greavu. Ayes - all. 3. Street Improvements - Beam Avenue (Project No. 70 -5) 8:00 P.M. a. Mayor Bruton convened the meeting for a public hearing regarding the adoption of - 4 - 8/20 the assessment roll for Beam Avenue Street and Storm Sewer Improvement No. 70 -5. The Clerk read the notice of hearing along with the dates of publication. b. Manager Miller stated the staff has reviewed the matter of the zoning of Beam Avenue with the attorney and we feel the north side of Beam Avenue, which is BC and as part of that is in the process of being zoned BC, should be assessed at this time; and that the assessments for the south side of Beam Avenue should be tabled until sometime in November. If the zoning question can not be resolved by that time, staff would recommend tabling the assessments again. If the assessments cannot be certified to the County in time for collection, a possibility is that the first in- stallment is collected at the City and then next year certify the balance. c. Councilman Wiegert moved to table the assessments for the south side of Beam Avenue Improvement No. 70 -5 until November 12. 1974_ Seconded by Councilman Greavu. Ayes - all. d. Mayor Bruton explained the procedures of the assessment hearing. Applications for adjustment or deferment are available and should be returned to City Hall no later than September 4, 1974. Council will review them on September 12, 1974. e. Director of Public Works Collier presented the specifics of the proposed assess- ment roll and how the rates were computed. The rates are as follows: Streets - North Side $169.43 per front foot; Storm Sewer .04 square foot f. Mayor Bruton called for proponents. None were heard. g. Mayor Bruton called for opponents. None were heard. h. Mayor Bruton closed the public hearing. i. Councilman Greavu introduced the following resolution and moved its adop (North Side of Beam Avenue, Street Improvement No. 70 -5; adopting assessment subject to adjustments) 74 -8- 183A WHEREAS, pursuant to proper notice duly given as required by law, the City Council has met and heard and passed upon all objections to the proposed assessment for the construction of Beam Avenue Street Improvement as described in the files of the City Clerk as Project 70 -5 and has amended such proposed assessment as it deems just, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA: 1. Such proposed assessment, as amended, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. Such assessment shall be payable in equal annual installments extending over a period of nine (9) years, the first of the installments to be payable - 5 - 8/20 on or after the first Monday in January, 1975 and shall bear interest at the rate of seven (7) percent per annum from the date of the adoption of this - assessment resolution. Councilman Greavu introduced the following resolution and moved its adoption: (North Side of Beam Avenue Storm Sewer Improvement No. 70 -5; adopting assessment roll subject to adjustments) 74 - 8 - 183B WHEREAS, pursuant to proper notice duly given as required by law, the City Council has met and heard and passed upon all objections to the proposed assessment for the construction of Beam Avenue Storm Sewer Improvement as described in the files of the City Clerk as Project 70 -5 and has amended such proposed assessment as it deems just, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA: 1. Such proposed assessment, as amended, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. Street Improvements - Lydia Avenue (Project 72 -17) 8:30 P.M. a. Mayor Bruton convened the meeting for a public hearing regarding adoption of the assessment roll for Lydia Avenue Improvements No. 72 -17. The Clerk read the notice of hearing along with the dates of publication. b. Mayor Bruton explained the procedures of the assessment hearing. Councilman Wiegert introduced the following resolution and moved its adoption: (adopting assessment roll for Lydia Avenue Street Improvements 72 -17, subject to adjustments) 74 - 8 - 184A WHEREAS, pursuant to proper notice duly given as required by law, the City Council has met and heard and passed upon all objections to the proposed assessment for the construction of Lydia Avenue Street Improvement as described inthe files of the City Clerk as Project No. 72 -17 and has amended such proposed assessment as it deems just, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA: 1. Such proposed assessment, as amended, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2. Councilman Wiegert introduced the following resolution and moved its adoption: (adopting assessment roll for Lydia Avenue Sanitary Sewer, Water, Storm Sewer Improve- ment 72 -17 subject to adjustments) 74 - 8 - 184B WHEREAS, pursuant to proper notice duly given as required by law, the City Council has met and heard and passed upon all objections to the proposed assessment for the construction of Lydia Avenue Sanitary Sewer, Water and Storm Sewer Improve- ments as described in'the files of the City Clerk as Project No. 72 -17 and has amended such proposed assessment as it deems just, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF MAPLEWOOD, MINNESOTA: 1. Such proposed assessment, as amended, a copy of which is attached hereto and made a part hereof, is hereby accepted and shall constitute the special assessment against the lands named therein, and each tract of land therein included is hereby found to be benefited by the proposed improvement in the amount of the assessment levied against it. 2.
